The above referenced project is nearing completion. Prior to the
Building Division issuing the Certificate of Occupancy, I would like to
ensure that you do not have any outstanding or pending conditions
concerning this site that must be rectified (excluding issues that are
covered entirely with a city approved surety) .
If any outstanding conditions are related to permits issued by the
Building Division, please provide this division a memorandum containing a
description of the unresolved conditions. If the unresolved conditions
are not permit related, please notify the owner or the owner's agent to
ensure that the matters are rectified.
Please respond to Don Johnson, Building Compliance Administrator, within
ten (10) days in order that we may proceed in a timely manner to issue
the Certificate of Occupancy. No response is necessary if your
department is satisfied with the current state of the above referenced
site. Thank you for your cooperation.

On the horizontal control plans and/or paving and
drainage plans, dimension the back-up space for all guest
parking spaces. Also, show the location of curbing and
identify the type of curbing for the guest parking spaces
located west of S.W. 26th street. Note: The type of
curbing shall meet city standards, and the back-up space
and location of curbing shall match what is shown on the
approved site plan drawings.

I am pleased to submit the following items herewith in response to your letter of June
3rd for final plat approval of Quail Run Villas:
1. Letter from Mark Bidwell (dated 6/14/94) including checks as requested and the
Performance Bond.
2. Ten (10) sets of the site engineering plans (2 signed and sealed) revised to reflect
all City comments and Palm Beach County Health Department comments. A
permit from the County is in the process of being issued. I will forward a copy of
it to you for your records as soon as I receive it.
3. Ten (10) sets of the site plan package (2 signed and sealed) revised to reflect all
City comments and Palm Beach County Land Development comments for
Woolbright Road landscaping. A County right-of-way permit is in the process of
being issued and I will forward a copy of it to you as soon as I receive it.
4. Time stable reproducible plat document fully executed by all parties and ten (10)
copies of same. The Homeowner Agreements have been approved and I will add
the OR Book and Page Number to the plat when the Agreement is recorded by
Palm Beach County. This will take place prior to the anticipated July 19th City
Commission meeting agenda that we wish to be included on.

Peters dated 6/16/94 regarding the Woolbright Road Median and one dated 6/22/94
to Jim Cherof regarding the property owner's obligations if submitting final plat
prior to County permit issuance).
We would like to be on the July 19th City Commission agenda for final approval of this

1. Revise survey note number 2 found on Sheet 2 of 2 of the
plat documents as follows: Building and Site Regulations as
regulated by the Boynton Beach Code of Ordinances and shown
on the approved master plan.
2. Include on the plat document landscape easements for the
landscape material that is located on the fee simple lots.
3. Identify on the plat document and development plans, the
type and size of the easement shown between lots 52 and 53.
4. Correct the inconsistency between the type of easement that
is shown on the Plat Document between lots 72 and 73 and the
Development plans that shows the easement used for utility
purposes. Amend the document accordingly.
5. Add to the Development Plans the type and size of the
easement located between lots 115 and 112.
6. On the horizontal control plans and/or paving and drainage
plans, dimension the back-up space for the guest parking
spaces. Also, show the location of curbing and identify the
type of curbing. (Note: The type of curbing shall meet City
standards, and the back-up space and location of the curbing

7. Correct the typical handicapped parking stall design to
match the Ci~y standard' (City Standard B-90012). Find
attached city Standard DraWii~ 8-90012.
8. Submit for review a legally constituted maintenance
association agreement required for improving, perpetually
operating, and maintaining all common facilities (streets,
drives, parking areas, open space, landscaping and
recreation areas). These documents are subject to approval
by the Engineering Department, planning & zoning Department
and the City's legal staff, and are required prior to final
plat approval. Note: This department is responsible for
review of this agreement for maintenance of open space,
landscaping and recreational facilities within the common
areas. [Appendix B, Section 11.d and Appendix C, Article
VIII, Section 6.0.12.]

The following COillment has been generated from the review of the
Quail Run Villas Homeowners Association documents:
Amend Article VI section 3 to specify that the
replacement of landscape material such as; grass,
ground cover, hedges and trees shall be at the expense
of the Association. Also, remove from section 3 the
text regarding the Association not being responsible
for maintenance within privacy areas without access and
insert a requirement that toere shall be adequate
access to the privacy areas.
The Planning and Zoning Oepartment reviewed the document for tile
department concerns identified in comment no. 8 of our memorandum
#94-114 (find attached). Please incorporate the above comment

Dear Vincent:
I am writing to address two issues raised in your plat comments letter
dated April 29. 1994.
The first issue is the maintenance obligation of various areas within and
extemal to the platted area. The landscaping around the buildings will
be maintained by the Quail Run Villas Homeowners Association. This
obligation is set forth in the homeowners documents and is referenced on
the plat by way of dedication of the Pervious Area Landscape Easement.
The wall and attendant landscaping along the Woolbright Road frontage
will be maintained by the Quail Run Master Association, Inc. The
easements covering these areas are dedicated to the master association
on the plat. The medians (Woolbright Road), pursuant to Kevin
Hallahan's letter dated April 27, 1994. will be maintained by the City of
Boynton Beach after inspection and approval. The medians in S.W. 26th
Street have been and will continue to be maintained by the Quail Run
Master Association. The so called "northeast buffer", in accordance with
the original Quail Lake West and Tracts One and Two plat, will be
maintained by the Quail Run Master Association. The littoral zones
adjacent to the Quail Run Villas will be maintained by the Villas
association. To me, the issue here is that the lake bank had never been
cleaned up and landscaped.
Your letter mentions the necessity to provide dedication language or
establishing other means to demonstrate who is responsible for the "off-
site improvements". At this point, the only area which has not been
accounted for is the small median area within the S.W. 26th Street right
of way. Based on the logic that the City will maintain the Woolbrightsmedians, it could be argued that the City should be maintaining these

medians as well. Since the master association has been maintaining
these medians all along, I don't know if it is really necessary to make this
an issue.
I am not refusing to honor your reqnest. I simply feel that the
maintenance obligations have been addressed previously by the Quail
Lake West plat and by precedent. If you are still uncomfortable with this.
I would prefer to establish the maintenance obligations by agreement.
The other issue raised in your letter is the establishment of the "fee in
lieu of land dedication" value. Your letter asks for the Purchase Contract
value as the basis for this fee. For your information, the total purchase
price was $2,000,000 which covered a total of 26.94 acres. This works
out to a per acre value of $74,239. Multiplying this value by the 0.4 acre
deficit results in a total fee of $29,695.60. You know of course that I
disagree with your position that the purchase price for what is net
developed land is the value intended by the subdivision ordinance. I
believe that the code intended a view that the value be based on raw
land. Given this, I feel it is allow us to incorporate a

would appreciate your consideration of this propos .

2. Water distribution sheet 7 of 14 - proposed water mains
near lots 86, 100, 109 and 127 need to be relocated or
additional utility easements provided, Sec. 26.33(a).
3. Mango creek Lane does not appear to have adequate fire
protection (no fire hydrant shown on Sheet 8 of 14,
water distribution plan), Appendix 3, Art. X, Sec. 16.
4. Water services of K copper must be used if either end
of service is under pavement, Sec. 26.33(b).
5. sanitary sewer profiles, sheets 12 and 13 of 14 need to
show storm drain pipe locations and elevations.
6. Sanitary sewer detail sheet #14 of 14 - note #3 or
General Note #18 to be deleted. Provide C.O. to
utility specs or mainline only.
7. Trees in utility easements must be removed or relocated
at Lot 97, on Spice Berry Circle, Crabapple circle and
median in Woolbright Road, Sec. 7.5-18.1.
8. Removal of ficus trees near storm drain pipes near
Woolbright Road, station 201+40 within limits of work,
Sec. 7.5-18.1.
9. Previous comments regarding HRS permitting and Utility
Department Criteria.
It is our recommendation that the plan proceed through the review
process.

8. Submit for review a legally constituted maintenance
association agreement required for improving, perpetually

drives, parking areas, open space, landscaping and
recreation areas). These documents are subject to approval
by the Engineering Department, planning & Zoning Department
and the City's legal staff, and are required prior to final
plat approval. Note: This department is responsible for

Staff has reviewed the above referenced project and offer the
following comments:
1. Water and sanitary sewer utilities will be transferred
to the City of Boynton Beach after completion of the
project, Sec. 26.33(e).
2. Water mains must be located a minimum of 10' from
building structures. Note corrections to be made
proximate to lots: 1, 9, 30, 33, 37, 100, 101, 109, 123
and 128 through 176, Sec. 26.33(a).
3. All sewer cleanouts in driveways must have approved
cleanout covers, per Utility Department Standards.
4. City to own and maintain sewer services to property
lines. Services must be built to City Standards, with
cleanouts, Sec. 26.33(b).
5. Easements and tracts designated as being intended, in
part, for public utilities purposes shall be dedicated
to all public utilities, Sec. 26.33(a).
It is our recommendation that the plan proceed through the review

MAY 17, 1994
Commissioner Aguila was concerned with the layout of the parking. He pointed
out that people can drive from Old Boynton Road at an angle across all the
parking spaces to the Boynton Beach Mall access road. He felt every other hori-
zontal run where cars would head into needs to be broken. He felt three lengths
of green area could be added without affecting the parking a great deal. This
would help with site drainage and soften the appearance of the asphalt. The
applicant can adjust the landscape islands on the north end and gradually taper
it down. Ms. Jarkesy agreed that if this works without loosing parking spaces,
it will be done.
Commissioner Aguila infonmed Ms. Jarkesy that if built as shown, the only alter-
native is to make the restaurants smaller. Ms. Jarkesy was aware of this. She
agreed to return with a sign package for review by the City and the Planning and
Development Board.
Commissioner Katz asked if Commissioner Aguila's proposal would accommodate more
trees. Commissioner Aguila answered affinmative1y. Commissioner Katz asked if
the applicant would be willing to plant more trees there. Ms. Jarkesy was
willing to plant more trees as long as the parking is not reduced.
In response to Commissioner Katz, Ms. Jarkesy confinmed that the tenants will
not come into Boynton Beach if parking spaces are reduced.
Vice Mayor Matson was not in favor of sending a negative message to people who
want to do business in Boynton Beach. She felt they should be accommodated, not
chased out. She referred to the removal of the Tamarind trees along Congress
Avenue for utility lines and asked the City Forester if he has any problem with
that and if he is going to work within Florida Power and Light guidelines.
Ms. Jarkesy answered affinmatively and stated that there is a note to this
effect on the landscape plan.
Motion
Commissioner Agulia moved to approve the Boynton Festive Center site plan as
submitted, per staff comments and per the comments that were made here this
evening by the City Commission. Vice Mayor Matson seconded the motion, which
carried 5-0.

City Manager Parker advised that this is a request for preliminary plat and
construction plan approval for the remaining Phases (II and III), to be known as
Quail Run Villas of the Quail Lake West PUD, located east and west of S. W. 26th
Street, south of Woolbright Road. The request is a replat of a portion of a

plat recorded December 14, 1984 known as Quail Lake West Tracts One and Two.
The Quail Run Villas development will be comprised of 176 townhouse lots, six
landscaped, common areas and private streets, with the exception of S. W. 26th
Street, which is a City right-of-way and the main thoroughfare running through
the PUD. This item was unanimously approved at the Planning and Development
Board. However, the following issues need to be considered by the Commission:
1. Maintenance responsibility of the off-site improvements;
2. Establishing a fair market value of the land for detennination of the Parks
and Recreation fee; and
3. The landscaping plan.
Landscaping Plan:
City Manager Parker stated that from the entrance of Quail Run, west to Military
Trail, the City does not have any utilities in the center islands. Therefore,
the landscaping plan submitted by the applicant is acceptable to the City. From
the entrance east; however, there is a six inch City force main in the island
and Utilities is concerned about planting trees there because of intrusion of
root damage and danger in the event of a stonn. This line serves approximately
400 to 600 homes and if it goes out, they would be out of sewer service. City
Manager Parker stated that it is critical to develop a landscaping plan that
meets Utilities' operational needs while still beautifying the City. She
advised that she met with Utilities and the City Forester this morning. The
developer had proposed Silver Buttonwood trees. However, they have an intrusive
root system which could go into the City's lines. The City proposes to substi-
tute Queen Palms and use the Silver Buttonwood as shrubbery. City Manager
Parker stated that she has asked the Forester to come up with an acceptable
planting list to provide to future applicants if a conflict should again arise
with utility lines and the landscaping code. She pointed out that the Queen
Palm is not a native species and the Code requires plantings to be at least
50 percent native. She asked the City Commission to consider reducing the
native requirement on these two islands and allow additional native plants on
another two islands to meet the 50 percent requirement.
Mayor Hannening suggested lowering the force main to just above the water table.
Mike Covelli of Caulfield and Wheeler did not think this would solve the prob-
lem. He pointed out that if the line had a fracture, it would require the same
amount of digging. He suggested eliminating the large shade trees and planting
trees that only grow to ten or fifteen feet tall.
Maurice Rosenstock, 1 Villa Lane, suggested coordinating this landscape plan
with the one for the Congress Avenue corridor. He felt it would add continuit~
to the medians and give it an overall cohesive look. Mayor Hannening added tnat
plans will soon be started on Woolbright Road and these plans should also b~'
coordinated with the others.
Kevin Hallahan, the City Forester, was directed to assimilate the plan for the
Congress Avenue corridor and the Woolbright medians. Mayor Hannening told him
to make sure the trees in the area of the force main are not potentially
destructive.

Mayor Hanmening asked if the proposed plans for Congress and Woolbright are
similar. Mr. Hallahan advised that they have common characteristics. The major
difference is that the trees selected for Woolbright are the Carpentaria and the
ones on Congress are Washingtonia Palms. He would probably steer toward the
Carpentaria Palms because the Washingtonia Palms are too large for the utility
islands. Commissioner Aguila noted that Yellow Tabebuia are proposed on
Woolbright and pointed out that they are very messy.
Maintenance Responsibility of Off-Site Improvements:
City Manager Parker stated that the City Attorney advised that the best way to
handle this is by a separate maintenance agreement, not a dedication on the
plat. He is, therefore, going to prepare a separate agreement, detailing the
maintenance responsibilities for the off-site improvements.
Fair Market Value:
City Manager Parker stated that staff has set the project's land value at
$74,239 per acre, which results in a fee in lieu of land dedication of
$29,695.60. She advised that the applicant has agreed to this fee.
In response to Commissioner Aguila, Ms. Heyden stated that Lawson and Noble had
a conflict of interest ,on this project. Therefore, Shalloway, Foy, Rayman &
Newell, Inc. is the City Engineer for this project.
Motion
Commissioner Aguila moved to approve the premliminary plat; that a separate
agreement for off-site improvements be prepared; that $29,695.60 be accepted as
the fee in lieu of land dedication; and that staff be allowed, mainly Kevin
Hallahan and his group, to work with the applicant to coordinate the Congress
Avenue landscape plan with the Woolbright Road landscape plan, being sensitive
to the force main. Commissioner Katz seconded the motion, which carried 5-0.

and he felt he would have problems doing so, therefore, he also
recommends that as a result of the difficult horizontal alignment
of this section of road (which deviates off the main road) he also
agrees that the reviewing board's should consider requiring the 'Developer
to align the structure in an east to west alignment, compatible
with the remaining structures and roadway.

Please be advised of the planning and Zoning Department's comments
with respect to the above-referenced request for a master plan

This statement is provided in fulfillment of Chapter 235.193, Section 2, Florida Statutes to ensure that
public education facilities are coordinated with plans for residential development.
The School Board places its school construction priorities in areas that facilitate the achievement of racial
balance in public schools. The School Board does not support approval of development where the
anticipated effect on the racial balance of public schools in the area is negative, and/or where public
facilities will not be available concurrent with development. Based upon the anticipated negative effect
of a development on racial balance in public schools, educational facilities [defined as "public facilities"
Florida Statutes 163.3164(23)] will not be provided in the area of the development concurrent with the
development [see F.S. 163.3177(1O)(h)].
This impact statement addresses the concerns of the School Board of Palm Beach County as they
specifically relate to the anticipated impact of the construction of 21 single family and 272 multi-family
units within Quail Lakes West PUD located at S.W. 26th Street and Woolbright Road in Boynton Beach.
A study was conducted utilizing demographic multipliers for Palm Beach County to estimate the number
of students which would be generated from this type of development. Information was not received
regarding the number of bedrooms found in these types of dwelling units. For the purpose of this
analysis it is assumed that all 21 single family units will consist of 3 + bedrooms and all 272 multi-family
units will consist of 3 bedrooms. The Planning and Real Estate Department estimates 23 elementary, 48
middle, and 48 high school students will be generated by the project.
The geographic area in which these proposed dwelling units will be located is presently served by Galaxy
Elementary, Congress Middle and Atlantic High Schools (see Note 1). Following is a breakdown of
membership for the 1993-94 school year and current permanent capacity for each school.

Students generated from this development will further overcrowd the assigned elementary, middle and
high school.
The School Board requests that the developer provide strategies for Quail Lake West P. U . D. to assist in
achieving School Board racial balance goals. The School Board will work with the developer to
accomplish an agreement containing strategies and steps to be taken by the developer to ensure that the
occupants of this development will be racially mixed. Since an agreement with the developer is not in
place at this time, we request that the following condition be placed as a condition of approval:
1. Prior to final City Commission approval, the petitioner shall demonstrate that they have met with
School Board staff ana discussed the potential of entering into an agreement to help achieve racial
balance and allow the children who reside within the development to attend the nearest available
schools.
Without such an agreement in place by March 2, 1994, this development is subject to a possible boundary
reassignment to schools where the children residing within the development will have a positive racial
impact at the assigned school. Reassignment will be considered at a School Board public hearing in
March, 1994 for the 1994-95 school year. The developer is requested to contact the School Board in
January, 1994 for the recommended school assignments for this development.
The School Board will continue to actively pursue a policy of providing adequate school facilities for all
the children of Palm Beach County.

The Recreation and Park Department has reviewed the Quail Lake
West PUD - Master Plan Modification. The following comments are
submitted:
1. Based on sub-division standards, the original master plan
recreation and park open space requirement was 4.8 acres.
The original master plan showed 4.14 acres to be dedicated
for civic purposes (including a one acre water storage
facility site). City Commission granted credit for all 4.14
acres of open space leaving a deficit of .6 acres which the
developer agreed to pay'in cash. While a land dedication
did occur, the City has never received a cash payment in
lieu of the .6 acres.
2. Based on the reduction in density in this master plan
modification, the dedication deficiency involved is reduced
to .4 acres cash payment in lieu of land.
3. The 1985 master plan included provisions of the following
recreation elements: 6 tennis courts, 1 pool, 1 beach, 1
dock, 1 clubhouse. To date, tennis courts, pool and
clubhouse have been provided. Two additional recreation
elements are ~equired based on approval by the Recreation
and Park Department
