Ballerano, Jr., agent for st. Joseph I s Episcopal Church and School, is requesting approval of an appeal to the above-referenced sections of the landscape code. The appeals are in connection with the proposed construction of a new gymnasium and school building at the existing church school site. The site is located at 3300 South Seacrest Boulevard. Attached is a locator map of the area. Also attached is Exhibit "A", a reduced copy of the landscape plan and a letter describing the request. BACKGROUND The site is an existing 14.68 acre church and elementary school facility. Construction of the proposed new gymnasium and school building requires the existing landscaping to be up-graded to meet current landscape requirements. Landscaping depicted on the site plan of a previous City Commission approved expansion to buildings at the facility in 1988, was not installed or in part, has not been maintained, is included with this appeal. The requirement of providing fifty (50) percent native species of required landscaping is the only change to the landscape code since the previous expansion. The first appeal requested is to Section 7.5-35 (d) of the Landscape Code which reads as follows: Section 7.5-35 (d) Required landscaping adjacent to public rights-of-way. On the side of a building or open lot use providing an off-street parking area or other vehicular use area, where such area will not be entirely screened visually by an intervening building or structure from any abutting right-of-way, excluding dedicated alleys to the rear of building, there shall be provided landscaping between such area and such right-of-way as follows: I page 2 Planning and Zoning memo #94-165 (1) A strip of land at least five (5) feet in width located between the abutting right- of-way and the off-street parking area or other vehicular use area which is exposed to an abutting right-of-way shall be landscaped, such landscaping is to include a minimum of :)ne tree for each forty (40) lineal feet or fraction thereof. Such trees shall be located between the abutting right-of-way and off-street parking area or other vehicular use area and shall be planted in a planting area of at least twenty- five (25) square feet with a dimension of at least five (5) feet. In addition, a hedge, wall, or other durable landscape barrier of at least three (3) feet in height shall be placed along only the interior perimeter of such landscaped strip. If such durable barrier is of nonliving material, for each ten (10) feet thereof, one shrub or vine shall be planted abutting such barrier along the street side of such barrier. The remainder of the required landscaped areas shall be landscaped with grass ground cover or other landscape treatment. The appropriate size landscape strip and the required number of trees are existing. The request is to appeal the installation of a portion of the visual barrier required to screen the view of the on-site vehicle use area from the adjacent public right-of-way. The proposed visual barrier is hedge plant material. To form the visual barrier, hedges planted two (2) feet on center and eighteen ( 18) inches in height at planting shall be placed along the perimeter of the vehicle use area as described above. The location of the required visual barrier and the areas requested to be omitted are shown on Exhibit "A". The second appeal requested is to Section 7.5-35 (e) of the Landscape code which reads as follows: Section 7.5-35 (e) Perimeter landscaping relating to abutting properties. On the site of a building or structure or open lot use providing an off-street parking area or other vehicular use area, such area shall be provided with a landscaped barrier, preferably a hedge no less than four (4) feet nor greater than six (6) feet in height to form a continuous screen between the off-street parking area or other vehicular use area and such abutting property. Such landscape barrier shall be located between the common lot line and the off-street parking area or other vehicular use area in a planting strip of no less than two and one-half (2!) feet in width. The provisions of this subsection shall not be applicable in the following situations: (1) when a property line abuts a dedicated alley. ( 2 ) Where a proposed parking area or other vehicular use area abuts an existing hedge, said existing hedge may be used to satisfy the landscape requirements of this subsection provided that said existing hedge meets all applicable standards of this article. 2. page 3 Planning and Zoning memo #94-165 The request is to appeal the installation of a portion of the visual barrier required to screen the view of the on-site vehicle use ~rea from abutting property. Hedge plant material is proposed for the visual barrier. To form the continuous visual barrier, a hedge plant spaced two (2) feet on center and eighteen (18) inches in height at planting shall be placed between the vehicle use area and the abutting property line. The appropriate landscape strip has been provided. As previously stated, the location of the required visual barrier and the areas requested to be omitted are shown on Exhibit "A". ANALYSIS As previously stated, the site is an existing church and elementary school facility. Landscaping shown as part of an expansion in 1988 is not in place at the site, some of which is being requested to be omitted with this appeal. The objective of the appeal for both sections of the code is to omit a portion of the visual barrier screening required to screen the on-site vehicle use area along the abutting property line and right-of-way. A hedge plant material is the proposed visual barrier. The basis for the justification to omit the visual barrier hedging is the distance the vehicle use area is located from the abutting right-of-way and property line. The supporting data is described in Exhibit "A". RECOMMENDATION staff recommends approval of the request to appeal section 7.5-35 (d) and (e) of the Landscape Code subject to the following stipulations: 1. All the applicable vehicle use area hedge landscaping depicted on the landscape plan submitted with the 1988 expansion that is not existing or proposed with this development, shall be installed. This landscaping is delineated on Exhibit "B". The specie shall match the specie of the abutting new hedge material. 2. The vehicle use area screening (hedge) identified as 6 on the landscape plan included with Exhibit "A" shall be installed. The specie shall match the specie of the abutting new hedge material. 3, The vehicle use area screening (hedge) shown on Exhibit "All west of the church and proposed dumpster area shall be installed. The specie shall match the other vehicle use area screening hedge material. 4. On both sides of each entrance driveway to the site, add hedges and ground cover treatment to draw focal attention away from the long vehicle use access aisles. Note that new material, preferably native species, shall be located outside of the required line-of-sight triangles. This is a request for a variance of the landscape code at St. Joseph's Episcopal School. The sections addressed in the code are as follows: Sec. 7.5-35(d) Required landscaping adjacent to a public rights-of-way. This request pertains only to the portion of the code that requires hedging, all the re'1uirements for trees are met. The justifications are as follO\/s: 1. This parking strip is 680 ft. from the publ ic rights.,of-\'/ay through a heavy stand of native pines and a playing field. These parking spaces are not visible in the line of site fro~ Seacrest Boulevard. These also are auxillary parking spaces that are rarely utilized. 2. The west section of this parking area is 12 ft. above the crown of the road elevation. At this height above the road these parking spaces are not visible from the public rights-of-~ay ( Swinton Avenue). Furthermore these spaces are rarely if ever utilized. Sec. 7.5-35(e) Perimeter landscapin~ relating to abutting properties 3. The parcel of land to the south of St. Joseph's is a preserved native scrub site. There are no inhabitiants that would be viewing the vehicular use areas. On the south- \~est portion of the property the access road is 41G ft. from the south property line and the access~ay is 4 ft. below the exisitng elevation and is net exposed to view. 4. The abutting properties on the north are residential and most have the rear yards fenced and/or hedged. The vehicular entrance road is 330 ft. fro~ the north property line and through a heavy stand of native pines and a playground. The abutting property on the south is undeveloped native scrub. Hedging the accessway would serve no purpose. 5.
