COMMUNICATIONS AND ANNOUNCEMENTS A. PLANNING AND ZONING REPORT (Tambri Heyden, Planning and Zoning Director) Ms. Heyden stated that late this afternoon her office received a request for a two-week postponement until May 26, 1998 of the public hearings for Barbara Bradshaw Zoning Code Variance for the two items on tonight's agenda. (Item 7 A.1 and 7 A.2) Motion Mr. Dube moved that the public hearing on the Zoning Code Variance from the City of Boynton Beach land Development Regulations, Chapter 2 - Zoning, Section 5.G,2.a (rear and side yard setback) and Request for Variances from Chapter 2 - Zoning, Section 5,G,2.a (dwelling size) in the matter of 658 Manor Drive (Barbara Bradshaw) be tabled until the May 26, 1998 Meeting. Motion seconded by Mr. Reed and carried 7-0. A. Ms. Heyden stated that at the last Planning and Development Board meeting there were two items on the Agenda relating to Benvenuto's Restaurant, one was for abandonment of a special purpose easement and the other was the gate elevations to be referred back for design review. Ms. Heyden stated that at the last City Commission meeting both items were approved. B. Ms. Heyden also stated that there were two items that had been tabled at the last City Commission meeting that were before this Board at the April 14, 1998 meeting. Those matters were the Hills at lake Eden PUD rezoning and the Palm Walk AClF conditional use application. With respect to the Palm Walk ACLF application the City Commission requested that the Applicant relocate the kitchen area and the Dumpster that was in the front of the property. Ms. Heyden stated that the Applicant did relocate the kitchen area and Dumpster and the City Commission was satisfied with the new location. Planners · Consultants January 21, 1998 Job No. 98-17 TRAFFIC IMPACT STATEMENT Palm Walk ACLF City of Boynton Beach, Florida SITE DATA The subject parcel is located on the north side of Southwest 19th Avenue approximately 300 feet east of Congress Avenue (just north of Golf Road) and contains approximately 2 acres. Proposed site development on the currently unimproved parcel consists of a 48 bed ACLF. Site access is proposed via a single driveway connection to Southwest 19th Avenue. For additional information concerning site location and layout, please refer to the site plan prepared by Ehasz Giacalone Architects, P.C. PURPOSE OF STUDY This study will analyze the proposed development's impact on the surrounding thoroughf ares wi thin the proj ect ' s radi us of development influence in accordance with the Palm Beach County Land Development Code Article 15, Traffic Performance Standards. The Traffic Performance Standards require that a proposed development meet two "tests" with regard to traffic. Test 1, or the Link/Buildout Test, requires that no site specific development order be issued which would, during the build-out period of the project, add project traffic at any point on any major thoroughfare link within the project's radius of development influence if the total traffic on that link would result in an average annual daily traffic or peak hour traffic volume that exceeds the adopted threshold level of service during the build-out period of the project. Test 2, or the Model Test, requires that no site specific development order be issued which would add project traffic to any link within the project's model radius of development influence if the total model traffic on that link would result in an average annual daily traffic volume, as determined by the model, that exceeds the adopted level of service. For the purposes of this analysis, the construction contemplated in the Modified 2010 Plan shall be used. The Palm Beach County Unified Land Development Code Article 15, Section 15 (I) (G) -Procedure, Subsection 1 (C) (1) provides that amendments to residential projects generating fewer than 200 gross trips shall not be required to submit a Traffic Impact Statement. In general, palm trees will be the only tree species allowed within utilities easements, Canopy trees may be planted outside of the easement so that roots and branches will not impact those utilities within the easement in the foreseeable future. LD R Sec. 7,5-18.1 gives public utilities the authority to remove any trees that interfere with utility services, either in utility easements or public rights-of-way. 2) Fire flow calculations will be required demonstrating the City Code requirement of 1500 g,p,m. as stated in LDR chap. 6, Art, , Sec, 16, or the requirement imposed by insurance underwriters, whichever is greater. (see Sec. 26-16(a)). Please submit these calculations with your HRS permit submittal. 3) Comp Plan policy 3C,3.4 requires the conservation of potable water. City water may, therefore, not be used for irrigation where other sources are readily available. SPECIFIC CONDITIONS 1. We still have concerns that a 4-foot high wall on the west side of the lift station will obstruct our drivers' view when they exit the station, and pose a hazard to pedestrians, bicyclers, etc. on the sidewalk. Although Jerzy Lewicki of her office has advised me by telephone on more than one occasion that if the property owner files the new application and for any reason the new application is not granted, the existing approvals from the Mr. Louis P. Giacalone November 25, 1997 Page 2 City would remain unaffected, I recently received a telephone call from Ms. Heyden's secretary which raised some concerns about what Mr. Lewicki has advised us. I will continue to try to get a response from the City. until we get such a response, I do not recommend filing the new application with the city. Please also note that I have not yet received written confirmation from the City that the one (1) year extension for the existing conditional use and concurrency certification for the Palm Walk Adult Congregate Living Facility has been issued by the city. On August 18, 1997, the City Commission approved the issuance of a one (1) year extension for the conditional use and concurrency certification for the Palm Walk Adult Congregate Living Facility. Although we have not yet received written confirmation of the extension, Jerzy Lewicki of your office recently advised me that the written confirmation would be provided shortly. As you may also be aware, our client's architect, Louis P. Giacalone, of Ehasz Giacalone Architects, P.C., has been in contact with Mr. Lewicki concerning a proposed change in the plans for the proposed facility to increase the area of the facility while maintaining the approved 48 beds. It is our understanding that in order to change the proposed plans for the facility, a new conditional use application must be submitted to the City, rather than an amendment to the existing conditional use approval. Tambri J. Heyden, AICP November 4, 1997 Page 2 In this regard, I spoke with Mr. Lewicki today concerning the new application, as well as the status of the existing approvals from the city. Specifically, I asked Mr. Lewicki to confirm that if our client files the new application and for any reason the new application is not granted, our client's existing approvals from the city would remain unaffected. Mr. Lewicki confirmed that the filing of the new application would not adversely effect our client's existing approvals. I also asked Mr. Lewicki if he could confirm this in writing, but he advised me that I would need to submit the request to you in writing. Accordingly, this will serve as a request for confirmation by the City that the filing of the new application would not adversely effect our client's existing approvals from the City.
