I am wrtting to request permission to make several change5 to the ap-
proved landscape plans for the Qua1l Run Vlllas proJect. As we dIS-
cussed. you will need to review these requests and then determine if they
can be handled administratively or if L"1ey will require City Commission

The first change is the substitution of various species. It is my under~

that all you need is a confirmation that any substitutions do not bring

proved plan shows all three of these species planted at 12" on center. It
is my opinion as a registered landscape architect that this spaCing is
much too tight and will result in poor development. I would like to
change the spacing to a m:inimum of 18" on center.

quantity of material from the approved plan and may not be approvable,
at least adm1n1stratlvely. I have a proposal which may make this work. I
received a letter from Kevin Hallahan regarding the required littoral zone
and upland hardwood management plan (copy attached). In the letter he
states that a layer IS missing from the management plan and from the
landscape plan. My imm.ediate response was why did this issue not get
raised during the approval proce513 - there certainly WaB plenty of oppor-

This letter is to establish a meeting between you, your company
representatives and the City of Boynton Beach as directed by the
City Commission. The meeting will be to comply with landscaping
comments for the Quail Run Villas project.
Item 11
Assimilate the Congress Avenue and Woolbright Road
medians landscape designs to redesign the project medians
east of the Woolbright entrance. The plan must be
acceptable to the City Utility Department for
consideration of existing underground utilities.
Item 12
The percentage of native species (trees/shrubs) on other
existing medians may be adjusted to compensate for less
than 50% native species on #1 above.
Item 13
The maintenance for all of the landscaped medians on
Woolbright Road abutting the project will be outlined in
a separate maintenance agreement for off site
improvements. The written document is being prepared by
the City Attorney.

PRELIMINARY PLAT~ Request preliminary plat and
construction plan approval for 176 townhouse lots,
infrastructure and amenities.
City Manager Parker advised that this is a request for preliminary plat and
construction plan approval for the remaining Phases (II and III), to be known as
Quail Run Villas of the Quail Lake West PUD, located east and west of S. W. 26th
Street, south of Woolbright Road. The request is a replat of a portion of a
plat recorded December 14, 1984 known as Quail Lake West Tracts One and Two.
The Quail Run Villas development will be comprised of 176 townhouse lots, six
landscaped, common areas and private streets, with the exception of S. W. 26th
Street, which is a City right-of-way and the main thoroughfare running through
the PUD. This item was unanimously approved at the Planning and Development
Board. However, the following issues need to be considered by the Commission:
1. Maintenance responsibility of the off-site improvements;
2. Establishing a fair market value of the land for determination of the Parks
and Recreation fee; and
3. The landscaping plan.
Landscaping Plan:
City Manager Parker stated that from the entrance of Quail Run, west to Military
Trail, the City does not have any utilities in the center islands. Therefore,
the landscaping plan submitted by the applicant is acceptable to the City. From
the entrance east; however, there is a six inch City force main in the island
and Utilities is concerned about planting trees there because of intrusion of
root damage and danger in the event of a stonn. This line serves approximately
400 to 600 homes and if it goes out, they would be out of sewer service. City
Manager Parker stated that it is critical to develop a landscaping plan that
meets Utilities' operational needs while still beautifying the City. She
advised that she met with Utilities and the City Forester this morning. The
developer had proposed Silver Buttonwood trees. However, they have an intrusive
root system which could go into the City's lines. The City proposes to substi-
tute Queen Palms and use the Silver Buttonwood as shrubbery. City Manager
Parker stated that she has asked the Forester to come up with an acceptable
planting list_pl'avtato. future applicants if a conflict should again arise
with utility,,,..... and the-landscaping code. She pointed out that the Queen
Palm is not a native species and the Code requires plantings to be at least
50 percent nafQlt She asked the City Commission to consider reducing the
native requirement on thes~ two islands and allow additional native plants on
another two islands to meet the 50 percent requirement.
Mayor Hannening suggested lowering the force main to just above the water table.
Mike Covelli of Caulfield and Wheeler did not think this would solve the prob-
lem. He pointed out that if the line had a fracture, it would require the same
amount of digging. He suggested eliminating the large shade trees and planting
trees that only grow to ten or fifteen feet tall.
Maurice Rosenstock, 1 Villa Lane, suggested coordinating this landscape plan
with the one for the Congress Avenue corridor. He felt it would add continuity
to the medians and give it an overall cohesive look. Mayor Harmening added that
plans will soon be started on Woolbright Road and these plans should also be
coordinated with the others.

Kevin Hallahan, the City Forester, was directed to assimilate the plan for the
Congress Avenue corridor and the Woolbright medians. Mayor Harmening told him
to make sure the trees in the area of the force main are not potentially
destructive.

Mayor Hanmening asked if the proposed plans for Congress and Woolbright are
similar. Mr. Hallahan advised that they have common characteristics. The major
difference is that the trees selected for Woolbright are the Carpentaria and the
ones on Congress are Washingtonia Palms. He would probably steer toward the
Carpentaria Palms because the Washingtonia Palms are too large for the utility
islands. Commissioner Aguila noted that Yellow Tabebuia are proposed on
Woolbright and pointed out that they are very messy.
Maintenance Responsibility of Off-Site Improvements:
City Manager Parker stated that the City Attorney advised that the best way to
handle this is by a separate maintenance agreement, not a dedication on the
plat. He is, therefore, going to prepare a separate agreement, detailing tha'
ma i ntenance respons,ibil1 ties for the off-s 1 te improvements.
Fair Market Value:
City Manager Parker stated that staff has set the project's land value at
$74,239 per acre, which results in a fee in lieu of land dedication of
$29,695.60. She advised that the applicant has agreed to this fee.
In response to Commissioner Aguila, Ms. Heyden stated that Lawson and Noble had
a conflict of interest on this project. Therefore, Shalloway, Foy, Rayman &
Newell, Inc. is the City Engineer for this project.
Motion
Commissioner Aguila moved to approve the premliminary plat; that a separate
agreement for off-site improvements be prepared; that $29,695.60 be accepted as
the fee in lieu of land dedication; and that staff be allowed, mainly Kevin
Hallahan and his group, to work with the applicant to coordinate the Congress
Avenue landscape plan with the Woolbright Road landscape plan, being sensitive
to the force main. Commissioner Katz seconded the motion, which carried 5-0.

This is in response to your recent request regarding the procedure that you would follow to remove
a handicap designation from one handicapped parking space located on Spiceberry Lane. With
approval from the Deputy Director of Development, Al Newbold, this letter will serve as the city's
authorization to allow you to remove the handicapped sign and revise the handicapped striping to
change one handicapped parking space, shown on the approved site plan on Spice berry Lane, to one
regular parking space.
If the proposed changes result in work beyond changing one space a permit will be required. I
recommend that you contact the Building Division of the Development Department at (561) 375-

We enclose an article featured in the Palm Beach Post dated Jan.26,1997 by Gary Poliakoff,Esq
., a noted authority on condo and homeowner association law.
Quoting from the article, Mr.Poliakoffhas previously stated that" As a general statement, laws
requiring that a given percentage of parking spaces be set aside for handicap individuals to use
do not apply to private residential property." He goes on to state that" all unassigned parking
spaces can be used for all owners and their guests without designating any for exclusive
handicap usage. "
Tht) approved plan for our development called for four guest parking spaces with one space
designated for handicap usage. Actually, there was room for a total of only three spaces, one of
which is designated for handicap usage.
There are 23 units in the Spiceberry peninsula, each home with a garage and driveway for one or
two vehicles, None of the present owners use or require the use of unassigned spaces and
handicap guests, if any, would find it more convenient to park on the driveway of the respective
host's house. The handicap space is rarely occupied while the remaining two spaces are
generally filled most of the time, with the overflow vehicles parked on the street causing
considerable problems with delivery trucks and other service vehicles.
The club house and pool area have 69 parking spaces, two of which are handicap designated.
There is no problem here with adequacy of parking space for handicap or other usage. Other
areas throughout Quail Run have larger parking areas with designated handicap spaces.
We are requesting permission to delete the handicap designation of the one space in Spiceberry
Lane so that the badly needed, and unused space, is available to all persons.

Please place the above-referenced request on the City Commission
agenda for April 19, 1994 under Development Plans, Non-Consent
Agenda.
DESCRIPTION: This is a request submitted in connection with site
plan approval of Quail Run Villas, south of the intersection of
Woolbright Road and S.W. 26th Street, for relief from a portion of
section 7.5-35(k) of the Landscape code. Although the applicant is
proposing to provide all of the required number of common area
trees (689), as well as 89 surplus trees (total of 778 trees), the
common areas proposed are too small to accommodate all of these
trees. Therefore, the applicant is requesting relief to plant 539
of the required, common area trees on the private lots.
Due to the fact that this project is only part of the overall Quail
Lake West PUD, and that a large proportion of the PUD common area
is comprised of lakes for storm water management purposes, of which
area cannot be planted except around the lake edges, the common
area space that can be planted is small. In addition, the entire
PUD was boundary platted more than ten years ago and the subject
phases are being replatted excluding all lake areas. Since the
calculation of required common area trees is based on developed
area, and the actual boundaries of this project include very little
undeveloped area, the common areas that will be provided within the
project boundaries are small in size and cannot accommodate all the
required trees.
RECOMMENDATION: The Planning and Development Board, with a 6-1
vote, recommended approval of the requested landscape appeal,
subject to the following conditions:
1. To safeguard against removal of the required, common area
trees that are proposed to be planted on private lots, the
City 'Attorney shall make a recommendation to the City
Commission, after reviewing the applicant I s deed restrictions,
as to whether the City would be better protected by requiring
recorded, landscape easements, dedicated to the homeowners'
assocation for maintenance and preservation of the trees on
private lots, or whether the applicant's deed restrictions
will suffice;
2. Proposed use of Dracaena margin at a (Red-edged Dracaena),
Bucida buceras (Black Olive) and Peperomia obtusifolia (Baby
Rubber Tree) be substituted for native species of comparable
size.

Please place the above-referenced request on the city Commission
agenda for April 19, 1994 under Development Plans, Consent Agenda.
DESCRIPTION: This is a request for site plan approval to construct
42 clusters of one-story, townhouses (a total of 176 dwelling
units) on 3,000 square foot, platted lots within the remaining,
undeveloped phases (II and III) of the Quail Lake West PUD. The
villa project will be located south of the intersection of
Woolbright Road and S.W. 26th Street. Garage and driveway parking
will be provided for each unit, along with a total of 45 guest
parking spaces, scattered along the private streets within the
proj ect. Two new recreational amenities; a bocci court and a
shuffleboard court, will be constructed within the existing,
recreation area that serves the entire PUD in order to complete the
remaining minimum, recreational requirements for the project.
The project is not located within a Community Design Plan district,
however the units are designed using a Spanish/ Mediterranean
style. A landscape appeal regarding common area landscaping is
requested and also scheduled for City Commission action on April
19, 1994 (see separate Planning and Zoning Department Memorandum
No. 94-102).
RECOMMENDATION: The Planning and Development Board unanimously
recommended approval of this site plan request, subject to staff
comments (Planning and Zoning Department memorandum, dated April 7,
1994, Engineering Department Memorandum No.94-097 and No. 94-064,
Building Department Memorandum No. 94-066, Utilities Department
Memorandum No. 94-087 and No. 081, Police Department memorandum,

Proposed Development: The site is located south of woolbright
Road and approximately 1,130 feet west of Congress Avenue
(see location map). The 23.72 acre Quail Run Villas site is
the f~nal project of the 80 plus acre residential
development. The existing developed portion of the project
consists of single family platted lots with detached homes
and multi-family, multi-story condominium buildings. A
recreation building and amenities are also existing as part
of the development. The proposed phase consists of 42
buildings that contain 3, 4, or 5 attached dwelling units.
Each dwelling unit is located on a platted lot. A total of
176 lots and dwelling units are proposed. Each lot has
frontage on a private street. Six open common areas and 45
guest parking spaces are distributed throughout the site.
Two recreational elements are planned to be installed as
part of this project. The new elements will be added to the
existing recreational tract that is located west of S.W.
26th Street and directly south of the subject site. Two
shuffleball courts and one boccie ball court will be
installed. The recreational site is to be available for use
by all residents of the development. The proposed project
received master plan approval on January 11, 1994. The
applicant is presently processing the project through the
City's platting approval process.
Existing Site Characteristics: The site is vacant of structures.
Viable landscape material is located in the northwest corner
of the site. This material will be saved as part of the
tree preservation plan for the project. The City's
forester/environmentalist is working with the applicant
regarding existing plant material. Utility easements are
located around the perimeter of the site and dedicated lake

6. Horizontal control has been submitted with plat
application.
7. Typical lot grading plan has been added to the drainage
plan.
8. Handicap parking detail complies with ADA and has been
noted on site plan.
9. Site visibility triangles and note have been added to
landscape plan.
10. Littoral zone planting plan will be submitted at a
later date.
11. Guardrail issue will be resolved during platting reviews.
12. Signage plans have been submitted with plat application.
Please note that all plans will be revised to conform to the
final plat and site plan comments.
BUILDING DEPARTMENT COMMENTS:
1. The entrance sign meets requirements noted - see
architectural plans.
2. The typical lot detail on the site plan has been revised
to show lot line setbacks.
3. Wall is shown on the site plan and detailed on the
architectural plans.
4. S.F.W.M.D. approvals will be obtained as necessary.

This is in response to your recent request regarding the procedure that you would follow to remove
a handicap designation from one handicapped parking space located on Spiceberry Lane. With
approval from the Deputy Director of Development, Al Newbold, this letter will serve as the city's
authorization to allow you to remove the handicapped sign and revise the handicapped striping to
change one handicapped parking space, shown on the approved site plan on Spiceberry Lane, to one
regular parking space.
If the proposed changes result in work beyond changing one space a permit will be required. I
recommend that you contact the Building Division of the Development Department at (561) 375-

Attached please find correspondence from the Quail Run Homeowners Association.
In researching the issue raised by their correspondence, it has been determined that
A.D.A. Standards do not require handicap parking associated with residential units as
they have stated.
However, the provision for a handicap space on Spiceberry Lane is a part of the
approved site plan. In that case, it must be determined what process should be followed
to accommodate their request to eliminate its exclusive use to the handicapped.
It would seem that the actions to be taken upon this request should come from the
Planning Department.

We enclose an article featured in the Palm Beach Post dated Jan.26,1997 by Gary Poliakoff,Esq
., a noted authority on condo and homeowner association law.
Quoting from the article, Mr.Poliakoffhas previously stated that" As a general statement, laws
requiring that a given percentage of parking spaces be set aside for handicap individuals to use
do not apply to private residential property." He goes on to state that" all unassigned parking
spaces can be used for all owners and their guests without designating any for exclusive
handicap usage, "
The)' approved plan for our development called for four guest parking spaces with one space
designated for handicap usage. Actually, there was room for a total of only three spaces, one of
which is designated for handicap usage.
There are 23 units in the Spiceberry peninsula, each home with a garage and driveway for one or
two vehicles. None of the present owners use or require the use of unassigned spaces and
handicap guests, ifany, would find it more convenient to park on the driveway of the respective
host's house. The handicap space is rarely occupied while the remaining two spaces are
generally filled most of the time, with the overflow vehicles parked on the street causing
considerable problems with delivery trucks and other service vehicles.
The club house and pool area have 69 parking spaces, two of which are handicap designated.
There is no problem here with adequacy of parking space for handicap or other usage. Other
areas throughout Quail Run have larger parking areas with designated handicap spaces,

On February 7, 1994, your submittal for Site Plan Review of the
above-referenced project was reviewed for completeness. It has been
determined that the submittal is substantially complete and accepted
for further processing. A Planning & Zoning Department staff member
will be responsible for the review and coordination of your site
plan through the remainder of the Site Plan Review process.
The next step in the review process is for the Technical Review
Committee to review the submittal for compliance with the review
standards identified in Part III, Land Development Regulations,
Chapter 4, Site Plan Review, Section 8 and all applicable sections
of the Boynton Beach Code of Ordinances. The results of the review
will be available to you on February 22, 1994.

maintenance easements border the perimeter of the existing
water management tract that is located east of S.W. 26th
street.
Traffic: The traffic generated for the project was vested as
part of the original master plan approval.
Driveways: Each dwelling has direct access to a private street.
The network of private streets leads to S.W. 26th Street
(Clty Street). S.W. 26th Street intersects with Golf Road
to the south and Woolbright Road to the north.
Parking Facility: Each dwelling unit has the required two
parking spaces; a garage, and one space in the driveway
located in front of the dwelling unit. Forty-five(45) guest
parking spaces are proposed and distributed throughout the
site. Each pod of guest parking spaces has a handicapped
parking space.
Landscaping: Upon compliance with staff comments, the
landscaping will meet the requirements ot the Landscape
Code. Because of the shape and type of development
required, site landscape material is proposed to be placed
on individually owned and platted lots. A landscape appeal
is being requested by the applicant to allow trees to be
located on platted lots. The applicant has provided a
number of surplus trees and shrubs on the site as indicated
in the plant tabulations. The City Forester/
Environmentalist is working with the applicant regarding the
existing landscape material located on the site,
installation of lake plantings around the water management
tract and off-site median planting.
Building and Site Regulations: As previously stated, the project
is a PUD. Planned Unit Developments may establish their own
building and site regulations. The building and site
regulations subject to the project were established at the
January 11, 1994 Planning & Development Board Meeting. The
height of the building is one story. The minimum lot size
is 3,000 square feet. The minimum lot frontage is 30 feet.
The minimum setbacks are as follows: Front - 15 feet, Side
- 10 teet or 0 feet, Rear - 15 feet.
Community Design Plan: The project is not located in a design
district. The buildings have a Spanish/Mediterranean style,
which is similar to the style of the existing multi-family
buildings.
Signage: The only signage proposed for the project is a wood
entry wall sign located adjacent to the Woolbright Road and
S.W. 26th Street intersection. The proposed sign will match
the existing entry wall sign located at the intersection of
Golf Road and S.W. 26th Street.
REVIEW OF DEPARTMENTAL COMMENTS:
Please find attached the comments from all reviewing departments.
Staft has determined that compliance with the outstanding
comments identified in their memoranda will not substantially
alter the configuration of the site and/or buildings.
Considering all comments, the project has been forwarded for
Planning and Development Board and City Commission review. The
applicant must understand that the permit plans shall be amended
to comply with the attached staff comments and that additional
comments may be generated by staff following their review for
technical compliance of permit documents that are required to be
submitted for the development of the project.

The following is a list of comments regarding the 2nd reVlew of
the above-referenced project. It should be noted that the
comments are divided lnto two (2) categories:
The first category is a list of comments that identify unresolved
comments elther from the flrst review or new comments as a result
of the 2nd review. To show compllance with these comments will
not substantially alter the configuration of the slte and the
deslgn of the building. There has been a formal submittal to
seek relief from the code requlrements for comment Number 7.
The second category is a list of recommendatlons I believe will
enhance the aesthetics and function of the proJect.
All comments and recommendatlons can be rectified on the plans at
time of permittlng considering that the request tor Site Plan
ReVlew and the landscape appeal are approved. The appllcant must
understand that additional comments may be generated upon review
of the documents and worklng drawings submitted to the Building
Department fer permlts for the proposed proJect.
I. SITE PLAN REVIEW COMMENTS:
1. On the landscape plan, place the following note: The
spacing specification identified in the plant key takes
precedence over the quantity of plant material identified on the
plans or plant key for the Red Tip Cocoplum, Philodendron and Wax
Myrtle hedge materlal.

5. In order to count the trees identified on the foundatlon
planting plan as requlred trees, the height of some of the False
Aralia and/or Alexander Palms shall be changed to lndicate their

the landscape plan and plant tabulations accordlngly.
6. To verify that the natlve count is correct, identify on the
plant key the native speCles with a distlnguishable symbol.
Amend the foundation planting plant key to correctly identify the
natlve species.
7. Approval of an appeal to the Landscape Code is required to
plant trees on the slte outslde of the open common areas.
8. Correct the typical handicapped parking stall drawlng found
on the paving and drainage detail drawing to comply with the City
standard drawing B-90012.
9. The installation of the recreational amenlties will require
approval of a minor slte plan modification to the eXlstlng
recreation tract site plan.
II. RECOMMENDATION(S):
1. Dedicate on the plat document a landscape easement for all
landscape materlal that is required for the site plan and
proposed to be installed on the individually owned and platted
lots.
2. Add the landscap1ng that is requested as part of the
platting process to the landscape plans for the site plan. The
plans may be incorporated as part of the site landscaplng or
added as separate drawlngs. If the landscaping is lncorporated
with the site plan landscaping( symbols should be used to
dist1ngulsh between the site and the plat landscape materlal.
3. The developer, contractor, City landscape inspector I and
staff from the Planning and Zoning and Building Department shall
cooperatlvely develop a "Landscape Phaslng Plan". The landscape
phaslng plan will establish a sequential order for the
installation and inspection of the landscape material for the
entire project. The plan will be created prior to the initial
permit being issued for construction of a dwelling unit. The
phasing plan 1S to ensure that landscape material is being
installed collectively as the project 18 developed and that by
completlon of the project all approved landscape material is in
place and accepted by the City.

12. Submit sign program for all regulatory signage and be advised
that decorative regulatory signage will not be accepted. All
signs must conform to State of Florida D.O.T. Standards and the
Federal Highway Aut'1ority "Manual on Uniform Traffic ContrC'l
Devices".
The applicant is herein advised that usually a site plan is
submitted along with plat documents and associated development
plans. In this instance, the applicant is submitting site plans
prior to plat approval, therefore, the Engineering Department
reserves the right to compel the applicant to modify this
site plan if during the review of the plat documents and develop-
ment plans, a need arises to bring all documents into a state of
compliance with City Codes as well as conformance between all plans

The Building Department reviewed the drawings for the above
project and the attached letter from Caulfield & Wheeler, Inc.
dated March 14, 1994 and offers the following comments:
Comment No. 2 - Typical details on the Site Plan referencing lot
lines are not germane to all lots. All setback lines must be
shown on the plans as distance from the lot lines and not
distance from right-of-way.
Comment No. 3 - Their reply to this can only be acceptable if the
land south of Unit 73, Building 3 does not belong to this sub-
division and is proven not to be their responsibility to develop.
We also need a maintenance easement for this wall along
Woolbright Road and an agreement for maintenance.
Comment No. 4 - The South Florida Water Management District
approval will be required prior to sign-off so we can confirm
their approval of the lake modifications, floor elevations, and
if drainage is adequate.
Comment No. 5 - As long as the Engineering Department approves
the road in compliance with Appendix C, Article 10, Section 10
(D) Dead End Streets, we have no problem with it dead ending 24'
beyond Unit 128.
Please be advised that we have no problem with this project going
forward as long as there is clarification on the above issues.
Comments apply to the Plat, Master Plan, and Site Plan and all
documents must be consistent.

1. Water and sanitary sewer utilities will be transferred

project, Sec. 26.33(e).
'2. Water mains must be located a minimum of 10' from
building structures. Note corrections to be made
proximate to lots: 1, 9, 30, 33, 37, 100, 101, 109, 123
and 128 through 176, Sec. 26.33(a).
3. All sewer cleanouts in driveways must have approved
cleanout covers, per Utility Department Standards.
4. City to own and maintain sewer services to property
lines. Services must be built to City Standards, with
cleanouts, Sec. 26.33(b).
5. Easements and tracts designated as being intended, in
part, for public utilities purposes shall be dedicated
to all public utilities, Sec. 26.33(a).

The Building Department reviewed the drawings for the above
project and the attached letter from Caulfield & Wheeler, Inc.
dated March 14, 1994 and offers the following comments:
Comment No. 2 - Typical details on the Site Plan referencing lot
lines are not germane to all lots. All setback lines must be
shown on the plans as distance from the lot lines and not
distance from right-of-way.
Comment No. 3 - Their reply to this can only be acceptable if the
land south of Unit 73, Building 3 does not belong to this sub-
division and is proven not to be their responsibility to develop.
We also need a maintenance easement for this wall along
Woolbright Road and an agreement for maintenance.
Comment No. 4 - The South Florida Water Management District
approval will be required prior to sign-off so we can confirm
their approval of the lake modifications, floor elevations, and
if drainage is adequate.
Comment No. 5 - As long as the Engineering Department approves
the road in compliance with Appendix C, Article 10, Section 10
(D) Dead End Streets, we have no problem with it dead ending 24'
beyond Unit 128.
Please be advised that we have no problem with this project going

1. Submit an amended Site Plan ReviewlConditional Use applicat10n form that

and documents to comply with the Code of Ordinances and the Technical
Review Committee comments. A copy of the original form with a
distinguishable symbol identifying the change(s) may be subm1tted or a
completed new form with the changes identified. If there are no changes
required to be documented on the application form, a letter from the
applicant stating same must be turned in with the amended submittal.
2. Submit twelve (12) assembled and complete sets of plans and documents,
including surveys that show compliance with the code of Ordinances and

shall have the appropriate legible raised seal and signature of the

3. Submit color photographs of the buildings on the site that are to remain
in their existing condition and photos of existing buildings that are
located on the sites that abut the perimeter of the subject property.
The minimum size is 5" by 7". Each photograph shall be labeled to
identify the location of the existing structures with respect to the
location of the proposed project.
4. Submit colored elevation view draw1ngs - a colored duplicate copy of all
drawings of the elevation views of each side of all buildings and
signage associated with the project. The colored elevation views shall
match the elevations shown in the documents that were submitted for site
plan review. The applicable exter10r surfaces as identified above shall
be colored with the color name and associated color reference number
identified. The type of exterior surface material shall be identlfied
next to the associated color. The colored elevation drawings shall have
compass direction or title of the side of the build1ng identified. The
title block of the original drawing shall be shown. The maximum size is
24" by 36". Do no submit on board of any kind.
5. Submit color samples as an example of the proposed colors. Each sample
shall. h<3:.ve_ attached a label that ldentifies the color by name and
numerlcal/letter code from an established color chart.
6. Submit a 8 1/2" x 11" transparency of the landscape site plan drawing to
be used on an overhead projector at board meetings.

The following is a list of 1st review comments regarding the Site
plan Review of the plans for the above-referenced project. It
should be noted that the comments are divided into two (2)
categories; the first category is a list of comments that
identify deficiencies that are required to be corrected and shown
in compl1ance on the plans submitted for second (2nd) review in
order for the project to continue through the site plan review
process. The second set of comment(s) are recommendations that
the Planning and Zoning Department staff believe will enhance the
proposed development. The applicant shall understand that all
documents/plans submitted for site plan and/or permit review are
subject to additional comments. I recommend that the applicant/
agent contact me regarding questions related to the comments. If
the applicant 18 not intending to correct code deficiencies they
should contact me regard1ng the procedures, application forms,
fees and submittal deadline dates for seeking relief from the
code requirement.
I. SITE PLAN REVIEW COMMENTS:
1. The gross density allowed for the entire development, as
identified on the Future Land Use Map, is 4.84 units per acre,
specify same on the slte data.
2. For the purposes of determining rear setbacks, include
within each dwelling unit number identified on the site plan
drawing, a distinguishable symbol that identifies whether the
unit is a Lake Lot, Standard Lot or Interior Lot. Please note
the setback line will be a line parallel to the shape of the rear
property line. [Chapter 4 Section 7.2.1.]
3. Add to the typical lot layout drawing, the location and
width of the roof overhang. The roof overhang may encroach a
setback by a maximum of two (2) feet. [Chapter 4 Section 7.2.1.]
4. The master plan for the project specifies the side setback
is ten (10) feet. Amend the typical lot layout drawing to
indicate a ten (10) foot side setback at each end of the end unit
of the building. [Chapter 4 Section 7.2.1.]
5. For clarity in determining setback dimensions add to the
site plan drawing a distinguishable symbol that represents each
building.

6. Add to the typical lot layout drawing the building dwelling
unit numbers that have specific designated setbacks. Such as the
buildings that house units I, 33, 34, 56, 57, 73, 82, 83, 94, 95,
99, 100, 104, 105, 109, 113, 114, 118, 122, 123, 127, and 128.
Clearly indicate on the typical lot layout drawing what each of
the setbacks are for the correlating building and unit number.
An alternate method is to provide on the plan a reduced drawing
of each bUilding that has designated setbacks and indicate the
appropriate setback dimensions. [Chapter 4 Section 7.2.1. J
7. On the slte plan dimension, the narrowest and widest width
of the landscape tracts that borders the west side of S.W. 26th
Street and the south side of Woolbright Road. [Landscape Code
section 7.5-35 (d)]
8. Identify on the site plan the drainage easement and width of
same that is proposed between Lots 60 and 61. Also add the
drainage easement between Lots 5 and 6 to the drainage plan and
site plan. [Chapter 4 Section 7.1.3]
9. On the landscape plan, show the location, size and type of
easements proposed for the entire site. Contact the appropriate
utility service to be certain what service holders will allow
landscape material and a perimeter wall structure in their
easement. [Chapter 4 Section 7.2.1]
10. On the landscape plan, add the continuous hedge material
required along both sides of S.W. 26th Street. The hedge
material is required to screen wood Fern Drive and Quaking Leaf
Lane, the on-site vehicle use areas, from view of S.W. 26th
Street. The hedge material is also required to screen the three
vehicle use areas located on the east side of S.W. 26th Street.
[Landscape Code section 7.5-35 (d)]
11. On the landscape plan, indicate the on-site tree material
required along both sides of S.W. 26th Street. The tree material
is part of the required vehicle use area screening that is
screening the on-site vehicle use area from S.W. 26th Street.
Note: Trees located in the right-of-way will not satisfy the
requirements of the Landscape Code. [Landscape code Section 7.5-
35 (d)]
12. Add to the landscape plan the required vehicle use area
hedge screening material at the south end of wood Fern Drive.
[Landscape Code Section 7.5-35 (e)]
13. Add to the landscape plan the required vehicle use area
hedge screening material along the south and east perimeters of
the project. [Landscape Code Section 7.5-35 (d) and (e)]
14. Specify on the landscape plan the spacing and height of the
required Ficus Benj. hedge material proposed for the west
property line. [Minimum height 18 inches at planting, maximum

15. Show on the landscape plan, the code specifications for
determlning the required tree, hedge, and ground cover landscape
material. Include the computations used to show compliance with
the code requirements for size, spacing, and total count of
landscape materlal including total count of required native

16. Indicate on the landscape plan, the speCles proposed for the
hedge along the outside of the slte wall. [Landscape Code

with the specifications identified in the landscape code:
irrigation, grade of plant material, and type of installation

19. Add to the landscape plan a detail planting drawing for the
foundation landscaping for the three unit and five unit building.

20. Add to the landscape plan for the site and the typical
building, a distinguishable symbol that represents the native
species landscape material. Note: Fifty (50) percent of the
total number of required trees, hedges, vines, and ground cover
landscape material shall be native specie. [Comprehensive Plan
Policy 4.4.6.]
21. On the site plan and landscape plan, clarify the location
and length of the open areas proposed for the aluminum rail
fencing. Also identify the length of the perimeter walllcolumns
portion of the wall. Specify the dlstance the wall is setback
from the adjacent property lines. Specify on Sheet 7 that both
sides of the wall are stuccoed and identify the color,
manufacturer's name and color number for the stucco and band.
Also specify same for the aluminum rail fencing.
22. Identify the color, manufacturer's name and color number for
the following exterior portions of the picnic pavilion: cement
roof tlle, cornice fascia, and CBS Columns.
23. Omit from the elevation view drawings, the two (2) unit
building and replace with the elevation view drawings of a three
(3) unit building.
24. Identify the color, manufacturer's name and color number for
the following exterior portions of the residential buildings:
cement roof tile (what is the shape of the tile), modified gable
wall material, fascia, wall stucco, raised band, window frame,
swinging door and frame, overhead door and sliding glass door
frames.
II. RECOMMENDATION(S):
1. I recommend dedicating a landscape tract or an easement for
all landscape material that is located on a fee simple lot and is
landscaping required for the development.
2. I recommend dedicating a wall and fence tract or an easement
for the wall fence structure that is located on a fee simple lot.
3. Show on all plan view drawings curbing to protect the
landscaping at the locations of the thirty-three (33) surplus
parking spaces. This recommendation is being made with the
understanding that the project was granted relief in 1988 from
providing the code required curbing. However, implementing the
request would better serve the project based on the following:
curbing the cul-de-sac median area would prevent the unsightly
problems of parking on and damaging the landscaped areas.

12. Submit sign program for all regulatory signage and be advised
that decorative regulatory signage will not be accepted. All
signs must conform to State of Florida D.O.T. Standards and the
Federal Highway Authority "Manual on Uniform Traffic Control
Devices".
The applicant is herein advised that usually a site plan is
submitted along with plat documents and associated development
plans. In this instance, the applicant is submitting site plans
prior to plat approval, therefore, the Engineering Department
reserves the right to compel the applicant to modify this
site plan if during the review of the plat documents and develop-
ment plans, a need arises to bring all documents into a state of

6. If a TRC member finds the plans acceptable, he/she shall forward
a memo, withln the time frame stated above, to the Planning and
Zoning Director stating that the plans are approved and they do
not have any comments on the plans submitted for review and
recommend the proj ect be forwarded through the approval process.
All comments shall be typed, addressed and transmitted to the Director
of the Planning and Zoning Department for distribution to the
applicant. Please include the name and phone number of the reviewer
on this memo. Michael E. Haag will be the Planning and Zonlng
Department staff member coordinating the 1st review of the project.
The Planning and Zoning Department will send the applicant a cover
letter which includes the comment(s) and directions to amend the plans
to comply with the comments and the procedures for resubmission. When
the Planning and Zoning Department receives the amended plans, they
will distribute the plans with a cover memo to all TRC Members for
review and approval.
