the above-referenced project. It should be noted that the comments
are divided into two (2) categories:
The first category is a list of comments that identify unresolved

not substantially alter the configuration of the site and the
design of the building.
The second category is a list of recommendations I believe will
enhance the aesthetics and function of the project.
All comments and recommendations can be rectified on the plans at
time of permitting if the site plan request is approved. The
applicant must understand that additional comments may be generated
upon review of the documents and working drawings submitted to the
Building Department for permits for the proposed project.
I. SITE PLAN REVIEW COMMENTS:
1. Landscape Comments:
A. The east access route (driveway) to the parking area
requires a landscape barrier between it and adjoining
property. The drawing has been changed from the first
submittal
and
no
longer
meets
landscape
code
requirements.
B. The north or rear wall requires a landscape barrier on
the applicants property. This can be met either by a new
hedge or in conjunction with the existing wall providing
vines as called for in section 7.5-35 (c)( 4} on the
applicants property with irrigating system on property.

2. Uni ty of Title must be provided prior to completion of
building permit application.
3. Easements have not changed from original submittal. Drawings
must have TRC sign offs on permit set of drawings prior to
issuing building permit so TRC comments regarding easement
must be complied with.
4. As a minimum, the control sets of drawings will need to have
a table added indicating color as shown on color elevations.
5. The roof variance request for Community Design District III
must be approved or design changes will be required to have
structure conform to the Community Design District ordinance.
6. Along S.W. 19th Avenue (the front of the building), a
representative sampling of those plant materials called out as
being acceptable to the modern design district as delineated
in Appendix III of Article V - Community Design Plan must be
shown on the drawings.
II. RECOMMENDATION(S):
1. It is recommended that all sets of drawings be checked through
to eliminate discrepancies between drawings prior to
submitting permit set of drawings. Indication of incorrect
features on a drawing even if it is not pertinent to the
purpose of the drawing is very confusing.
NOTE: If recommendations are approved, incorporate them into the
working drawings required for permits for the project.

list must meet the height requirement of 8 feet minimum
when planted on site.
This is rigorously enforced by
site inspection. Please delineate trees differently on
the building permit set of drawings.
F. The list of landscape materials and the landscape drawing
contain discrepancies that must be corrected.
- There is no listing for the symbols C1, CL, SL, CI
which are shown on the drawing.
- For the symbols ZF, RE1, LS, SN, there does not seem to
be any items shown on the drawing.
- Discrepancies seem to exist for the following symbols:

H. Please add note to drawing that indicates that
interference with a structure may cause relocation of a

following comments:
1. Item numbers 3, 5 and 6 of Utility Memorandum #94-154

10' from existing water and sanitary sewer mains.
3. Specify size of proposed water meter on Sheet C-1.
4. Continue proposed asphalt drive/entrance to existing
sanitary lift station north to match existing co~crete
north edge for access and maintenance.
5. Add the following note to Sheet C-l: The City of
Boynton Beach Utility Department to own and maintain
sanitary sewer main line only.
6. A Hold Harmless Letter will be required on proposed
paver blocks in utility easements.
7. Plan Sheet 1 of 5 shows several structures (sculpture,
breezeway, gates, fences, etc.) within utility
easement. Please clarify and identify all objects
encumbering easement for review and comment, Appendix
C, Art. VIII, Sec. 9.
It is our recommendation that the plan not proceed through the
review process until Items 1, 3 and 7 are addressed.

Dear Mr. Fassy:
Please be advised that your request for conditional use approval
for a 48 bed, adult congregate living facility, to be known as
Palm Walk and to be located on a 1.955 acre parcel on the north
side of S.W. 19th Avenue, approximately 351 feet east of Congress
Avenue, was approved by the City Commission on August 16, 1994,
subject to conditions (see attached City Commission meeting
minutes for conditions). Also at this meeting, the City
Commission approved your request for a community design plan
appeal for roof material, as submitted.
Although additional requirements and procedures are set forth by
code for conditional use requests, pursuant to Section 11.2.D.11
and 11.2.F.5 of Appendix A - Zoning of the Boynton Beach Code of
Ordinances, conditional use requests must contain the same site
plan information and be reviewed incorporating the standards set
forth in the city's site plan ordinance. Therefore, the August
16th conditional use approval encompasses site plan approval as
well and entitles you to proceed to the building permit process.

regarding the city's project approval process for conditional use
requests.

Dear Mr. Fassy:
On May 4, 1994, your submittal for Site Plan Review of the above
referenced project was reviewed for completeness. It has been
determined that the submittal is substantially complete and accepted
for further processing. A Planning & Zoning Department staff member
will be responsible for the review and coordination of your site
plan through the remainder of the Site Plan Review process.
The next step in the review process is for the Technical Review
Committee to review the submittal for compliance with the review

Dear Mr. Fassy:
The city of Boynton Beach has completed its first review of the
documents submitted for the above-referenced project. Attached are
comments made by the reviewing departments during their initial
review of your project.
In order to complete the review process, the site plan and
documents must be amended to comply with these comments within 90
days of the date of this letter. (If amended plans are not
submitted in 90 days, a new application fee will be required.)
when there are comments made by the reviewers that you feel are not
applicable to the approval of the project or will be addressed
separately and you have not amended the plans to comply with the
comment(s), you must prepare written explanation for each comment
stating why the comment is not applicable and return the
explanation with the amended plans and documents.
After amending the plans and documents, please submit twelve (12)
complete sets (including surveys) of the plans to the Planning and
Zoning Department. When the amended plans and documents have been
submi tted to the Planning and Zoning Department, they will be
distributed to the reviewing departments for a second review and
the reviewers will recommend if the site plan will be placed on a
board meeting agenda for approval (see attached meeting schedule).
If there are major comments not addressed by new plans or the
reviewers recommend that the plan not be forwarded through the
approval schedule, this office will notify you of your alternatives

CHECKLIST
The following list and information is provided as a checklist to ensure that
the submittal of amended plans and documents is substantially complete for
review. Turning in this list and the appropriate plans and documents will
enable the submittal to be efficiently checked prior to being accepted by the
Planning and Zoning Department.
Project Name: Palm Walk A/K/A Boynton Belvedere
1. Submit an amended Site plan Review/conditional Use application form that
reflects the changes that were made as a result of amending the plans
and documents to comply with the Code of Ordinances and the Technical
Review Committee comments. A copy of the original form with a
distinguishable symbol identifying the change(s) may be submitted or a
completed new form with the changes identified. If there are no changes
required to be documented on the application form, a letter from the
applicant stating same must be turned in with the amended submittal.
2. Submit twelve (12) assembled and complete sets of plans and documents,
including surveys that show compliance with the Code of Ordinances and
comments made by the Technical Review Committee. Two (2) of the sets
shall have the appropriate legible raised seal and signature of the
designer responsible for the drawing(s). Plans and documents shall be
assembled in twelve (12) individual complete packages with the title of
the project on all pages and/or sheets and each page or sheet
numerically numbered such as the following example: 1 of 3, 2 of 3, 3 of
3.
3. Submit color photographs of the buildings on the site that are to remain
in their existing condition and photos of existing buildings that are
located on the sites that abut the perimeter of the subject property.
The minimum size is 5" by 7". Each photograph shall be labeled to
identify the location of the existing structures with respect to the
location of the proposed project.
4. Submit colored elevation view drawings - a colored duplicate copy of all
drawings of the elevation views of each side of all buildings and
signage associated with the project. The colored elevation views shall
match the elevations shown in the documents that were submitted for site
plan review. The applicable exterior surfaces as identified above shall
be colored with the color name and associated color reference number
identified. The type of exterior surface material shall be identified
next to the associated color. The colored elevation drawings shall have
compass direction or title of the side of the building identified. The
title block of the original drawing shall be shown. The maximum size is
~4" by 36". Do no submit on board of any kind.
5. Submit color samples as an example of the proposed colors. Each sample
shall have attached a label that identifies the color by name and
numerical/letter code from an established color chart.
6. Submit a 8 1/2" x 11" transparency of the landscape site plan drawing to
be used on an overhead projector at board meetings.

The following is a list of 1st review comments regarding the site
Plan Review of the plans for the above-referenced project. It
should be noted that the comments are divided into two (2)
categories; the first category is a list of comments that
identify deficiencies that are required to be corrected and shown
in compliance on the plans and/or documents submitted for second
(2nd) review in order for the project to continue through the
site plan revieW process. The second set of comment(s) are
recommendations that the Planning and Zoning Department staff
believe will enhance the proposed development. The applicant
shall understand that all documents/plans submitted for site plan
and/or permit review are subject to additional comments. I
recommend that the applicant/ agent contact me regarding
questions related to the comments. If the applicant is not
intending to correct code deficiencies they should contact me
regarding the procedures, application forms, fees and submittal
deadline dates for seeking relief from the code requirement.
I. SITE PLAN REVIEW COMMENTS:
1. The initial drawings submitted were dated both December 1993
and April 1994. There are numerous discrepancies between
these sets of plans. The drawings must be updated to
reflect one concept for second staff review. The drawings
must specifically include the following details:
* All horizontal control dimensions distances from
property lines to all building, widths of walkways,
driveways, berms, etc.,
* Vertical height of all buildings,
* Identify type and extent of paving and ground cover
everi~here including between trees,
* Clarification of construction of canopy, is it intended
to have vehicles pass beneath?
2. ACLF requires new conditional use application to be
submitted with package in preparation to going to Planning
and Development Board. (Find attached conditional/Use
Application).
3. Road and utility required easements need to be determined
and then formally added or abandoned on the survey along
with unity of title provided for the property.
4. Facility is in community design district III (modern).
Landscape, colors and features must comply with attached
code.

5. All walls must meet the fence requirement of being no higher
than four feet in the front setback (40 feet in from
property line along S.W. 19th Avenue). This affects the
dumpster enclosure and the west property wall.
6. Landscape screening for parking and drive must meet minimum
code requireme~ts and be called out on drawings. The view
from the west through breezeway and in front of main
building needs to be clarified on landscape drawings.
Identifications, sizes and spacings need to be clarified on
landscape drawing.
7. Traffic analysis letter must be rewritten to conform with
concurrency requirements.
8. Density limits for R-3 zoning limit the capacity of the ACLF
to 48 beds. Future expansion of beds is not possible under
current codes.

above project. After reviewing the plans, I find that the
administration building encroaches a 30' right-of-way. The 25'
easement has fountain and sign encroachments. Either the
easements must be abandoned or the structures relocated.
There is no information on the details of any ground signs. All
must be in compliance with applicable codes.
Appropriate documentation must be provided to the Building
Department from all State Agency approvals at permit submittal.

proposed utility easements. Include existing sanitary
sewer Lift Station #607 shown outside existing utility

A BellSouth Telecommunications representative visited the two-acre
site on SW 19th Avenue, 100 yards east of Congress Avenue currently
under consideration for a 48 bed Alzheimer ACLF.
After reviewing the site plan presented by Mr. Fassy, we realized
that royal palms and ground cover shrubs will be planted on the
northernmost 12' of a 30' road easement in which one of our buried
cables is located.

The attached package will be presented to the Planning and
Development Board on August 9, 1994 (see attached agenda) and
then to the city Commission the following week (August 16, 1994).
The applicant must understand that the permit plans shall be
amended to comply with the attached staff comments and that
additional comments may be generated by staff following their
review for technical compliance of permit documents that are
required to be submitted for development of the project.
For the applicant's convenience, attached is a list of documents
required for permit submittal.
An approval of the site plan by the city Commission shall be
valid for one (1) year, unless a building permit from the
Building Department is secured. If the applicant fails to secure
a building permit in that time, all previous approvals shall
become null and void.

Site Plan Review Comments -
All horizontal control dimensions ie, set backs from property to
buildings width of driveways, etc. are indicated on the site plan
drawings.
Vertical height of all buildings are shown on elevations.
Type and extent of paving are shown on Landscape and Paving and
Drainage Site Plans.
The canopies - both entry and breezeway canopies have minimum
clearance of 13'-6" above grown and are constructed of steel frame
and canvas material. Both canopies will be lit from beneath;
giving illumination to the canvas material and the ground beneath.
3. Item 3 - All easements shown on the submitted survey indicate that
there are three roadway and or utility easements through the
property. All easements are to remain.
Furthermore, I've reviewed these easements with various City
Utilities and Water and Sewer Departments; with FP&L, Southern Bell
and Adelphia Cable, and the Building Department. All those above
have reviewed the location of the existing utilities currently
within these easements and each has voiced no objection to either
the landscape design and/or our building locations and/or the entry
fountain wall and sign - Note, we have provided gat~s access to the
existing City Lift Station in the southeast part of the property.
Also, as no wall or fence will be higher than 4' (within the 40'
front setback) and our "sight lines from entry drive to street all
meet code."
4. As the facility is located within district III (modern) we have
complied with all feature requests as per code: ie:
Architectural features and/or treatment 2 required - we have accent
color tile and decorative moldin<]s in the form of "raised stucco
bands."

Windows: We have fixed glass in our "light dormers" and have
provided a "sculpture" on the "palm walk" court.
We have exceeded our requirements according to code, in that we
also provide extra amenities such as a "fountain" on our entry wall
design.

planning department and we have selected to use 4' high walls
permitted within the 40' front setback requirements and
additional shrubbery and/or landscaping plantings in addition

Please note that the landscape screening from the west through
breezeway is effectively screened by a 6' high chainlink fence
with plantings on both sides of the property line (it is with
permission indeed with the direction) of the Cedarwood Villas
immediately to the west of our site, that we build this fence
them and provide the shrubs on both sides of the fence. See
landscape site plan drawing.

FPL has no objections to your request to plant PALM trees in the
existing utility easement providing the following is agreed to:
1.) Clearance to padmounted transformers must be adhered to (3
feet clearance on either side and the rear, 6 feet at the
front of the transformer) .
2.) Locations must be obtained prior to planting.
3.) No tree may be planted directly over the existing direct
buried cable.
4.) An easement consent form must be obtained from the city
Building Division and forwarded to my office for approval
along with a site plan or sketch showing the easement and the
proposed placement of the trees.
