Modifications
The Quarterly Report was transmitted for the period through September 30, 1995. When the
last Quarterly Report was issued, the board requested that a I ist of approved waivers and
modifications be included. This report indudes a separate list of those items. The next
Quarterly Report will contain a separate list by category - commercial versus residential.
Chairman Dube noted that Longhorn has submitted a request to enclose their porch. He
inquired as to their plan to accomplish this enclosure. Ms. Heyden was not able to answer
that question at this time.

John Hoecker, managing age for the Shoppes of Boynton, reporte that they are attempting to
modify an entryway to one of tn major anchor tenant spaces. A grea eal of money has been
invested in this shopping center, an there are no plans to do anything w " h will detract from its
appearance. "Ross Dress for Less" wi occupy the largest space in the buil "ng. This area lacks
identity. The space has been vacant for ove year, and that problem has been res ved by filling the
space with "Ross Dress for Less". The problem countered in filling the space resul from the fact
that the space is set back from the remainder of t center. Because it is an anchor s ce, and the
largest space in the building, the owners feel it warran ore identity than currently exis

MarkSal14archited for the project, reported that a new sketch exists which addresses staff's
comments and his client's need for identity. They arrived at a proposal which replicates the triangular
peaks, but extends the peak to a higher elevation over what was originally Freddy's. In doing this, the
sign band can be placed in the identical height location in relation to the ground. He displayed
photographs of the current conditions, and a sketch of the proposal. At a meeting with Ms. Heyden,
there was discussion relative to bringing the two columns forward so that they are flush and will allow
a location for placement of the "Ross" sign. If the peak is replicated to match the top parapet of the
building, no advantage is gained. The sign will still remain at the same elevation, and will not be able
to be seen from the street. The applicant is proposing to align the trim bands. This will then permit
the "Ross" sign to be placed in line with the "Luria's" sign. The applicant is attempting to match the
height of the "Luria's" sign.
Mr. Saltz feels that if the Commission approves raising the peak, he can work out everything else with
staff.
Ms. Heyden advised that the applicant has taken staff's comments, worked with them, and met staff
somewhere in between. The applicant is proposing a letter height of 72". The sign program for the
shopping center was amended in 1993 to allow letters up to 48". She would approve the sketch as
long as the letter height is not greater than 48".
Mr. Saltz pointed out that when the sign program was amended to 48", it was done for Ben Franklin
which is a junior anchor. "Ross" would not want a sign less than "Luria's". The original sign criteria
called for all the anchor tenants to have one color sign, and all junior anchors to have another color.
Vice Mayor Bradley pointed out that the project could be approved subject to the sign matching the
size of Luria's sign.
Commissioner Rosen asked for clarification on the design of the "Ross Dress for Less" sign. Mr. Saltz
explained that the "Ross" sign is blue in color, and it is internally neon lighted. The sign has individual
channel letters.
Mayor Taylor inquired as to the height of the individual letters.
1000 Quincy, store architect for RossDJ'ess furless, explained that if they use 60" "Ross" letters, they
would then use 30" "Dress for Less" letters. "Ross" would like to maintain parity with the other major
tenant in the center. The "Dress for Less" portion of the sign will be located lower than the "Ross"
portion. It is essential that the name "Ross" be the same size as Luria's (5'), and then the lower band
at 30".
Mayor Taylor feels this tenant will then have a sign, when the two lines are combined, which measures
approximately 8'. Luria's may then have the same complaint.
Mr. Quincy stated that the lower the sign location is placed, the more the planting area will obscure
it. There is not sufficient room to place the entire logo in the upper area. "Ross" feels the 5' sign

Ms. Heyden advised that Mr. Fassey could not attend this meeting because one of his family
members has a medical problem. She reviewed Planning and Zoning Department
Memorandum 95-491. She stated that this request is consistent with the code and has been
timely submitted. She explained that Mr. Fassey has requested this extension because of
financial problems. He is seeking assistance from HUD on this project, but his partner was
not accepted by HUD. The Technical Review Committee and Concurrency Review Board
recommended approval of a one year time extension, subject to continued maintenance of the
property and adherence to all staff comments that were attached to the original approval.
Motion
Vice Chainnan Golden moved to recommend approval of the time extension for Palm Walk
for one year for the conditional use and concurrency certification for construction of a 48 bed
adult congregate living facility for Alzheimer's/dementia patients, subject to staff comments.
Mr. Wische seconded the motion which carried 6-0.

Mr. DeCarlo gave a very brief presentation since no one was in the audience and the members
of the Board had already read Planning and Zoning Department Memorandum 95-448.
Mr. Kilday represented the petitioner. He said condition number 3 of Planning and Zoning
Department Memorandum 95-449 should be deleted because the final plan was approved to
replace the vines with a hedge along the wall. Also, page 2 of that memo contains a
recommendation which the petitioner cannot meet because he would have to put some vines on

comments. Mr. Wische seconded the motion, which carried 5-0. Mr. Elsner was away
from the dais.
8. COMMENTS BY MEMBERS
Mr. Aguila stated that several meetings ago, Chairman Dube brought up an issue about
this board acting in the capacity of the Community Redevelopment Advisory Board. He
inquired about the status of that issue. Chairman Dube felt there was duplication of effort.
He said he brought this up because the Community Redevelopment Advisory Board was
not having meetings for awhile and they did not have anything to discuss. He said he had
discussed this with Ms. Heyden, and she did not feel there would be any problem adding
it to the Planning and Development Board agenda when something arises. Mayor Taylor
advised that the City Commission has not yet officially discussed this issue.
Mr. Aguila inquired about the status of RaceTrac. Mr. Haag advised that the berm along
the west property line and the landscaping on the berm, as well as the sign and the unity
of title connecting the little portion of the property that RaceTrac bought with the regular
site, are the only outstanding Planning and Zoning Department issues.
