Finizio Administrative Coordinator of Engineering RE: BEATHERLAKE AT THE MEADOWS MODIFICATION OF PLAT DOCUMENT Please be advised that this office has received a copy of the Heatherlake at the Meado',s master plan modifications regarding front, sj je, side corner and rear setbacks. This submission appears to be improper as various signature lines from the original plat have been superimposed over a title sheet, which includes signatures of the City Engineer, the Mayor and City Clerk. Said composite signatures being removed from an original recorded document and superimposed on this inaster plan giving the appearance that this document was signed by the aforementioned City Officials on the 6th day of October, 1987. I recommend that you seek the advice of the City Manager and/or City Attorney regarding the duplication of City Official's signatures on documents which those Officials did not actually sign. Continued the public hearing for the Cross Creek Centre parking lot variance to the December 10, 1991 meeting at 7:00 p.m., as per the applicant's request for another 30 day postponement. 2. After conducting a public hearing, recommended approval of Kilday & Associates request for Tradewinds Development Corporation (Boynton Beach Boulevard rezoning) to amend the Future Land Use Element of the Comprehensive Plan from "Moderate Density Residential" to "Office Commercial". Motion was made by Mr. Collins and seconded by Mrs. Huckle. The vote was 4-2 with Mr. Lehnertz and Mrs. Stevens dissenting. Also, recommended approval to rezone from R1AA/PUD (Single-family Residential) to C-1 (Office and Professional Commercial), subject to provisos, which are necessary for consistency of the proposed rezoning of the property with the Comprehensive Plan. Motion was made by Mr. Collins and seconded by Mrs. Huckle. The vote was 4-2 with Mr. Lehnertz and Mrs. Stevens dissenting. (PM91-287) 3. Approved the request submitted by William Turner for the Lakeshore/Heatherlake Homeowners' Association to amend the Meadows, Tract "L", Heatherlake master plan to reduce the rear setback for hard-roofed screen enclosures, from 25 to 15 feet, subject to proviso. Vote was 5-1 with Mr. Lehnertz dissenting. 4. Unanimously recommended approval of the request for an amended site plan for Bethesda Memorial Hospital to construct a parking lot expansion, subject to proviso. The motion was made by Mr. Collins and seconded by Mrs. Huckle. Mrs. Stevens and Mr. Rosenstock left the room prior to the motion being made. (PM91-288). 5. Unanimously recommended approval of the request for an amended site plan for Motorola P.I.D. to construct phase III of the P.I.D. to include 83,564 square feet of additional office place, changes to the existing parking lot layout and design and the addition of 112 parking spaces, subject to proviso. Tabled the determination of consistency with the Comprehensive Plan for the proposed amendment to Appendix A-Zoning, to amend the regulations governing service stations and convenience stores until further analysis, including mapping of all existing service station locations, potential locations under the existing code and potential locations under the proposed amendment and evaluation of the existing distance separation against current safety standards, is prepared by the Planning Department and presented to the Planning and Zoning Board at the December meeting. 7. Unanimously made a finding of consistency with the Comprehensive Plan for the proposed amendment to Appendix A-Zoning, to include limitations on restaurants located in the C-1 zoning district, as conditional uses, subject to proviso. Motion was made by Mr. Lehnertz and seconded by Mrs. Huckle. First reading of the ordinance for this amendment is proposed for the December 3, 1991 City Commission meeting. 8. At the request of the City Commission, revisited the issue of towing companies as a permitted use in the M-1 zoning district and unanimously decided not to amend the Planning and Zoning Board's September 10, 1991 finding of consistency with the Comprehensive Plan for the proposed amendment to Appendix A-Zoning, to allow towing companies in the 00-1 zoning district. At the November 5, 1991 City Commission meeting, the City Commission made a finding of no substantial change for the requested modification. The Technical Review Board recommends approval of this request, subject to the attached staff comments. Heyden Senior Planner DATE: October 18, 1991 SUBJECT: The Meadows, Tract L, Heatherlake - File No. 650 Master Plan Modification (rear setback reduction) William Turner, agent for the Lakeshore/Heatherlake Homeowners' Association, has requested a modification to the previously approved master plan" for the Meadows 300 PUD, as outlined in Exhibit "A". The modification requested is to allow for a reduction of the rear setback from 25 feet to 15 feet for all interior lots and lots with rear yards abutting Meadows Boulevard, for the purpose of constructing screened enclosures with hard roofs. The approved building setback for the lake front and canal front lots is 15 feet, therefore approval of this request would result in a rear building setback and hard-roofed screen enclosure setback of 15 feet, for all lot types within Heatherlake. No change is requested to the approved 12 foot pool and screened enclosure setback for the lake front, canal front and lots with rear yards abutting Meadows Boulevard and the approved 8 foot pool and screened enclosure setback for the interior lots (see Exhibit liB" for illustrations of the approved and proposed, typical setbacks). The procedure for approving master plan modifications in planned unit developments is twofold. First, the City Commission must make a determination as to whether or not the changes requested are substantial in nature. A determination of substantial change on the part of the City Commission which has sole discretion in this matter, would require a new application for PUD. On the other hand, a determination of no substantial change allows the forwarding of this request to the Planning and Zoning Board. The planning and Zoning Board then may approve the request. This procedure appears in Appendix B, Section 12 of the Code of Ordinances. with respect to the changes requested by Mr. Turner, the Technical Review Board (TRB) met on Thursday, October 10, 1991 to review the plans and documents submitted, and they offer for your consideration, a recommendation that the City Commission make a finding of no substantial Change for the requested modification, and the Planning and Zoning Board approve this request subject to the attached comments from the Building Department, Engineering Department, Utilities Department and Planning Department in Exhibit "C". ,- J~~'14-~ Tambri J.
