ABANDONING A UTILITY EASEMENT LOCATED IN
BOYNTON LAKES, PLAT NO.2, LOCATED ON
THE EAST SIDE OF NORTH CONGRESS AVENUE,
SOUTH OF HYPOLUXO ROAD, SAID PROPERTY
BEING MORE PARTICULARLY DESCRIBED
HEREIN; AUTHORIZING THE MAYOR AND CITY
CLERK TO EXECUTE A DISCLAIMER FOR SAID
UTILITY EASEMENT; PROVIDING THAT THE
ATTACHED DISCLAIMER BE RECORDED IN THE
PUBLIC RECORDS OF PALM BEACH COUNTY,
FLORIDA; PROVIDING AN EFFECTIVE DATE;
AND FOR OTHER PURPOSES.
WHEREAS, David Shaw, agent for Boynton Lakes Plat No.
2, has requested the abandonment of the hereinafter
described utility easement; and
WHEREAS ,
comments have been solici ted from the
appropriate City Departments; and
WHEREAS, public hearings have been held before the
City's Planning and Zoning Board- and City Commission on the
proposed abandonment; and
WHEREAS, based on the foregoing information, said
utility easement no longer serves any useful purpose.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA THAT:
Section 1:
The City of Boynton Beach, Florida, by
and through its City Commission, does hereby abandon a
certain 12 foot wide utility easement located in the City of
Boynton Beach, Florida, attached hereto as Exhibit A.
Section 2:
The Mayor and City Clerk a~e hereby
authorized and directed to execute and deliver the attached
Disclaimer and cause the same to be filed in the 'Public
Records of Palm Beach County, Florida.
Section 3:
This Resolution
shall take
effect
immediately upon passage.

A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
SUPPORTING THE PLAN OF THE BOYNTON
BEACH COMMUNITY REDEVELOPMENT AGENCY
TO PROTECT SOME 21-ACRES OF MANGROVES
WITHIN THE MUNICIPALITY'S COMMUNITY
REDEVELOPMENT AREA BY CREATING A
NATURE-STUDY CENTER/PUBLIC OPEN
SPACE/PARK OF THIS ACREAGE AND TO
APPLY FOR FUNDING ASSISTANCE FOR THE
CONSERVATION AND RECREATION LANDS
PROGRAM.
WHEREAS, protection for natural resources and environmentally-
sensitive lands is pledged by established laws of the nation, the region,
the county, and this City; and
WHEREAS, within the Community Redevelopment Area of the City, in
the downtown Central Business District, approximately 21-acres of mangrove
trees initiate a productive ecosystem critical to marine life of both the
Intracoastal Waterway and Atlantic Ocean; and

WHEREAS, these mangroves are being damaged and destroyed by the

wake of boats plying the adjacent waterway, which wake predictably will
increase greatly upon the imminent opening of a new marina directly south
of the mangroves; and
WHEREAS, the Community Redevelopment Agency of the City
Beach is mandated to preserve this ecologically-vital area while
economic revitalization of the downtown district; and
WHEREAS, this Agency proposes to create in this area a mangrove
nature-study center/public open space/park to provide protection from boat
wake destruction while simultaneously creating a municipal presence with an
ambience beneficial to citizens and visitors who frequent the area; and
WHEREAS, this project complies with comprehensive planning for the I

WHEREAS, this project will protect a vital natural resource that
helps populate our waters, while providing an educational tool for public
understanding and appreciation of our environment; and
WHEREAS, this project implementation depends on receiving funds
for acquiring the mangrove acreage, and such funds are being sought by the
Community Redevelopment Agency of Boynton Beach from the Conservation and
Recreation Lands (CARL) Program administered by the Florida Department of'
Natural Resources.
NOW, THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY 0

Section 1. The City supports the plan for a downtown mangrove
nature-study center/public open space/park as proposed for downtown by the
Boynton Beach Community Redevelopment Agency and supports the application
for funds for the Florida Conservation and Recreation Lands Program.
Section 2. The City urges the Land Acquisition Selection
.
Committee for the Conservation and Recreation Lands Program to grant a high
priority ranking to the Mangrove Nature Center/Park Project proposed by the
Community Redevelopment Agency of Boynton Beach, and to expedite, in all
possible ways, site-acquisition funding for this project.

BEACH, FLORIDA, AMENDING ORDINANCE NO.
87-10 BY EXTENDING A TEMPORARY
MORATORIUM ON THE ISSUANCE OF BUILDING
PERMITS FOR THE CONSTRUCTION OR
ALTERATION OF BUILDINGS AND STRUCTURES
BETWEEN THE WESTERN BOUNDARY OF THE
CENTRAL BUSINESS DISTRICT OF THIS CITY
AND THE WESTERN CITY LIMIT ALONG BOYNTON
BEACH BOULEVARD; BY AMENDING SECTION 4
OF SAID ORDINANCE TO INCLUDE
APPLICATIONS FOR SITE PLAN APPROVAL
WITHIN THE MORATORIUM AND PROHIBIT
SUBSTANTIAL ALTERATIONS OF BUILDINGS AND
STRUCTURES; BY AMENDING SECTION 7 OF
SAID ORDINANCE TO CONTINUE THIS
MORATORIUM; PROVIDING FOR AUTOMATIC
REPEAL; PROVIDING AN EFFECTIVE DATE; AND
FOR OTHER PURPOSES.
WHEREAs, Ordinance No. 87-10 declared a temporary
moratorium on the issuance of building permits for the
construction or alteration of buildings and structures along
portions of the Boynton Beach Boulevard corridor within this
City; and
WHEREAs, Ordinance 87-10 indicated in Section 7 that
there would be an automatic repeal of the provisions of the
Ordinance as of 11:50 P.M. on the 22nd day of July, 1987;
and
WHEREAs, a new development plan for Boynton Beach
Boulevard has not yet been adopted by the ,Mayor and City
Commission of the City of Boynton Beach.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
I Section 1: All provisions of Ordinance No. 87-10

II with the exception of Sections 4 and 7 shall be reaffirmed
and readopted. \

Section 2: Section 4 of Ordinance No. 87-10 is
hereby amended by adding the words and figures in underlined
type as follows:
Section 4: Moratorium Declared.
As to any real property located in whole
or in part within any zoning category
which fronts on Boynton Beach Boulevard,

to the western City limit, there is
hereby declared to be a moratorium on:
1. The acceptance of applications
for, the processing of, and the issuance

plats, including the replatting of
formerly platted properties.
3. The acceptance of applications
for and the issuance of site plan
approval, master plan or plat approval
for planned unit developments.
4. The acceptance of applications
for and the approval of petitions for
the zoning and rezoning of property.
Section 3:
Section 7 of Ordinance No. 87-10 is
hereby amended by adding the words and figures in underlined
type and by deleting the words and figures shown in
struck-through type as follows:
Section 7: Automatic Repeal;
Suspension of Conflicting Ordinances and
Resolution. This Ordinance shall stand
repealed as of 11:50 P.M. on the 22fta

1988, provided that nothing herein shall
prevent the readoption or ratification
of this Ordinance in the same or similar
form. During the effective period of

AMENDING ORDINANCE NO. 79-24 OF SAID
CITY BY AMENDING THE LAND USE ELEMENT OF
THE COMPREHENSIVE PLAN OF THE CITY BY
ADOPTING THE PROPER LAND USE OF CERTAIN
PROPERTY MORE PARTICULARLY DESCRIBED
HEREINAFTER; SAID LAND USE DESIGNATION
BEING CHANGED FROM LOCAL RETAIL
COMMERCIAL TO LOW DENSITY RESIDENTIAL;
PROVIDING A SAVINGS CLAUSE; PROVIDING
REPEALING PROVISIONS; PROVIDING AN
EFFECTIVE DATE; AND FOR OTHER PURPOSES.
WHEREAS, the City commission of the City of Boynton
Beach, Florida has adopted a Comprehensive Land Use Plan and
as part of said Plan a Land Use Element by Ordinance No.
79-24 in accordance with the Local Government Comprehensive
Planning Act; and
WHEREAS, the owners of the property more particularly
described hereinafter have requested the above mentioned
Land Use Element Amendment; and
WHEREAS, the procedure for amendment of a Land Use
Element of a Comprehensive Plan as set forth in Chapter 163,
Florida Statutes, has been followed; and
WHEREAS, after public hearing and study, the City
Commission deems it in the best interest of the inhabitants
of said City to amend the aforesaid Land Use Element of the
Comprehensive Plan as adopted by the City herein.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1 Ordinance No. 79-24 of the City is hereby /
amended to reflect the following:
That the Land Use of the following described land shall

WHEREAS, the City Conunission of the City of Boynton
Beach, Florida, has heretofore adopted Ordinance No. 80-19
in which a Revised Zoning Map was adopted for said City; and
