I am Wl1t1ng in hopes of reaching a final understandIng of what the city is
looking for in terms of rnalntenance obligatlons for both on-site and off-
site improvements relative to the Qua1l Run V1llas project. As we have
proceeded through the approval process. I feel that the different city de-
partments have reached diflerent conclusions about these obligations
aXld hOVl they will be handled, I would like to set forth herein my under-
standing of theBe obligations and will propose what I believe t.o be the ac-
ceptable way to memorialize the maintenance obligation.
It 1s my understand1ng that the concern over maintenance obligations
originated With the variance from the landscape code to allow the place-
ment of "conunon areal' trees within the indiVidually platted lots. It was
determined by the city attorney that the homeowners docnments were
not sufficient and that an easement in favor of the association would be
necessary. This easement has been added to the plat as a "pervIOUS
landscape easementll. This item gave rise to a concern over the mainte-
nance of other improvements, both off-site and on-site. Specitlcally these
improvements include 1) \Voolbrlght Road median landscaping. 2) s.w.
26th Street median landscapIng. S) lake bank along the south side of
Woolbright Road. 4} wall and attendant lan.dscaptng along the south side
of WoolbI1ght Road, 5) the littoral zone plantmg located wtthin the water
management tract - the area below the water surface and 6) the on-sUe
water, sewer, paving and drainage.
1) WOOLBRIGHT ROAD MEDIAN LANDSCAPING - It is my understand-
lng that this landscaping will be maintained by the City of Boynton

being maintatned by the Quail Run Master Assoclatton. Inc. as has the
median on the south end of S.W. 26th Street. Our work will include the
addition of four Queen Palms. I do not feel there ie any need for a fonnal
maintenance agreement on this median stnce 1t has conBlstently been
maintained by the master assOCiation, However. If the city feels it is ab-
solut~ly necessaty. I can include the median in a maintenance agree-
ment.
3) LAKE BANK ALONG THE SOUTH SIDE OF WOOLBRIGHT ROAD - The
bind area whIch include3 this lake bank is contained within the water
management tract (Tract 9) of the eJdating Quail Lake West and Tracts
One and Two plat, That piat obl1g:atcs the master aB8Octation to maintain
Tract 9. Additionally, the guan Run Master Asso('.latlon. Inc. homeowner
documents address the ma:lntenance obligation as befng the responsibil-
ity of the master assoc1atian. The problem as I see It 15 that the bank
has never been improved for the master association to matnta1n. As J
have asserted before. I do not believe an additional document IS gOing to
make maintenance more enforceable, However. in the spIrit of coopera-
uon we are w1lling to provide a maintenance agreem.ent addreSS1ng this
obligatIon.
4) WALL AJ.'J'D lANDSCAPING SOlrm SIDE OF WOOLBRIGHT ROAD -
'This work will be maintained by the QuaU Run Master Association, Inc_
An easement in favor of the master assOC'Jatlon has been included on the
plat. The easement includes language for maintenance. Again. we are
Willing to include these improvements In a Inaintenance agreement.
5) LITTORAL ZONE PLANTING - These plantings refer to an area outSide
the plat bmmdary for Quail Run Villas and are therefore not considered
on~site trnprovements. Since the area is located wIthin the water man-
agement tract, it Will be the responBibillty of the master associatlon to
maintain these plantlngs. We can Jnclude these areas ~"ithin the above
mentioned maintenance agreement.
6) WATER. SEWER. PAVING AND DRAINAGE - The water and sewer
3ystelns will be turned over to the elty after completion for perpetual
matntenance. The paving and drainage are the maintenance responsI-
bility of the Quail Run Villas assOCiation. The plat dedicates the drainage
easenlents to the Villas and the Villas homeowners documents address
the maintenance of the connnon areas which includes the roadways. The
roads are also dedicated to the VUlaB association on the plat_ No further
maintenance agreement is necessary.

My interest 1n wrtttng this letter 18 to confirm that the only areas wbich
may require a matntenance agreement are the S.W. 26th Street median
(at Woolbright Rd.), the lake bank along the south side of Woolbnght
Road and the littoral zone plantlngs. The other areas d1scussed above
are to be maintained by eUher the City (e.g., ,voolbrtght median) or the
Quail Run Villas assoCiation (e.g., on-site streets). In order for me to
complete the maintenance agreement. I w.Ul need a positiVe conflnnatlon
of my underst.anding. I will be Faxing thts letter to the persons noted
below in the c.e. so everyone will have the benefit of my understanding.
In additiOn to a conftnnation on the items to be included in the agree-
ment, I would like you (or someone) to confirm that these areas can be
referenced in the agreement by WI1tten description ( as they were above)
with the proposed planting plans attached as extrtbtts.
This is the only item listed in your letter of technical compllance whtch I
have not been able to complete. I would therefore appreciate a resolution

Gentlemen:
The Engineering Department for the City of Boynton Beach, Florida is in receipt of
recorded time stable mylar reproducible documents for the above referenced plat.
In accordance with City Code of Ordinances, speCifically Appendix C, Subdivision
& Platting Regulations and applicable concurrency ordinances, the undersigned herein,
issues you a Land Development Order authorizing the construction of infrastructure
improvements as set forth in the Developer's Engineer's Opinion of Cost (bonded
improvements), and herein advises you that pursuant to Appendix C, Article XI, Section 5,
all required improvements shall be completed within 21 months from the date of the
issuance of this Land Development Permit. Absent a time extension from the City
Commission, failure to complete the required infrastructure improvements within the fixed
time interval may result in the City Engineer formulating a recommendation to the City
. Commission wherein the City may call upon the posted surety in order to complete the
infrastructure.
I recommend that prior to construction, you schedule and attend a pre-construction
meeting with the City's Utility Department and Engineering Department staff at which time
the topics of permitting, inspections, etc. will be discussed. Additionally, Appendix C,
Subdivision & Platting Regulations, ArticleXI, Section 2, requires that your Design Engineer
submit monthly status reports on the progress of construction, to the Office of the City
Engineer and be responsible to coordinate joint reviews of the construction with the City
Engineer.

The following COillment has been generated from the review of the
Quail Run Villas Homeowners Association documents:
Amend Article VI section 3 to specify that the
replacement of landscape material such as; grass,
ground cover, hedges and trees shall be at the expense
of the Association. Also, remove from section 3 the
text regarding the Association not being responsible
for maintenance within privacy areas without access and
insert a requirement that tbere shall be adequate
access to the privacy areas.
The Planning and Zoning Department reviewed the document for the
department concerns identified in comment no. 8 of our memorandum
#94-114 (find attached). Please incorporate the above comment
with your review commellts prior to forwarding the document to the
city Attorney for approval.

Preliminary Plat, Development Plans and Landscape
Drawings (First Revision)
Please be advised of the following Planning and zoning Department
comments with respect to the above-referenced request:
1. Revise survey note number 2 found on Sheet 2 of 2 of the
plat documents as follows: Building and Site Regulations as
regulated by the Boynton Beach Code of Ordinances and shown
on the approved master plan.
2. Include on the plat document landscape easements for the
landscape material that is located on the fee simple lots.
3. Identify on the plat document and development plans, the
type and size of the easement shown between lots 52 and 53.
4. Correct the inconsistency between the type of easement that
is shown on the Plat Document between lots 72 and 73 and the
Development Plans that shows the easement used for utility
purposes. Amend the document accordingly.
5. Add to the Development Plans the type and size of the
easement located between lots 115 and 112.
6. On the horizontal control plans and/or paving and drainage
plans, dimension the back-up space for the guest parking
spaces. Also, show the location of curbing and identify the
type of curbing. (Note: The type of curbing shall meet City
standards, and the back-up space and location of the curbing
shall match what is shown on the approved site plan drawings
and master plan).
7. Correct the typical handicapped parking stall design to
match the Ci~y standard' (City Standard B-90012). Find
attached City standard Drawing B-90012.
8. Submit for review a legally constituted maintenance
association agreement required for improving, perpetually
operating, and maintaining all common facilities (streets,
drives, parking areas, open space, landscaping and
recreation areas). These documents are subject to approval
by the Engineering Department, Planning & Zoning Department
and the city's legal staff, and are required prior to final
plat approval. Note: This department is responsible for
review of this agreement for maintenance of open space,
landscaping and recreational facilities within the common
areas. [Appendix B, Section 11.d and Appendix C, Article
VIII, Section 6.D.12.)

This letter is to establish a meeting between you, your company
representatives and the City of Boynton Beach as directed by the
City Commission. The meeting will be to comply with landscaping
comments for the Quail Run Villas project.

Assimilate the Congress Avenue and Woolbright Road
medians landscape designs to redesign the project medians
east of the Woolbright entrance. The plan must be
acceptable to the City Utility Department for
consideration of existing underground utilities.
The percentage of native species (trees/shrubs) on other
existing medians may be adjusted to compensate for less
than 50% native species on #l above.
The maintenance for all of the landscaped medians on
WOOlbright Road abutting the project will be outlined in
a separate maintenance agreement for off site
improvements. The written document is being prepared by
the City Attorney.

PRELIMINARY PLAT~ Request preliminary plat and
construction plan approval for 176 townhouse lots,
infrastructure and amenities.
City Manager Parker advised that this is a request for preliminary plat and
construction plan approval for the remaining Phases (II and III), to be known as
Quail Run Villas of the Quail Lake West PUD, located east and west of S. W. 26th
Street, south of Woolbright Road. The request is a replat of a portion of a
plat recorded December 14, 1984 known as Quail Lake West Tracts One and Two.
The Quail Run Villas development will be comprised of 176 townhouse lots, six
landscaped, common areas and private streets, with the exception of S. W. 26th
Street, which is a City right-of-way and the main thoroughfare running through
the PUD. This item was unanimously approved at the Planning and Development
Board. However, the following issues need to be considered by the Commission:
1. Maintenance responsibility of the off-site improvements;
2. Establishing a fair market value of the land for determination of the Parks
and Recreation fee; and
3. The landscaping plan.
Landscaping Plan:
City Manager Parker stated that from the entrance of Quail Run, west to Military
Trail, the City does not have any utilities in the center islands. Therefore,
the landscaping plan submitted by the applicant is acceptable to the City. From
the entrance east; however, there is a six inch City force main in the island
and Utilities is concerned about planting trees there because of intrusion of
root damage and danger in the event of a storm. This line serves approximately
400 to 600 homes and if it goes out, they would be out of sewer service. City

Mayor Harmening suggested lowering the force main to just above the water table.
Mike Covelli of Caulfield and Wheeler did not think this would solve the prob-
lem. He pointed out that if the line had a fracture, it would require the same
amount of digging. He suggested eliminating the large shade trees and planting
trees that only grow to ten or fifteen feet tall.
Maurice Rosenstock, 1 Villa Lane, suggested coordinating this landscape plan
with the one for the Congress Avenue corridor. He felt it would add continuity
to the medians and give it an overall cohesive look. Mayor Harmening added that
plans will soon be started on Woolbright Road and these plans should also be
coordinated with the others.

Kevin Hallahan, the City Forester, was directed to assimilate the plan for the
Congress Avenue corridor and the Woolbright medians. Mayor Harmening told him
to make sure the trees in the area of the force main are not potentially
destructive.

Mayor Hanmening asked if the proposed plans for Congress and Woolbright are
similar. Mr. Hallahan advised that they have common characteristics. The major
difference is that the trees selected for Woolbright are the Carpentaria and the
ones on Congress are Washingtonia Palms. He would probably steer toward the
Carpentaria Palms because the Washington1a Palms are too large for the utility
islands. Commi ss i oner Aguil a noted that Yellow Tabebu1a are proposed on
Woolbright and pointed out that they are very messy.
Maintenance Responsibility of Off~S1te Improvements:
City Manager Parker stated that the City Attorney advised that the best way to
handle this is by a separate maintenance agreement, not a dedication on the
plat. He is, therefore, going to prepare I seplrat~ agreeMent, deta1l1..t~
mai ntenance respons,1b11ities for the off-site improvements.
Fair Market Value:
City Manager Parker stated that staff has set the project's land value at
$74,239 per acre, which results in a fee in lieu of land dedication of
$29,695.60. She advised that the applicant has agreed to this fee.
In response to Commissioner Aguila, Ms. Heyden stated that Lawson and Noble had
a conflict of interest on this project. Therefore, Shalloway, Foy, Rayman &
Newell, Inc. is the City Engineer for this project.

Commissioner Aguila moved to approve the premliminary plat; that a separate
agreement for off-site improvements be prepared; that $29,695.60 be accepted as
the fee in lieu of land dedication; and that staff be allowed, mainly Kevin
Hallahan and his group, to work with the applicant to coordinate the Congress
Avenue landscape plan with the Woolbright Road landscape plan, being sensitive
to the force main. Commissioner Katz seconded the motion, which carried 5-0.

Statement of Technical Compliance and Surety Establishment
Dear Mr. Tate:
Please be advised that the City Commission during their May 17,
1994 regular meeting, ruled favorably on the above referenced
preliminary plat conditioned upon Engle Homes, under your
direction, resolving the two remaining outstanding issues relative
to maintenance of both on-site and off-site landscaping as well as
choice of landscape materials to be planted within the centerline
median of Woolbright Road.
In accordance with the City's Code of Ordinances, specifically
Appendix "C", Subdivision and Platting Regulations, this office
herein transmits this Statement of Technical Compliance and Surety
Establishment and directs the applicant to provide the following:
1. Provide a 2% Administration Fee (non reimbursable) made
payable directly to the City of Boynton Beach, Florida in the
amount of $10,888.50.
2. Submit a "fee in lieu of land dedication" (non reimbursable)
in the amount of $29,695.60.
3. Submit a Street Lighting Fee (non reimbursable) in the amount
of $33,000.00.
4. Submit a Final Plat Filing Fee in the amount of $750.00 to
which the City will additionally bill the applicant for exact
costs associated with final plat review and processing
(tracking man hours).
5. Submit surety in a form acceptable to the City's Finance
Director and City Attorney in the amount of $598,867.50 (based
on your Engineer's Opinion of Cost).

6. Submit Palm Beach County permits to construct within the
public rights-of-way of Woolbright Road.
7. Submit 10 sets of plat documents and plans (blue lines) having
Health Department approval.
8. Provide 1 time stable reproducible plat document (s) fully
executed by all affected parties.
9. Provide written verification that you have resolved with City
staff necessary agreements for the performance of maintenance
on both the off-site and on-site landscaping and other
improvements as well as a written verification that you have
resolved the issue regarding what type of landscaping will be
. acceptable within the centerline median of Woolbright Road
(conditions of City Commission approval).
Failure to submit for Final Plat approval within the time intervals
set forth within Chapter 19 of our City's Code of Ordinances will
result in the expiration of the preliminary plat approval which
pursuant to City Code of Ordinances, Appendix "C", Subdivision and
Platting Regulations, Article ViII, Section 5D5, indicates that
"technical compliance of the, construction plans and preliminary
plat shall not constitute acceptance of the findl plat; rather it
shall be deemed an expression of acceptance of the layout submitted
on the preliminary plat as a guide to the preparation of the final
plat.", therefore, staff may impose additional code requirements
(if necessary) in conjunction with the review of your anticipated
final plat submission in order to ensure that the subject
submission attains the highest level of code compliance.
