Dear Mr. Rumpf:
Please find enclosed an estimate of cost for landscape improvements that the City is requesting
for the area west of the western buffer wall on the above mentioned project. Due to time
constraints associated with receiving the Certificate of Occupancy, the owner is willing to
provide a cash performance surety in lieu of the completed work in the hopes that some
resolution can be worked regarding what exactly is required for this buffer. At this time the cost
estimate will include all plantings as shown on the plan, a sod strip and irrigation, although we
do not feel all this is warranted for this area. Please let me know if you have any questions or
ne additional information regarding this matter.

Dear Mr. Nguyen:
The purpose of this letter is to inform you of a discrepancy that occurred on the above mentioned
project with regard to the Littoral Zone Planting Plan around the lake area. Cotleur & Hearing Inc.
provided the Common Area Landscape Plans and there were 27 Cypress trees proposed for the lake
bank areas on Sheet L-l through L-6 of the plans. These plans were prepared by our office in
September 1997 with the final revision of January 6, 1998. After these plans were prepared we then
prepared Littoral Zone Planting Plans specific for the lake banks on January 13, 1998.
The Littoral Zone Planting Plans not only proposed aquatic planting at the edge of water but also
proposed Cypress and Wax Myrtle trees on the lake banks. It was intended that these Littoral Zone
Planting Plans supersede the planting shown in this area on the Common Area Landscape Plans and
therefore, the 26 Cypress trees that are proposed on the lake banks on the Littoral Zone Planting Plans
supersede the 27 Cypress trees that were proposed on the Common Area Plans. Hopefully, this clears

Dear Mr. Codeur:
Your request to modify the Via Lugano site plan to remove landscaping along the west side of
the west buffer wall has been reviewed, and is eligible to be processed administratively through
the permit process, beginning with the updating of your permitting plans (assuming that tree
species are relocated to the opposite side of the wall and not omitted). However, your proposed
plan excludes an explanation of surface material to remain to determine finished appearance and
maintenance needs (which are required to be shown on the approved site plan). An
approximately 6-foot wide strip ofland exists between the wall and property line. City Code
requires that all surfaces consist of approved materials, (e.g. sod) and depending on material
used, the code requires proper maintenance including irrigation of plant materials. Please realize
that I am assuming that the proposed revision will not negatively impact the appearance nor
value of the project, nor negatively affect adjacent properties. I would suggest that you indicate
on the revised plans the specific surface material proposed, and maintenance requirements. City
regulations will not allow it to be left unimproved, nor mulched. Please revise plans accordingly.
If final approval is needed prior to the time required to complete the said improvements, the city
will accept cash performance surety in lieu of completed work prior to issuance of a final
certification of occupancy. Please contact Jim Nyugen at (561) 742-6260, regarding the plan

Modifications to the Approved Landscape Plans on the
Western Buffer of the Project

Dear Mr. Nguyen:
As per our telephone conversation today, this letter is intended to inform you that a change has
been made to the proposed landscaping for the above-mentioned project. A total of 10 Sabal
palms, 7 canopy trees and 78 #1 gallon vines will not be installed within the western buffer area
ofthe project. The owner of the project has decided that he did not want to have plants installed
on the west side of this wall due to the fact that there is no irrigation proposed on that side of the
wall and maintenance of these plants would be very difficult once the project to the west is
developed. Also, at the time the project to the west is developed, it will be their responsibility to
provide buffer landscaping and it will be much easier for that development to maintain this
landscaping. The area in question is shown on sheets #L-5 and #L-6 of the approved Landscape
Plans prepared by our office, last revised January 6, 1998. For your records I have also included
a copy of these two plan sheets and have highlighted the trees that were not installed. Please let
