RIDER TO SITE PLAN APPLICATION
The undersigned as applicant for Final Site Plan Approval does
hereby acknowledge, represent and agree that all plans,
specifications, drawings, engineering, and other data
submitted with this application for review by the City of
Boynton Beach shall be reviewed by the various boards,
commissions, staff personnel and other parties designated,
appointed or employed by the City of Boynton beach, and any
such party reviewing the same shall rely upon the accuracy
thereof, and any change in any item submitted shall be deemed
material and substantial.
The undersigned hereby agrees that all plans,
specifications, drawings, engineering and other data which may
be approved by the City of Boynton Beach, or its boards,
commissions, staff or designees shall be constructed in strict
compliance with the form in which they are approved, and any
change to the same shall be deemed material and shall place
the applicant in violation of this application and all
approvals and permits which may be granted.
The applicant agrees to allowing the City of Boynton
Beach all rights and remedies as provided for by the
applicable codes and ordinances of the City of Boynton Beach
to bring any violation into compliance, and the applicant
shall indemnify, reimburse and save the City of Boynton Beach

Dear Mr. Willard:
We have reviewed your request for a waiver of the replatting requirement for the portion of Lots 46-A and
47-A at Quantum proposed for use by the Flowers Distribution Center. Because of its simplicity we hereby
waive submission of a replat for that lot, subject to full compliance, however, with all other provisions of the
City's Land Development Regulations including, but not limited to, Chapters 1, 1.5,2,6, 7, 20, 21, 22 and 23
as well as the City's Code of Ordinances and all other applicable rules and regulations. This waiver does not
apply to any reconfiguration of property within the City of Boynton Beach except this single lot.
A building permit(s) will be issued promptly upon written acceptance by the Director of Planning and Zoning
and Director of Development of all conditions as yet unsatisfied in the site plan review process, plus the
following:
I. Certified statement that no restrictive covenants exist on the land.
2. Certified statement that no buildings or structures will be placed on any easements or setbacks.
3. Dedication of a 5 foot wide limited access easement (L.A.E.) along Park Ridge Boulevard.
4. Certified statement from design engineer that drainage complies with all City codes and
standards.
5. Certified statement that all development and construction will comply with all laws,

Center, Quantum Park
Dear Bill:
Pursuant to our meeting yesterday in Boynton Beach, this
letter will serve as the formal request on behalf of Quantum
Associates, as owner, as well as First Eagle Developments, Inc. as
purchaser/developer, for a waiver of the replatting requirement
associated with the proposed sale by Quantum Associates to First
Eagle Developments, Inc. of the land proposed for the Flowers
Bakery Distribution Center. The legal description of the subject
property (being a portion of Lots 46A, 47A and 47B) is attached
hereto as Exhibit "A".
This waiver is requested under the provisions of Chapter 5,
Article II, Section l(B) of the City Land Development Regulations.
We believe the waiver is appropriate, in this instance, for the
following reasons:
1. The development site is already platted and is of
sufficient size and dimensions to qualify for a legal
building site in the PID zoning district.
2. No additional road right-of-way or other infrastructure
or easements need to be dedicated as part of the
development of this site.
3. Existing improvements are available in the right-of-way
of Park Ridge Boulevard to serve the site, and waiver of
the requirements for replatting would not conflict with
the purpose and intent of Chapter 5 of the LDR.

At Carrie Parker's suggestion, I spoke this morning with Jim ,
Cherof, Boynton Beach city Attorney. Jim was sympathetic to your
permitting difficulties and as a result of my discussion, offered
the following advice:
1. He agrees that it appears we can be exempted from the
platting requirement under Article II of Chapter 5 of the
Land Development Code. Pursuant to Section 3 of Article
II, the decision can be made by the Director of
Development, Bill Hukill. Jim Cherof will speak to Bill
and advise him of this issue. Therefore, since I will be
on vacation next week, Bill Hukill will be expecting a
phone call directly from you. His phone number is
407/375-6371.
For your information, the basis for the waiver is Article
II, Section l(B), which stat~s "The resubdivision of land
heretofore platted is of such simplicity or surrounded by
such development as to justify the waiving of the
requirements for preparing a replat".
2. With respect to ISO-foot driveway spacing, it will be
necessary to file a variance application. Jim Cherof
will research what type of application for a variance is
required and whether it can be submitted directly to the
City Commission or needs to go before the Board of Zoning
Appeals. I told him we would much prefer going directly
to the City Commission, but would await his advice. He
will also some direction to Bill Hukill regarding this
issue also. Therefore, you should confirm with Bill
Hukill that he spoke to Jim Cherof regarding the
appropriate variance request procedure.
Based on the site plan which you sent to me (which I
explained over the phone to Jim Cherof), Jim thought that
there was sufficient basis for the variance to be
granted, and in fact, expressed dismay that staff had not
already told you the best way to overcome this obstacle.
It certainly does not appear to me, from examining your
site plan, that there will be any conflicting turning
movements or traffic concerns caused by your proposed
driveway design.
Because I will be out-of-town next week, please deal directly
with Bill Hukill. If necessary, you may call Jim Cherof, City
Attorney, who is sometimes at City Hall or is otherwise in his
office in Ft. Lauderdale, the phone number of which is 305/771-
