Item No.1 - Fire Prevention A hydrant will be added on the southwest corner of the existing parking area. This will ensure that the new Building No. 12 will fall into this 200'-0" radius. Item No.2 - Parking There is no new parking in this proposed construction. The parking required from a City memorandum on shared parking dated 9/29/1980 and Memo No. 94-158 is 133 spaces. The existing off-street parking is 173 spaces (this includes the 31 parking spaces not yet complete under Permit No. 95-5261). Per the Florida Accessibility Code, six accessible spaces are required. There are six accessible spaces plus two spaces reserved for the elderly. We have again submitted for another zoning approval for the construction of a new library and arts building to be constructed in the area of one of two buildings which will be demolished if approval is granted. At an earlier informal meeting with Zoning, Jerome Milord was told that a major site plan review would most likely not be required since the building area would not increase the total site building area by more than 5% (it increases the area by less than 2%). We now know that this is not the case and have submitted for a major review by the March 29, 1996 deadline. Our original schedule was to submit for building permit and receive same by the last week in May. Demolition of existing Building No.7 and part of Building No.6 would begin at that time, enabling us to do this portion of demolition and the exterior shell of the new building while the students were home for the summer. The building would be complete by Christmas vacation and the move from the existing library to the new would be done at that time, as well as the remaining demolition of Building No.6. As you can see, it is a rather tight schedule but necessary so as not to interfere with the educational requirements of the administration. The plan review schedule, under normal procedures, will not allow us to obtain final approval until June 18, 1996. Assuming that we can apply for building permit concurrently Mr. T ambri Heyden City of Boynton Beach April 3, 1996 Page 2 with the zoning and site plan review, we will still lose three to four weeks in construction time. Is there an accelerated procedure that we could perhaps follow to obtain an earlier approval? If so, please advise me so we can follow this procedure for deadline dates. We will be submitting construction drawings for permit on a new Library/Arts building in the next few weeks. This building will be replacing existing Buildings Nos. 6 and 7, which will be demolished to make room for this new construction. We are hopeful that you will review this as a minor modification to the approved site plan which is on record. We believe that we meet the requirements listed in Section 9, Chapter 3 of "Master Plan Review of Boynton Beach." The respective items listed in 9-C are as follows: 1. New Building No. 12 area is 7,591 sq. ft. Areas of existing Buildings/Numbers 6 and 7 are 6,930 sq. ft. The total building area of all existing buildings is 57,156 sq. ft. The total building area of all buildings in the proposed plans would be 58,117 sq. ft. (this area includes the new library of 7,591 sq.ft, new washroom addition to Building No.5 of 300 sq. ft., and the demolition of Buildings Nos. 6 and 7). The increase of 961 sq. ft. represents an increase in area of 1.6%, which is far lower than the 5% allowable under this section. City of Boynton Beach Planning & Zoning March 21, 1 996 Page 2 2. The modification does not reduce the number of parking spaces or increase the number of students. The building is replacing two older buildings that would require extensive mechanical and physical repairs to provide a usable area. 3. This modification would meet all development standards of the zoning district. 4. The modification, in our opinion, would enhance the entire campus and have no adverse effect on the adjacent property. Note that the building is buffered from both streets by the existing buildings and new landscaping would be provided, as required for all new buildings by the City of Boynton Beach. 5&6. The proposed modification would meet the requirements and standards of the community design and comprehensive plans. 7. The proposed modification would still resemble the existing plan. The new building would be constructed in the same location as Building No.7. This would create a larger open courtyard after building No.6 is demolished. This courtyard, in addition to being landscaped, will allow the campus to be more easily supervised by staff and City since most of the educational buildings will have entrance doors facing the open area. I sincerely hope that you will view this request favorably and allow us to proceed without going through a major site plan review. Our present schedule is to have construction drawings in by mid-April so that permits can be issued by the end of May and the demolition of the buildings and major site work completed while the students are off for summer vacation. He expressed an interest in allowing a future expanding of the enrollment to 225 students. He agreed with my suggestion to address Traffic Performance Standards and Fair Share Road Impact Fees based on the increase over the 1988 base of 182 students. The increase in 43 students will result in 47 additional daily trips. The additional ancillary class rooms have the potential for adding students. For this reason, the Traffic Division requests that two conditions be placed on the project to assure that no additional traffic is generated. 1. The maximum of 225 students be a condition of the development order. 2. A Restricted Deed Covenant be placed on the property restricting the number of students to 225 students. Item 12.b - The school has informed us that it is anticipated that staff will be increased from 24 to 27 full-time positions and 1 part-time position. For your information, these increases are comprised of two (2) additional office staff and one (I) full-time and one (I) part-time teacher. Per your request we enclose a revised shared parking study, including the introduction memorandum, schedule for use of language rooms and sacred studies room, schedule for use of music room, schedule for use of computer room and schedule for school. The proposed construction of the education and gymnasium buildings is not intended to increase the daily enrollment, traffic or parking. The education building consists of five (5) special classrooms: French, Spanish, Music, Computer and Sacred Studies. These courses are presently being taught in existing smaller or shared spaces, and the teachers are members of the project staff. The school intends, however, to continue its efforts to bring enrollment back to the level at which it existed prior to the recent recession. Although current enrollment is at approximately 182 students and the existing shared parking arrangement provides for 188 students, it is anticipated that peak enrollment will result in a total student population of 225. Since this is an elementary school, and the students do not drive automobiles, the increased enrollment is expected to have little or no effect on the use of the parking facilities. While the gymnasium may have other after-school functions, its primary use will be for daily physical education activities. This building also has folding bleachers which will seat 264 and will be used for general school assemblies and permit the entire school enrollment (approximately 188 students currently, with expectations of up to 225 students in the future) plus staff (currently 24 with anticipated additional 2 office staff, 1 full time teacher and 1 part-time teacher for a total of 28) to assemble at the same time. The administration will organize all after-school activities with the other religious and non-religious activities to ensure that the existing parking will be adequate. See attached schedules are as prepared by St. Joseph's Episcopal School administration. The School and Church schedules are not expected to change from the current schedules. The projected future maximum student population of 225 is based upon a maximum of 25 students for each kindergarten class and a maximum of 20 students for each of the other classes. Joseph's Episcopal Church and School - COUS #94-002 Shared parking study Dear Mr. Ballerano: I am writing to you regarding your May 10, 1994 letter to Mr. Michael Haag (transmitted with the most recent resubmittal of plans for the above-referenced conditional use request) and a May 26, 1994 letter received May 31, 1994, by Mr. Haag from Dan Weisberg of Palm Beach County Traffic Division; specifically as these letters relate to shared parking. Please note that several of Mr. Haag's staff comments, listed under item 12 of his April 27, 1994, remain outstanding and/or are revised based upon the aforementioned letters received by Mr. Haag. These outstanding, shared parking comments are as follows: 1. Item 12.a - The total number of staff (24) was indicated on a May 4, 1994 letter from the school to Palm Beach County and was based on a student body of 182. The number of students/staff are not indicated for the cheerleading practice, pep rallies (also time and day are not indicated), drama class (also time and day are not indicated or does the after school, 3:15 - 5:30 p.m., during inclement weather note correspond to this?) and ballet class (also time and day are not indicated). In addition, games are not listed, including time, day and number of students/staff/guests. Therefore, the schedule for use of the gymnasium must be revised. This information is particularly important since actual sharing of parking and peak demand may be after school with weekday, religious functions. The sections addressed in the code are as follows: Sec. 7.5-35(d) Required landscaping adjacent to public rights-of-way. This request pertains only to the portion of the code that requires hedging, all the requirements for trees are met. The justifications are as follows: 1.This parking strip is 680. from the public right-of-way through a heavy stand of native pines. These parking spaces are not visible in the line of site from Seacrest Boulevard. These also are auxi11ary parking spaces that are rarely uta1ized. 2. The west section of this parking area is 12' above the crown of the road elevation. At this height above the road these parking spaces are not visible fron the public right-of-way (Swinton Avenue). Furthermore these spaces are rarely if ever uta1ized. Sec. 7.5-35(e) Perimeter landscaping relating to abutting properties 3. The parcel of land to the south of St. Joseph's is a preserved native scrub site. There are no inhabitants that would be viewing the vehicular use areas.On the southwest potion of the property the access road is 410 ft. from the south property line and the accessway is 4 ft.. below the existing elevation and not exposed to view. 4. The abutting properties on the north are residential and most have the rear yards fenced and hedged. The vehicular entrance road is 330 ft. from the north property line and through a heavy stand of pines and a playground. The abutting property on the south is undeveloped preserved native scrub. Hedging the accessway would serve no purpose. 5. The vehicular access road on the west end of the property is 180 ft, from the nearest neighbors and is obscurred by the exisiting vegetation. 6. This access road is 680 ft. from Seacrest Boulevard and is not visible through the stand of pines that seperates it from the road. This also is an access road to a rarely used parking area. Also enclosed is a copy of the Site Plan for the property showing the two (2) new proposed structures. You will note that the Conditional Use Application includes a copy of the shared parking allocation memorandum which details the traffic and parking plan for the project since its last construction project in September, 1988 and includes a schedule of Church activities (indicating the number of persons attending). We have also enclosed for your consideration a schedule of proposed uses for the new ancillary classroom building and the gymnasium. By way of summary and explanation, there are a total of One Hundred Eighty-Two 182 children enrolled in the school which is comprised of kindergarten through grade 8,. In addition, school staff is comprised of twenty-four (24) individuals. The traffic impact to date has been minimal inasmuch as many of the students are siblings or carpool with other students, since many of them come from the same neighborhoods. As you will note from the enclosed schedules, that the students from grades fifth through eighth have their days divided into eight (8) periods. Subjects such as French, Spanish, Sacred Studies, Music and Computer are currently conducted in rooms throughout the existing facility based upon vacancies so that, for example, sixth graders may be learning Spanish in a kindergarten classroom while the kindergarten students are out to lunch or at play outside of their classroom. The sole purpose of the new ancillary school building is to provide specific study and teaching areas for the existinq students who would otherwise attend these classes in various vacant rooms throughout the existing school buildings. They are, therefore, truly ancillary classrooms in that (a) there is no plan to increase the student population as a result of the addition of these new classrooms and (b) their use is specifically designed for the teaching of French, Spanish, Sacred Studies, Music and Computer. Where conformance with the County's Environmentally Sensitive Lands Ordinance is required, an Application for Alteration of Environmentally Sensitive Lands (Environmental Impact Study) must be submitted to the Palm Beach County Department of Environmental Resources Management (copy to City) prior to or concurrent with the submittal of the site plan to the City. 28. For projects that generate more than five hundred (500) net trips per day, a traffic impact analysis must be submittd which complies with the Municipal Implementation Ordinance of the Palm Beach County Traffic Performance Standards Ordinance. a. For projects that generate two thousand (2,000) or more net trips per day, the traffic impact analysis must be submitted to the City at least 60 days prior to the deadline for site plan approval, in order to allow for timely processing of the site plan application and review by the City's traffic consultant and Palm Beach County. The applicant shall be billed for the cost of review by the City's traffic consultant. b. For projects that generate between five hundred (500) and two thousand (2,000) net trips per day, the traffic impact analysis must be submitted at least 30 days prior to the deadline for site plan approval, in order to allow for timely processing of the site plan application and review by Palm Beach County. However, if it is the desire of the applicant to utilize the City's traffic consultant for review of the traffic impact analysis prior to review by Palm Beach County, then the procedure and requirements outlined under item "a" above shall be followed. A project shall not be forwarded to the Planning and Development Board unless the traffic report from the County is reviewed by the City Engineer and the Planning and Zoning Director so that they may formulate a recommendation for the reviewing authorities. [Chapter 19 section 19-87 (e) of the City Code of Ordinances] 5. Add to the site plan drawing the horizontal control dimensions for the parking area located west of the proposed gymnasium. The dimensions shall be consistent with City Standards (f;nd attached City Standard drawingB-90013). [Chapter 5 Article x] 6. Add, city standard curbing around the entire median located north and west of the proposed gymnasium. Also, add to the paving and drainage plan the City required curbing in all locations specified in Chapters 5 Article x section 5-142 (e) . 7. Add to the site plan drawing the overall dimensions of the inside of the dumpster enclosure (min. 10 feet by 10 feet). Also, specify the height, type of finish material and color of the walls. [Landscape Code section 7.5-35 (j)] 8. The data turned in to establish that the height of the gymnasium does not exceed the twenty-five (25) foot height limitation for the subject zoning district is incorrect. The data did not use the overall height of the building which is five point thirty-five (5.35) feet higher than the figures used in the data. To allow the structure to be built at the proposed height will require a variance to the zoning code. This type of variance is heard by the Board of Adjustment. Applying for the variance by May 06, 1994 will allow the Board determination to be made on June 20, 1994 which is the day prior to the conditional use approval being presented to the city Commission. [Appendix A-Zoning section 5 B.2.a.] 9. The site is located in the Modern and/or Mediterranean/Spanish design district as specified on the community design district map. To be in compliance with the Community Design Plan the appropriate architectural features and treatments shall be incorporated into the design of both buildings. Find attached Appendix II of the Community Design Plan which includes the architectural theme standards and an evaluation of how the proposed buildings are deficient from complying with the Standards for the Modern Design theme. On the eleva~ion view drawings of both buildings identify the color, color number and manufacturer's name for the following exterior finish materials, also including the material required for the design theme treatments: a. cross, sign, b. coping, gutter, downspouts, window frames, door frames swinging and overhead doors, and handrails. c. recessed and/or raised band, entrance canopy and walls [Community Design Plan Appendix II (d)] 11. Submit for review a landscape plan for the entire site that is in compliance with the landscape code required improvements and specifications, including the required fifty {50} percent native species. I recommend purchasing a Landscape Code from the Building Department. The site landscape plan shall include the location, size and type of species for all existing material, and specifications for new material, such as; height, spacing, total count, species (identity of 50% the native species), type and location of lawn grass, grade of material, method of irrigation and installation practices. The location standards and material specifications for all required landscaping is identified in the Landscape Code, such as; vehicle use area screening (trees and hedges), parking area interior landscaping and landscaping tor dumpsters, etc.. Basically the landscaping shown on sheets L-1 and L-2 is supplemental landscaping and is not specifically required by the code. This landscaping enhances the project. However, the landscaping specified in the Landscape Code is required to be installed. [Landscape Code section 7.5-38] 12. The shared parking study has been revised to reflect the construction of the education and gymnasium buildings. However, the impact this new construction may have on the current peak parking demand cannot be determined because information is needed to evaluate the parking demand of all after-school activities and other religious and non- religious activities held during after-school hours. Therefore, the following data and clarification needs to be provided. a. total number of school staff (cover page indicates 188 students and staff is mentioned, but no number given). b. verification of total number of students (cover page indicates 188 students and individual class sizes provided on schedules indicate 182). c. verification of fellowship hall gross (inside walls) square footage (previous study indicates 4,350 square feet and plans submitted indicate 5,350 square feet; plans shall be revised if the figure of 5,350 is inaccurate) . d. maximum number of students, day(s) of the week and time of day for each of the activities listed on the "use of gymnasium" schedule (cover page indicates the gymnasium may have other after school functions; these need to be included, such as games, to evaluate against the parking demand of the religious and non-religious activities held after-school hours). lor3 'S I. All property owners located within four hundred (400) feet surrounding the subject parcel shall be notified. b. The ownership of all surrounding properties as submitted by the applicant, shall be reviewed by the City Clerk, who shall notify the owners by regular mail of the date and purpose of the public hearing held in conjunction with the conditional use application. c. Notice of the pUblic hearing shall also be advertised in a newspaper published in the City at least ten (10) days in advanc~ of the hearing. d. At the public hearing held by the Planning and Zoning Board, evidence for or against may be presented. e. The Planning and Zoning Board may recommend approval, approval with modification or denial of the application subject to the standards provided in Ordinance No. 76-46. A written report of the Board's findings shall be forwarded to the City Commission. f. At a regular meeting, the City Commission may approve, approve with modification or deny the application subject to the standards provided in Ordinance No. 76-46. g. Each ~ application for conditional use approval shall be accompanied by a fee payable to the City of Boynton Beach as per the attached fee schedule. h. Each application for an extension in time of a conditional use approval shall be accompanied by a fee payable to the City of Boynton Beach for one hundred and twenty-five ($125) dollars. Such application shall be submitted to the Planning Director not less than 45 days prior to the expiration of the approval. PLANNING DEPARTMENT - APRIL 1991 A:CUse.app ( 4 ) CONTENTS OF THE CONDITIONAL USE APPLICATION II. CONTENTS OF THE CONDITIONAL USE APPLICATION. Application for conditional use shall contain two (2) copies of the following items: a. Statement of the applicant's interest in the property to be developed, including a copy of the last recorded Warranty Deed, and a certificate from an attorney-at-law or a title insurance company certifying who the current fee simple title holders of record of the subject property are, and the nature and extent of their interest therein, and 1. If joint and several ownership, a written consent to the development proposal by all owners of record, or 2. If a contract purchase, a copy of the purchase contract and written consent of the seller/owner, or 3. If an authorized agent, a copy of the agency agreement and written consent of the principal/owner, or 4. If a lessee, a copy of the lease agreement and written consent of the owner, or 5. If a corporation or other business entity, the name of the officer or person responsible for the application, and written proof that said representatives have the delegated authority to represent the corporation or other business entity, or in lieu thereof, written proof that he is in fact an officer of the corporation. b. Legal survey, prepared by a surveyor registered in the State of Florida, showing an accurate legal description of the subject property, and the total acreage computed to the nearest one-hundredth (1/IOO) of an acre (these two surveys are in addition to the surveys required on page 6 of this application, Sec. III.l9.). c. Vicinity map, showing the location of the subject property in relntion to the surrounding street system. d. Drawing showing the location of all property lying four hundred feet (400) adjacent to the sUbject parcel, and a complete list of the property owners' names, mailing addresses and legal descriptions. The owners of property shall be those recorded on the latest official County tax rolls. Such list shall be accompanied by an affidavit stating that to the best of the applicant's knowledge, said list is complete and accurate. PLANNING DEPARTMENT - APRIL 1991 A:CUse.app ( 5) III. SITE PLAN REQUIREMENTS The following materials are to be submitted in seven (7) copies. Each set of plans must be stapled together in a single package to submit 7 sets or packages of plans. Scale of drawings must be 200 ft. to the inch. For requests which require review by the Planning and Zoning Board, nine (9) sets or partial sets, comprised of only a site plan, landscape plan, typical floor plans and building elevations are required in addition to the seven (7) full sets mentioned above. For requests which do not require review by the Planning and Zoning Board, three (3) partial sets are required in addition to the seven (7) full sets. Incomplete site plans will not be processed. (check) 1. Boundaries and dimensions of the parcel. 2. Scale, graphic scale, north arrow, and date. 3. Adjacent properties or land uses. 4. Pavement edge and/or right-of-way lines for all streets, alleys, sidewalks, turn lanes, driveways and unimproved rights-of-way within one-hundred (100) feet of the site. Also, names of adjacent streets and rights-of-way. 5. Location of all proposed structures, and any existing structures that are to remain on the site. 6. Setbacks of all structures (over 3 ft. in height) from property lines. 7. Use of each structure, indicated on the site plan. 8. Number of efficiency, I-bedroom, 2 bedroom, etc., dwelling units in each residential structure, to be indicated on site plan. 9. Indication of height and number of stories of each structure. 10. Ihdication of structures, equipment, etc., above 45 foot height, including height in excess of 45 ft. 11. Floor plans or typical floor plans for all structures. 12. Finish floor elevations of all structures. 13. Uses within each structure, indicated on floor plans. 14. Elevations or typical elevations of all structures; including materials, surface treatments, and color scheme of all exterior surfaces, including roofs. 15. Indication of the numbers and types of recreational facilities to be provided for residential developments. 16. Indication on site plan of location, orientation, and height of all freestanding signs and wall signs. . 17. Location of walls and fences, and indication of their height, materials, and color. 18. A landscape plan, showing conformance with the Lundscape Code and Tree Preservation Code, and showing adequate watering facilities. Plants must be keyed out according to species, size and quantity. PLANNING DEPARTMENT - APRIL 1991 A:CUse.app ( 6 ) 19. A sealed survey, by a surveyor registered in the State of Florida, and not older than six (6) months, showing property lines, including bearings and dimensions; north arrow, date, scale, existing structures and paving, existing elevations on site, rights-of-way and easements on or adjacent to the site, utilities on or a~jacent to the site, legal description, acreage to the nearest one-hundredth (1/100) of an acre, location sketch, and surveyor's certification. Also, sizes and locations of existing trees and shrubs, including common and botanical names, and indication as to which are to be retained, removed, relocated, or replaced. - 20. Location of existing utility lines on or adjacent to the property to be indicated on the site plan, in addition to being shown on the survey. Also, location of existing fire hydrants on or adjacent to the site. 21. Location of additional fire hydrants, to meet standards set forth in Article X, Section 16 of the Subdivision and Platting Regulations. 22. Fire flow calculations justifying line size for both on/off site water lines. 23. Sealed engineering drawings for proposed utilities, as per City specifications. 24. Information regarding form of ownership (condominium, fee simple, lease, etc.). 25. Location and orientation of garbage cans or dumpster facilities. All garbage dumpsters must be so located to provide direct access for the City front-end loaders, and the dumpster area must be provided with adequate width and height clearance. The site must be so designed to eliminate the necessity for the front-end loader to back into any street. If any use requires the disposal of wet garbage, a ten foot by ten foot (10' x 10') concrete slab shall be provided. All dumpsters must be screened and landscaped in accordance with the City Landscape Code (see Sec. 7.5-35(i)). A minimum 10 foot wide opening is required for dumpster enclosures. 26. A parking lot design and construction plan showing conformance to the City Parking Lot Regulations, and including the following information. Any exceptions to the Parking Lot Regulations that are proposed or that are to continue will require an application for variance to the Parking Lot Regulations. a. Location of all parking and loading facilities. b. A parking lot layout plan, including curbs, car stops, and double striping. c. A cross-section of materials to be used in the construction of the parking lot. d. A lighting plan for the building exterior and site, including exterior security lighting, and lighting for driveways and parking lots; to include the location of lighting standards, direction of lighting, fixture types, lamp types and sizes, and average illumination level(s) in footcandles. PLANNING DEPARTMENT - APRIL 1991 A:CUse.app (7 ) e. Information showing conformance with the City Street and Sidewalk Ordinance, including construction of sidewalks along adjacent pUblic stree'ts. f. Location of existing and proposed public and private streets, including ultimate rights-of-way. g. On-site traffic plan, including arrows and other pavement markings, traffic signs, and stop signs at exits. h. Location of handicap parking spaces, plus signs and access ramps, consistent with the State Handicap Code. i. A drainage plan for the entire site, including parking area; to include finish grade and pavement elevations, drainage calculations, and details of the drainage system. If the total impervious area on site exceeds twenty-five thousand (25,000) square feet, then drainage plans and calculations must be prepared by an engineer registered in the State of Florida, and must be sealed. Percolation tests must be provided with drainage calculations. j. Existing elevations on adjacent properties, and on adjacent rights-of-way. 27. Where conformance with the County's Environmentally Sensitive Lands Ordinance is required, an Application for Alteration of Environmentally Sensitive Lands (Environmental Impact Study) must be submitted to the Palm Beach County Department of Environmental Resources Management (copy to City) prior to or concurrent with the submittal of the site plan to the City. 28. For projects that generate more than five hundred (500) net trips per day, a traffic impact analysis must be submittd which complies with the Municipal Implementation Ordinance of the Palm Beach County Traffic Performance Standards Ordinance. a. For projects that generate two thousand (2,000) or more net trips per day, the traffic impact analysis must be submitted to the City at least 60 days prior to the deadline for site plan approval, in order to allow for timely processing of the site plan application and review by the City's traffic consultant and Palm Beach County. The applicant shall be billed for the cost of review by the City's traffic consultant. b. For projects that generate between five hundred (500) and two thousand (2,000) net trips per day, the traffic impact analysis must be submitted at least 30 days prior to the deadline for site plan approval, in order to allow for timely processing of the site plan application and review by Palm Beach County. However, if it is the desire of the applicant to utilize the City's traffic consultant for review of the traffic impact analysis prior to review by Palm Beach County, then the procedure and requirements outlined under item "a" above shall be followed. NOTE: Failure to submit traffic impact analysis in the manner described above may delay approval of the site plan application. PLANNING DEPARTMENT - APRIL 1991 A:CUse.app ( 8 ) 29. In addition to the above requirements, the fOllowing items shall be submitted to the Planning Department no later than the site plan deadline: a. One copy of colored elevations for all buildings and signage to be constructed on site. These elevations must be of all sides of each type of building and signage proposed and the colors proposed must be accompanied by a numerical code from an established chart of colors. Elevations must also include information related to building materials. All elevations must be submitted on 24" x 36" drawings. Buildings constructed will be inspected on the basis of the elevations submitted to the City and approved by the City Commission. Failure to construct buildings consistent with elevations submitted will result in the Certificate of Occupancy being withheld. b. A transparency of the site plan (maximum size of 8-1/2" x 11"). At the discretion of the applicant, the Planning Department will prepare transparencies from the site plan document. However, the Planning Department will not be responsible for poor quality transparencies which result from the submission of poor quality site plan blueprints, and poor quality transparencies will not be presented to the Planning and Zoning Board or City Commission. c. Colored photographs of surrounding buildings (minimum size 8" x lO"). 30. Any other engineering an/or technical data, as may be required by the Technical Review Board to determine compliance with the provisions of the City's Code of Ordinances. Any of the above requirements may be waived by the Technical Review Board, if such information is deemed to be non-essential by the Board. PLANNING DEPARTMENT - APIUL 1991 A:CUse.app ( 12) NOTICE TO APPLICANTS Effective October 12, 1984, the procedures for processing site plans for Community Appearance Board review have changed. In this regard, please read the following procedures completely and carefully and comply with all items, or you plans will not be approved in the standard 21 day format. On Friday (or Thursday in the instance of a holiday) preceding the Planning and Zoning Board. regular meeting, the applicant shall submit to the Community Appearance Board Secretary, between the hours of 8 a.m. and 5 p.m. only, the following documents: 1. An original of the Community Appearance Board application filled out completely and legibly, and if the legal description is lengthy, it may be attached as an exhibit. 2. Three sets of the proposed landscaping plans, building elevat.Lons and tree survey when required. 3. A copy of the Technical Review Board staff comments to include a location map. These documents will be available in the Office of the Planning Director by 8 a.m. on the above-referenced Friday or Thursday in the instance of a holiday. Those applicants requesting relief from any section of the landscaping code must complete an application for Appeal of Administrative Decision. This form must be filled out completely and legibly to include the Administrative Official's explanation of justification. This form must be submitted in addition to all documents listed above and in the same time frame. Applications for Community Appearance Board review and for an Appeal of Administrative Decision are available from the Deputy Building Official or Community Appearance Board Secretary. PLANNING DEPARTMENT - APRIL 1991 A:CUse.app (14) SOLID WASTE CONTAINERS 1. All dumpsters should be placed on a concrete pad ten (10) feet wide with an appropriate depth and be screened on three (3) sides. Ref: Boynton Beach Code (Environmental Regulations) 2. Collections and Removal of Solid Waste: (a) Frequency of solid waste removal - the owner or tenant of any premises, business establishment or industry is responsible for the satisfactory removal of all solid wastes accumulated by him on his property or his premises. Excepting disruptions in normal collection schedules, garbage should be collected a minimum of two (2) times a week. More frequent removal may be required. PLANNING DEPARTMENT - APRIL 1991 A:CUse.app ~OTICE TO APPLICANTS FOR A~ .ROVAL OF LAND (17) DEVELOPMENT ORDERS OR PERMITS Please be advised that all applications for the following land development orders and permits which are submitted on or after June 1, 1990 will be subject to the City's Concurrency Management Ordinance, and cannot be approved unless public facilities (potable water, sanitary sewer, drainage, solid waste, recreation, park, and road facilities) would be available to serve the project, consistent with the levels of service which are adopted in the City's Comprehensive Plan: - Building permit applications for the construction of improvements which, in and by themselves, would create demand for public facilities. - Applications fer site plan approval. - Applications for conditional use approval. - Applications for subdivision master plan approval. - Applications for preliminary plat approval. - Applications for final plat approval. Applications for rezoning to planned zoning districts. - Applications for revisions to any of the applications listed above, which would increase the demand for any public facility. - Any other application which, in and by itself, would establish the density or intensity of use of land, or a maximum density or intensity of use of land. * Applications for development orders and permits submitted after February 1, 1990 and which generate more than 500 net vehicle trips per day, must comply with the Palm Beach County Traffic Performance Standards Ordinance, unless exempt from that ordinance. Please be advisee, however, that the following applications will be exempt from the Concurrency Management Ordinance, pending final approval of this ordinance by the City Commission: - Applications for the development of property which was platted on or after January 13, 1978 and either the final plat or the preliminary plat and Palm Beach County Health Department permit applications were submitted or approved prior to June 1, 1990, and the use of the property is consistent with the general use which was intended for the property at the time of platting. - Applications for the development of property which was platted prior to January 13, 1978, the area of the platted lots does not exceed 2 acres, and the proposed use would not generate more than 500 net vehicle trips per day. - Applications for building permit, if a site plan or conditional use application was submitted prior to June I, 1990 and subsequently approved, and the site plan or conditional use has not expired. - Applications for the development of property within an approved Development of Regional Impact, and which are consistent with the approved DRI. - Applications f.)r approval of final plats, if the preliminary plat and application for Palm Beach County Health Department permits for utilities have been submitted prior to June 1, 1990. - Applications for revisions to previously approved development orders or permits, which do not increase the demand for any public facility. Please be advised that these exemption rules are tentative and will be subject to final approval by the City Commission. PLANNING DEPARTMENT - APRIL 1991 A:CUse.app (18) NOTICE TO APPLICANTS FOR SITE PLAN, CONDITIONAL USE, PLANNED ZONING DISTRICT, SUBDIVISION, OR OTHER APPROVALS RE: Plans, Elevations, and Other Documents Submitted at City Commission and Board Meetings Any documents prepared by applicants which are distributed at the public meetings must be provided, at a minimum, in the following quantities in order to allow each Commission or Board member to have a copy, as well as the City Manager, City Attorney, and Recording Secretary, Planning Director, and Building Official: City Commission: 10 copies Planning & Zoning Board: 12 copies Community Appearance Board: 12 copies Also, for any site plans, master plans, and elevations which are submitted for the record at Commission or Board meetings, and which are revisions to plans or elevations which were previously submitted to the City, six (6) copies of the revised plans or elevations must be subsequently submitted to the Planning Department. Furthermore, any colored elevations which are exhibited to the Boards or Commission which are different from those which were previously submitted must be submitted to the Building Department so that the building color and elevations can be inspected prior to the issuance of a Certificate of Occupancy. These measures will allow the City to have an accurate record of the project as it was approved by the Commission or the Boards, and will allow for the efficient inspection of the project.
