Mr. Annunziato explained the location. He advised these

The planning & Zoning, Board unanimously recommended approval
of this request subject to staff comments. It was also
reviewed by the Community Appearance Board and subsequently

Councilman Cassandra referred to there being concern about
the physical affect to Leisureville from these buildings and
askeq if planting of certain type trees had been resolved.
Mr. Cheney replied the community Appearance Board included
these conditions, which must be met.
Councilman Cassandra moved to CiPprove this request to
construct two office buildings based on. the unanimous appro-
val of the Planning & Zoning Boar~ and subject to staff com-
ments. Councilman Warnke seconded the motion. No
discussion. Motion carried 4-0.
Mr. Knowles showed a picture of the proposed building.
Councilman Warnke asked if these were designed to withstand
120 to 160 mph winds and Mr. Knowles replied they have been
designed to meet the code. .
Approve request to construct a two story, 16,000 sq. ft.
industrial warehouse on .86 acres to be known as
Quickrentals. This request was submitted by Herbert Pecht,
Jr. for Quickrentals, a Florida partnership, and would be
located on Industrial Avenue.

Mr. Annunziato informed the Council this request was
reviewed by the Technical Review Board and went to the
Planning & Zoning Board with a positive recommendation sub-
ject to staff comments. The Planning & Zoning Board unani-
mously recommended this request be approved subject to staff
comments. The request was reviewed by the community
Appearance Board and subsequently approved.

Mr. Herbert pecht, Architect, came forward and stated there
were two items under staff recommendations they would like
to correct or modify A The first one is the dumpster loca-
tion and he,told about moving it based on recommendations,
but the Public Works Department r,ecommended it be in the
noted location. He then pointed out the final location of
the fire hydrant based on recommendations of the Fire Chief.
Mr. Annunziato stated if these solutions are acceptable to
the various. department heads, it !Would be acceptable and Mr.
Pecht replied that he talked to these departments.

Board recommend approval.

Councilman Warnke moved to approve this request for
Cedarwood Villas, phase II. Councilman Wright seconded the
motion. Under discussion, Councilman Cassandra asked if all
setbacks were satisfied and Mr. Annunziato replied affir-
matively. Motion carried 4-0.

Approve request for a height exception of 15 feet to accom-
modatemechanical equipment for Boynton Commercenter at 1600
Corporate Drive, submitted by Fred J. Popper for Boynton
Commercenter, Inc.
Mr. Annunziato corrected that this height exception should
be 9 feet and not 15 feet for the mechanical equipment. It
was reviewed by the Technical Review Board and the Planning
& Zoning Board and approval recommended. The Community
Appearance Board also approved. If the Council decides to
approve, they must make findings in accordance with Section
4-F of the zoning code.

Councilman Cassandra asked if this was requested for air
conditioning equipment and Mr. Fred J. Popper replied affir-
matively with it being a cooling tower for the air con-
ditioning system. Councilman Cassandra clarified the
original building is 45 feet and this is an additional 9
feet in the center of the building and Mr. Popper agreed.
Councilman Warnke remarked that it could hardly be seen from
the ground. Mr. Cassandra asked if water cooling makes it
more efficient and Mr. Popper replied affirmatively and
explained that it is a heat pump system and they investi-
gated others, but additional height would be required.
Councilman Warnke moved to approve this request for the
height exception for the Boynton Commercenter, seconded by
Councilman Cassandra. Under discussion, Mr. Cheney referred
to the Council's finding to justify this variance and Mr.
Annunziato suggested finding there would be no adverse
impacts. Mr. Warnke included this in the motion and Mr.
Cassandra agreed. Motion carried 4-0.

in front of the Boynton Commerce, Center's ,Planned Industrial
Development. S. w. 7th Court ,i$the only entrance into Boynton
Commerce Center. There'are three entrances into the site (one
onTVoolbright Road and two coming off of S.'W. 7th Court). Mr.
Cannon showed there is circulat,ion.around the site by two-way
driv.es. There is a one-way dl::rive going through the center of the
site which contains a future drive-in teller location.
Mr. Cannon said the buildincrs are two stories with one story of
under building parking for,ci total of 30 feet~ He read the
staff comments from the Building Department, Engineering Depart-
ment,Utilities Department, an additional memo from the utilities
Department, Public Works Department, Plann;i.ng Department, and
the Energy Coordinator.
Leo Noble, P.E., Lawson & Noble, Inc., 1123 Crestwood Boulevard,
L.ake Worth, Florida 33460, had no problems with any of the comments
with the exception of the comments on water and sewer by Perry ,
A. Cessna, Director of utilities .1-1r. Noble said they are work-
ing with Mr. Cessna on this.
Chairman Ryder was informed by ~Ir. Noble that the driveway just
east of the E-4 canal is a new one. .Mr. Noble said it was part
of the overall site and that entrance will have a right turn in
and a right turn out to improve the traffic circulation through-
out the whole site, and he explained.

They do not go outside of the confines of the foundation
except on the "D" Model where they have asked that it go out
as much as ten feet.
Mr. Worrell stated they would replace any trees that would
be removed. He said the only change would be a screened
wall and screened roof. Mr. Dono',an explained that Mr.
Worell was before the Board because he changed the external
appearance of the building and the approved site plan had
been altered. They added screened rooms on the back where
they were not shown before.
Mr. Worrell was asking to be allowed to put the screened
rooms on as the individual owners would desire them and
want to pay for them. He said the applicant was not wanting
to do it. It was a site plan revision. Mr. Blanchette
advised the applicant was asking for a blanket authorization
to put the screened rooms on as people might want them.
There was discussion about the buildings and landscaping.
Chairman Reid noted there were trees and shrubs. Mr.
Worrell informed the Members that all of the patios are
blocked off from the street by a wood fence.
Mr. Donovan determined that Mr. Worrell was asking that all
of the landscaping be moved ten feet north. Mr. Worrell
added, "as the screened porches are constructed."
Mr. Worrell wanted to set the record straight so anyone
who wants a permit to put in a screened porch or enclosure
can do so. Dr. Kennedyguestionedwhether that came under
landscaping. Chairman Reid informed him the relocation of
the trees comes under landscaping. The Board cannot address
the other. Mrs. Centola, reminded the Members that they
previously had The Crossings, which was similar to this.
In making it possible for people to have screens, Colonel
Reid told the Members the applicant is moving the Sable Palms
back. The project was previously approved.
Mr. Buck moved to approve the site plans and allow the
applicant to move the trees, seconded by Mr. Mucciolo.
Motion carried 6-0.

Mr. Mucciolo had a voting conflict ani wished to abstain
from voting on this project. (Form 4, Memorandum of Voting
Conflict is attached to original minutes in City Clerk's
Office as Addendum #1.)
Mr. Leo NOble, Lawson & NOble, Inc., ll23 Crestwood
Boulevard, Lake Worth, had an Architect from Briel, Rhame,
Poynter & Houser Architects-Engineers, Inc., Boca Raton, and
the Landscape Architect with him.
Dr. Kennedy asked if they were going to replace any of the
trees along the canal so the project will be blocked off
from the people in Leisureville. Mr. Noble replied that all
of the trees on the canal bank are just scrub, and they will
be corning down. He informed Colonel Reid there are some
slash pines back there but they are too big to be moved and
cannot be saved. Chairman Reid advised Ranger Construction
would move them. Mr. Noble said the water level in the E-4
Canal is so low it lowered the ground mark.
Dr. Kennedy asked City Manager Cheney about the Jarvis
agreement with the City. City Manager Cheney was not sure
whether it started with this site or the Boynton Commerce
Center, which is just south of there, but said he would
check on it before tomorrow night (Council Meeting, August
21) .
Colonel Reid observed they had Black Olives. He noted the
property line, and theArchitectfromariel, Rhame, etc.
(BRP&H) indicated alO foot utility easement and property
owned by the Lake Worth Drainage District. TheArchitect
did not think the LWDD would allow a tree to be planted
there. Chairman Reid did not think Leisureville wanted to
look at their building, and he referred to the reflection of
the west sun hitting the glass of the building. The
Architect said the building is 30 feet, and the trees are 14
feet.
Mr. Winston Lee, ASLA, Vice President, Urban Design Studio,
Suite 600, The Concourse, 2000 Palm Beach Lakes Bouleard,
West Palm Beach, Florida 33409, stated they want to keep a
corporate park look and put the varl.Ous plantings on the'
interior. Colonel Reid asked why they did not put the ficus
benjamina hedge on the property line. Instead of having two

hedges to be edged, Mr. Lee said they thought they would put
the hedge on the side. He assured Chairman Reid they would
maintain it all the way down to the canal.
Mr. Noble said there will definitely be some grade chauges.
If they have native trees in the planning area, Colonel
Reid stressed they should save them. The Architect from.
BRP&H assured him they will. Colonel Reid said the trees
were not shown on the plan exactly as they relate. Mr. Lee
explained that very few of them are in the setback areas.
Chairman Reid was informed there were mostly clusters of
Sables and Washingtonias. Colonel Reid suggested they use
all Washingtonias, as the two types of trees are not com-
patible and not a good combination. The Architect from
BRP&H said it is already landscaped, and Dr. Kennedy com-
mented that it is very nice.
Chairman Reid felt the applicant should provide enough
screening in height along the west line. He noted there
were fifty feet between trees, and thereshduld be forty.
Mr. Lee said they clustered those. Colonel Reid recommended
they cluster more to get more screening. Mr. Lee thought
they could dD that. Chairman Reid again referred to the sun
hitting the building, which he thought was quite a problem.
He suggested some other trees be used along with the Black
Olives and that they be staggered to get a variation and
natural or native feeling back there. Mr. Lee reiterated
that their intent was to get a corporate look on the exterior
and a variety would go into the center so it could be repeated
for all of the parcels that come in. There was more discussion
about variety and height.
Mr. Buck moved that the plans be accepted. Mr. Donovan
wanted the additional trees to be spelled out. He wanted no
confusion when the Building Department goes out for final
inspections. Mr. Blanchette seconded the motion.
Chairman Reid suggested Silk Oak. Mr. Lee wanted to keep
Mahogany. Colonel Reid agreed Mahogany would be all right
and told them to just run a sprinkler line back there.
A vote was taken on the motion and carried 5-0.

colonel Reid added that Mr. Hamilton should have his plans before
the Board the nearest meeting to March 12. City Manager Cheney
advised that Mr. 1<eehr wanted Mr. Hamilton to come in December,
and Mr. Hamilton said he would come in March. When Mr.
Hamilton comes in, Chairman Reid said the Board wants finished

Mr. Prezioso thought the Board should also keep their eyes on
this too before they start having problems. city Manager
Cheney asked if Mr. Prezioso was Suggesting that the planting
on Industrial park should go in at a particular date. Mr.
prezioso and Dr. Kennedy recalled tbe man a:greed to put
planting in right away. Dr. 1<ennedy remembered that they told
the man to come and talk to Colonel Reid about it.
At the last meeting, wbenthe man was before the Board, Mr.
Cheney asked if there was a commitmerit, a timetable, or just
as a part of the total development plan. He told the Members
the development plan requires that trees be planted. Dr.
Kennedy thought Colonel Reid suggested they put treeS in as soon
as possible. Chairman Reid'remembered that the man was very
agreeable, and City Manager Cheney commented that they are all
agreeable when they come here.
Colonel Reid advised that it was in the notes and marked on his
plan.
Mr. Berman felt City Manager Cheney's suggestion was very well
taken and that ,the Board J).1embers should put a definite date
when someone is to come ba9k. Mr. Cheney added,"ora point
within the development state (after buildingl, before building
2, or something like that)." City Manager cheney advised the
Board Members to "pinthem down." Mayor Warnke agreed with
having a certain date and felt the Building Department would have
much more leverage. If they have a certain date, Mayor Warnke
said they cannot get a c/o unless it is done by that date.
Incomplete plans
When they come in with incomplete plans without meeting specifi-
cations, Chairman Reid said they could send the applicant back
and refuse to approve the plans regardless of their hardship.
If by chance a plan comes to the Board incomplete, and it should
not, City Manager Cheney told the Board Members to send it back
and not look at it. That way the Board is reminding the city
that they let an incomplete plan come to the City and t'"le Board
is making a statement. He urged the Board Members to SInd
incomplete plans back, and that will help the city get 1he message
across to developers, the planners, engineers, etc.

Mr. O'Brien called attention tot.hedifference. Someone is saying

He asked where you make the distinction that the plan is ,an
incomplete plan. .~r. O'Brien thought the City staff had to look
at it as meeting minimum Code and then make c:ertainreC:Ol11l1lendations.
If they send the plans to the Board, inmost cases, Mr. OIBrien
thought you would find they are complete plans. Chairman Reid
disagreed, saying they come before the Board devoid of meeting
landscape principles in plans. some oftnem have nothing on them,
and Colonel Reid has ended up drawing on the plan.
Mr. O'Brien stated ,that the Board Members.are stretching the
minimum Ordinances, and they get agreements to stretch the minimum.
Vice Chairman Blanchette thought Mr. Q'Brienwas questioning
why they, as a Board, ask for more than the minimum Code. Vice
Chairman Blanchette advised that staff can't and as BOard Memoers,
they cannot do it either. If the Code says that a tree should be
8 feet tall, the Board cannot ask for a 9 foot or 12 foot tree.
Vice Chairman Blanchette said the Board wanted the applicant to
sign his name to a 12 foot tree. There was discussion regarding
this.
Unfortunately, colonelReidsaidtllE;dCity's Code is the least of
any municipality. Vice Chairman Blanchette disagreed. Chairman
Reid felt they should convince an owner of the advantage in
using better landscaping to improve his property. There was more
discussion about the minimum requirements.
Mayor Warnke thought it would behoove the Board to have a
Workshop Meeting and to bring before the Council the Board's
recommendations as to how the Code should be changed or how this
whole thing could be more easily handled. Eventhough the
Code had been changed, Mayor v~arnke pointed out that the Board
still seemed dissatisfi,ed with it.
Chairman Reid said a conscientious developer will improve <their
property. He will agree and go ahead and do it. If the Board
does that, they are improving the City's landscaping. There
was more discussion and disagreement.
Code
Mr. O'Brien stated that applicants come in with the minimum plan
and the Members request people to change their plans.
Mayor Warnke informed the Members that the last time the Code was
revised was in July of 1981.
Vice Chairman Blanchette told of several people he knowS of who
cannot put additions on their buildings because they cannot meet
the City's Codes as they are now. vice Mayor Zimmerman
reminded Mr. Blanchette that they were talking about the land-
scaping.

BOYNTON
Mr. Blanchet.te kneW a man who had to fill out ten ;;lpplications
for a variance and it was only dealing with a parking lo~. Cit.y
Manager Cheney seemed amazed and did not know why anyone would
have to fill out ten applications. He asked that Vic~ Cha,irman
Blan-::hette bring them in so the City can look at them.
What Vice Chairman Blanchette was getting at was it is not the
big developer because he can afford it. city Manager Cheney
advised that the Board has to decide. In most cases, Chairman
Reid said the little guys who come before the Board have been
the most agreeable.
There was discussion about problems from staff and Ordinances.
City Manager Cheney reminded the Members that the current Land-
scape Ordinance was reconunended by the Board, and the council
adopted it. Some of the.Merobers were saying the City does not
enforce it strictly enougl1. other Members were saying appli-
cants cannot get by the staff. city Manager Cheney said the
fact is, the City enforces what is in the Ordinance.
Chairman Reid told Mr.Cheney,.the"little fel.lows" come in and
do not have a plan, and> he ends up making notes. . He>eJIlphasized
that he does not mind doing it. If he can get them'to put in
a few more trees and do something, Colonel Reid said he will
draw their plans for them. Although they get a sheet on how to
draw a landscape plan, Chairman Reid said the little fellow does
not follow it so they come in unprepared.
If the Board wants the little guy to come in with an incomplete
plan, City Manager Cheney said that. was ,fine, but then the
Board should not tell him they do not want the little guys to
come unless the plans are complete. city Manager Cheney asked
where the Board draws the line between those people and these
people. Mr. Mucciolo questioned whether the Board can make a
distinction between little guys,and ones thatcanaffordi.t.
There was more di.scussion. Mr. Mucciolofeltthe issue was
minimum code. There was talk about applicants and subdivisions.
On larger ones, Chairman Reid said if they are incomplete, the
Board will send the plans back.
NEW BUSINESS
There was discussion about a new Ordinance and whether they
should have a Workshop. Vice Chairman Blanchette said there was
no sense in making a couple of amendments when it would take
awhile to go through the entire ordinance and it will have to go
to the City Attorney. There was discussion about the minimum
requirements and the availability of trees.

Cit.y Manager Cheney confirmed that Mr. Berman's impression is correct.
Mr. Hamilton is not going to have the same type of berm that is
on 4th Street. Mr. Berman recalled that Mr. Hamilton will have
native plant material to reseed itself.
City Manager Cheney observed that it was the Board's suggestion
that Mr. Hamilton had not continued it. Colonel Reid remarked
that it looks bad when you just see the sand. The berm will be
brown. Mr. Berman inquired whether, the berm would eventually
be green or stay brown as it is. He added that everybody will
be riding by to see the City of Boynton Beach. Mr. Berman did
not like the comments that this is a low rent place. "This is
not Boca Raton. This is Boynton Beach;' and Mr. Berman continued,
"We love it."
City Manager Cheney informed Colonel Reid the railroad right-
of-way is adjacent to The Crossings. Chairman Reid thought they
might explore it. City Manager Cheney said the City only had
the right to put a 2-1/2 foot Australian Pine hedge there.
They will not allow anything there. If the City does not keep
them at 2-1/2 feet, City Manager Cheney said they will rip
them out of there, and the City will have nothing. The City
puts them in at the City's risk, and they can take them out
any time they want to.

Property East of E-4 Canal, South of Woolbright Road
Dr. Kennedy called attention to this property and said City
Manager Cheney had some calls. City Manager Cheney reported
they looked at it, and they are doing exactly what the plan
calls for, are taking down what the plan allows and are putting
ba-::k in what the plan calls for. There will be 102 feet
between the edge of the canal and the first building. City
Manager Cheney said he could give the Members another copy of
the letter he wrote in detail, explaining exactly what is
happening. He added that all of the trees are going down in
accordance with the plan.
Dr. Kennedy recalled that when they OK'd the plan, they did
not have the tree survey. He said the people are really upset.
City Manager Cheney said they have gone over this over and
over again. What they are doing and what they have done and
what they will do is what is shown on the plan that was
approved by the Board. Mr. Cheney said Bert Keehr, Deputy
Building Official, knows the plan tree by tree and assured
him that he has been out there. There is no City property
except where the wells are, and there is a limit as to what
they can do there.
If the Members want to review that, City Manager Cheney
suggested that they put it on their next Agenda and talk about
it when they have the plan in front of them because they can-
not remember.

city Manager Cheney said the developer will be glad to com6 back.
and meet with the Board again. The developer meets with the
neighbors out there week after week. The neighbors have been
there in the morning.talking to the developer, have been to
Bert Keehr, 'and they call city Manager Cheney and Bud Howell,
Building Official.
Catalina Club
Mr. Berman asked if anyone remembered plans coming in for
Catalina Club, which is a neighborhood shopping area. He
noticed that it has been completely cleared and fill has been
put in on the upper east corner of 22nd Avenue. The Board
does not know what is happening. Chairman Reid asked if there
were any trees in the area. Mr. Hallahan answered that there
were a lot of scrub pines.
Bethesda park
Colonel Reid noticed they put the wood around three or four of
the pines and then stopped. Mr. Halla'.hanadvised that only
those in the southwest corner are going,to remain. Kids have
been tearing the batterpjards down. Chairman Reid said the only
trees he saw with batter boards were those looking more or
less directly across. Mr. Hallahan stated those will remain
and those along I-95 and the overpass will remain.
Mr. Hallahan said the developer is well aware of the situation,
and the plan was submitted before the Board.
Chairman Reid said they would have to come back again with that
in order to save all of those pines.
Board s.eatingArrangement
It looked to Mr. o'Brien like they would need another table.
city Manager Cheney said the Board Members have a memorandum
which the council asked him to send to the Members addressing
the seating arrangements for Alternates. He made a note to
send the Members another copy of the memorandum. city Manager
Cheney recalled that he sent the memorandum a couple of months
ago.
