R98-/88 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A SECOND AMENDMENT TO THE RECIPROCAL PARKING INDENTURE AGREEMENT BETWEEN THE CITY OF BOYNTON BEACH AND TAJ ENTERPRISES AND RIVERWALK SHOPPING PLAZA, SUBJECT TO STAFF COMMENTS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Boynton Beach, upon recommendation of staff, does hereby authorize and direct the Mayor and City Clerk to execute a Second Amendment to the Reciprocal Parking Indenture Agreement between the City of Boynton Beach, TAJ Enterprises and Riverwalk Shopping Plaza, subject to staff comments, as outlined in the attached letter from the City of Boynton Beach Director of Development, dated October 27, 1998, and made a part hereof; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA THAT: Section 1. The City Commission of the City of Boynton Beach, Florida, hereby authorizes and directs the Mayor and City Clerk to execute a Second Amendment to ~- the Reciprocal Parking Indenture Agreement between the City of Boynton Beach, TAJ Enterprises and Riverwalk Shopping Plaza, subject to staff comments, as outlined in the attached letter from the City of Boynton Beach Director of Development, dated October 27, 1998, and made a part hereof. Perry & Schone, PA 50 Southeast 4th Avenue Delray Beach, FL 33483 RE: RIVERWALK SHOPPING PlAZA - SECOND AMENDMENT TO RECIPROCAL PARKING INDENTURE Dear Mr. Perry, Your reply of October 6, 1998, to my letter of September 30, 1998 and our telephone conversation today helped clarify the circumstanced behind the proposed Second Amendment. When and if an application for a site plan approval is received from your client, Holding and Management, Inc., for the development of the two landlocked parcels, the Department of Development will undertake the site plan review process. At that time, all the issues and possibly others mentioned in your Second Amendment will be addressed and conditions for ~proval will be determined. At this time, without prejudging the site plan review process and including or excluding conditions for approval, I have no objection to proceeding with the execution of the Amendment for reasons of convenience.
