Rei Request to reduce setback from 25 ft. to 20 ft.
Dear Jim,
Enclosed with this letter is the revised site plans for
track ILl, Heatherlakes of the Meadows 300 P.U.D. in Boynton
Beach. This site plan is a revision to the one that was
approved approximately one year ago. This site plan
revision request is for one minor modification on the
approved plan. This modification is the change from the
existing 25 ft. front setback for all the dwelling units to
20 ft.
As part of this site plan modification, we will not be
modifying the number of dwelling units, the size of the
lots, or the configuration of the parcel. The only request
of this modification is internal to the lot and the
reduction of the front setback by 5 ft. The following is a
breakdown of the purpose and history behind our request, and
should answer any questions concerning the site plan
modification. If you have any questions, or if I can be of

JUSTIFICATION STATEMENT
HEATHERLAKE SITE PLAN MODIFICATION
I. Introduction
Heatherlake is a residential parcel located within the
Meadows 300 planned unit development. The primary access to
this property is off of Meadows Boulevard which intersects
with Congress Avenue just south of Hypoluxo Road. This
parcel was site planned originally one year ago by Ryan
Homes. At the time of the site plan approval, Ryan Homes
was planning to use their American portfolio product on this
parcel. That product was slightly higher in value than
their previous parcels which they developed adjacent to this
property known as Lakeshores which is track 'K' of the
Meadows 300 P.U.D.
Today, the land

II. History
Approximately nine months ago, shortly after
Heatherlake was originally approved by the City of Boynton
Beach, Ryan Homes was purchased by another large home
builder known as NV Homes. After Ryan Homes was purchased,
the new development company was called NV Ryan. Under the
new management, the Ryan Homes Company went through several
revisions in product line, philosophy and staff. The final
rate change was the increase in the quality and value in
size in the product being sold. Traditionally, Ryan Homes
has been known as an affordable home builder constructing
houses throughout the United States. NV Ryan wanted to
maintain the same product line however enhancing certain
residential construction homes. Under this new leadership,
the new developers decided to increase the size of the
homes still to be constructed.
III. Request
Under the new home leadership, the size of the houses
to be constructed at Heatherlake increased. In addition to
the home increasing in size, a lanai was added as an
optional feature. The major problem with the approved site
plan was that the lanai could not be constructed under the
existing setbacks.

Statement
Since the lanais could not be constructed with the
present setbacks, there were two options. The first option
was to reduce the rear setback by 5 ft. The second option,
and the one chosen, was to reduce the front setback by 5 ft.
and move the whole house forward. Reduction in the front
setback by 5 ft. will still continue to maintain the
integrity of the homes and lots at Heatherlake. This
reduction will maintain the same size rear yard as
originally approved. The rear yard is the more useful space
within a residential lot. Adding, the 5 ft. lanai on the
rear of the home will actually increase the outside useable
area in the rear of the home. The reduction in the front
setback by 5 ft. to 20 ft. will still allow a car to be
parked behind the garage and totally off the right-of-
way.
IV. Conclusion
This modification of the site plan will ultimately
produce a better project for the City of Boynton Beach. The
value of the homes will be higher, and these yard areas for
the residents will be larger. This variance will allow the
construction of a lanai onto the rear of the home to
increase the actual living area of the residence.

with the Engineer's Opinion of Cost prepared by Simmons and White
consulting Engineer dated January 6, 1994 for our Meadow Lake subdivision.
An original copy of the Opinion of Cost was hand delivered to you on January
6, 1994. Please advise when this request will be heard by the City Council.
