VIA LUGANO PUD
The Via Lugano PUD project received its Master Permit on April 22, 1998. During the course of
the application and review process, Mr. Tom Cavanaugh, Vice President ofP.A.C. Land
Development Corporation (the applicant), has indicated several times that he will present the
requested "Control Documents" for the PUD. He was unable to produce these documents, other
than his company's partnership document, which was found to be insufficient as a recordable
document for the PUD. He said that he is not aware of any other document which will serve the
purpose. During their negotiations with the seller of the property (land), P,A.C. has not dealt
with an entity resembling a Master Homeowners Association in control of all common areas of
the PUD. P.A.c. has agreed to purchase the property as an independent "subdivision."
After comparing my fIndings with Michael Pawelczyk, I came to the conclusion that there is a
distinct possibility such "Control Documents" (i.e., covenants for the entire PUD) do not exist
now, although they may have existed some fIfteen years ago when the PUD was formed.
This raises the question of whether the PUD actually exists today. Via Lugano is composed of
three neighborhoods, According to Mr. Cavanaugh, one of these neighborhoods has a
homeowners association, others do not.
I think the subject warrants a "due diligence" investigation. Unknown to the City, the PUD may
have been dissolved and the change of status never recorded. If so, the properties involved may
have to be rezoned, possibly as multi-family. -

This office received a copy of a letter written to you by Tom Cavanaugh, Vice-President of
P.A.C. Land Development Corporation. In this letter dated April 8, 1998, he makes a clear
misstatement of fact. He says, "1 have been speaking with Mike Pawelczyk of the City
Attorney's office, and 1 believe he has agreed with me that a unified control document is not
necessary." It is true that 1 have spoke with him on the telephone for about three minutes, but
never did 1 render an opinion on whether unified control documents are necessary. Mr.
Cavanaugh can "believe" what he wishes, but no member of this office will render an opinion
without first being presented with the facts and circumstances of a matter, including all plans,
correspondence, memoranda, and otherwise. 1 indicated this to Mr. Cavanaugh during our short
telephone conversation. As of this date, I have not been presented with such information, nor has
a legal opinion been requested.

In regards to Tom Cavanaugh's letter received March 11 th, Planning and Zoning's Via Lugano
land development permit comments were generated February 20th. Therefore, I am the one who
is amazed as to why Mr. Cavanaugh doesn't understand that sign-offs don't occur until comments
are addressed. However, to get closure, we have taken it upon ourselves to modify his drawings
and have now signed-off on his land development permit. I can only hope that there will be no
future repercussions in having done this.

Dear Jerzy:
On behalf of P.A.C Land Development we are pleased to submit to the City revised plans
addressing the comments from the September 29, 1997 Technical Review Committee
(TRC) meeting. The plans submitted are construction level documents and thus, contain
a very high level of detail as was discussed at the Technical Review Committee meeting.
To assist the City staff please find below our response to each of the respective
departmental comments together with the actions taken to address each comment. The
responses are organized in the same manner as each of the departmental responses.
Police Department Memorandum No. 97-0055 (Sgt. Marlon Harris)
1 a. The proposed access onto Congress Avenue was resolved by the City
Commission by way of the approval of the Master Plan Amendment to the PUD.
1 b. As recommended by the Technical Review Committee, the applicant has revised
the plans to reflect the access on Sandalwood to be both ingress and egress.
1 c. We agree that the security gates for Via Lugano should comply with the
guidelines and standards set forth by the Boynton Beach Fire Department. The
plans have been modified accordingly. For further information refer to the
construction specification located on Sheet L-20.

Public Works Department Memorandum #97-234 (Mark Lips)
1. We agree, no further action required.
Department of Development Memorandum No. 97-253 (Michael Haag)
Building Division
1.
A note has been added on Sheet SP-1 indicating that a handicap accessible
route from Congress Avenue to entrance of each building, including recreational
buildings, shall be provided in accordance with Section 4.1.2"1 (1) thru (4) of the
Florida Accessibility Code for Building Construction. An accessibility plan has
been prepared to demonstrate compliance.
2.
A note has been added on Sheet SP-1 indicating that a handicap accessible
route between each handicap parking space and the entrance to each building
and recreational amenity is provided.
3.
A special plan has been prepared to demonstrate compliance with this provision.
4.
The applicant has applied for a variance to Article IV. Section. D. of the sign code
to allow the maximum height to exceed 6'. In the case of the Via Lugano project
the sign walls are an integral part of the projects entrance feature. In order to
achieve the desired architectural and artistic character of the proposed entrance,
a height of greater than 6' is essential.
5.
We agree that the sign code specifies that the maximum sign area for each sign
wall should not exceed 32 square feet. The actual dimension of the signage
lettering proposed is less than 10 square feet.
6.
We agree. Only two sign walls at the project entrance are proposed. Free
standing sign at the corner of Sandalwood and Congress has been omitted.
7.
Sheets 5 and 16 of 18, "Paving and Drainage Plans," shows the handicap
accessible route and the Florida Accessibility Code for Building Construction, with
relevant notes, is specified.
8.
Details of a curb cut and ramp have been added to Sheet 7 of 18 "Paving and
Drainage Details."

Engineering Division (Sebastian J. Puda and Kenneth R. Hall)
1. All relevant permits shall be submitted with the application for the Building Permit.
2. A copy of the Engineer's Certification Letter on drainage is attached.
3. A copy of Palm beach County right-of-way permit will be submitted with the
application for the building permit.
4. As requested, the locations of proposed site lighting have been provided on the
engineering and site plan.
5. The locations of stop bars and stop signs at all intersections have been provided
on the engineering and site plans.
6. Details of signage and striping plan of the entrance from Congress Avenue is
shown on Sheet 9 of 18 "Congress Avenue Modification."
7. We disagree. The approved Melear PUD Master Plan provides for a single
sidewalk on the north side of Sandalwood Drive.
8. Notes to regrade the swale on Sandalwood Drive have been added to Sheet 5 of
18 "Paving and Drainage Plans."
9. A typical section of lake bank slopes is shown on Sheet 7 of 18 "Paving and
Drainage Details."
10. Typical details of handicap and regular parking is shown on Sheet 7 of 18
"Paving and Drainage Details."
11. A modification to the previously issued excavation permit application will be
applied for.
12, As discussed and agreed to at the Technical Review Committee meeting, this
provision is not acceptable for this type of project.
13. Circulation and parking will be in compliance with the Palm Beach County
Thoroughfare Plan and Traffic Performance Ordinance.
14. Plans for the Congress Avenue access point and median modifications will be
permitted through Palm Beach County.
15. Unified Control Documents will be provided prior to building permit.
16. Pavement markings as requested for Sandalwood Drive are shown on Sheet 2 of
18 "Striping/Dimension Plans."

Recommendation:
1. It is the developers experience that greater liability exists with cars encroaching
onto sidewalks than the trip hazards associated with concrete wheel stops.
Wheel stops have been retained adjacent to the sidewalks.
Recreation and Park Memorandum (Kevin John Hallahan)
1. Landscape and irrigation drawings for the medians adjacent to the Melear PUD
from the Miner Road to the L-21 Canal have been prepared. The landscape
design is similar to that proposed from Congress Avenue between Miner Road
and Hypoluxo Road.
2. We agree, permit shall be obtained from Palm Beach County for the required
work within the Congress Avenue right-of-way.
Recreation and Park Memorandum #97-456 (John Wildner)
1. We agree. A cut-sheet of the proposed play equipment located within the tot lot
is enclosed herein.
Utilities Department Memorandum No. 97-318 (John Guidry)
1.
As requested, all utilities easements known as of this date have been shown on
the landscape development plans. In addition, trees other than palm trees have
been located so they are outside and will not interfere with utility services or
public rights-of-way. Notes regarding the same have also been added to the
plans.
2.
Department of HRS permits will be processed through the Utilities department in
the usual manner.
3.
Fire flow calculations will be submitted with the HRS permit submittal.
4.
The capacity reservation fee will be paid with the initial plan submittal and HRS
permit application.
5.
The utilities easements will be shown on the plat and submitted along with the
engineering plans and HRS permit application.
6.
The Water Plans Sheets 11, 12 and 13 of 18 show that all points on each building
will be within 200 ft. of an existing or proposed fire hydrant. All hydrants, both
existing and proposed are shown.

9. Backflow preventers are shown on the fire sprinkler lines. Fire Sprinkler Piping
Plans will be submitted together with the engineering plans and HRS permit
application.
10. City water will not be used for irrigation.
13. An engineer's written certification that drainage will conform with all the rules of
the City and the S.F.W.M.D. will be issued upon receipt of the permit from
S.F.W.M.D.
14. Preliminary discussion with the County indicates that a turn lane is not warranted.
Formal documentation will be provided during the permitting process.
Fire Prevention Division Memorandum No. 97-302 (William D. Cavanaugh, FPOI)
1. The proposed entrance to Via Lugano on Congress Avenue has been designed
in keeping with the requirements provided by the Fire Prevention Department. A
minimum 45' radius have been provided and are shown on the site plan to
accommodate the Fire Departments ladder trucks. Additionally as requested,
both an ingress and egress have now been provided on Sandalwood Drive.
2. We agree, the security gates will comply with the City of Boynton Beach
September 25, 1996 memorandum in reference to the same. Notes and
specifications have been added to the plans to accommodate this requirement.
Planning and Zoning Department Memorandum #97-489 (Jerzy Lewicki)
1. We agree. This comment however is not applicable to the Via Lugano project
since no roof top equipment is proposed. All a/c units will be ground located and
appropriately screened as shown on the landscape plans.
2. We agree. The subject property will be platted prior to the issuance of the first
building permit in accordance with LOR, Chapter 5. Article 1.
3. The applicant wishes to further discuss this requirement with the Planning and
Zoning Department. The landscape plans have been prepared at a scale greater
than that of the site plans so that additional information could be provided. The
plans have been drawn utilizing computer aided design, thus they are an exact
replication of the site plan. It is our opinion that the scale of the plans that have
been drawn are most appropriate for both construction and holistic review of the
project. If the Planning Department so desires, a plot of the landscape plan at the
same scale of the site plan could be provided for demonstrative purposes. From
a constructibility perspective however, this would be impractical. We would
request the Committee's further consideration.

4. We agree. All existing and proposed property easements have been added to
the landscape plan. Proposed parking lot lighting fixtures have also been
included.
5. A rectified Master Plan pursuant to LOR, Chapter 3, Article IV, Section 3 was
submitted to the Planning Director in early October.
6. All canopy trees have been removed from the 20' wide utility easement along
Congress Avenue. Additionally, notes have been provided on Sheets L-1, L-2,
and L-3 to ensure that trees are not planted within the utility easements.
7. On the site plan all proposed and required setbacks have been provided.
8, We agree. The revised site plan provides for both ingress and egress from
Sandalwood Drive.
9. We agree. As requested the number of parking spaces in each group have been
provided.
10. As requested, the proposed earth berming as shown on the Master Plan has
been reflected on the landscape plans. These grades are also reflected on the
engineering plans.
11. Traffic control markings within the vehicular use areas are shown on the
engineering plans in accordance with LOR, Chapter 4, Section 7.B.2.
12. We agree. Prior to the Planning and Development Board meeting a sample
board containing samples of all exterior building materials to be used from
construction will be provided in accordance with LOR, Chapter 4, Section 7.0.
13. We agree. Colored elevations of the proposed buildings have been previously
provided to the Technical Review Committee. Colored elevations of the project's
entrance and signage will be provided at the Planning and Development Board
meeting.
14. The proposed signage for the project is delineated on the landscape and
hardscape construction plans. Additionally, the proposed building sign age has
been provided as part of this resubmittal.
15. The architectural plans have been amended to reflect the building height of all
buildings as required by the code.
16. The architectural plans have been amended to reflect the color code and
manufacturer of all exterior finishes on the buildings and structures in accordance
with LOR, Chapter4, Section 7.0.

17. We agree. Notes have been added to the plans to indicate that the finishes on
the exterior walls will match the proposed buildings in accordance with LDR,
Chapter 9, Section 10.E.
18. Concurrent with this resubmittal, the applicant is submitting a request for variance
from LOR, Chapter 2, Section 4.J.1 which limits walls located outside the building
setback line in all residential districts to 4 feet. In the case of this project, the
fencing is utilized as a decorative architectural element or edge treatment as
opposed to a buffer treatment. It is proposed for aesthetics purposes only. It is
our opinion that the design proposed by the applicant is consistent with the spirit
and intent of the City code and provides the most appropriate design solution.
We respectfully request the Planning and Zoning Departments, as well as the
Planning and Development Board's, favorable consideration in this regard.
19. Same as 18 above.
20. The applicant proposes as a part of this submittal to establish the accessory
structures setbacks along the southerly property line at 10 feet. A setback matrix
has been provided on the site development plan accordingly.
21. We agree. The tabular data has been added to the landscape plans.
22. We agree. The plan has been modified to be consistent with the required
minimum standard for native plant material.
23a. We agree. The net buildable land area has been identified on the site plan,

24. The dimension of all proposed fountains have been provided on the hardscape
plans. The plans submitted are fully detailed construction level plans.
25. We disagree. As determined at the Technical Review Committee the trellises are
located within the buildable area of the site.
26. The landscape guidelines for the Via Lugano project were established as a part
of the Master Plan. The landscaping shown on the plans is consistent with the
minimum standards established by the Master Plan guidelines for Phase 2.
27. The rooms within the car wash building have been identified on the architectural
plans. Please refer to architectural plans.
28. All accessory buildings are included with this resubmittal.
29. The maintenance facility for the Via Lugano project are integrated with the car
wash. Please refer to the architectural plans for the car wash building.

30. As requested, the site plan and landscape plans have been modified to provide
the appropriate screening for the dumpster facility.
31, Documents of Unified Control per LOR, Chapter 2.5, Section 6 will be provided
prior to building permit.
32. As requested, more detailed calculations concerning the parking permitted for the
amenities and recreational facilities on site have been provided on the site plan.
33. As discussed at the Technical Review Committee, LOR, Chapter 2, Section
11.H.2. is not applicable to the multi-family configuration in question.
34. A table of minimum setbacks is provided for on the approved site plan.

The City of Boynton Beach has completed its first review of the documents submitted
for the above-referenced project. Attached are comments made by the reviewing
departments during their initial review of your project.
In order to complete the review process, the site plan and documents must be
amended to comply with these comments within 90 days of the date of this letter. (If
amended plans are not submitted in 90 days, a new application fee will be required:)
When there are comments made by the reviewers that you feel are not applicable to the
approval of the project or will be addressed separately and you have not amended the
plans to comply with the comment(s), you must prepare written explanation for each
comment stating why the comment is not applicable and return the explanation(s) with
the amended plans and documents.
After amending the plans and documents, please submit twelve (12) complete sets
(including surveys) of the plans to Planning and Zoning. When the amended plans and
documents have been submitted to Planning and Zoning, they will be distributed to the
reviewing departments for second review and recommendation to the appropriate
boards for approval or denial. A recommendation for denial will be made if there are

PROJECT DESCRIPTION
The project known as Via Lugano - Portion of the Melear P.U.D. is a 23.6-acre multi-family
residential site. Development of the site will include construction of 13 apartment buildings
(28 dwelling units each), a clubhouse, gatehouse, carwash building, and recreational
facilities (pool, tennis court, etc.).
Available soil boring information indicated the water table to be 3 feet below the ground
surface. Average site elevation is approximately 10 feet (NGVD '29). Therefore, the water
table is located at approximately 7.0' NGVD. The USGS Altitude of Water Table Surficial
Aquifer Map for Palm Beach County (attached for reference) indicates the wet season
water table is 8.0 NGVD. The controlled water elevation in the L-21 canal, located
immediately south of the project site was measured at 8.04' NGVD. For design purposes,
we have assumed a wet season water table of 9.0' NGVD, which is a conservative
approximation.
A 3.6-acre water management tract (2.55-acre water surface area) will provide wet
retention for the site. A land use table is attached for reference to impervious and pervious
acreage.
