NATURE OF REQUEST
Caulfield and Wheeler, Inc., acting as agent for Engle Homes, is
requesting preliminary plat and construction plan approval for the
above-referenced project. The 23.7273 acre plat is located east
and west of S.W. 26th street, south of Woolbright Road. The plat
is proposed in conjunction with the development of the Quail Run
Villas project.
BACKGROUND
The project (Quail Run Villas) is part of the Planned Unit
Development (PUD) zoning district referred to as Quail Lake. Upon
approval of the requested plat the Quail Lake PUD will include the
following plats and projects:
1. Quail Lake (plat recorded July 25, 1980) - Whalers Cove
Apartments (AKA Quail Lake Apartments)
2. Quail Lake West and Tracts One & Two (plat recorded
December 14, 1984)
a.) Quail Run (replat recorded August 3, 1987) - Quail
Run single-family homes and condominiums with
recreation area and water management tract
b.) Quail Run Villas (proposed replat) platted
townhouse lots
Whalers Cove and Quail Run are existing developed and occupied
projects. The Quail Lake plat is a separate plat not part of the
other plats. The Quail Run Villas land is vacant and the last
undeveloped land in the Quail Lake West and Tracts One & Two plat.
The platting process is the final phase to be completed prior to
the development of the subject project. The project consists of
platted lots for townhouses.

ANALYSIS
On January 11, 1994, a master plan modification was approved that
established the type of development for the Quail Run Villas
project. On April 19, 1994, the City Commission approved the site
plan for the project. The plat document is reviewed to ensure it
is consistent with the approved master plan, site plan and the
applicable platting regulations identified in Appendix C of the
City Code of Ordinances. The proposed 23.7273 acre plat (Quail Run
Villas) contains 176 lots, 6 open space landscape areas, and tracts
dedicated for private streets (see attached reduced copy of the
plat document). The following types of easements are located
within the plat and dedicated as noted on the cover page of the
plat: drainage and lake maintenance, utility, limited access, wall
maintenance, tennis court and landscape, and pervious landscape.
The lake {water management tract 9) is not part of the plat and as
indicated on the plat, is dedicated to the Quail Lake West
Condominium or Homeowners Association. The Quail Lake West
Condominium or Homeowners Association is the Association identified
on the original Quail Lake West and Tracts One and Two plat. The
construction plans depict the infrastructure that makes the
development function. The construction plans were reviewed for
compliance with the applicable required improvements specified in
Appendix C. The review included ensuring the construction plans
coincided with the approved master plan and site plan. Included
with the construction plans are the following off-site
improvements:
street lighting (south side of Woolbright Road, east of the
proj ect) ,
Right-of-way and median landscaping, those portions of S.W.
26th street and Woolbright Road that abut the project,
Lake plantings (around the perimeter of the water management
tract that abuts the project and south of Woolbright Road,
east of the project) and
Two recreation elements; boccie and shuffle board (added to
the existing recreational area located on the Quail Run
proj ect) .
RECOMMENDATION
Under the direction of the City Engineer for this project,
Shalloway, Foy, Rayman & Newell, Inc., staff reviewed the plat and
construction documents for the project. Consistent with Article
VIII Section 5. D. ::. of Appendix C Subdivision and Platting
Regulations, the City Engineer and TRC (Technical Review Committee)
are forwarding to the Planning and Zoning Board (Planning and
Development Board) the request for preliminary plat and
construction plan approval with a recommendation for approval. The
recommendation is subject to the applicant complying with staff
comments and final platting requirements prior to final plat
approval. Find attached a summary of the staff comments prepared
by the Engineering Department.

RE: Preliminary Plat Submission - Quail Lake West Phases II and III
Departmental Request to Place Preliminary Plat on P & D Agenda
Provided herein, please find a quantity of seven (7) sets of Plat
documents and associated construction (development) plans for the
above referenced plat.
HISTORY
The City's P & D Board as well as the City Commission approved the
site plan (conditioned on compliance with staff comments) during
April 1994.
The Developer, that being Engle Homes submitted Plat documents and
construction plans to the Technical Review Committe as required by
Appendix "C", Subdivision and Platting Regulations. Approximately
three (3) submissions and reviews resulted in the aforementioned
documents attaining a substantial level of compliance with the
subject ordinance with two (2) exceptions. They are as follows:
1. The Landscape Plan for the centerline medians of Woolbright
Road contain materials which are acceptable to the City's Forester
but are unacceptable to the utility Department. The difference
of opinion relative to what type(s) of material should occupy the
median, should not interfere with the applicant's ability to move
this project forward to the reviewing City Boards, as the Developer
is willing to comply with whatever is the final determination of
the City Commission (see Developer's Engineer letter dated May 4th).
2. The Maintenance Responsibilties for both onsite and especially
offsite Landscape Improvements (ie lake banks and slopes, littoral
zone plantings, landscape buffer, common areas etc.) is an unresolv-
ed issue between the Technical Review Committee and the Developer.
The Technical Review Commitee has determined that the landscaping
should be placed in areas which should be identified as a Landscape
Easement with specific plat dedication text stating the entity
responsible for perpetual maintenance. The Developer has indicated
that an Agreement with the City would be a more appropriate measure
to ensure maintenance. The TRC has directed the Developer to co-
ordinate with the City Attorney toward determining the suitability
of either approach relative to enforcing City Code of Ordinances for
maintenance of required landscaping. To date the developer has not
coordinated the resolution of this outstanding issue. The TRC has
indicated that the plans should move forward and that this issue shall
be fully resolved prior to submission for Final Plat, by the Develop-
er.

The City Engineer, that being Shalloway Engineers, has performed the
duties of Chairperson for the TRC, during their deliberations on
this proj~ct and have reviewed the Plat document for conformity with
State Law.
The Preliminary Plat section of our City's Code specifies that the
approval of the Preliminary Plat submission represents an expression
of the acceptance of the layout, therefore, the TRC will retain the
authority to elevate the submission to a higher state of compliance
with Codes, should that action become necessary during the review of
a subsequent Final Plat submission.
REQUIRED ACTION OF THE PLANNING AND DEVELOPMENT BOARD
Pursuant to the City's Subdivision and Platting Regulations, the P & D
Board shall either accept the Developer's representation that the land
which is the subject of this matter, is valued at $74,239.00*or establ-
ish a fair market value of their own. The TRC however recommends the
P & D Board accept the Developer's value which will result in a "Fee in
Lieu of Land Dedication" in the amount of $29,695.60, to be made pay-
able directly to the City once approved by the City Commission.
The P & D Board shall also deliberate upon the submission and if deemed
reasonable, submit a recommendation of approval to the City Commission
via the City Manager's Office, conditioned on resolving the landscape
issues setforth in items 11 and 12 of this memo, prior to submission
of Final Plat.
