Planning and Zoning Director ~ TO: DATE: August 11, 1994 SUBJECT: Palm Walk - COUS #94-003 conditional Use - ACLF Please place the above-referenced item on the August 16, 1994 city commission agenda under Public Hearings. DESCRIPTION: This is a request for conditional use approval to construct a 48 bed, specialized (for alzheimer's and dementia patients) adult congregate living facility (ACLF) with limited nursing services. The property is located on the north side of S.W. 19th Avenue, approximately 100 yards east of Congress Avenue, and is zoned R-3 and within the modern district of the Community Design Plan. The two buildings proposed total 17,042 square feet and are 25 feet in height. One entrance, on S.W. 19th Avenue, is proposed to serve the parking lot of 17 parking spaces (one space is surplus) which is to the rear of the buildings. Loading and service areas are proposed in front of the buildings. The walls of the building will be pale pink stucco with white cement tile roofs (see separate item on the August 16th agenda for a community design plan appeal of roof material for the project) and light green tile trim, including canvas canopies, striped white, pink and green. RECOMMENDATION: The Planning and Development Board unanimously recommended approval of this request, subject to staff comments (Public Works Department Memorandum #94-201, utilities Department Memorandum #94-253, Engineering Department Memorandum #94-205, Engineering Department Memorandum #94-209, Building Department Memorandum #94-178, Parks and Recreation Department Memorandum #94-258, Planning and Zoning Department Memorandum #94-234 and Planning and Zoning Department memorandum dated August 3, 1994), with the exception of comment II.1, recommending a building height reduction to 20 feet, of the August 3, 1994, Planning and Zoning Department memorandum. Since the day of the Planning and Development Board meeting, the applicant has prepared the attached sketch showing another roll- out dumpster scheme. The sketch shows the raised curbing around the dumpster, required by Public Works and shows the roll-out on the south side of the loading/service area, rather than the north side of this area; the location stated in the memorandum from Public Works. This issue was not discussed at the Planning and Development Board meeting and staff has since then discussed the new location with concerned departments; Public Works and Utilities. The Utilities Department has stated that the new location and design are too close to the city's lift station and wet well, causing a tripping hazard for city utility personnel and possible serious injury. The Public Works Department has indicated that roll-out dumpsters are problematic in that City workers cannot always rely on property owners rolling out their dumpsters for pick-up. Also dumpsters have been .known to roll into rights-of- way (thus the curbing) and dumpsters are frequently not returned by property owners to their enclosures (an aesthetic problem). For these reasons, Public Works has allowed roll-out dumpsters in TO: Carrie Parker -2- August 11, 1994 very few projects within the city (such as Snug Harbor, Village Royale on the Green, Coastal Towers, Seagate of Gulfstream, Gulfstream Apartments). such projects are residential and typically multi-story with drop chutes into the dumpster and the dumpsters are privately owned and modified with wheels. There are 2-3 commercial projects on Industrial Avenue that have had roll-out dumpsters for years, but no recent commercial projects have been granted roll-out dumpsters for safety reasons. However, since the dumpster was a difficult issue with this project, in the spirit of compromise, Public Works has accepted the attached sketch for this quasi-commercial project. In addition, it is noted that the roll-out dumpster location conflicts with handicap requirements by encumbering the sidewalk needed for public pedestrian access from the right-of-way. Also, the sketch shows the dumpster enclosure having moved east; shortening the paved area by the kitchen, that was credited towards the required 12 foot by 35 foot loading zone. Therefore, to meet City and handicap codes, the dumpster enclosure and paved area needs to remain as shown on the plans forwarded to Commission.
