Commission, subject to all staff comments.
. Boynton Beach Community Development Corporation Parking Lot Variance - This
board recommended that all staff comments be deleted except comment 9, which
required the applicant to reduce the width of the driveway from 27 feet to 20 feet.
The City Commission concurred with that comment and also required the applicants
to move the driveway as far south as possible, The applicants have done that, and
they have been able to make the driveway work without the variance, They have
been able to set it back 30 feet, as required by the Code.

At this time, Chairman Dube acknowledged the presence of Mayor Jerry Taylor and his
wife in the audience.
Mike Carey, President of Carey Company, agreed with all of staff's conditions on Exhibit
E.
Mr. Aguila asked Mr. Carey what he is going to do with the drive-thru canopy. As
Mr. Carey understands the recommendation, the drive-thru canopy is to reflect the canopy
in front of the Walgreen's, Therefore, it will have full height to the roof of the larger building
behind it, and we would pick up the column details that exist on the building and carry them
over to the drive-thru canopy. The arched canopy that runs from the northwest corner of
the building to the drive-thru will be the Teflon canvas canopy, and it would be cantilevered
off of the building in arches the same size and dimensions as the ones in front of the Winn-
Dixie. It would, however, not be as deep as those, which are 10 feet deep.
Vice Chairman Golden said he is going to vote against this request. He is strongly
opposed to any drive-thru windows facing major roads. He feels that they should be
located on the sides or rear.

Mr. Wische moved to approve the request to appeal aspects of the Community Design
Plan applicable to a street front facade containing a drive-up window, to allow a reduction

carried 5-1. Vice Chairman Golden cast the dissenting vote.
At this time, Mr. Aguila suggested dealing with Item 7.F.1 before Item 7.0.1, since the
parking lot variance may have some impact on the site plan modification.

Mr. Lewicki used the overhead projector to point out the location. He displayed the site
plan and described the variance. He explained that this parcel was reduced when the
ramp to 1-95 was built.
Ms. Heyden explained that because we have reduced our parking lot variance application
process to get applicants through as quickly as possible, the applicant has less time to
receive comments and respond to them. Also, variances were previously required to be
submitted with the site plan. This is no longer a requirement. However, if the site plan

awnings. However, we agreed that when the elevations come in on the site plan level, we
will discuss this again.
No one in the audience wished to speak on this item.

Commissioner Bradley moved to approve the Community Design Plan Appeal for
Riverwalk Shopping Center, subject to all staff comments. Vice Mayor Jaskiewicz
seconded the motion.
Mayor-Taylor asked if there will be other opportunities to discuss landscaping on the side'-
of the building, Ms, Heyden stated that this is the last time the City Commission will see
this project. The next step is permitting. Mayor Taylor pointed out that when we changed
this to allow drive through windows facing streets, we said we were going to be very strict
on its appearance. He asked if staff is satisfied that this project will look good.

Ms. Heyden said in terms of landscaping, yes. The plans that were submitted the last time
the Commission saw this did not address the Community Design Plan comments for
landscaping. The applicant understands that he has to comply with those comments, This
application is being driven by the applicant's position that adding these windows will bring
about a security problem. That was one of the reasons why Ms. Heyden added invitation
windows into the Code. She thinks their percentage was about 8 1/2 or 9 percent in
compliance with the windows. She recommended this subject to staff comments; however,
she felt they could have extended themselves a little further and provided more invitation
windows. This carries the front elevations around to the side so it will look more consistent
all the way around.
Commissioner Bradley asked if there is landscaping between the street and the drive
through. Ms. Heyden answered affirmatively. Commissioner Bradley asked her to
describe the berm. Ms. Heyden said it is a 3 to 1 slope, minimum 10 foot wide buffer with
landscaping, including understory. ' ;I

Request for a COMMUNITY DESIGN PLAN appeal
Please place the above-referenced item on the September 17, 1996 City Commission
agenda under Development Plans.
DESCRIPTION: Lee Starky of the Lee Starky Group, agent for Mike Carey, contract
purchaser of Riverwalk Shopping Center (a.k.a. Causeway Square), is requesting an
appeal to aspects of the Community Design Plan regulations applicable to a street front
facade containing a drive-up window, to allow a reduction in the percent of window
coverage and the omission of a pitched roof. The Riverwalk Shopping Center is a 124,
190 +/- square foot multi-building shopping center that is located at the southeast corner
of US #1 and Woolbright Road. A conditional use approval for a drive-up window within
this shopping center was approved by the Commission subject to the applicant redesigning
the west facade of the building to meet the community design regulations regarding drive-
up windows. For further details pertaining to this request please refer to attached Planning
and Zoning Department Memorandum No. 96-451.
RECOMMENDATION: The Planning and Development Board, with a 6-0 vote,
recommended approval subject to the staff comments in Exhibit "E".

Comments:
1. Considering the approved design of the center does
not include a pitched roof, staff recommends that
the design of the southwest corner of the building,
including the drive-up structure, display a canopy
that matches the design of the canopy approved
above the entrance to the Walgreens store, rather
than incorporating into the design the required
pitched roof.
2. To articulate compatibility of design along the street
frontage of the center, it is further recommended
that an arched canopy, matching the design of the
canopy approved for the front of the building
occupied by Winn Dixie, be added above the
proposed windows. The arched canopy should
connect the northwest corner of the building to the
recommended new canopy that starts at the north
side of the drive-up structure and terminates at the
southwest corner of the building.
3. It is recommended that the color of the frames
proposed for the spandrel glass, service window
and other storefront frames match the storefront
frames of the other tenant spaces.
