Existing Site
Characteristics:
The site is currently occupied by NationsBank, a commercial banking
facility, and is developed according to city standards.
Proposed
Development:
The modification of the banking facilities will consist of the following:
a) a 16 feet by 58 feet addition on the north side of the building,
b) addition of a drive-in lane south of the building,
c) relocation of the existing A TM station from the south of the
building to the north, (see Exhibit "B" - proposed site plan).

Concurrency:
a. Traffic-
The project was reviewed by the Palm Beach County Traffic
Division. It was determined that the project meets the
requirements of the Traffic Performance Standards of Palm
Beach County.
b. Drainage-
Insufficient drainage information has been submitted for the
Engineering Division to certify compliance with the City's
drainage levels of service at the time of site plan approval, as
required. The Engineering Division is recommending that this
be postponed to time of permit review.
Driveways:
Direct access is provided by an existing driveway onto Boynton Beach
Boulevard that is shared with the Boynton Plaza Shopping Center.
Additional indirect access points to this property are provided from
the shopping center parking lot system. An existing ingress/egress
easement abutting the south lot line of the Bank site allows two-way
access to Congress A venue.
Parking Facility:
There is sufficient on-site parking providing 34 spaces. It exceeds the
minimum requirement of 14 parking spaces as required by the Land
Development Regulations, Chapter 2 - Zoning.
Landscaping:
The landscaping of the site will fully meet the code requirements when
staff comments are addressed.
Building and Site
Regulations:
Building and site regulations will fully meet the code requirements
when staff comments are addressed.
Community Design
Plan:
The proposed addition will fully match the appearance of the existing
structure as indicated on the colored elevations that have been
submitted.
Signage:
Additional signage is proposed on the northern wall of the addition.
It meets the Community Design Plan criteria, however, its
conformance with the sign section of the code is contingent upon
providing inventory of existing signage.
RECOMMENDATION:
The Planning and Zoning Department recommends approval of this site plan request,
subject to the comments included in Exhibit C - Conditions of Approval. The Technical
Review Committee recommends that the deficiencies identified in this exhibit be corrected
on the set of plans submitted for building permit.

Reduction to 10 feet of the rear yard
cannot be applied since rear yard
access is not available from a public
street or alley. In order to meet the
code requirements, designate on the
site plan, sheet A-1, abutting
Congress Avenue as the front yard and
apply the above setbacks accordingly.

following perimeter landscaping
requirements:
a) between the public rights-of-way
and a vehicular use area, one
tree shall be planted for every
40 lineal feet. Indicate

to six feet high hedge located
within a 2.5 feet wide landscape
buffer.

comments transmitted to the Director of the Planning and Zoning
Department no later than 5:00 P.M. on Februarv 7, 1996. Do not
return plans and exhibits. Retain same for the review of the
amended plans (second review) .
Adhering to the following review guidelines will promote a
comprehensive review and enable the applicant to efficiently
obtain Technical Review Committee approval:
1.
Use the review standards specified in Part III, Land
Development Regulations, Chapter 4, Site Plan Review,
Section 8 of the Code of Ordinances to review and formulate
comments.

2. The documents submitted for the project were determined to
be substantially complete based on the submittal
requirements identified in Section 7 of the Site Plan Review
Ordinance. However, if the data provided to meet the
submittal requirements is insufficient to properly evaluate
and process the project based on the review standards or the
documents show code deficiencies, additional data and/or
corrections should be requested by the reviewer through the
Planning and Zoning Department.
3. Each comment shall reference the section of the code that is
incorrectly depicted on the documents.
4. Technical Review Committee member(s} shall identify in their
comments when the plans depict or when the location and
installation of their departmental required improvements may
conflict with other departmental improvements.

5. When a TRC Member finds a code deficiency that is outside of
his/her review responsibility, the comment and the specific
code section may be included in their review comments with the
name of the appropriate TRC Member that is responsible for the

6. If a TRC member finds the plans acceptable, he/she shall
forward a memo, within the time frame stated above, to the
Planning and Zoning Director stating that the plans are
approved and they do not have any comments on the plans
submitted for review and recommend the project be forwarded
through the approval process.
All comments shall be typed, addressed and transmitted to the
Director of the Planning and Zoning Department for distribution to
the applicant. Please include the name and phone number of the
reviewer on this memo. Michael E. Haag will be the Planning and
Zoning Department staff member coordinating the 1st review of the
project.
The Planning and Zoning Department will send the applicant a cover
letter which includes the comment(s) and directions to amend the
plans to comply with the comments and the procedures for
resubmission. When the Planning and Zoning Department receives the
amended plans, they will distribute the plans with a cover memo to
all TRC Members for review and approval.

Automatic Teller Machine (ATM) security requirements (video, lights, etc.) were discussed at
TRC today. As it turned out, no one was certain whether legislation has been enacted recently at
state, county or city level covering A TM security.
Speculation was heavy toward newly passed Florida Statute. Are you aware if such regulation is
in place?
Our concern relates specifically to a proposed A TM at Congress Avenue and Boynton Beach
Blvd., but ifno regulations exist, we probably should consider preparing an Ordinance for all
future prospects.
Your thoughts are solicited.

1. Revise documents to reflect all comments.
2. All plans submitted for specific permits shall meet the City's code requirements at
time of application. These permits include, but are not limited to the following;
site lighting, paving, drainage, curbing, landscaping, irrigation and traffic control
devices. Permits required from agencies such as the FDOT, PBC, SFWMD and
any other permitting agency shall be included with your permit request.
3. Provide pollution retardant baffles in drainage structures. Chap.2, SecANllb,

4. Provide Certification by Developer's Engineer that drainage plan complies with all

(10) "Operator" means any financial institution, as
defined in s. 655,005, other business entity, or any per-
son who controls the use or operation by a customer or
other member of the general public of an automated
teller machine, An operator controls the use or operation
of an automated teller machine for the purposes of ss.
655.960-655.965 if such person or entity has the present
legal authority to determine when and by whom the
automated teller machine may be used or operated and
how it is to be maintained in compliance with the provi-
sions of S5. 655.960-655.965. An operator does not
include any person or entity which is not a financial insti-
tution, if the primary function of such person or entity is
to provide data processing services for automated teller
machine transactions or to provide for the exchange,
transfer, or dissemination of electronic funds transfer
data.
(11) Terms which are defined in the financial institu-
tion codes, unless the context otherwise requires, have
the meanings ascribed to them therein for purposes of
ss. 655.960-655.965.

655.961 Evaluations.-
(1) Each existing automated teller machine shall be
evaluated by its operator within 1 year after the effective
date of this section to determine whether such machine
is in compliance with the provisions of s. 655.962(2), (3),
and (4), If a machine fails to comply with such provisions,
the operator shall bring it into compliance within 1 year
after October 1, 1994.
(2) A violation of the provisions of ss. 655.960-
655.965 or any regulation made pursuant thereto does
not constitute negligence per se.

655.962 Ughting; mirrors; landscaping.-
(1) Each operator of an automated teller machine
that controls the access area or defined parking area to
be lighted shall comply with subsections (2), (3), and (4)
no later than 1 year after October 1, 1994. If the access
area or defined parking area to be lighted is controlled
by a person other than the operator, such other person
shall comply with subsections (2), (3), and (4) no later
than 1 year after October 1, 1994.
(2) Each operator, or other person responsible for an
automated teller machine pursuant to ss. 655.960-
655.965, shall provide lighting during the hours of dark-
ness with respect to an open and operating automated
teller machine and any defined parking area, access
area, and the exterior of an enclosed automated teller
machine installation, as follows:
(a) There shall be a minimum of 10 candlefoot power
at the face of the automated teller machine and extend-
ing in an unobstructed direction outward 5 feet.
(b) There shall be a minimum of 2 candle foot power
within 50 feet in all unobstructed directions from the
face of the automated teller machine. If the automated
teller machine is located within 10 feet of the corner of
the building and the automated teller machine is gener-
ally accessible from the adjacent side, there shall be a
minimum of 2 candlefoot power along the first 40 unob-
structed feet of the adjacent side of the building.
(c) There shall be a minimum .of 2 candlefoot power
in that portion of the defined parking area within 60 feet
of the automated teller machine.
(3) The operator shall provide reflective mirrors or
surfaces at each automated teller machine which pro-
vide the customer with a rear view while the customer
is engaged in using the automated teller machine.
(4) The operator, or other person responsible pursu-
ant to ss. 655.960-655.965 for an automated teller
machine, shall ensure that the height of any landscap.
ing, vegetation, or other physical obstructions in the
area required to be lighted pursuant to subsection (2) for
any open and operating automated teller machine shall
not exceed 3 feet, except that trees trimmed to a height
of 10 feet and whose diameters are less than 2 feet and
manmade physical obstructions required by statute,
law, code, ordinance, or other governmental regulation
shall not be affected by this subsection.

655.963 Access devices.-Customers receiving
access devices shall be furnished by the respective
issuers thereof with such information regarding safety
precautions as the department may require by rule. This
information shall be furnished by personally delivering or
mailing the information to each customer whose mailing
address as to the account to which the access device
relates is in this state. Such information shall be fur-
nished with respect to access devices issued on or after
October 1, 1994, at or before the time the customer is
furnished with his or her access device. With respect to
a customer to whom an "accepted access device: as
defined in Federal Reserve Board Regulation E, 12
C.F.R. part 205, has been issued prior to October 1.
1994, the information shall be delivered on or before 6
months from October 1, 1994. Only one notice need be
furnished per household, and if access devices are fur-
nished to more than one customer for a single account
or set of accounts or on the basis of a single application
or other request for access devices, only a single notice
need be furnished in satisfaction of the notification
responsibilities as to those customers. The information
may be included with other disclosures related to the
access device furnished to the customer, such as with
any initial or periodic disclosure statement furnished
pursuant to the Electronic Fund Transfer Act.

1. Revise documents to reflect all comments.
2. All plans submitted for specific permits shall meet the City's code requirements at
time of application. These permits include, but are not limited to the following;
site lighting, paving, drainage, curbing, landscaping, irrigation and traffic control
devices. Permits required from agencies such as the FDOT, PBC, SFWMD and
any other permitting agency shall be included with your permit request.
3. Provide pollution retardant baffles in drainage structures. Chap.2, SecANll b,

4. Provide Certification by Developer's Engineer that drainage plan complies with all

The following is a list of comments regarding the second review of the above-referenced
project. It should be noted that the comments are divided into two (2) categories. The
first category is a list of comments that identify unresolved comments either from the
first review or new comments as a result of the second review. To show compliance
with these comments will not substantially alter the configuration of the site and design
of the building. The second category is a list of recommendations I believe will enhance
the aesthetics and function of the project.
All comments and recommendations can be rectified on the plans at time of permitting if
the site plan request is approved. The applicant must understand that additional
comments may be generated upon review of the documents and working drawings
submitted to the Building Division for permits for the proposed project.
I. SITE PLAN REVIEW COMMENTS:
1. The building is located within the C-3 (Community Commercial) zoning
district. According to City's Land Development Regulations, Chapter 2,
Section 6.C.3 the required minimum setbacks for structures in this zoning
district are as follows:

Reduction to 10 feet of the rear yard cannot be applied since rear yard
access is not available from a public street or alley. In order to meet the
code requirements, designate on the site plan, sheet A-I, abutting
Congress A venue as the front yard and apply the above setbacks
accordingly.
2. Amend the landscape plan to meet the following perimeter landscaping
requirements:
a) between the public rights-of-way and a vehicular use area, one tree
shall be planted for every 40 lineal feet. Indicate locations of these
additional trees,
b) along interior property lines the vehicular use areas shall be
screened with a continuous four to six feet high hedge located
within a 2.5 feet wide landscape buffer.

(Chapter 7.5, Article II, Section 5, D and E) If any of these requirements
cannot be met, a request for a landscape appeal shall be submitted.
3. Provide photometrics of the entire outparcel.
4. Identify color code and manufacturer and provide material sample for:
a) the finish of the stair by the main entrance,
b) entrance element frame
5. Provide information regarding the ownership of properties located
immediately south and west of the subject site to include description of the
access easements allowing for cross access to the bank property.
II RECOMMENDATIONS:
6. Relocate dumpster to a location west of the building for the following
reasons:
a) to increase safety and reduce the probability of collisions at the
southeast entrance to the property and
b) to limit visibility of the dumpster from either major arterial streets

Proposed signage conformance with the code will be determined upon
submittal of information regarding the size of existing signage.
NOTE:
If recommendations are approved, they shall be incorporated into the
working drawings required for permits for the project.

The City of Boynton Beach has completed its first review of the
documents submitted for the above-referenced project. Attached are
comments made by the reviewing departments during their initial
review of your project.
In order to complete the review process, the site plan and
documents must be amended to comply with these comments within 90
days of the date of this letter. (If amended plans are not
submitted in 90 days, a new application fee will be required.)
When there are comments made by the reviewers that you feel are not
applicable to the approval of the project or will be addressed
separately and you have not amended the plans to comply with the
comment(s) I you must prepare written explanation for each comment
stating why the comment is not applicable and return the
explanation with the amended plans and documents.
After amending the plans and documents, please submit twelve (12)
complete sets (including surveys) of the plans to the Planning and
Zoning Department. When the amended plans and documents have been

Submit an amended Site Plan Review/Conditional Use application form that
reflects the changes that were made as a result of amending the plans
and documents to comply with the Code of Ordinances and the Technical
Review Committee comments. A copy of the original form with a
distinguishable symbol identifying the change(s) may be submitted or a
completed new form with the changes identified. If there are no changes
required to be documented on the application form, a letter from the
applicant stating same must be turned in with the amended submittal.
Submit twelve (12) assembled and complete sets of plans and documents,
including surveys that show compliance with the Code of Ordinances and
comments made by the Technical Review Committee. Two (2) of the sets
shall have the appropriate legible raised seal and signature of the
designer responsible for the drawing(s). Plans and documents shall be
assembled in twelve (12) individual complete packages with the title of
the project on all pages and/or sheets and each page or sheet
numerically numbered such as the following example: 1 of 3, 2 of 3, 3 of

Submit color photographs of the buildings on the site that are to remain
in their existing condition and photos of existing buildings that are
located on the sites that abut the perimeter of the subject property.
The minimum size is 5" by 7". Each photograph shall be labeled to
identify the location of the existing structures with respect to the
location of the proposed project.
Submit colored elevation view drawings - a colored duplicate copy of all
drawings of the elevation views of each side of all buildings and
signage associated with the project. The colored elevation views shall
match the elevations shown in the documents that were submitted for site
plan review. The applicable exterior surfaces as identified above shall
be colored with the color name and associated color reference number
identified. The type of exterior surface material shall be identified
next to the associated color. The colored elevation drawings shall have
compass direction or title of the side of the building identified. The
title block of the original drawing shall be shown. The maximum size is
24" by 36". Do not submit on board of any kind.
Submit color samples as an example of the proposed colors. Each sample
shall have attached a label that identifies the color by name and
numerical/letter code from an established color chart.

Submit a 8 1/2" x 11" transparency of the landscape site plan drawing to
be used on an overhead projector at board meetings.

Ordinance No. 91-1 (January, 1991) Land Development Regulation, Chapter 21, Section 7, Page 21-14 reads in
part as follows:
"Any existing sign which does not conform to the requirements of this chapter, shall hereafter be
deemed nonconforming. All signs must be maintained to original standards and conditions and upon
modification must comply with all section of this chapter. Relettering or change of copy, provided there is no
alteration or repair made to the sign structure, shall not constitute a modification.
Nonconforming signs shall be removed, changed or altered to conform to the provisions of this chapter
within five (5) years from the date this Sign Code takes effect."
Until this month two groups of signs co-existed; one group which complied with Ordinance 91-1 and one group
which did not comply. We no longer have the second group because those signs must be removed, changed or
altered to conform with Ordinance 91-1 when the fifth anniversary of Ordinance 91-1 occurs, as it recently did.
My strict reading of this Sign Ordinance is that henceforth all signs must comply with Ordinance 91-1 whether
they be new, changed, altered, damaged, or existing: Exceptions: The Ordinance allows exceptions as follows:
"A sign shall not be deemed nonconforming if either of the following conditions apply:
A. The sign is a freestanding sign which does not exceed 24 feet in height;

The following is a list of comments regarding the second review
of the above-referenced project. It should be noted that the
comments are divided into two (2) categories. The first category
is a list of comments that identify unresolved comments either
from the first review or new comments as a result of the second
review. To show compliance with these comments will not
substantially alter the configuration of the site and design of
the building. The second category is a list of recommendations I
believe vlill enhance the aesthetics and function of the project.
All comments and recommendations can be rectified on the plans at
time of permitting if the site plan request is approved. The
applicant must understand that additional comments may be
generated upon review of the documents and working drawings
submitted to the Building Division for permits for the proposed
project.
I. SITE PLAN REVIEW COMMENTS:
1. The building is located within the C-3 (Community
Commercial) zoning district. According to City's Land
Development Regulations, Chapter 2, Section 6.C.3 the
required minimum setbacks for structures in this zoning
district are established as follows:

Your proposal, as submitted, does not meet these
requirements. Reduction to 10 feet of the rear yard
cannot be applied since the rear yard access is not
available from neither public street or alley.
In order to meet the code requirements designate the
yard abutting Congress Avenue as a front yard and apply
the above setbacks appropriately. Amend the site plan,
sheet A-I, appropriately.
2. Perimeter landscaping should meet the following
requirements:
-between the public rights-of-way and a vehicular
use area, one tree should be planted for every 40
lineal feet. Indicate locations of additional

-along interior property lines the vehicular use
areas should be screened with a four to six feet
high hedge located within a 2.5 feet landscape
buffer.
For the above requirements refer to Land Development
Regulations, Chapter 7.5, Article II, Section 5, D and
E, and amend the landscape plan accordingly. If any
of these requirements cannot be met, a landscape appeal
needs to be submitted.
3. Provide photometrics of the entire lot.
4. Identify color code and manufacturer of:
-stair by the main entrance finish
-entrance element frame
Provide material sample of same.
5. Provide information regarding the ownership of
properties located immediately south and west of the
subject site. Include description of the access
easements allowing for cross access to the bank
property.
II RECOMMENDATIONS
6. It is a recommendation of the Planning and Zoning
Department staff that the dumpster will be relocated to
a location west of the building for the following
reasons:
-to increase safety and reduce the probability of
collisions on the south-east entrance to the property
-to limit visibility of the dumpster from either major
arterial streets
NOTE:
If recommendations are approved, they shall be
incorporated into the working drawings required for
permits for the project.

DESCRIPrION: Frank Choueiki of Lincoln Property Company C.S.E., Inc., agent for
NationsBank, a tenant at the Boynton Plaza, located at 289 North Congress Avenue, zoned
C-J, is requesting to a~end the previously approved site plan to include a 928 square foot
building addition, a new auto lane and an A TM relocation.
RECOMMENDATION: The Planning and Development Board, with a 7-0 vote,
recommended approval of this request subject to the comments in the attached Exhibit C,
with the exception of the recommendation to relocate the dumpster.
