City Commission agenda under Public Hearing.
DESCRIPTION: This is a request from Jerome F. Milord, agent for
st. Joseph's Episcopal Church and School for conditional use
approval to add a new 6,329 square foot classroom building (pre-
school and kindergarten), minor exterior changes to the library
building, a new parking lot and conversion of two basketball courts
and a volleyball court to three new tennis courts. The 14.68 acre
site is located at 3300 South Seacrest Boulevard and zoned R-1AAB.
RECOMMENDATION: The Planning and Development Board, with a 7-0
vote, recommended approval subject to all staff comments (Utilities
#95-303, Fire Prevention Memorandum No. 95-343 WDC, Engineering
Division Memorandum No. 95-363, Building Division Memorandum No.
95-359 and Planning and Zoning Department Memorandum No. 95-549).

A 1988 shared parking agreement was modifIed 111 1994 to allow
dpproval of the gymnasium and classrcor.1 expanSIon in 1994.
The Palm Beach County Traffic DIVISIon also required a deed
rEstrIctIon to be fIled that lImited student enrollment to
2~5. The subJect application verifies that the student
pc.pl.lation IS below the deed restrIction lImit and tllat tlle
illlllllJel:S referenced In the shared pal-king agreement do not
change. The proposed proJect adds 31 parkIng apaces
br1ilg1ng the total number of spaces to 174, including t
handicapped spaces, which is ~lell above the 133 apaces
required by the shared parkIng agreement.

The enclosed documents reflect the changes made as a result of your review completed on
August 24, 1995. As briefly a~ possible, I will only reply to comments that are not covered
on the drawings.
Comments from Michael Haag: ~
1) The shared parking agreement is still valid. The proposed addition (Building
11) is not to house additional students. It is to relocate the existing students
from two separate bu'ildings (Building No. 7 and part of No.6). The
administration at St. Joseph's feels strongly that excellence in education is a
combined effort between staff and environment. The environment or
dedication of space is the reason for the addition. Building No.7, which now
h.ouses PK-3, PK-4 and kindergarten, will be remodeled to contain the art
room and lecture room. These areas are presently contained in Building No.
6. In this phase of construction, we are also proposing a new 31 car parking
area.
2) The proposed school population is to remain the same as the present
population (note: there is only one classroom for each level: PK3, PK4,
kindergarten and grades 1 through 8, The number of students in each level
varies from 11 to 20 students.

by major paint manufacturer. Stucco bands and surrounds to be white.
5) Sheet A2 - All rooftop units and/or ground mounted condensing units shall be
screened .
6) Gymnasium building does not have an overhead door facing Seacrest and has
been previously permitted.
7) Shrubs have been extended on Sheet C-1 to meet this request.
I have talked to Mr. Hukill on August 30, 1995, and we will comply with City requirements
and such will be indicated when construction documents are submitted for permitting. This
was agreed to by Mr. Hukill and myself.
I trust that this letter and the revised and amended drawings will be adequate for your
approval, as well as recommendation of approval to the Board.

Staff has reviewed the above referenced project and offer the following comments:
Our previous comment, as stated on memo no. 95-260 has not been addressed, so we
repeat it below-
1. Please provide Flow and Demand calculations for the existing and proposed
additions to insure the water and sanitary sewer services to be extended are of
sufficient size to handle the proposed additional demands.
It is our recommendation that the plan proceed through the review process.

The following is a list of comments regarding the second review of
the above-referenced project. It should be noted that the comments
are divided into two (2) categories. The first category is a list
of comments that identify unresolved comments either from the first
review or new comments as a result of the second review. To show
compliance with these comments will not substantially alter the
configuration of the site and design of the bUilding. The second
category is a list of recommendations I believe will enhance the
aesthetics and function of the project.
All comments and recommendations can be rectified on the plans at
time of permitting it the site plan request is approved. The
applicant must understand that additional comments may be generated
upon review of the documents and working drawings submitted to the
Building Dep~rtment for permits for the proposed project.
I. SITE PLAN REVIEW COMMENTS:
1. Please ensure that adequate grade elevations are given on
drawing to shown that maximum height above grade is
limited to twenty five feet.
II RECOMMENDATIONS
2. It is recommended that the site lighting fixtures for the
new parking facility have shields to eliminate glare to
adjacent properties. It is further recommended that the
light levels for the new parking area not exceed minimum
City standards and that light level readings above .5 not
extend outsIde the property line.
3. It is recommended that melaleuca mulch be used instead of
cypress bark mulch.
NOTE:
If recommendations are approved, they shall be
incorporated into the working drawings required for
permits for the project.

The following is a list of comments regarding the site plan review of the plans for the
above-referenced project. It should be noted that the comments are divided into two (2)
categories. The first category is a list of comments that identify deficiencies from the City's
Land Development Regulations (L.D.R.) that are required to be corrected at the permitting
stage of the project. The second set of comment(s) lists recommendations that the Planning
and Zoning Department staff believe will enhance the proposed development. The applicant
shall understand that all documents and plans submitted for site plan are subject to
additional comments by the Planning and Development Board and/or the City Commission.
If the applicant is not intending to correct code deficiencies, he should contact me regarding
the procedures, application forms, fees and submittal deadline dates for seeking relief from
the code requirement.
I. SITE PLAN REVIEW COMMENTS:
1. On Sheet C-2, Site Plan, include legal description, as required by the city's
Land Development Regulations, Chapter 2 - Zoning, Section 1l.2.F.5d.
2. On Sheet C-2, Site Plan, indicate traffic flow pattern of the on-site vehicular
system, as required by the city's Land Development Regulations, Chapter 2-
Zoning, Section 1l.2.F.5g.
3. Provide parking information for the entire site in a tabular form that consists
of:
-number of required parking spaces,
-number of provided parking spaces,
Include relevant calculations in accordance with the city parking regulations.
Proposed parking should reflect requirements of the American Disability Act.
4. To show compliance with the city standards, indicate dimensions of parking
aisles and driveways.
5. Depict on the site plan the height and building materials of all fences and
buffer walls.
6. Clearly identify on the site plan all existing and new outdoor lighting fixtures.
7. Provide enlarged sketch of solid waste containers. Depict their dimensions,
height and building materials of enclosures. Provide appropriate landscaping
in accordance with the city code.
8. On the proposed site plan, Sheet C-2, insufficient data regarding site
development, as required by the Land Development Regulations, Chapter 2 -

with the above city's code provision.
9. Eliminate discrepancies in dimensioning of the proposed parking lot along
Swinton Avenue right-of-way between correctly drawn paving plan and the
substandard layout shown on the site plan.
10. Eliminate discrepancies regarding landscaping between Existing Site Plan,
Sheet C-l; Proposed Site Plan, Sheet C-2; and Landscape Plan (not depicted
with a symbol). Eliminate inconsistencies between planting materials shown
on all the above sheets.
11. In a tabular summary of proposed shrubs indicate their quantities for each
specie category.
12. Index sheet, Sheet C-l, contains incorrect list of submitted drawings. Two
of the submitted drawings are depicted with the symbol C-l and two other
ones with the symbol C-2. Correct denotation of symbols on each sheet.
13. Provide information regarding use of north-east portion of the property. If
the use is recreational, as indicated on the survey, draw in the layout of
recreational facilities as they currently exist. If the area is just landscaped
make appropriate denotation on the plans, and indicate locations of trees.
14. On the proposed site plan, indicate with an identifiable symbol the limits of
construction related to site work such as sidewalks, new paved or repaved
areas, etc.
15. On the site plan, write a note that the submitted proposal meets the
expansion limits, as set out in the restrictive deed covenant of the property
of 225 students and 133 parking spaces, during use of the gymnasium. If
these limits are exceeded, a new traffic study for the site needs to be
submitted before the final approval.
16. Permit plans should meet all applicable city codes.
II RECOMMENDATIONS
17.
Provide color elevations of proposed library building and proposed addition
to the classroom building identified on the proposed site plan as building 5.
NOTE:
If recommendations are approved, they shall be incorporated into the
working drawings required for permits for the project.

a potential hazard.
I f this can be done, we recommend approval, otherwise the existing cond-
ition is unacceptable.

The following is a list of 1st review comments regarding the Site
Plan Review of the plans for the above-referenced project. It
should be noted that the comments are divided into two (2)
categories; the first category is a list of comments that
identify deficiencies that are required to be corrected and shown
in compliance on the plans and/or documents submitted for second
(2nd) review in order for the project to continue through the
site plan review process. The second set of comment(s) are
recommendations that the Planning and Zoning Department staff
believe will enhance the proposed development. The applicant
shall understand that all documents/plans submitted for site plan
and/or permit review are subject to additional comments. I
recommend that the applicant/ agent contact me regarding
questions related to the comments. If the applicant is llQt
intending to correct code deficiencies they should contact me
regarding the procedures, application forms, fees and submittal
deadline dates for seeking relief from the code requirement.
I. SITE PLAN REVIEW COMMENTS:
1. On the site plan, and sheet A3 & A4, indicate with a
distinguishable symbol the proposed new construction related
to site work such as; sidewalks, steps, handrails, slabs,
paved areas etc.. [Limits of Construction - Scope of Work]
2. Include in the parking tabulations the required and provided
number of handicapped parking spaces. Show on the site plan
drawing the location of same. [Accessibility Requirements
Manual]

3. Add to the site plan drawing the following site plan
tabulations:
a. total acreage and square footage of the entire site,
b. total square footage of all buildings and str tures
and the percentage the total area is of the over
site,
c. total square footage of all other impervious areas such
as; exterior porches covered or open, slabs, paved
surfaces, sidewalks, athletic courts et. and the

percentage the total area is of the entire site,
d. total square footage all pervious areas of the entire
site including athletic courts and the percentage the
total area is of the entire project.
The total of the percentages shall equal one hundred (100)
percent and the total of the square footages shall equal the
total area of the entire site. [Chapter 4 Land

4. To keep the project on-line with the review approval
process, submit, as soon as possible, the required traffic
data. The traffic data is transmitted to Palm Beach County
for their review. They are allowed thirty (30) days to
review same and transmit their conclusions to the City
Engineer. A project shall not be forwarded to the Planning
and Development Board unless the traffic report from the
County is reviewed by the City Engineer and the Planning and
Zoning Director so that they may formulate a recommendation
for the reviewing authorities.
[Chapter 19 section 19-87 (e) of the City Code of
Ordinances]
5. Add to the site plan drawing the horizontal control
dimensions for the parking area located west of the proposed
gymnasium. The dimensions shall be consistent with City
Standards (find attached City Standard drawing B-90013).
[Chapter 5 Article x]
6. Add, city standard curbing around the entire median located
north and west of the proposed gymnasium. Also, add to the
paving and drainage plan the city required curbing in all
locations specified in Chapters 5 Article x section 5-142
( e) .
7. Add to the site plan drawing the overall dimensions of the
inside of the dumpster enclosure (min. 10 feet by 10 feet).
Also, specify the height, type of finish material and color
of the walls. [Landscape Code section 7.5-35 (j)]
8. The data turned in to establish that the height of the
gymnasium does not exceed the twenty-five (25) foot height
limitation for the subject zoning district is incorrect.
The data did not use the overall height of the building
which is five point thirty-five (5.35) feet higher than the
figures used in the data. To allow the structure to be
built at the proposed height will require a variance to the
zoning code. This type of variance is heard by the Board of
Adjustment. Applying for the variance by May 06, 1994 will
allow the Board determination to be made on June 20, 1994
which is the day prior to the conditional use approval being
presented to the city Commission. [Appendix A-Zoning
section 5 B.2.a.]
9. The site is located in the Modern and/or
Mediterranean/Spanish design district as specified on the
community design district map. To be in compliance with the
Community Design Plan the appropriate architectural features
and treatments shall be incorporated into the design of both
buildings. Find attached Appendix II of the Community
Design Plan which includes the architectural theme standards
and an evaluation of how the proposed buildings are
deficient from complying with the standards for the Modern
Design theme. [Community Design Plan Appendix II]

10. On the elevation view drawings of both buildings identify
the color, color number and manufacturer's name for the
following exterior finish materials, also including the
material required for the design theme treatments:
a. cross, sign,
b. coping, gutter, downspouts, window frames, door frames
swinging and overhead doors, and handrails.
c. recessed and/or raised band, entrance canopy and walls
[Community Design Plan Appendix II (d)]
11. Submit for review a landscape plan for the entire site that
is in compliance with the landscape code required
improvements and specifications, including the required
fifty (50) percent native species. I recommend purchasing a
Landscape Code from the Building Department. The site
landscape plan shall include the location, size and type of
species for all existing material, and specifications for
new material, such as; height, spacing, total count, species
(identity of 50% the native species), type and location of
lawn grass, grade of material, method of irrigation and
installation practices. The location standards and material
specifications for all required landscaping is identified in
the Landscape Code, such as; vehicle use area screening
(trees and hedges), parking area interior landscaping and
landscaping for dumpsters, etc.. Basically the landscaping
shown on sheets L-l and L-2 is supplemental landscaping and
is not specifically required by the code. This landscaping
enhances the project. However, the landscaping specified in
the Landscape Code is required to be installed. [Landscape
Code section 7.5-38]
12. The shared parking study has been revised to reflect the
construction of the education and gymnasium buildings.
However, the impact this new construction may have on the
current peak parking demand cannot be determined because
information is needed to evaluate the parking demand of all
after-school activities and other religious and non-
religious activities held during after-school hours.
Therefore, the following data and clarification needs to be
provided.
a. total number of school staff (cover page indicates 188
students and staff is mentioned, but no number given).
b. verification of total number of students (cover page
indicates 188 students and individual class sizes
provided on schedules indicate 182).
c. verification of fellowship hall gross (inside walls)
square footage (previous study indicates 4,350 square
feet and plans submitted indicate 5,350 square feet;
plans shall be revised if the figure of 5,350 is
inaccurate) .
d. maximum number of students, day(s) of the week and time
of day for each of the activities listed on the "use of
gymnasium" schedule (cover page indicates the gymnasium
may have other after school functions; these need to be
included, such as games, to evaluate against the
parking demand of the religious and non-religious
activities held after-school hours).

13. On the site plan numerically identify the parking spaces for
the entire site. Add to the site plan drawing the parking
tabulations using the ratios specified in the zoning code
for the uses for the entire project. with a distinguishable
symbol, indicate the parking spaces required for the
proposed new structure/uses. Combine the required parking
spaces for all uses and identify same as the total required.
Specify the total number of parking spaces allowed per the
previous approved shared parking allocation. Also, identify
the number of spaces provided per the previous approval.
With a distinguishable symbol, identify the total number of
parking spaces you are requesting the City to allow,
considering the new shared parking allocation. Specify the
total number of parking spaces provided as a result of the
new construction and proposed shared parking allocation.
Note: ensure that the total count of parking spaces shown
on the paving and drainage and site plan match and/or equal
the proposed shared parking tabulations. [Chapter 4 Land
Development regulation section 7.5.5]

1. This Department recommends the sanitary sewer main be
extended on site at least to the property.

be required within 30 days of Commission approval based
on the size of the new water meter, Sec. 26-34(e).
3. Backflow preventor on domestic water service to be
located near proposed water meter location (1st
connection after water meter), Sec. 26.107.
4. Proposed classroom exceeds maximum allowable distance
from existing or proposed fire hydrants, Appendix C,
Art. X, Sec. 16.
It is our recommendation that the plan not proceed through the

The data turned in to establish that the height of the
gymnasium does not exceed the twenty-five (25) foot height
limitation for the subject zoning district is incorrect.
The data did not use the overall height of the bUilding
which is five point thirty-five (5.35) feet higher than the
figures used in the data. To allow the structure to be
built at the proposed height will require a variance to the
zoning code. This type of variance is heard by the Board of
Adjustment. Applying for the variance by Hay 06, 1994 will
allow the Board determination to be made on June 20, 1994
which is the day prior to the conditional use approval being
presented to the City Commission. [Appendix A-Zoning
section 5 B.2.a.]

The site is lo~ated in the Modern and/or
Mediterranean/Spanish design district as specified on the
community design district map. To be in compliance with the
Community Design Plan the appropriate architectural features
and treatments shall be incorporated into the design of both

and an evaluation of how the proposed buildings are
deficient from complying with the Standards for the Modern

the color, color number and manufacturer's name for the

material required for the design theme treatments:

11. Submit for review a landscape plan for the entire site that
is in compliance with the landscape code required
improvements and specifications, including the required
fifty (50) percent native species. I recommend purchasing a
Landscape Code from the Building Department. The site
landscape plan shall include the location, size and type of

The shared parking study has been revised to reflect the
construction of the education and gymnasium buildings.
However, the impact this new construction may have on the
current peak parking demand cannot be determined because
information is needed to evaluate the parking demand of all
after-school activities and other religious and non-
religious activities held during after-school hours.
Therefore, the following data and clarification needs to be
provided.
a. total number of school staff (cover page indicates 188
students and staff is mentioned, but no number given).
b. verification of total number of students (cover page
indicates 188 students and individual class sizes
provided on schedules indicate 182).
c. verification of fellowship hall gross (inside walls)
square footage (previous study indicates 4,350 square
feet and plans submitted indicate 5,350 square feet;
plans shall be revised if the figure of 5,350 is

gymnasium" schedule (cover page indicates the gymnasium

SUMMARY: st. Joseph's Church and School, owner, through its agent,
Chapin and Armstrong, is requesting approval of a conditional use
and major site plan modification to add a 5,433 square foot
classroom building and a 13,272 square foot gymnasium to a
previously approved 14.68 acre church and school site. The
existing church and school is located and operating in zone R-1AAB,
single-family residential as approved by City Commission originally
in 1972 as a conditional use ~nd a 1988 expansion approved by the
City Commissi.on.
This request is being forwarded for review, consistent with Section
11.2 of Appendix A - Zoning and Chapter 4 of the Site Plan Review
Ordinance.
PROPOSED USE: The applicant is requesting to expand an existing
school by adding classrooms and gymnasium.

STANDARDS FOR EVALUATING CONDITIONAL USES: Section 11.2 D of the
Zoning Code contains the following standards to which conditional
uses are required to conform. Following each of these standards is
the Planning and Zoning Department's evaluation of the application
as it pertains to the standards.
The Planning and Development Board and City Commission
shall consider only such conditional uses as are
authorized under the terms of these zoning regulations
and, in connection therewith, may grant conditional uses
absolutely or conditioned upon the conditions including,
but not limited to, the dedication of property for
streets, alleys, recreation space and sidewalks, as shall
be determined necessary for the protection of the
surrounding area and the citizens' general welfare, or
deny conditional uses when not in harmony with the intent
and purpose of this section. In evaluating an
application for conditional use, the Board and Commission
shall consider the effect of the proposed use on the
general health, safety and welfare of the community and
make written findings certifying that satisfactory
provision has been made concerning the following
standards, where applicable:
1. Ingress and egress to the subject property and
proposed structures thereon, with particular reference
to automobile and pedestrian safety and convenience,
traffic flow and control, and access in case of fire
or catastrophe.
The site has two (2), two-way driveways leading to the on-site
parking area. The driveways are located on Seacrest Boulevard
and Swinton Avenue. An on-site sidewalk is located adjacent
to the Seacrest Boulevard entrance access aisle to allow
pedestrian access to the project.

2. Off-street parking and loading areas where required, with
particular attention to the items in subsection I above
,
and the economic, glare, noise, and odor effects the
conditional use will have on adjacent and nearby properties,
and the city as a whole.
As part of the 1988 expansion approval, a shared parking
allocation was approved. By code, the various principal uses
on site would require 265 parking spaces as follows: church-
75 spaces, existing school - 24 spaces, new classrooms - 12
spaces, parish hall - 44 spaces, fellowship hall - 44 spaces,
and new gymnasium - 133. The 1988 shared parking study has
been revised to include the new schedule (day and time) of
religious and non-religious activities and the new enrollment
(limited to 225 students and 28 staff). The study indicates
that the church sanctuary is primarily used for services on
Sundays and that the school operates on weekdays. Certain
other ancillary uses occur on Saturdays and weekdays, during
the daytime and evening hours.
The most significant difference in the new study results from
the gymnasium construction and its anticipated activities.
The peak parking demand will occur during use of the gymnasium
for games. Since there is no overlap of this use with other
activities, and therefore no buffer calculation required,
staff has determined that the minimum number of parking spaces
required is 133. The 133 parking spaces is the number of
spaces shown on the previous site plan modification in 1988.
The majority of the parking spaces are located interior to the
perimeter of the property, therefore not causing an adverse
effect on adjacent properties regarding noise, glare and odor.
3. Refuse and service areas, With particular reference to the
items in subsection I and 2 above.
Three parking spaces interfere with the proposed dumpster
location and must be moved to accommodate the turning radius
of the dumpster truck.
4. utilities, with reference to locations, availability, and
compatibility.
There are no utility concerns with the proposed new
construction.
5. Screening, buffering and landscaping with reference to
type, dimensions, and character.
A landscape variance is being requested of the Board for a
portion of the required vehicle use area screening (see
separate staff report). The majority of the landscaping shown
on their landscape plan is existing. New trees and hedges are
proposed for the perimeter of the gymnasium and new classroom
building.
6. Signs, and proposed exterior lighting, with reference to
glare, traffic safety, economic effect, and compatibility
and harmony with adjacent and nearby properties.
Additional parking lighting is not anticipated to conflict
with neighborhood harmony.

7. Required setbacks and other open spaces.
There are no problems with setback or open space requirements.
8. General compatibility with adjacent properties, and
other property in the zoning district.
The existing facility has not generated adverse comments. The
addition is not expected to change compatibility with adjacent
properties.
9. Height of buildings and structures, with reference to
compatibility and harmony to adjacent and nearby properties,
and the city as a whole.
A Board of Adjustment variance is being requested for an
additional six feet in building height in connection with the
new gymnasium and is scheduled to be heard June 20, 1994.
10. Economic effects on adjacent and nearby properties, and
the city as a whole.
No additional effect is foreseen.
11. Conformance to the standards and requirements which apply
to site plans, as set forth in Chapter 19, Article II of the
City of Boynton Beach Code of Ordinances. (New Chapter 4 Site
Plan Review).
Comliance of permit drawings with the attached staff comments
will provide conformance to the above-referenced requirements.
12. Compliance with, and abatement of nuisances and hazards
in accordance with the performance standards section 4 of
the zoning regulations; also, conformance to the City of
Boynton Beach Noise Control Ordinance.
No additional effect is foreseen. Existing situation meets
requirements.

After careful review of the attached site plans we determined that in order
for the planned Dumpster location to be acceptable, parking space numbers
65, 66. & 67 must be eliminated.
The calculated distance for the solid waste collection vehicle to maneuver
would be restricted with vehicles parked in these spaces, thereby creating
a potential hazard.
I f this can be done, we recommend approval, otherwise the existing cond-
ition is unacceptable.

The following is a list of comments regarding the second review of
the above-referenced project. It should be noted that the comments
are divided into two (2) categories:
The first category is a list of comments that identify unresolved
comments either from the first review or new comments as a result
of the second review. To show compliance with these comments will
not substantially alter the configuration of the site and the
design of the building.
The second category is a list of recommendations I believe will
enhance the aesthetics and function of the project.
All comments and recommendations can be rectified on the plans at
time of permitting considering that the site plan request is
approved. The applicant must understand that additional comments
may be generated upon review of the documents and working drawings
submitted to the Building Department for permits for the proposed

I. SITE PLAN REVIEW COMMENTS:

up-grade the existing vehicle use area/parking area to

Parking Lot Ordinance. Modify the site plan, landscape

for the project. Show and chronologically number no less
than 133 parking spaces in compliance with the parking
lot design standards. Also, show the 133 parking spaces
on the landscape plan and paving and drainage plan.
Sometime since issuing the permits to construct the
improvements shown on the site plan approved in 1988,
I (see Exhibit" A" ), the parking layout changed. The
. diagonal parking north of the gymnasium with 30 approved
spaces, now contains 19 spaces with the extra spaces
distributed throughout the site. The location of the
spaces violates city design standards which will require
the spaces to be relocated. These required spaces are
identified in comment number l(n) above. It is
recommended that the existing parking area north of the
gymnasium be reconstructed to accommodate the required
number of parking spaces.

required parking for the multi-use gymnasium as one (1)
parking space per one hundred (100) square feet of gross
floor area. Also, place a distinguishable symbol next to
the 133 required parking count that indicates the 133

shared parking study. Add to the parking data, two (2)
parking spaces required and provided for the residence.

II. RECOMMENDATION(S):
1. Enhance the entrance to the site by adding tree, hedge
and ground cover landscaping on both sides of each
driveway.
2. To lessen the impact of the 35 foot tall wall on the east

Shared Parking Allocation
Section 11-H(13) of Appendix A, Zoning, contains the following
provision for shared parking:
Parking spaces required in this ordinance for one use or
structure may be allocated in part or in whole for the required
parking spaces of another use or structure if quantitative
evidence is provided showing that parking demand for the
different uses or structures would occur on different days of the
week or at different hours. Quantitative evidence shall include
estimates for peak hour/peak season parking demand based on
statistical data furnished by the Urban Land Institute or an
equivalent traffic engineering or land planning and design
organization. Quantitative evidence may also include, where
appropriate, field studies and traffic counts prepared by a
traffic consultant experienced in the preparation of parking
studies. In addition, a minimum buffer of ten CIO) percent shall
be provided to ensure that a sufficient number of parking spaces
are available at the peak hour/peak season of parking demand.
Calculation of said buffer shall be based on the total number of
parking spaces determined to be required at the peak hour/peak
season of parking demand. Evidence for joint allocation of
required parking space shall be submitted to the Technical Review
Board, and approval of joint allocation of required parking
spaces shall be made by the City Commission, after review and
recommendations by the Planning and Zoning Board.
With respect to the above, Glen Harris of Peacock and Lewis
Architects and Planners, Inc., agent for St. Joseph's Episcopal
Church, is requesting approval of a shared parking allocation in

enlarged, the entire parking lot shall be modified to meet the
requirements of this article.1I In connection with the request
for approval of the fellowship hall, the applicant is also
requesting approval of a revised parking lot plan in order to
meet the design and landscape requirements specified in the
Parking Lot Regulations. The existing parking lot is
non-conforming with respect to the current Parking Lot
Regulations. The revised parking lot plan provides for 133
parking spaces, which is the same number that currently exists on
site.
With regard to the number of parking spaces required by the
Zoning Regulations for the church site, the requirement is listed
in Section 11-H(16)(b)(1) of Appendix A, Zoning, which reads as
follows:
Churches, temples, and other places of worship: One (1)
parking space per four (4) seats in the auditorium, but not
less than one (1) parking space per one hundred (100) square
feet of gross floor area for the auditorium, plus required
parking spaces for any other principal uses, including
offices, classrooms, meeting rooms, recreation facilities
and dwellings.

The church sanctuary contains 300 seats (not 150 as noted on the
site plan application) requiring the provision of 75 parking
spaces (1 parking space for every 4 seats). Based on information
submitted by Glen Harris, including but not limited to the
attached correspondence, the Planning Department has determined
that in addition to the church, the school facilities, the parish
hall and the proposed fellowship hall function as principal uses
and would require the provision of additional parking spaces.
All other uses listed in the attached correspondence were deemed
to be accessory uses to the church and/or school functions. In
accordance with Section ll-H(l6)(c)(5) of Appendix A, Zoning, the
parking requirement for the school (pre-kindergarten through
grade 8) is one parking space per 500 square feet of gross floor
area. The school classroom and administration facilities occupy
approximately 11,648 square feet of gross floor area. The
parking requirement for the school is 1l,648 divided by 500
equals 24 parking spaces. In accordance with Section
11-H(16)(b)(2) of Appendix A, Zoning, the parking requirement for
the parish hall and fellowship hall is one parking space per 100
square feet of gross floor area. The parish hall occupies
approximately 4,311 square feet. The parking requirement for the
parish hall is 4,3ll diviAed by 100 equals 44 parking spaces.
The proposed fellowship hall occupies approximately 4,350 square
f~e~. The parking requirement for the fellowship hall is 4,350
d~v~ded by 100 equals 44 parking spaces. The total combined
par~ing requirement for all principal uses (excluding the
res~dence which has separate parking spaces) is as follows:

Re: Shared Parking Allocation
The administration of St. Joseph is requesting that the City grant them the approval to use
the shared parking allocation as was granted in September of 1988. The proposed
construction of the education and gymnasium buildings will not increase the daily
enrollment, traffic or parking.
The education building consists of five (5) special classrooms: French, Spanish, Music,
Computer and Sacred Studies. These courses are presently being taught in existing smaller
or shared spaces and the teachers are members of the project staff. '

While the gymnasium may have other after-school functions, its.primary use will be for daily
physical education activities. This building also has folding bleachers which will seat 264
and be used for general school assemblies, and permit the entire school enrollment
(approximately 188 students plus staff) to assemble at the same time.
The administration will organize all after-school activities with the other religious and non-

schedule of activities, indicates that the church sanctuary
primarily used for services on Sundays and that the school
operates on weekdays. Certain other ancillary uses occur on
Saturdays and weekdays, during the daytime and evening hours.

documentation submitted. It was the consensus of the Technical
Review Board that there is sufficient on-site parking to

CONTENTS OF THE CONDITIONAL USE APPLICATION
II. CONTENTS OF THE CONDITIONAL USE APPLICATION. Application for
conditional use shall contain two (2) copies of the following
items:
a. Statement of the applicant's interest in the property to be
developed, including a copy of the last recorded Warranty
Deed, and a certificate from an attorney-at-law or a title
insurance company certifying who the current fee simple
title holders of record of the subject property are, and the
nature and extent of their interest therein, and
1. If joint and several ownership, a written consent to
the development proposal by all owners of record, or
2. If a contract purchase, a copy of the purchase contract
and written consent of the seller/owner, or
3. If an authorized agent, a copy of the agency agreement
and written consent of the principal/owner, or
4. If a lessee, a copy of the lease agreement and written
consent of the owner, or
5. If a corporation or other business entity, the name of
the officer or person responsible for the application,
and written proof that said representatives have the
delegated authority to represent the corporation or
other business entity, or in lieu thereof, written
proof that he is in fact an officer of the corporation.
b. Legal survey, prepared by a surveyor registered in the State
of Florida, showing an accurate legal description of the
subject property, and the total acreage computed to the
