review and recommendation. Please review this amended site plan submittal to determine if
the plans have been adjusted to satisfy the comments previously made by your department.
If your comments have been satisfied or if your comments can be met at time of
building permit, please advise this office in writing. If your comments have not been
met, please indicate this in writing to my office.
Finally, include in your memorandum a recommendation as to whether the project should be
forwarded to the Planning and Development Board for consideration. Please return your
memorandum and the amended plans (Building and Engineering Divisions shall keep
their plans) to Planning and Zoning by 5:00 P.M. on Thursday October 30,1997.

The document shall, at minimum, contain the following statements:

document shall bind in perpetuity all heirs, assignees, successors and future
property owner or owners, if any, to develop, operate and maintain said
property under unified control, in compliance with the City of Boynton Beach
Code of Ordinances and conditions of approval of all Development Orders or
Development Permits issued for the property, without recourse to the city or
any other public agency. The name or title of the entity responsible for
developing, operating and maintaining the subject property under unified
control shall be . This entity shall be identified on the
plat and plat dedications with the signatures of the controlling party or parties
identified on the plat. This document shall not be amended or modified
without written consent from the City of Boynton Beach City Attorney or

The following is a list of comments regarding the first review of the above-referenced project. It should be noted
that the comments include recommendations we believe will enhance the aesthetics and function of the project.
The comments that identify deficiencies from the City's Land Development Regulations (L.DR.) or previous
conditions of approval are required to be corrected and shown in compliance on the plans andlor documents
submitted for second (2nd) review in order for the project to continue through the site plan review process.
The applicant shall understand that all documents and plans submitted for site plan review are subject to
additional comments, I recommend that the applicant/agent contact this office regarding questions related to the
comments. If the applicant is not intending to correct code deficiencies or deficiencies from previous conditions
of approval and they request that the project remain on the review schedule identified he/she should contact this
office regarding the procedures, application forms, fees and submittal deadline dates for seeking relief from the
code requirement or previous condition of approval.
1. Any roof top equipment will have to be screened from view at a distance of 600 feet. If
such equipment is planned, indicate its location and the height of the equipment
above the roof level. Provide elevations of the structure showing the roof top
equipment and the required screening (all reduced to a small scale) and draw in on
these elevations the lines-of-sight connecting the highest point of the equipment with
the eye level from a distance of 600 hundred feet from the building (LOR, Chapter 9,
Section 11.E).
2. The property is being subdivided from the parent tract of land. Since previous splits
already took place a subdivision plat shall be submitted, processed and approved prior
to issuance of the first building permit. (LOR, Chapter 5, Article I).
3. Land Development Regulations require that the landscape plan submitted as a part of
the site plan submittal shall be drawn to the same scale as the site plan. With the site
plan re-submittal provide a landscape plan meeting this requirement. (LOR, Chapter
4, Section 7.C.1).

4. The landscape plan shall contain all existing and proposed on the property easements
and lighting fixtures. With the resubmittal include a landscape plan containing these
information. (LOR, Chapter 4, Section 7.C.1).
5. Prior to the site plan approval submit a rectified master plan. (LOR, Chapter 3, Article
IV, Section 3).
6. Remove all canopy trees from the 20 feet wide utility easement along Congress
Avenue. (City policy).
7. On the site plan depict all proposed and required setbacks. (LOR, Chapter 4, Section
7.C.1).
8. Approved Master Plan indicates a secondary access to the property from Sandalwood
as both egress and ingress. Alter the notation on the site plan to allow ingress to the
property from Sandalwood Drive.
9. In order to simplify the review process, depict number of parking spaces in each
grouping of parking.
10. With the second submittal provide a grading plan or grading information on the site
and landscape plan in compliance with the approved master plan.
11. Traffic control markings shall be shown within the vehicular use areas as required by
LOR, Chapter 4, Section 7.B.2.
12. Prior to the Planing and Development Board meeting submit to the Planning and
Zoning Department a presentation board containing samples of all exterior building
materials to be used for construction. (LOR, Chapter 4, Section 7.0).
13. Prior to the Planing and Development Board meeting submit to the Planning and
Zoning Department color elevations of all buildings and signage. (LOR, Chapter 4,
Section 7.0).
14. Submit all proposed signage with the second submittal. If the information is not
submitted, another, formal submittal of proposed signage or a sign program will be
required to be reviewed by the Planning and Development Board and the City
Commission. (Chapter 9 - Community Design Plan, Section 10. I. and Chapter 21 -
Sign Code, Article IV, Section 7 of the Land Development Regulations).

15. Indicate the height of all buildings as required by the code. (LOR, Chapter 4, Section
7.0.1).
16. Depict color code and manufacturer on all exterior finishes on elevations of all
buildings and structures. (LOR, Chapter 4, Section 7.0).
17. The code requires that buffer and screen walls exterior finishes resemble the color
and material of exterior finished used for principle structure. (LOR, Chapter 9, Section
10.E).
18. Reduce the height of the aluminum picket fence to the maximum of 4 feet as per
approved master plan.
19. No fences or walls are allowed to be higher than 4 feet in front yards of all residential
districts. (LOR, Chapter 2, Section 4.J.1).
20. The accessory structures in excess of 100 square feet shall comply with the minimum
setback requirement established by the master plan. Relocate all accessory
structures to comply with the minimum setback requirements. (LOR, Chapter 2,
Section 4.8).
21. On the Landscape Plan, amend the tabular summary of the planting material to
include a "landscape material required by the code" category. Also, provide relevant
calculations for this category. For the landscape buffer adjacent to the right-of way
and along abutting properties, provide perimeter distances of the parcel for which the
landscape buffer material is being calculated (Chapter 7.5, Article II - Landscape
Code).
22. Incorporate the above calculation into the tabulation of the landscape material
provided for the site. All native species shall be distinguished from non-native species
with a recognizable symbol. Note, that the native requirement is fifty percent of the
required landscape planting (Comprehensive Plan Policy 4.4.6).
23. In accordance with LOR, Chapter 4, Section 7.E, amend your site plan tabulation to
include the following:
A. net buildable land area in acres and feet (net buildable land area is the area of
the lot within the required setback lines)

B. total lot coverage (total lot coverage is a sum of building coverage and all hard
surface pavement coverage)
O. height of all buildings.
24. Indicate the dimensions of all proposed fountains in compliance with LOR. Chapter 2,
Section 4.J(12).
25. Alter the height of proposed trellises located outside of the buildable area of the site to
comply with LOR. Chapter 2, Section 4.J(7).
26. It is recommended that landscape standards be established for all perimeter buffers.
These standards, where applicable, will be used to provide landscape design
uniformity within the remaining portion of the PUO.
27. Identify the use of every spacelroom within the carwash building, as required by the
code. (LOR, Chapter 4, Section 7.B.1).
28. Provide all elevations of all accessory buildings. (LOR, Chapter 4, Section 7.0).
29. Indicate on the site plan the location of the maintenance facility building.
30. The code requires that the dumpster/trash collection area be screened with a wall and
accent shrubs be placed along all three sides of the enclosure. Provide the
required hedge along the northwest wall of the trash compactor screening wall. (LOR,
Chapter 9, Section 10.B).
31. Provide verified control documents as required per LOR, Chapter 2.5, Section 6.
32. Provide the square footage of all amenities for which parking is required and submit
for review required calculations for the recreational facility parking areas.
33. Parking spaces abutting garage doors shall conform to minimum size requirements as
stated in LOR, Chapter 2, Section 11.H.2.
34. Establish minimum setbacks for accessory structures as denoted on the approved
master plan.

Site Specific Reauirements
The applicant has agreed to my previous comments, however the plans do not reflect all of the
medians on Congress Avenue to be landscaped by the developer. There are discrepancies in the
planting list and the landscape plans.
The applicant should prepare Littoral and Upland planting plans for the proposed lake on the
project. A Lake Management plan should also be included in the document.
Code Reference
The above requirements are in accordance with Comprehensive Plan Policy 2.4.5. P42; &
3.2.7.2.2.a.
The project should continue in the normal review process.

We offer the following comments on this project:
GENERAL COMMENTS:
1) All utilities easements shall be shown on the rectified landscaping drawings so that we may
determine which trees may interfere with utilities. In general, palm trees will be the only tree species
allowed within utilities easements. Canopy trees may be planted outside of the easement so that roots
and branches will not impact those utilities within the easement in the foreseeable future. LDR Sec.
7.5-18.1 gives public utilities the authority to remove any trees that interfere with utility services, either
in utility easements or public rights-of-way,
2) Dept. of HRS permits will be required for the water and sewer systems serving this project. (Sec.
26-12)
3) Fire flow calculations will be required demonstrating the City Code requirement of 1500 g.p.m. as
stated in LDR chap. 6, Art. , Sec. 16, or the requirement imposed by insurance underwriters,
whichever is greater. (see Sec. 26-16(a)). Please submit these calculations with your HRS permit
submittal.
4) Sec. 26-34(E) of the City Code requires that a capacity reservation fee be paid for this project either
upon my request for signature on the Health Dept. application forms or within 30 days of site plan
approval, whichever occurs first. This fee will be determined based upon final meter size, or expected
demand.
5) Comp Plan policy 3C. 3.4 requires the conservation of potable water. City water may, therefore, not
be used for irrigation where other sources are readily available
6) Provide an engineer's written certification that drainage will conform to all rules of the City and the
South Florida Water Management District. (LDR Chap. 4, sec. 7F)
SPECIFIC COMMENTS:
1 ) Water and sewer lines to be owned and operated by the City shall be included within utilities
easements. Please show all proposed easements on the engineering drawings, using a minimum width
of 12 feet. The easements shall be dedicated via separate instrument to the City as stated in Sec. 26-
33(a) of the Code.
2) LDR chap. 6, Article N, Sec. 16 requires all points on each building to be within 200 feet of an
existing or proposed fire hydrant. Please demonstrate that the plan meets this condition, by showing all
hydrants.
3) Appropriate backflow preventers will be required on any fire sprinkler line if there is one, in
accordance with Sec. 26-207.
4) The off-site water and sewer mains serving this parcel were oversized, at City expense, to
accommodate the future development now proposed. Section 26-34 of the City Code allows the City to
recover this cost, plus interest, from developers. The costs per equivalent dwelling unit are as follows:
potable water = $ 441.39
sewer = $ 161.29
These costs are in addition to the regular capital facilities charges for water and sewer.
As a partial offset for these fees, credits are due for the donation of the parcel containing the water
storage tank on Miner Road. The credits cannot be calculated until we have a firm number for the total
number of units allowed for the entire Melear P. U . D.

2. To ensure compliance with the handicap accessibility code, add to Sheet 6 of 18 the
accessible path leading to thc recreation amenities from Building 9. Also, extend the
accessible path shown at the pcrimetcr of the recreation area to the handicap entrance of the
recreation building, pool and tot 10t/vol1ey bal1 area. Also show on the plans thc acccssiblc

I have reviewed the above plans and have the following comments/recommendations:
1 . The plans show a proposed median cut and left turn lane for northbound traffic to make a left
turn into Via Lugano. This has been approved. The plans also show a left turn lane for
southbound traffic at the same median break on Congress Ave. I do not recommend this left
turn lane. There are no logistics behind this maneuver. Dos Lagos Condominiums are
located to the east of this site and is fully developed. There is no ingress to Dos Lagos in this
area, thereby making this a u-turn only location.
2. I recommend a right turn/deceleration lane for southbound traffic turning into the driveway.

To Whom It May Concern:
Boynton Beach Fire-Rescue continues to maintain the position that secUfity gates are
potentially detrimental to fire and rescue operations. The proliferation of security gated
communities has resulted in many problems for responding emergency apparatus trying to gain
entry,
The minimum performance for all security gates should be as follows:
1) All gates must have one security entry code (0911)
2) The gate must remain open until the Fire-Rescue units have completed the call and have
reentered 0911 while leaving.
3) Gates may be operable by telephone from our dispatch office, A phone call from our
dispatchers will open the- gate and a second call will be required to close the gate,
4) In case of power failure, the gate shall open automatically and remain open,
5) An exception will be where a 24-hour security guard is stationed at the gate.
6) Authorized key security boxes (Le. Knox, NuTech, Supra) should be located on all
buildings where alarms and/or sprinkler systems are located to assist in minimizing
damage due to rapid forcible entry.
7) Authorized key security boxes may be used on gates, provided each gate has one and it
is well marked. A key security box on a gate will not be used in lieu of any other section
of this letter,
8) No other code numbers, operating methods or key systems will be kept on file by the Fire
Department.
9) In the event our units are unable to gain rapid entry with the above methods, it will
require us to use rapid forcible entry methods to gain entry,
10) Information on where authorized key security boxes can be purchased is available from
Boynton Beach Fire-Rescue Fire Safety Division by calling #(561) 735-0272 during
normal business hours.
The liability of a delayed Fire-Rescue response to an emergency in your community should be a
serious concern.

amenities is designed in compliance with Section 4.1.2,u' (1) thru (4) of the Florida
Accessibility Code for Building Construction.
2. Indicate with a notc on Sheet SP-l that thc accessiblc route required between each handicap
parking spacc and the handicap entrance to each residential building, recrcation building
and recrcation amenity is dcsigncd in compliance with Section 4.1.2.III (1) thru (4) and
Section 4.6 of the Florida Accessibility Code for Building Construction.
3. On Shect SP-l identifY the location of the acccssible route that is described in comment #1
and #2.
4. The sign code (Articlc IV, Section I.D.) specifies that the maximum height allowcd for a
wan sign is six (6) fect therefore rcduce the height ofthe proposed 11 foot tan wan sign to
comply with thc sign code regulation.
5. Thc sign code (Article IV, Scction I.D.) specifies that the total maximum sign area for each

We offer the following comments on this project:
1) All utilities easements shall be shown on the rectified landscaping drawings so that we may determine
which trees may interfere with utilities. In general, palm trees will be the only tree species allowed within
utilities easements. Canopy trees may be planted outside of the easement so that roots and branches will
not impact those utilities within the easement in the foreseeable future. LDR Sec. 7.5-18.1 gives public
utilities the authority to remove any trees that interfere with utility services, either in utility easements or
public rights-of-way.
2) Dept. of HRS permits will be required for the water and sewer systems serving this project. (Sec. 26-12)
3) Fire flow calculations will be required demonstrating the City Code requirement of 1500 g.p.m. as
stated in LDR chap. 6, Art. , Sec. 16, or the requirement imposed by insurance underwriters, whichever is
greater. (see Sec. 26-16(a)). Please submit these calculations with your HRS permit submittal.
4) Sec. 26-34(E) of the City Code requires that a capacity reservation fee be paid for this project either
upon my request for signature on the Health Dept. application forms or within 30 days of site plan
approval, whichever occurs first. This fee will be determined based upon final meter size, or expected
demand.
5) Water and sewer lines to be owned and operated by the City shall be included within utilities easements.
Please show all proposed easements on the engineering drawings, using a minimum width of 12 feet. The
easements shall be dedicated via separate instrument to the City as stated in Sec. 26-33(a) of the Code.
6) .LDR chap. 6, Article IV, Sec. 16 requires that all points on each building will be within 200 feet of an
existing or proposed fire hydrant. Please demonstrate that the plan meets this condition, by showing all
hydrant.
9) Appropriate backflow preventers will be required on any fire sprinkler line if there is one, in
accordance with Sec. 26-207.
10) Comp Plan policy 3C.3.4 requires the conservation of potable water. City water may, therefore, not
be used for irrigation where other sources are readily available.
13) Provide an engineer's written certification that drainage will conform with all rules of the City and the
South Florida Water Management District. (LDR Chap. 4, sec. 7F)
14) The off-site water and sewer mains serving this parcel were oversized, at City expense, to
accommodate the future development now proposed. Section 26-34 of the City Code allows the City to
recover this cost, plus interest, from developers. The costs per equivalent dwelling unit are as follows:
potable water = $ 441.39
sewer = $ 161.29
These costs are in addition to the regular capital facilities charges for water and sewer.

was designed to access all PUD's that were to be built on this property. We have
other similarly designed PUDs on N. Congress Ave. that do not have individual
access to N. Congress; only from the main roadways that run throughout the
PUD. This entrance/exit further complicates traffic flow on N. Congress Ave.
and presents further traffic hazards and potential accidents on N. Congress Ave.
Having all traffic enter/exit on Sandalwood Drive would help minimize traffic
crashes and congestion. Access to the Melear PUD has been greatly improved

Adhering to the following review guidelines will promote a comprehensive review and enable
the applicant to efficiently obtain Technical Review Committee approval:
1. Use the review standards specified in Part IV, Land Development Regulations, Site Plan
Review and the applicable code sections of the Code of Ordinances to review and
formulate comments.
2. The documents submitted for the project were determined to be substantially complete,
however, if the data provided to meet the submittal requirements is insufficient to
properly evaluate and process the project based on the review standards or the
documents show code deficiencies, additional data and/or corrections should be
requested by the reviewer by contacting Jerzy Lewicki.

3. Each comment shall reference the section of the code that is incorrectly depicted on the
documents.
4. Technical Review Committee member(s) shall identify in their comments when the plans
depict or when the location and installation of their departmental required improvements
may conflict with other departmental improvements.
5. When a TRC Member finds a code deficiency that is outside of his/her review
responsibility, the comment and the specific code section may be included in their review
comments with the name of the appropriate TRC Member that is responsible for the
review specified.
6. If a TRC member finds the plans acceptable, he/she shall forward a memorandum, within
the time frame stated above, to the Planning and Zoning Director. The memorandum shall
state that the plans are approved and that they do not have any comments on the plans
submitted for review and that they recommend the project be forwarded through the
approval process.
All comments shall be typed, addressed and transmitted to the Director of the Planning and
Zoning Division for distribution to the applicant. Please include the name and phone number of
the reviewer on this memorandum. Jerzy Lewicki will be the Planning and Zoning staff member
coordinating the review of the project.
Planning and Zoning staff will send the applicant a cover letter which includes the comment(s)
and directions to amend the plans to comply with the comments and the procedures for
resubmission. When Planning and Zoning staff receives the amended plans, we will distribute
the plans with a cover memorandum to all TRC Members for review and approval.
