Dear Ms. Heyden:
This letter is written as a follow-up to our telephone
conversation yesterday with respect to the captioned matter. As I
indicated to you, our office represented Palm Walk Associates,
Ltd., a Florida limited partnership ("Palm Walk Associates"), in
connection with its acquisition of the subject property.
Palm Walk Associates acquired title to the subject property
on April 17, 1997. Its acquisition of the subject property
followed a foreclosure action against Mark Fassy. It is our
understanding that a former owner of the subject property had
obtained a conditional use approval and concurrency certification
for the Palm Walk Adult Congregate Living Facility. As the new
owner of the subject property, Palm Walk Associates intends to
construct an adult congregate living facility on the property.
However, our client recently discovered that the conditional use
approval and concurrency certification for the Palm Walk Adult
Congregate Living Facility will expire on August 16, 1997.
Although our client intends to commence construction shortly, it
does not anticipate being in a position to commence construction
by August 16, 1997.
Accordingly, this letter will serve as a formal request by
Palm Walk Associates to the City of Boynton Beach for the issuance
of a one (1) year extension for the conditional use and
concurrency certification for the Palm Walk Adult congregate

Living Facility. In this regard, enclosed is our firm's trust
account check made payable to the city of Boynton Beach in the
amount of $400.00, representing the fee required in connection
with this request for the one (1) year extension.

(I) To facilitate the processing of the request, it is recommended that the applicant set up, by appointment, a
pre-application meeting with the Director of the Planning & Zoning Division (561) 375-6260 prior to the submittal
deadline date, The meeting will address concerns regarding the type of submittal, Board review schedule, submittal
procedures, fees, application form, and type and number of plans/documents that are required to be submitted.
(2) Applications which require submittal of a traffic impact analysis, pursuant to the Municipal
Implementation Ordinance of Palm Beach County Traffic Performance Standards Ordinance or abandonment requests
which are associated with rights-of-way by the State or County may require additional review time. (Refer questions
regarding traffic to the Director of the Planning & Zoning Division,)
(3) Prior to an abandonment being recommended for approval and presented to the Planning & Development
Board, the respon~es from the appropriate outside agencies, county or state, regarding the abandonment, shall be received
by the Planning and Zoning Division,
(4) An application for concurrency time extension or concurrency appeal the Concurrency Review
Committee will take the place of the Technical Review Committee.
(5) Contact the Planning and Zoning Division Regarding processing appeals to an administrative decision
and/or a variance or special exception to other provisions of the Land Development Regulations not specifically listed
above.
(6) THE ABOVE DATES MAY BE SUBJECT TO CHANGE. Contact the Planning & Zoning Division
to verify dates.
