Jerry Milord, of Milord Development Corporation located at 3600 S. Congress Avenue,
Boynton Beach, agent for the project, took the podium. Chairman Wische informed the
petitioner that there were several staff comments and inquired if the applicant had an
opportunity to review the comments. Mr. Milord stated that they agree with all staff
comments.
Chairman Wische inquired if Mr. Rumpf had any additional comments and there were
none.
Ms. Frazier questioned the year of 1979 as being the original church, fellowship hall and
school and stated that the church has been in existence for a long time. Ms. Frazier
was informed that the date of the original church was in fact 1954 and the school date
was 1957.
Chairman Wische stated this was a public hearing and inquired if anyone in the
audience had any comments. There were none and Chairman Wische closed the
public hearing.
Mr. Dube commented upon the fine work that has been achieved at this property and
the enhancement of the landscaping has made this area of Seacrest very pleasing.
Motion
Mr. Dube moved to approve the request for conditional use approval to construct the
addition of a 4,543 square foot youth and day care center in the northwest comer of the
campus, subject to all staff comments.
Mr. Myott seconded the motion. Motion carried 7-0.
For clarification purposes Mr. Milord stated that the addition would be used primarily for
a youth center for children who attend the school as well as other children in the

Description:
Chairman Wische noted that this applicant has three items on the agenda.
Ellen Smith, of Unruh, Smith and Associates, 105 S. Narcissus Avenue, West Palm
Beach, Florida took the podium. Ms. Smith stated that the applicant agrees with staffs
comments. The first request of the three-part variance deals with a request for a
variance in required parking spaces. Ms. Smith stated that the City Code does not
identify package or liquor stores. The parking code groups retail uses not otherwise
listed with general retail uses. Ms. Smith handed members a report prepared by a
project engineer, which demonstrates that the actual parking demand of package stores
within the State of Florida is much less than required by City Code. Based on traffic
patterns, it is anticipated that only 30 parking spaces would be needed. Ms. Smith
briefed members of a typical customer's time at a package store and there would never
be 40 people at one time in the store. The parking code ratio presents a hardship.
Staff suggested that some square footage be taken off the size of store, but Ms. Smith
requested this not be a requirement. Ms. Smith stated that the if the building were at
40% lot coverage, which is allowed, the building in fact could be 14,000 square feet if it
could support the parking. The building size proposed has been reduced to 24% of lot
coverage.
Chairman Wische noted that staff recommends approval of the request for a variance to
reduce the minimum parking ratio required of one space per 200 square feet to one

· Blockbuster Video Community Design Plan Appeal - Approved by the City
Commission, subject to all staff comments.
· St. Joseph's Episcopal Church Conditional Use Approval - Approved by the City
Commission, subject to all staff comments.
· East Ridge PUD Rezoning - Postponed. The applicant is resubmitting plans. This
item will be heard at the next meeting.
· Woolbright Place Master Plan Modification - Ended with the Planning and
Development Board making the final determination.
· Riverwalk Shopping Center Community Design Plan Appeal - Approved by the City
Commission, subject to all staff comments.
· Boynton Beach Community Development Corporation Parking Lot Variance - This
board recommended that all staff comments be deleted except comment 9, which
required the applicant to reduce the width of the driveway from 27 feet to 20 feet.
The City Commission concurred with that comment and also required the applicants
to move the driveway as far south as possible. The applicants have done that, and
they have been able to make the driveway work without the variance. They have
been able to set it back 30 feet, as required by the Code.

Commissioner Bradley referred to a previous approval and asked if the applicant agreed
to screen the air conditioning and appurtenances on the roof as requested by the Planning
and Development Board.
City Manager Parker advised that any rooftop installation on this facility will have to be
screened. However, the applicant did not agree to screen the older equipment that was
already installed on the other buildings.

comments if we are going to limit ourselves when we see the entire building in the future.
Ms. Heyden stated that she is looking at this as a tradeoff. These comments are what she
feels are necessary to minimize the amount of the awnings. They are extensive. They are
the prime feature of the building. There is no other feature on the building right now,
except the awnings. She felt the two have to go hand in hand. She would not support the
awning issue without these conditions.
Motion
Mr. Aguila moved to approve the request to appeal the Community Design Plan to allow
back-lit awnings on a new outparcel building, subject to staff comments and
recommendations, for Blockbuster Video at Boynton Lakes Plaza. Mr. Wische seconded
the motion.
Vice Chairman Golden wondered if we should put a stipulation on the recommendation
subject to agreeing that we may have to deviate from some of the items when we see the
entire package. Mr. Aguila felt we are going to see a totally different building. He said the
applicant is already aware of some of the conditions, and we will probably only have to deal
with the color of the building, the accents, and the size of the sign.
The motion carried 5-1. Mr. Elsner cast the dissenting vote.

pavement and it is a joint use for both properties. The applicant is proposing to provide the
10' PCD buffer. The only difference is that the applicant would like to place it on the north
side of the easement. A hedge and tree row are proposed along the area.
Motion
Vice Chairman Golden moved to recommend approval of the landscape code appeal for
Boynton Commons to omit a 2%' wide landscape strip between the vehicle use area and the
abutting property line at the southwest corner of the site. Mr. Wische seconded the motion
which carried unanimously.

6,482 square foot classroom building to the existing
school, a 30 space parking lot and tennis courts.
Mr. Titcomb declared a conflict of interest and would not participate in this hearing. Mrs.
Frazier replaced Mr. Titcomb as a voting member.
Dan DeCarlo made the presentation. The surrounding land uses and zoning include existing
si ngle-fam i Iy homes zoned R-l AAB to the north; Seacrest Boulevard, existi ng houses and the
Seacrest Scrub zoned R-1 AAB to the east; undeveloped vacant land zoned R-l AA to the south;
and a single-family neighborhood zoned R-1 AAB to the west.
The following standards were evaluated:
1. Ingress and egress - The site has two driveways to the on-site parking area. The
driveways are located on Seacrest Boulevard and Swinton Avenue.
2. Off-street parking and loading area - A 1988 shared parking agreement was
modified in 1994 to allow approval of the gymnasium and classroom expansion
in 1994. Palm Beach County Traffic required a deed restriction to be filed that
limited student enrollment to 225. This request provides a new 6,329 square
foot classroom building and an adjacent 970 square foot fenced playground

area. The 31 new parking spaces will be located north of the building.
3. Refuse and service area - The Public Works Department does not anticipate any
problems with the proposed layout and waste pickup.
4. Utilities - Utilities are available and there are no concerns relative to the
proposed new construction.
5. Screening, buffering and landscaping - The new landscaping will be consistent
with all Cit'{ codes.
6. Signs and proposed exterior lighting - Additional parking lot lighting is not
anticipated to produce glare or pose problems for the surrounding
neighborhood provided the recommendations set forth in Planning and Zoning
Department Memorandum No. 95-549 regarding shielding lighting and
illumination levels, are required as conditions of approval.
Chairman Dube acknowledge the presence in the audience of Mayor and Mrs. Taylor.
7. Setbacks and open space - AI! setbacks meet the R-1 AA building and site
regulations and the majority of the site remains pervious.
8. General compatibility with adjacent properties - The existing facility has not
generated any adverse comments.
9. Height of the buildings and structures - The building height is compatible with
the remainder of the site and adjacent communities. The highest point of the
new building is 21' 10" above adjacent ground level.
The proposed project is in compliance with Standards 10, 11, and 12.
The Planning and Zoning Department recommends approval of this conditional use request
subject to reflection of staff comments and all of the other applicable City of Boynton Beach
Code of Ordinances on the plans submitted for building permits.

building now houses the library, two pre-kindergarten classes, and kindergarten. The pre-k
