Dear Mr. Carey,
Thank you for returning my call in response to the
concerns we at Crown Colony have with the Winn Dixie
Building at River Walk Plaza. Our condo complex has 147
units across from the property on the inter coastal. Our
building, Kings Bay House, directly overlooks the East and
South East end of the Winn Dixie Building.
The issues we discussed on the phone not only affect
the quality and enjoyment of our daily life, but also the value
of our investment in the apartments at Kings Bay House.
The following are specific concerns, which we hope
could be satisfactorily resolved:
· Inadequate landscaRing and noise
More trees and bushes need to be planted to "cover-
up" the unsightly rooftop and driveway, particularly, across
the entire rear (East-end) and the side (South-end) of the
building. Hopefully this will not only camouflage the area
but will also muffle the noise of delivery trucks, air
conditioning, freezer and exhaust units. Since the building

will be operating on a 24-hour basis, deliveries, air
conditioning and freezer noise must be adjusted or
eliminated during nighttime hours

According to the planning and zoning department of
the City of Boynton Beach, the lights presently far exceed
the minimum code requirements.
1. When fully lit, the Plaza has a "ball park" appearance
rather than a shopping area. (Photo #1) Is it pOSSible that
there be fewer lights on a pole? (some have four, others
one)
2. Can these lights be lowered below rooftop level so
they are not visible across the waterway? These poles far
exceed in height and candlepower regulation city street lamp
poles. (Photo #2)
3. Can the lights be dimmed and shielded in order to
diffuse the intensity so they do not beam into our
residences? (Photo #3) (Example of nighttime living room
view)

Consideration should be given to conceal by a box or
wall the large "railroad container" freezer/air conditioning
unit and blower fans and paint them the same color as the
building. Every effort should be made to alleviate the noise
from these units as it echoes across the water.

interior remodeling comply with the current development orders and all applicable
codes, there is no reason of which we are aware which would prohibit the issuance of
permits for interior remodeling.

Request for a variance to Section

Lot Regulations.
Miss Heyden discussed the three requests from Causeway
Square Shopping Center at this time as they were all
related. She stated that the old Grand Union grocery store
was to be convered into a location for the Ben Franklin
store. Parking would be upgraded and three variances were
being requested. The first request involves the three
driveways which currently exist on South Federal Highway.
Description:
The second request is necessary as the northern-most drive-
way is within 180 feet of the intersection rights-of-way
lines of South Federal Highway and Woolbright Road. One of
the two existing driveways onto Woolbright Road (the
western-most) is within 180 feet of the same intersection.
The TRB recommended approval of this request as submitted.
The applicant has agreed to make one of the three existing
driveways onto Federal Highway (the southern-most) a one-
way, exit only drive. The driveway onto Woolbright Road
which is within 180 feet of the interesetion is used to
access the platted outparcel at the southeast corner of the
interesection (Carteret Bank). A cr~ss access agreement
exists between the shopping center and the bank. The
history of traffic accidents in the vicinity does not indi-
cate that the current driveway design at the shopping center
has significantly contributed to accidents.
The applicant is also requesting that the existing storm-
water discharge into the Intracoastal Waterway be allowed to
continue. The TRB recommended this request be subject to

the construction of pollution control devices at the two
storm water outfalls into the Intracoastal Waterway and
submittal of a management plan for maintenance of the pollu-
tion control devices to the City Engineer. Miss Heyden
noted that maintenance is very important if the pollution
device is to work properly. It would be a hardship to
require that retention areas be installed as the parking lot
paving would have to be removed at considerable cost. The
applicant will add landscaped islands in the parking lot.
The third request is site plan approval to allow for eleva-
tion change to the vacant supermarket and change in parking
lot layout and design for the Ben Franklin store. The TRB
recommended approval of this request subject to staff com-
ments.
Brenda Arnold, Kilday & Associates, 1551 Forum Place, Suite
lOOA, West Palm Beach, was present to represent' the appli-
cant. She stated that this shopping center is 20 years old
and there were many problems they had tried to rectify. The
parking lot is paved from property line to property line.
The markings were to be upgraded as well as the handicapped
parking spaces. The dumpsters would be screened with a 6'
wall and landscaping would be added. Presently there is no
landscaping or green space. The site would not allow them
to make all the changes they would like to make, and they
would not be able to bring all up to Code. They were having
a problem providing enough parking, but with careful
planning had come up with just enough to meet code. She
felt that once the Ben Franklin is finished more people will
be coming into the center to shop and the rest of the center
will probably have a better occupancy rate. The TRB has
approved the variances requested subject to staff comments.
Mr. Richter asked if Ms. Arnold had any problem with the
staff comments, and she repl ied that she was in ag'reement
with the staff comments. They were working on the signage
situation and it was their understanding that they have
three years to bring this up to the new code. Mr. Richter
asked if they were repairing the seawall, and Ms. Arnold
replied that they were as this was to their advantage as
well. The parking lot was being undermined and it was
necessary to make the seawall repairs.
Chairman Walshak asked how the polution devices would work.
Rick Rossi, Rossi and Malavasi, stated that his firm had
done the enigneering for the pollution abatement process.
They had used a system which has been used throughout the
South Florida Flood Control District. He explained that the
system works much like a grease trap. The oils and sediment

are separated and contained and can then be removed by
access from the top of the box.
Mrs. Huckle asked if Ms. Arnold represented the project at
the TRB meetings, and Ms. Arnold stated that she was. Mrs.
Huckle questioned the use of the southerly Highway curb cut
to remain as long as it was a one-way exit. Ms. Arnold
agreed and stated this was decided because of the trucking
flow. The trucks exit 1-95, come in off Woolbright, go into
the center and exit out onto Woolbright Road and to 1-95.
Mrs. Huckle had looked at this as being an entrance to pre-
vent some of the jamming up at the next entrance. She had
not thought about the truck situation.
Mrs. Huckle stated that on most of the shopping centers
approved recently, the Board has felt that it works well for
the exists out of shopping centers to contain a double exit
- one for right and one for left turn. She referred to the
Sunshine Square publix store and Oakwood Square. She noted
this had worked very well. She had looked at the Causeway
Square and saw a couple of areas where this would not work.
She did feel the one coming out of K-Mart and turning right
toward the bridge would work well with the two lanes. Mr.
Aguila stated that this does not appear to have 27' of space
and to make another lane would cause them to have to give up
the landscaped island. Ms. Arnold noted that they have a
very critical parking problem. At present they have a
buffer of only two spaces. Since this is an exising center
she felt these were needed to maintain the parking required.
If they do have excess, they will be glad to put in the
additional turn lane. Ms. Arnold also stated that another
problem they have is the existing agreement with Carteret.
Mr. Annunziato stated that the problem is that they are at
or near the number of required parking spaces.' To add a
left turn lane at that eastern most entrance may require
eliminating one parking space and put them into a Code
problem. He recommended that if they remain above the mini-
mum requirements, that they install a turn lane. He did not
want to throw them into a Code violation.
Mr. Aguila asked if all the islands ,indicated would be
landscaped and have raised curbs. Ms. Arnold stated that
all but a couple would be, but they were trying to leaving
the existing light fixtures to avoid any additional costs.
Shade trees would be placed in all the interior parking
islands and would be fully irrigated. Ms. Arnold felt that
by working with staff to get the building remodeled for Ben
Franklin an improvement in the site would result. She
acknowledged that for her as a site planner, the plans were

less than desirable, but this center is 20 years old. The
plans would certainly be an improvement. Mr. Richter agreed
this would be quite an improvement as far as the looks are
concerned.
Mr. Annunziato spoke on behalf of staff recommendations. He
felt that the City would be getting a tremendous upgrade for
a substandard shopping center which would probably not occur
if the variances were not approved. He referred to the
pOllution abatement system and noted that this came about as
a result of a recommendation he had made. Mr. Annunziato
referred to a time when Colonel Trauger was Mayor. At that
time he required the property owners to "wash their face,
and comb their hair." He felt the improvements to Sunshine
Square, although modest, were somewhat responsive to the
plea from Colonel Trauger.
Mrs. Huckle asked if the Ben Franklin was going to be a
large one, and Ms. Arnold stated that it would not occupy
all of the Grand Union space. She was not aware of any
other tenants at this time. Mr. Richter felt that it was
commendable that common sense was used on everyone's part to
put this project together.
As no one wished to speak for or against the requests, THE
PUBLIC HEARING WAS CLOSED.
Motion on Request for Variance to Section 5-142(h)(3) and

Mrs. Huckle moved to approve the requested variance to
Sect ion 5-142 (h)( 3) and Sect ion 5-142 (h) ( 7) "Dr i veways" of

southeast corner subject to all staff comments (attached as
Addendum "C-l - C-2" to the original copy of these minutes

Dear Michael Carey:
The City of Boynton Beach has completed its first review of the
documents submitted for the above-referenced project. Attached are
comments made by the reviewing departments during their initial
review of your project.
In order to complete the review process, the site plan and
documents must be amended to comply with these comments within 90
days of the date of this letter, (If amended plans are not
submitted in 90 days, a new application fee will be required.)
When there are comments made by the reviewers that you feel are not
applicable to the approval of the project or will be addressed
separately and you have not amendoQ the plans to comply with the
oomment(s), you must prepare written explanation for each comment
stating why the comment is not applicable and return the
explanation with the amended plans and documents.
After amending the plans and documents, please submit twelve (12)
complete sets (including surveys) of the plans to the Planning and
Zoning Department. When the amended plans and documents have been
submitted to the Planning and Zoning Department, they will be
distributed to the reviewing departments for second review and
recommendation to the appropriate boards for approval or denial

1. Submit an amended Site Plan Review/Conditional Use application form that
reflects the changes that were made as a result of amending the plans
and documents to comply with the Code of Ordinances and the Technical
Review Committee comments. A copy of the original form with a
distinguishable symbol identifying the change(s) may be submitted or a
completed new form with the changes identified. If there are no changes
required to be documented on the application form, a letter from the
applicant stating same must be turned in with the amended submittal.
2, Submit twelve (12) assembled and complete sets of plans and documents,
including surveys that show compliance with the Code of Ordinances and
comments made by the Technical Review Committee. Two (2) of the sets
shall have the appropriate legible raised seal and signature of the
designer responsible for the drawing(s), Plans and documents shall be
assembled in twelve (12) individual complete packages with the title of
the project on all pages and/or sheets and each page or sheet
numerically numbered such as the following example: 1 of 3, 2 of 3, 3 of
3 ,
3. Submit color photographs of the buildings on the site that are to remain
in their existing condition and photos of existing buildings that are
located on the sites that abut the perimeter of the subject property.
The minimum size is 5" by 7". Each photograph shall be labeled to
identify the location of the existing structures with respect to the
location of the proposed project. If the abutting property is vacant
photographs are not required.
4. Submit colored elevation view drawings - a colored duplicate copy of all
drawings of the elevation views of each side of all buildings and
signage associated with the project. The colors shown and described on
the colored elevation views shall match the colors identified on the
elevation drawings submitted for site plan review. All exterior
surfaces of the structure (s) shall be colored and the color' name,
associated color code and manufacturer identified. The type of exterior
surface material shall also be identified on the drawing. The colored
elevation drawingn shall have cc~pass direction or ti e of the side of

5, Submit color samples as an example of the proposed colors, Each sample
shall have attached a label that identifies the color by name, color

6. Submit a 8 1/2" x 11" transparency of the landscape site plan drawing to
be used on an overhead projector at board meetings.

JUNE 1996
The Riverwalk Shopping Center Project is the rehabilitation and remodelling of an existing
shopping center. The project is located in Sections 33 and 34, Township 45 South, Range 43
East, on the southeast corner of U.S. Highway 1 and S.E. 15th Ave. (Woolbright Road) in
Boynton Beach, FL.
The existing project contains 125,997 S.F. of general retail space and the proposed plan calls
for 124,686 S.F., which is a net reduction of 1,311 S,F. Since there is no increase of general
retail floor space, there will be no increase in the traffic generated by this project.

We have not: been informed by you as to if the requested modification is minor or major,

have been advised to pay for both the major and minor application fee until you have made your

The documents attached to my leases from 1967 and the title documents both reference a site plan
that has 520 parking spaces, It appears that during maintenance and sealcoating lines along the
north side of the garden area were not repainted along with spaces on the south property line, On
the south, car stops are still in place along the property line but no lines are painted. These spaces
were part of the approved siteplan and should be the basis for the current parking count of 520
spaces. The 1984 variance approved a parking plan of 562 spaces, Both plans have parking above
500 spaces,

Walgreen's Drive- Thru Pharmacy at the

Woolbright Road, This decision would
bring about erection of the first and only
commercial enterprise in a residential
area that encompasses more than 2-1/2
square miles,
At present, no stores are located in the
en tire area bordered by Mili tary Trail on
the east, El Clair Ranch Road on the
west, Boynton Beach Boulevard on the
north and Piper's Glen Boulevard on the
south. A Walgreen presence would effec-
tively change the purely residential
character of the community in a negative
fashion. Considering its encroachment
on purely residential communities in
purely residential areas, approval of the
project is an exercise in crass commer-
cialism.
What is more, the store site would be
on Woolbright Road only a quarter mile
west of an existing Walgreen store in the
Village Square shopping center of
Boynton Beach, It should be pointed out
that this center is presently in the
process of being enlarged to more than
double it's original size.
Traffic officials, in spite of heroic
efforts, experience great difficulty in
enforcing present speed limits and safety
regula Hans applying to the area. It is a
situation that will surely be exacerbated
by the, enlargement of Village Square and
the consequent increase of the local traf-
ficload. u
Location of a Walgreen "Drive- Thru
facility at the corner of Military Trail and
Woolbright Road would have an
extremely adverse effect on the almost
4,000 residents of the Indian Spring com-
plex and on all the other existin~ and
planned residential developments In the
area. They are deeply concerned with the
traffic and safety implications involved
in the Walgreen project. It would be at
one of the busiest intersections in the
area where development currently under
way gives promise of t~e dou~ling or
even tripling of area traffIC denSIty, .
Additional access and egress reqUIre-
ments of the proposed Walgreen location
would make for extremely dangerous
traffic patterns in which residents ~f
Indian Spring and other local commu~u-
ties would be competing for access w~ th
those seeking use of the commercIal
facilities, This problem would be espe-
cially impacted by those vehicles leaving
the proposed location ~ishin? to t~rn on
to Woolbright Road With the mtent,l~n of
making a turn to go south on MIlItary
Trail.
The WalgI'een proposal pu ts the wrong
thing in the wrong place at the wro~g
time, making a mockery of the necess~ty
to promote the good-will of commumty
residents. Addressing the concerns of
residents and re-thinking of the project
by both management and county offi-
cials is unquestionably in order, The
comfort, safety and life-style of area res-
idents must take priority over commer-
cial considerations,

DRAINAGE STATEMENT
April 1996
The proposed Riverwalk: Shopping Center is the remodeling of an existing project located on the
southeast corner of U.S. Highway No 1 and S.E. 15th Ave (Woolbright Road). The existing
drainage system consists of a series of catch basins located throughout the parking lot with an
outfall to the intracoastal waterway.
The proposed site plan calls for the removal of 10,294 square feet of building area and the
addition of a slightly smaller amount of new space. The entire parking area will receive a
maintenance program and will be restriped to allow more efficient and safer use. New landscape
areas will added to the parking area to improve its appearance and serve to increase the amount
of pervious area over the existing condition. The drainage system will also receive a
maintenance program to restore the system to its original condition and performance. It is
anticipated that the maintenance program of the parking area will qualify for a no notice general
permit from the South Florida Water Management District.

less than desirable, but this center is 20 years old. The
plans would certainly be an improvement. Mr. Richter agreed
this would be quite an improvement as far as the looks are
concerned.
Mr. Annunziato spoke on behalf of staff recommendations. He
felt that the City would be getting a tremendous upgrade for
a substandard shopping center which would probably not occur
if the variances were not approved. He referred to the
pollution abatement system and noted that this came about as
a result of a recommendation he had made. Mr. Annunziato
referred to a time when Colonel Trauger was Mayor. At that
time he required the property owners to "wash their face,
and comb their hair." He felt the improvements to Sunshine
Square, although modest, were somewhat responsive to the
plea from Colonel Trauger.
Mrs. Huckle asked if the Ben Franklin was going to be a
large one, and Ms. Arnold stated that it would not occupy
all of the Grand Union space. She was not aware of any
other tenants at this time. Mr. Richter felt that it was
commendable that common sense was used on everyone's part to
put this project together.
As no one wished to speak for or against the requests, THE
PUBLIC HEARING WAS CLOSED.
Motion on Request for Variance to Section 5-142(h)(3) and
Section 5-142(h)(7) "Driveways" of the Parking Lot
Regulations
Mrs. Huckle moved to approve the requested variance to
Section 5-142(h)(3) and Section 5-142(h)(7) "Driveways" of
the Parking Lot Regulations for Causeway Square Shopping
Center located on South Federal Highway at Woolbright Road,
southeast corner subject to all staff comments (attached as
Addendum ItC-l - C-21t to the original copy of these minutes
in the Office of the City Clerk). Motion was seconded by
Dr. Jackier and carried 7-0.
