Basehart & cottrell, Inc., agent for Racetrac Petroleum Inc.,
property owner of a portion of the Shoppes of woolbright PCD
subdivision, proposed for development as a Racetrac service
station/convenience store is requesting approval of a second site
plan extension. The Racetrac site is located at the northwest
corner of Woolbright Road and S.W. 8th street (see Exhibit "A" -
location map). The request is for a five (5) month retroactive and
one (1) year time extension for site plan approval and concurrency
exemption (see Exhibit "B" - letter of request prepared by Basehart
& cottrell, Inc.). If approved, the request would extend the
expiration of the site plan submitted by Racetrac to April 20,
1996.
BACKGROUND
On May 8, 1990, the Shoppes of Woolbright PCD plat was recorded.
A modification to the master plan was approved on April 20, 1993 to
allow station to be built within the PCD.
April 20, 1993 the City Commission approved the Racetrac site
p-an (see Exhib "C" - approved Racetrac site plan). On April 30,

Milt Duff of the Building Division).
On May 17, 1994, the City Commission granted a one (1) year time
extension for site plan approval and concurrency exemption. This
extension expired April 20, 1995. A justification for the
extension was that power poles existed on the site and obstructed
the construction of the service station. FP&L was responsible for
the removal of the poles, which were located along the old S.W. 8th
street right-of-way. At that time the applicant indicated that by
mid-June 1994, FP&L would complete the removal of the poles and the
installation of new lines, which had been impeding their progress
in applying for a new building permit. On Hay 16, 1995, the
Building Department voided the permit application due to no
activity having occurred for six months or more.

On April 13, 1995, the Planning and Zoning Department received an
incomplete application~ an environmental review permit. On May
11, 1995, the Environmental Review committee approved the
application, subject to conditions. These conditions have not yet
been satisfied. However, by code, the applicant has one year to
satisfy them.
Chapter 4, Section 5 of the city's land development regulations
which governs a request for an extension of a site plan states
that "At its discretion, the City Commission may extend the

approval of a site plan for a one year period, provided a request
for extension is filed prior to the expiration of the one (1) year
period. In granting such extensions, the city Commission may impose
additional conditions to conform the site plan to current
development standards." Historically, site plan extensions have
been granted under certain circumstances.
ANALYSIS
The request for time extension was filed five months after the site
plan expiration date, as the site plan approval was valid through
April 20, 1995 and the extension was filed september 14, 1995. A
site visit indicated that the power poles have been removed. As
previously stated, the applicant submitted for a building permit to
construct the service station on April 30, 1993 and on May 16, 1995
the Building Division voided the permit application. As indicated
in the site plan ordinance, securing a building permit vests the
site plan. The applicant states in their letter of request that
the construction of the service station is expected to be completed
by May of 1996.

with respect to concurrency, the Shoppes of Woolbright PCD is
exempt and vested indefinitely without requiring extension. This
is a result of comprehensive Plan Policy 9D.5.2., which states that
development orders which are the subject of, or required by court
orders, shall be construed to be vested for as long as the court
order remains in effect. The Shoppes of Woolbright PCD was a
result of the Tradewinds lawsuit.
RBCOMMENDATION
The Concurrency Review Board and Technical Review Committee met on
september 26, 1995 to discuss this request. They have unanimously
recommended that the five (5) month retroactive and one (1) year
site plan extension be granted, subject to compliance with the
previously approved site plan and permit review comments. This
recommendation is based on a technical standpoint only and does not
take into consideration whether there have been changing market or
economic conditions; nor does it re-evaluate the appropriateness of
the use at this location or in relation to the rest of the PCD.
Since by court order, the PCD cannot be held to new changes in
city's codes, other than those codes which are life/safety related,
the 1993 approved site plan does not have to be reviewed against
any code changes that may have occurred between 1993 and the
present.

Commissioner Katz referred to paragraph 4 of Gee & Jenson's memo regarding the
stonmwater drainage system and the lake west of S. W. 8th Street. W. Richard
Staudinger, City Engineer, advised that this will be taken care of in the
Building Penmit stage. In addition, he talked to Mr. Morton this evening about
the continuing prOblems in that area and was advised by him that they would be
taken care of immediately. Mr. Staudinger said he will not sign the plans until
the outfall lake and stonm services are completed according to the original
plans.
Commissioner Ka~z asked if a variance is needed relative to the number of dri-
veways. . Mr. Cutro answered in the negative and advised that the two driveways
are allowed under the 1986 Code.

Commissioner Katz referred to the minutes of the Planning and Development Board
meeting wherein Chainman Lehnertz made reference to the site being within 1,000
feet of a site which has been platted for a church. Mr. Cherof explained that
the 1986 Code contains the 1,000 foot restriction, but the 1992 Code does not
have a distance req~irement and that the applicant is penmitted, under Court
Order and a stipulation entered into by the City, to build under the 1986 Code. ,
However, the applicant has been put on notice that the City.s interpretation of
this is that if he first builds a gas station, he may never get to build a
church on that site.
Vice Mayor Aguila wanted the dumpster location resolved before approving this
project. He saw potential danger with traffic heading east on Woolbright and
making a u-turn at the intersection to enter the gas station. Mr. Staudinger
referred to comment number 3 of his memo, which states that a traffic study is
required to assess the impact of the driveway and use of the intersection of
S. W. 8th and Woolbright Road. To date, Mr. Staudinger has not yet received
that report.
Vice Mayor Aguila felt there was insufficient landscaping.
Melvin Simms of Racetrac stated that he is working with the owner of the pond to
resolve the issue relating to the joint use pond. Mr. Simms was willing to
locate the dumpster anywhere the City wants it. A traffic engineer 1s working
on the traffic count. A local landscape architect did the landscape plan, based
on the regulations. Vice Mayor Aguila wished additional landscaping at the
northwest corner of the intersection where the retention pond is. Mr. Simms
advised that he applied to DOT to fill in that ditch and make it a flat, grassy
area. Mr. Simms was agreeable to the additional landscaping if DOT allows it.

Mr. Cherof confinmed for Ms. Huckle that the owner of Tradewinds has input
regarding what happens to this outparcel, and that someone can legally own an
outparcel and still be under the umbrella of the PCD.
Chainman Lehnertz referred to the ordinance in effect when all this came about.
This ordinance specified a minimum 1,000 foot distance between gasoline stations
and church properties. Chainman Lehnertz pointed out that if the Board approves
this, then it is almost locked into approving a gasoline station on this site,
regardless of what happens with the site plan. Mr. Cutro was not certain how to
deal with this. He said the Court specifically told the City to be flexible
with reviews. He added that Tradewinds has infonmed him that the church has
shown a willingness to sell them the property so they could put housing on it.
Mr. Cherof advised that in previous discussions with Tradewind representatives
in Court and in a mediation setting, the City has advised them that if they go
with the gas station, nothwithstanding the designation of the church site, they
may foreclose the future development of that site as a church. Mr. Cherof said
they apparently wish to proceed in that fashion, and that if and when they
develop the church parcel, the City will have to deal with it. He further
advised that the position that the City has asserted is that the 1,000 foot rule
will apply at that point in time.
In response to Chainman Lehnertz, Mr. Cutro stated that if the Board recommends
approval, subject to staff comments, the comment regarding the traffic analysis
will be addressed.

Utilizing the overhead projector and color elevations, Mr. Cutro reviewed the
agenda material relative to this site plan. Mr. Cutro advised that he received
a memo today from the Utilities Department indicating that Racetrac and Mr. Kolb
are aware that the utility lines have to be relocated and that they will address
this issue as part of their development plan. Staff recommended that this be
forwarded to the City Commission.
Chainman Lehnertz expressed concern about the stonm water drainage into the
unfinished lake. Mr. Staudinger stated that he has been assured in writing that
the lake will be finished. He assured the Board that he will not sign these ~
plans off at the penmit stage until the proper drainage system is available. ...
Mr. Staudinger stated that the comment on the site plan pertains to an inlet
grate located in the driveway off-Southwest 8th Street. The engineers indicated
to Mr. StaUdinger that this is actually a control structure and it is not
necessary to have an inlet top on it. They are going to change that to a
manhole so that no drainage will go into there. Then the site will meet the dry
pretreatment requirements of the Code.
Chainman Lehnertz expressed concern about the owner mining the lake for fill
material. Mr. StaUdinger stated he had concerns that the lake was being overex-
cavated and, therefore, had interim survey depths done through the lake.
Mr. StaUdinger assured the Board they are within the requirements.
Ms. Huckle inqUired about the driveway widths exceeding City standards.
Mr. Staudinger advised that City Code states that driveways cannot be wider than,
32 feet unless approved by the City Engineer, and that it is very common on gas
station sites to request larger ones so the gasoline trucks can enter without
driving over the curb. He received such a request and will review the circula-
tion plan.
Mr. Weigle wondered how long the red and white fabric awning will last in the
Florida sun. Melvin Simms of Racetrac Petroleum advised that the awning is an
all-weather fabric material with an aluminum frame. It is entirely illuminated
and attaches to the fascia of the building. He has had no problems with this
type of awning and fully intends to maintain it.

Ms. Huckle asked about the location of the dumpster. Mr. Simms was not sure why
staff thinks the location of the dumpster would interfere with traffic flow.
Mr. Cutro explained the problem with the present location of the dumpster and
stated that there are enough options on the site to work this problem out. He
will ask Bob Eichorst, the Public Works Director, which location is best for the
dumpster. Mr. Simms was willing to cooperate.
Mr. Simms referred to the Building Department's comment about the lack of detail
of the handicap ramp. Mr. Simms said the sidewalk is flush with the parking
lot, making the entire parking lot handicapped accessible. Mr. Cutro advised
him to submit the plan to that effect.

The Technical Review Committee re~nded approval, subject to staff comments.
Mr. Haag pointed out that in order t comply with his comments and the comments
of the Public Works Depanmtent, a subs ~tial change in the layout of the site
would be required, unless the applicant r~ ives a variance for a reduction in
the setback and relief from the Community De n requirements. The Planning and
Zoning Department recommended that the Board r nd this project back to staff
and direct staff to work with the applicant to re lve the staff comments.
However, Mr. Cherof advised that the Board cannot re nd this project back to
staff; it must go forward to the City Commission with recommendation for
approval, approval with conditions, or denial.
Discussion ensued regarding the problem with the setbacks due 0 the subdivision
of the property.
In response to Chainman Lehnertz, Mr. Haag advised that Mr. Staudin
traffic generation for this site and had no comments.
Since this is a 24 hour operation and since it is next to a residential ar ,
Chainman Lehnertz asked if City staff considered the negative impacts of lig

Racetrac Gas Station/Convenience store
Kilday and Associates has requested a modification of the Shoppes
of Woolbright PCD to subdivide Parcel "B" for the construction of
a convenience store with gasoline sales, reduction of a 40 foot
internal setback and two additional driveways for the use.
The applicant had agreed to a reduction of retail square footage
to accommodate this use. Based on this reduction, water and
rawer impacts go down and drainage remains the same.
.2 p~an submitted to staff showed a reduction of the main
;::;;l.::cuct.ure on Parcel "B" to 52,000 square feet. However, this
reduction of square footage will not be sufficient to allow the
proposed use. A new plan showing a reduction to 28,000 square
feet was submitted to Staff on Tuesday. I have asked the city
Engineer to review this proposal to determine if the traffic
generated by the proposed use plus the 28,000 square feet of
retail is equal to or less than the traffic generated by 62,000
square feet of retail. This analysis will also show if
improvements to the intersection are warranted.
The other modification regards the criteria for gas stations in
1986 and 1992. Two driveways are allowed in both overlay
districts and the proposed driveways meet the 1986 criteria. The
canopy is not addressed in the 1986 ordinance, but is addressed
in the 1992 ordinance. since the setback is not crucial, and
because the court order stresses that the City must be flexible
regarding application of codes, Staff feels the request is
reasonable.
The Planning and Development Board reviewed this request at its
!~eeting of April 13, 1993 and forwarded it to the city Commission
~h a recommendation for approval.

Master Plan Modification - Shoppes of Woolbright PCD
Racetrac Gasoline, represented by Kilday and Associates, is requesting
an amendment to the master plan for the Shoppes of Woolbright that
would allow the subdlvision of Tract B, to allow the outparcel to be
used for a convenience store with gasoline sales, to allow two
additional driveways and a canopy encroachment in a required setback
area.
The criteria for determining if this is a major or minor amendment if
the amendment increases impacts of traffic water use, sewer use or
stormwater by 10 percent.
Originally the property owner showed 62,000 square feet of commercial
use on this parcel. In the submitted proposal Parcel B has been
reduced to 55,040 square feet. This reduction would reduce the
impacts for water and sewer use. Drainage will remain the same.
The one impact we have been unable to determine is traffic. In
evaluating this impact we would determine how many trips are generated
by the new use compared to the traffic generated by the 6,960 square
foot reduction, and show a corresponding reduction of square footage
if the number of trips is not equal. We have received no
documentation to date showing this comparison.
The convenience store with gasoline sales is an allowable use in the
peD. The base for the PCD is C-3.
Depending upon the future development of Parcel B, it may be necessary
to replat the parcel. However, a waiver of plat may be an acceptable
alternative for subdividing the property.
The parking lot ordinance limits the number of driveways on Parcel B
to two. However, the 1986 gas station ordinance allowed these uses to
have two of ltS own driveways. Since the gas station ordinance served
as an overlay zoning, the two additional driveways would be allowed.
On the master plan a 40 foot building setback is shown on S.W. Eighth
Street. Since the enroachment into this setback is the canopy and not
a building and, since our new service station ordinance allows
canopies to within 20 feet of the property, the encroachment should be
allowed.
Staff recommends that this request be forwarded to the City Commission
with a recommendation of approval subject to:
(1) a traffic analysis showing that the new use, plus the
square footage of other uses in Parcel B, will not exceed
the allowable trips for 62,000 square feet of commercial.
This traffic analysis should also address how driveways will
affect traffic flow in the intersection. (See Engineering
Comment 3).

Commercial Area West (734)
Our review of this proposed Master Plan Modification resulted in the following comments:
1. Any transfer of properties, as is indicated in the Master
Plan submittal, which is in conflict with the Shoppes of
Woolbright PCD Plat (PB 65, Pages 137-138), will
require a replat to align the proposed property lines
with modified (replatted) tract boundaries.
2. The proposed driveways exceed the City Standards for
width.
3. A traffic study outlining the traffic impacts of the
proposed new driveways on the intersection of SW 8th
& Woolbright Road is required.
4. The stormwater drainage system from the PCD outfalls
into a lake west of SW 8th Street. This lake has not
been completed in accordance with approved plats.
The lake must be finalized in accordance with City
Codes, and the applicant shall provide calculations to
determine if this Master Plan Modification changes the
conditions of the existing storm water management
permit (SFWMD).

Upon review of the above mentioned project, the following
comments must be addressed in order to conform with Boynton Beach
City Codes:
1. All drawings and/or docuements, submitted for public record
and prepared by a design professional, shall show original
raised seal and signature of a Florida registered design
professional responsible for the drawings.
2. Show and specify on the master plan drawing the location
and width of the required peripheral greenbelt for the
entire PCD. Minimum width of greenbelt is ten feet (10').
Where PCD abuts and/or is contiguous with a residential
zoned district the minimum width of the greenbelt is
twenty-five feet (25').

1. Excavation and Fill Permit - Plat No. 5 Boynton Lakes PUD
Richard Staudinger referred to Memorandum #91-59. Since writing
the memo, he received a letter from the applicant's engineer,
Rossi and Malavasi, addressing the reclamation plan, indicating
that furnished topography and construction drawings will be pro-
vided and the operation will last two to three days with silt
screens and turbidity screens in place along the lake bank. The
request is for an excavation and fill permit to remove approxima-
tely 500 yards of material from the commercial site and place it
on the lake slopes within Boynton Lakes Plat No.5. Subject to
receiving the cross sections and the topography which was pro-
mised, Mr. Staudinger recommende~ approval.
Linda Grub, 6 Redford Drive, read a letter she prepared stating
her concerns and those of other homeowners in Boynton Lakes. (A
copy of this letter is on file in the City Clerk's Office with
the original copy of the minutes of this meeting.) The letter
pointed out that the owners had no official notification of this
hearing and are unaware of any problem with the lake. Without ..

build closer to the property line, the height of the wall will
get lower.

Please place the referenced item on the City Commission agenda
for August 20, 1991 under Development Plans, Nonconsent Agenda.
DESCRIPTION: Request submitted by Kilday and Associates for
approval of an amended master plan to allow relocation and
addition of driveways, and changes in size and use of outparcels.
The project is located at the northeast and northwest corners of
Woolbright Road and S.W. 8th Street.
RECOMMENDATION: The Planning and Zoning Board denied that part
of this master plan modification which requests an additional
driveway onto Woolbright Road (item #1 of attached Planning
Department Memorandum No. 91-165).
The applicant is requesting an appeal of the denial by the
Planning and Zoning Board. If the City Commission grants the
additional driveway onto Woolbright Road, it is recommended that
approval be subject to condition #4 of the attached Planning
Department Memorandum No. 91-183 and the attached letter from
Richard Staudinger, dated July 9, 1991.
