Re: Vinings at Boynton Beach II - Fountain Variance
Dear Tambri:
Yesterday I was informed that we could not pull a permit for an above ground fountain because
it was too large,
Our approved site plan indicated a location of a fountain area which contained a 9' radius
fountain, 4 decorative benches on a decorative pavement area, with Washingtonians and other
perennial garden planting, This fountain was approved with a 9' radius,
I received a fax of Chapter 2, Section 4.J, from an associate in your office. I don't know what
section of the Code this falls under an cannot determine the context. Please help me understand
why the City would want to limit the size of a privately owned, purchased and maintained
fountain. We have designed a beautiful artistic structure--one that has been custom designed
and ordered for this space,
I have enclosed detailed drawings of the fountain and have enclosed a detailed section of Plan
L-2 and L-5, Grading and Landscaping, respectively for this job,
Please call me as soon as you are able to discuss this matter. I don't think this is worthy of a
$400 variance,

Dear Bettina Scherer:
The City of Boynton Beach has completed its first review of the
documents submitted for the above-referenced project. Attached are
comments made by the reviewing departments during their initial
review of your project.
In order to complete the review process, the site plan and
documents must be amended to comply with these comments within 90
days of the date of this letter. (If amended plans are not
submitted in 90 days, a new application fee will be required.)
When there are comments made by the reviewers that you feel are not
applicable to the approval of the project or will be addressed
separately and you have not amended the plans to comply with the
comment(s), you must prepare written explanation for each comment
stating why the comment is not applicable and return the
explanation with the amended plans and documents.
After amending the plans and documents, please submit twelve (12)
complete sets (including surveys) of the plans to the Planning and
Zoning Department. When the amended plans and documents have been
submi t ted to the Planning and Zoning Department, they will be
distributed to the reviewing departments for second review and
recommendation to the appropriate boards for approval or denial
(see attached meeting schedule). A recommendation for denial will
be made if there are major comments that have not been addressed on
the resubmitted plans.

below.

SITE PLAN REVIEW COMMENTS:
1. Sheet 1 of 2 now indicates that Phase I as "existing" and a darker boundary line between
the two phases has been provided.
2. a. Perimeter control dimensions are shown.
b. Drive isles with back-up spaces are shown to be 27 feet.
c. The sidewalk in front of the leasing office is 5' to accommodate any overhang of
parked cars.
3. a. We have repositioned building #10 to provide for the 20' setback requested.
b . We have repositioned building #5 to provide for the 40' setback along S. W. 8th Street.
4. The established perimeter building setbacks are shown.
5. Access Isle has been dimensioned at 27 feet.
6. A current survey of Phase II and copy of the Plat for Phase I is attached, as requested.
7. Note as to "first 10 d.u.'s per bldg. " has been deleted.
8. Parking for Tennis, Pool and Leasing Office have been increased as requested.
Calculations have been modified accordingly.
9. Floor plan drawings indicate the 9'xI8' parking stall in the garage as well as in the tandem
space in front of each garage.
10. An Easement, Maintenance and Cost Sharing Agreement, which grants Phase II access
through the shared entry road, is attached. This document was recorded back in July of
1995. It was prepared by Amy Schlosser, Esquire and Broad & Cassel. If Jim Cherofhas
any questions or concerns, she can be reached at 407-483-7000.
11. You have asked us to dimension on the site plan the building overhang so that it doesn't
encroach into an easement or setback. Patios on the second floor on the non-parking side
have been shown. On the front of the buildings where a patio is above a tandem parking
space we are unable to show the patio because we needed to show the full parking space.
The only area that a patio may be in close proximity to an easement is at Building #6. A
detailed plan can be drawn to accommodate this request separately.
12. FAR information has been included on the site plan.
13. With respect to the landscaping around the lift station, we have modified the plan to provide
for palm trees to be on the south side of the station to provide for a continues screen.
14. Our planting plan on the north boundary of the PUD is similar to that as forwarded. Does
it need to be exactly as shown, including slash pines? We prefer the live oak and laurel oak
plantings as it will provide a better screening. Please advise. We can work this out in the
working drawing stage of our submittal.
15. We have shown the existing easements on the landscape plan. The native canopy trees
shown near the easement which borders the single family development can be planted on
the north side of the easement so that we can accommodate the utility department and your
pre-approved landscape requirements for that area.
16. Tree Management Plan for Phase I and Phase II was submitted with the original application
A copy is attached and the plan is still effective.
17 . We ask you to consider that the north property line buffer be installed in conjunction with
the schedule of construction. Our sequence of construction, much like Phase I would begin
at the entry and work it's way back to the eastern part of the project.
18. Height of Section "A" and "C" berms have been called out on the landscape plans at cross
sections. With respect to Section "B", the railroad bufferlberm exceeds a height of 12' in
Phase I and we expect a similar situation to present itself during the grading of Phase I.
This will be more clearly defined in the working drawings and will be shown on the
drainage plans.
19. Height of fence and native trees have been called out at buffer Section "C".
20. Cocoplum notation has been made on the plan with respect to Section "C" buffer, as well
as a comment for same to be 24" oc.
21. Hedge heights have been called out on the landscape plan.
22. Contour lines have been sbown on the landscape as best as possible considering this is a SO
scale drawing. Please note that funclional grnding will be developed in the working
drawings and full in place with the working drawings for grndiug and drainage plans.
23. Fire HYdrants are shown on the site plan and master utililiesplan. Resolulions of conflicts,
if any, will be dealt with in the landscape working drawings.
24. With various symbols and DOtes, we believe we have indicated more clearly your requests.
*PJease note that while Phase r and Phase II "'" both owned by TCR, they will not
share a unity of lille. With this in mind, we as the owner, feel that the City needs to
work with us on allowing us 10 determine the buffering between these two sites,
especially in light of the setbacks and lake feature, shared entry, etc., that provides for
a very pleasing transition between the two phases.
25. Building colors will match Phase 1. Please note that a site plan amendment was processed
amending the colors during the Phase I construction. Your building </epartmeut has the
revised site plan color selections on file. P&Z was copied and approved the revisions.
26. Elevations drawings show colors as requested.
27. Dumpster enclosures have been depicted with colors.
RECOMMENDA TIONS:
28. We have moved the volleyball court as shown on the landscape drawing.
(still need to add it to the site plan)
29. We prefer DOt 10 use maleleuca mulch. Cypress was approved and used for Phase 1.
ENGINEERING COMMENTS~
1. All plans will meet code requirements and we understand the pennjlling process.
2. Bill Asbury with the Buynton Beach Post Office designated that road for Phase II will be
Darned · Asbury Way.. Upon finalizalion of the addresses for the buildings, we will
forward to you this information.
3. Chapter 2, Sec. 9C page 2-80 deals primarily with rezoning. Is there something in that
section pertaining to this site plan modification?
4. Master Landscape plan was provided.
5. Structures have been shown. No temporary structures above ground are existent with the
exception of the lift station. Abandonment of the old can lift station will be provided on
working drawings for this portion of the development
6. Master drainage plan was provided.
7. Plat is forthcoming.
8. Sidewalks are shown.
9. Bikepath is existing.
10. Drainage certification will be provided.
11. Minimum pavement widths are called out or shown to meed code.
12. Parking lot dimensions are detailed and garage and tandem spaces are shown on the
architectural drawings.
13. Drainage permits will be forwarded to you.
14. Remove median in entryway? These have already been built.
15. Photometries as well as a lighting plan was prepared, however, a few spots showed
deficiencies with respect to .5 lumens. A revised photometric plan has been ordered.
16. Lighting plan will be provided.
17. Stop signs and bars are shown.
18. We were unable to show all the wheel stops at this time. We will provide it on a secondary
site plan.
20. Curbing will be same as Phase I as approved and to Code.
21. Handicapped provision have been made.
22. Handicapped space at Leasing Area has been shown.
23. Handicapped space will be painted in accordance to Code and City's requirements.
RECOMMENDATIONS:
A. Prefer not to include a one-way out at Building 3 & 4 as the entry flows beautifully as
designed. It is an elegant entry for both communities. A one-way would require excessive
signage and policing.
B. Speed limit has been reduced to 25 mph.
C. Wheel stops were approved for Phase I. Both communities should have the same parking.
POLICE DEPARTMENT COMMENTS:
1. Speed limit reduced to 25mph and posted.
2. Stop signs and bars have been shown.
3. No Parking signs will be posted at Building's 9 & 4. See R8-3 detail.
4. We will install a guard rail at the "Tn intersection as recommended.
UTILITIES
1. HRS permits will be provided.
2. Palms will be provided in utility easements. Please review the landscape area between the
single family an the western portion of Phase II where the water main easement falls. P&Z
has instituted that native canopy trees must be planted in those locations. Please advise.
PUBLIC WORKS
1. Dumpsters have been properly shown with 10' inside dimensions on all plans.
FORESTER
1. The tree management plans had been previously submitted. The slash pines can not be
relocated and provisions to provide replacement trees will be made as indicated.

Dear Mr. Hallahan:
This letter serves as our Tree Management Plan for the above
referenced site as you requested.
INTRODUCTION: The proposed Vinings at Boynton Beach Phase I and
Phase II is located within the Woolbright Place PUD. The Phase I
site consists of 15.37 acres. The Phase II site contains 18.50
acres. The majority of the sites have been previously cleared.
The remaining vegetation, due to the condition of the deep sandy
soils, consists dominantly of scrub plant species with minor
invasions by the undesirable exotics.
EXISTING TREES ON SITE: On August 18, 1994, Gregory S. Mire,
P.L.S., made an inspection of the site and found no hardwoods,
122 Slash Pine (Pinus elliottii) and 2 Sabal Palms on the sites.
PRESERVATION PLAN: We will attempt to move and preserve the
Sabal Palms to the areas shown on the Landscape Plan at the
perimeter buffer area. Removal of the Slash Pines is
contemplated for two reasons (a) interference with proposed
improvements and (b) due to finish grade changes contemplated to
the site.
RELOCATION OF PALMS: The two Sabal Palms selected for relocation
will be tagged with colored surveyor's tape and markedo The best
method of relocation is believed to by tree spade or equivalent.
Fronds shall be carefully removed except for the young protective
growth surrounding the heart or bud at time of transplanting.
REPLACEMENT OF SLASH PINES: The Slash Pines will be removed and
replaced in equal quantity with differing species as shown on the
landscape plan. Please note the following tabulation:

MAINTENANCE PROGRAM: At the time of planting relocated material, an
earth berm shall be formed along the outside edge of the root ball to
create a basin for retaining water within the root ball area.
Irrigation of relocated plant material shall be administered in
adequate amount by means of an automatic or manual system in
conjunction with rain fall. The duration for the watering program is
intended to continue until the root system is established and the tree
can maintain itself on natural rain fall. Bracing of relocated trees
will be determined in the field as to size of the tree and site
conditions such as on a slope. Fertilization of relocated plant
material shall occur once at the time of transplanting.

CHECKLIST
The following list and information is provided as a checklist to ensure that
the submittal of amended plans and documents is substantially complete for
review. Turning in this list and the appropriate plans and documents will
enable the submittal to be efficiently checked prior to being accepted by the
Planning and Zoning Department.
Project Name: Vinings at Boynton Beach - Phase II (File No. MSPM 96-003)
1. Submit an amended Site Plan Review/Conditional Use application form that
reflects the changes that were made as a result of amending the plans
and documents to comply with the Code of Ordinances and the Technical
Review Committee comments. A copy of the original form with a
distinguishable symbol identifying the change(s) may be submitted or a
completed new form with the changes identified. If there are no changes
required to be documented on the application form, a letter from the
applicant stating same must be turned in with the amended submittal.
2. Submit twelve (12) assembled and complete sets of plans and documents,
including surveys that show compliance with the Code of Ordinances and
comments made by the Technical Review Committee. Two (2) of the sets
shall have the appropriate legible raised seal and signature of the
designer responsible for the drawing(s). Plans and documents shall be
assembled in twelve (12) individual complete packages with the title of
the project on all pages and/or sheets and each page or sheet
numerically numbered such as the following example: 1 of 3, 2 of 3, 3 of
3.
3. Submit color photographs of the buildings on the site that are to remain
in their existing condition and photos of existing buildings that are
located on the sites that abut the perimeter of the subject property.
The minimum size is 5" by 7". Each photograph shall be labeled to
identify the location of the existing structures with respect to the
location of the proposed project. If the abutting property is vacant
photographs are not required.
4. Submit colored elevation view drawings - a colored duplicate copy of all
drawings of the elevation views of each side of all buildings and
signage associated with the project. The oolors shown and described on
the colored elevation views shall match the colors identified on the
elevation drawings submitted for site plan review. All exterior
surfaces of the structure (s) shall be colored and the color name,
associated color code and manufacturer identified. The type of exterior
surface material shall also be identified on the drawing. The colored
elevation drawings shall have compass direction or title of the side of
the building identified. The title block of the original drawing shall
be shown. The maximum size is 24" by 36". Do not submit on board of
any kind.
5, Submit color samples as an example of the proposed colors. Each sample
shall have attached a label that identifies the color by name, color
code and manufacturer. The colors should be referenced from an
established color chart.
6. Submit a 8 1/2" x II" transparency of the landscape site plan drawing to
be used on an overhead projector at board meetings.

The latest suit comes from

what's going on with Palm V, and
they've been stalling as far as in
showing us."
According to the complaint,
Handelsman's company stopped
paying on the loan in September
1995. Because Handelsman oper-

through his Love Realty, Lessner
says those books should be
opened, too.
Handelsman could not be

UPSCALE TOWNHOMES
FOR BOYNTON: Trammell Crow,
one of the country's biggest apart-
ment builders, is counting on
growth in Boynton Beach.
Earlier this month, the compa-
ny, which has Boca Raton regional
headquarters, took out a
$14,6 million loan from Fleet Na-
tional Bank for phase two of an
~partment community it's build-
mg.
Called the Vinings at Boynton
Beach, the 252 units in the first
phase already are leased, said
Greg Iglehart, a development
partner at Trammell Crow's Boca
Raton office.
Construction on the second
phase, which will have 296 units,
began earlier this month, he said.
It's expected to be finished at the
end of next year.
For this phase, TrammeR
Crow decided to go more upscale.
About 30 percent of the new units
will be townhomes with attached
garages, Iglehart said, The exist-
ing development has no town-
homes.
"It's a good infilllocation," he
said of the site, which already has
the roads and utilities and a
strong retail base around it, in-
cluding a Home Depot next door,
"It's close to entertainment and
the beach."
The property is at the north-
west comer of Interstate 95 and
Woolbright Road,
The new units, however,
won't share amenities such as a
pool, jacuzzi, tennis courts, chil-
dren's playroom and fitness cen-
ter with the existing apartments,

SITE PLAN REVIEW COMMENTS:
1. Sheet 1 of 2 now indicates that Phase I as "existing" and a darker boundary line between
the two phases has been provided.
2. a. Perimeter control dimensions are shown.
b. Drive isles with back-up spaces are shown to be 27 feet.
c. The sidewalk in front of the leasing office is 5' to accommodate any overhang of
parked cars.
3. a. We have repositioned building #10 to provide for the 20' setback requested.
b. We have repositioned building #5 to provide for the 40' setback along S. W. Sth Street.
4. The established perimeter building setbacks are shown.
5. Access Isle has been dimensioned at 27 feet.
6. A current survey of Phase II and copy of the Plat for Phase I is attached, as requested.
7. Note as to "first 10 d.u. 's per bldg." has been deleted.
S. Parking for Tennis, Pool and Leasing Office have been increased as requested.
Calculations have been modified accordingly.
9. Floor plan drawings indicate the 9'xlS' parking stall in the garage as well as in the tandem
space in front of each garage.
10. An Easement, Maintenance and Cost Sharing Agreement, which grants Phase II access
through the shared entry road, is attached. This document was recorded back in July of
1995. It was prepared by Amy Schlosser, Esquire and Broad & Cassel. If Jim Cherof has
any questions or concerns, she can be reached at 407-483-7000.
11. You have asked us to dimension on the site plan the building overhang so that it doesn't
encroach into an easement or setback, Patios on the second floor on the non-parking side
have been shown. On the front of the buildings where a patio is above a tandem parking
space we are unable to show the patio because we needed to show the full parking space.
The only area that a patio may be in close proximity to an easement is at Building #6. A
detailed plan can be drawn to accommodate this request separately.
12. FAR information has been included on the site plan.
13. With respect to the landscaping around the lift station, we have modified the plan to provide
for palm trees to be on the south side of the station to provide for a continues screen.
14. Our planting plan on the north boundary of the PUD is similar to that as forwarded. Does
it need to be exactly as shown, including slash pines? We prefer the live oak and laurel oak
plantings as it will provide a better screening. Please advise. We can work this out in the
working drawing stage of our submittal.
15. We have shown the existing easements on the landscape plan. The native canopy trees
shown near the easement which borders the single family development can be planted on
the north side of the easement so that we can accommodate the utility department and your
pre-approved landscape requirements for that area.
16. Tree Management Plan for Phase I and Phase II was submitted with the original application
A copy is attached and the plan is still effective.
17. We ask you to consider that the north property line buffer be installed in conjunction with
the schedule of construction. Our sequence of construction, much like Phase I would begin
at the entry and work it's way back to the eastern part of the project.
18. Height of Section" A" and "C" berms have been called out on the landscape plans at cross
sections. With respect to Section "B", the railroad buffer/berm exceeds a height of 12' in
Phase I and we expect a similar situation to present itself during the grading of Phase I.
This will be more clearly defined in the working drawings and will be shown on the
drainage plans.
19. Height of fence and native trees have been called out at buffer Section "C".
20. Cocoplum notation has been made on the plan with respect to Section "C" buffer, as well
as a comment for same to be 24" oc.
21. Hedge heights have been called out on the landscape plan,
22. Contour lines have been shown on the landscape as best as possible considering this is a 50
scale drawing, Please note that functional grading will be developed in the working
drawings and fall in place with the working drawings for grading and drainage plans.
23. Fire Hydrants are shown on the site plan and master utilities plan, Resolutions of conflicts,
if any, will be dealt with in the landscape working drawings.
24. With various symbols and notes, we believe we have indicated more clearly your requests,

share a unity of title. With this in mind, we as the owner, feel that the City needs to
work with us on allowing us to determine the buffering between these two sites,
especially in light of the setbacks and lake feature, shared entry, etc., that provides for
a very pleasing transition between the two phases.
25. Building colors will match Phase I. Please note that a site plan amendment was processed
amending the colors during the Phase I construction. Your building department has the
revised site plan color selections on file. P&Z was copied and approved the revisions.
26. Elevations drawings show colors as requested.
27. Dumpster enclosures have been depicted with colors.
RECOMMENDATIONS:
28. We have moved the volleyball court as shown on the landscape drawing.
(still need to add it to the site plan)
29. We prefer not to use maleleuca mulch. Cypress was approved and used for Phase I.
ENGINEERING COMMENTS:
1. All plans will meet code requirements and we understand the permitting process.
2. Bill Asbury with the Boynton Beach Post Office designated that road for Phase II will be
named "Asbury Way". Upon finalization of the addresses for the buildings, we will
forward to you this information.
3. Chapter 2, Sec. 9C page 2-80 deals primarily with rezoning. Is there something in that
section pertaining to this site plan modification?
4. Master Landscape plan was provided.
5. Structures have been shown. No temporary structures above ground are existent with the
exception of the lift station. Abandonment of the old can lift station will be provided on
working drawings for this portion of the development
6. Master drainage plan was provided.
7. Plat is forthcoming.
8, Sidewalks are shown.
9. Bikepath is existing.
10. Drainage certification will be provided.
11. Minimum pavement widths are called out or shown to meed code.
12. ParkiDg lot dimensions are detailed and garage and tandem spaces are shown on the
architectural drawings.
13. Drainage permits will be forwarded to you.
14. Remove median in entryway? These have already been built.
15. Photometries as well as a lighting plan was prepared, however, a few spots showed
deficiencies with respect to .5 lumens. A revised photometric plan has been ordered.
16. Lighting plan will be provided.
17. Stop signs and bars are shown.
18. We were unable to show all the wheel stops at this time. We will provide it on a secondary
site plan.
20. Curbing will be same as Phase I as approved and to Code.
21. Handicapped provision have been made.
22. Handicapped space at Leasing Area has been shown.
23. Handicapped space will be painted in accordance to Code and City's requirements.
RECOMMENDATIONS:
A. Prefer not to include a one-way out at Building 3 & 4 as the entry flows beautifully as
designed. It is an elegant entry for both communities. A one-way would require excessive
signage and policing.

The City of Boynton Beach has completed its first review of the
documents submitted for the above-referenced project. Attached are
comments made by the reviewing departments during their initial
review of your project.
In order to complete the review process, the site plan and
documents must be amended to comply with these comments within 90
days of the date of this letter. (If amended plans are not
submi t ted in 90 days, a new application fee will be required.)
When there are comments made by the reviewers that you feel are not
applicable to the approval of the proj ect or will be addressed
separately and you have not amended the plans to comply with the
comment(s), you must prepare written explanation for each comment
stating why the comment is not applicable and return the
explanation with the amended plans and documents.
After amending the plans and documents, please submit twelve (12)
complete sets (including surveys) of the plans to the Planning and
Zoning Department. When the amended plans and documents have been
submitted to the Planning and Zoning Department, they will be
distributed to the reviewing departments for second review and
recommendation to the appropriate boards for approval or denial

CHECKLIST
The following list and information is provided as a checklist to ensure that
the submittal of amended plans and documents is substantially complete for
review. Turning in this list and the appropriate plans and documents will
enable the submittal to be efficiently checked prior to being accepted by the
Planning and Zoning Department.
Project Name: Vinings at Boynton Beach - Phase II (File No. MSPM 96-003)

Submit an amended Site Plan Review/Conditional Use application form that
reflects the changes that were made as a result of amending the plans
and documents to comply with the Code of Ordinances and the Technical
Review Committee comments. A copy of the original form with a
distinguishable symbol identifying the change(s) may be submitted or a
completed new form with the changes identified. If there are no changes
required to be documented on the application form, a letter from the
applicant stating same must be turned in with the amended submittal.

Submit twelve (12) assembled and complete sets of plans and documents,
including surveys that show compliance with the Code of Ordinances and
comments made by the Technical Review Committee. Two (2) of the sets
shall have the appropriate legible raised seal and signature of the
designer responsible for the drawing(s). Plans and documents shall be
assembled in twelve (12) individual complete packages with the title of
the project on all pages and/or sheets and each page or sheet
numerically numbered such as the following example: 1 of 3, 2 of 3, 3 of
3.
Submit color photographs of the buildings on the site that are to remain
in their existing condition and photos of existing buildings that are
located on the sites that abut the perimeter of the subject property.
The minimum size is 5" by 7". Each photograph shall be labeled to
identify the location of the existing structures with respect to the
location of the proposed project. If the abutting property is vacant
photographs are not required.
Submit colored elevation view drawings - a colored duplicate copy of all
drawings of the elevation views of each side of all buildings and
signage associated with the project. The colors shown and described on
the colored elevation views shall match the colors identified on the
elevation drawings submitted for site plan review. All exterior
surfaces of the structure (s) shall be colored and the color name,
associated color code and manufacturer identified. The type of exterior
surface material shall also be identified on the drawing, The colored
elevation drawings shall have compass direction or title of the side of
the building identified. The title block of the original drawing shall
be shown. The maximum size is 24" by 36". Do not submit on board of
any kind.

Submit color samples as an example of the proposed colors. Each sample
shall have attached a label that identifies the color by name, color
code and manufacturer. The colors should be referenced from an
established color chart,
Submit a 8 1/2" x 11" transparency of the landscape site plan drawing to

The following is a list of 1st review comments regarding the site
plan review of the plans for the above-referenced project. It
should be noted that the comments are divided into two (2)
categories. The first category is a list of comments that identify
deficiencies from the City's Land Development Regulations (L.D.R.)
that are required to be corrected and shown in compliance on the
plans and/or documents submitted for second (2nd) review in order
for the project to continue through the site plan review process.

To properly determine if the parking areas and landscape areas
comply with code regulations add to the sheet tilted "Site Plan"
(sheet 1 of 2) the appropriate horizontal control dimensions from

parking spaces, width of the access aisle/back-up space and
dimension of landscape ares, The control dimensions shall cover
