The following is a list of comments regarding the second review of the above-referenced
project. It should be noted that the comments include recommendations. I believe the
recommendations will enhance the aesthetics and function of the project.
All comments and recommendations can be rectified on the plans at time of permitting if
the site plan request is approved. The applicant must understand that additional
comments may be generated upon review of the documents and working drawings
submitted to the Building Division for permits for the proposed project.
1. Delineate on the site plan the areas of Phase I that are being modified or place a note
on the site plan indicating that there are no changes proposed for Phase I ,
2. To verify that the parking areas and landscape areas comply with code regulations
and/or previous approvals regarding size and/or dimension, add to the sheet tilted "Site
Plan" (sheet 1 of 23) the appropriate horizontal control dimensions. The control
dimensions shall identify the distance through the property from north to south and east
to west. The control dimensions shall include the following measurements:
The distance from all property lines to the vehicle use areas.
The length of the parking spaces.
The width of the access aisle/back-up space,
The width of the landscape area adjacent to the building.
The width of the sidewalks adjacent to the building,
Maintain the distance between buildings as shown on the plan,
3, With a distinguishable symbol show, label and dimension on the site plan (sheet 1 of
23) the approved setback along the east property line and the south setback that
separates Phase I from Phase II. Show and label these setbacks on the landscape plan
sheet 3 of 23).
4. To ensure that the building overhang or building structures that are located above the
building footprint area depicted on the plan view drawings sheets 1 of 23, 2 of 23 and
3 of 23 do not encroach into an easement or setback line, delineate with a symbol and
dimension on the first floor plan drawings (including recreation building), second floor
plan drawings, third floor plan drawings and all elevation view drawings the width of
the overhang or building structure that is not depicted on the building footprint
depicted on the plan view drawings, Also place a statement on the site plan (sheet 1 of
23), preliminary master plan (sheet 2 of 23) and landscape plan (sheet 3 of 23)

indicating what part of the building is depicted by the footprint shown on the plan.
Also show, using the symbol found on sheet 1 of 23, the location of the two story
portions of the buildings in Phase II.
5. Dimension the width of the access aisle leading to Phase II. Minimum width for
two-way traffic is 20 feet, However, a 27 foot back-up space is required adjacent to
the parking spaces at the tennis court. Dimension the plan accordingly.
6. The survey submitted with the request does not show a utility easement along the north
property line adjacent to the existing residential homes this existing easement shown
on lake Boynton Estates Plat 2 (PB 14, Pg. 17 P,B,C.R.). Correct the survey
accordingly.
7. Place a note on the site plan (sheet 1 of 23) indicating that there is a recorded
easement agreement which allows access to Phase II through Phase I. Also indicate on
the sheet the recording data,
8, In the total parking data provided on sheet 1 of 23 indicate which total is for Phase I
and Phase II.
9. The detail drawing included with the submittal (sheet 2 of 23) identifies the length of
the parking spaces as 16 feet, If this is correct show with a distinguishable symbol the
remaining two feet of the required eighteen (18) foot long parking space. The eighteen
foot long parking space shall not encroach into the required width of landscape areas
or sidewalks. Clarify the drawings and show compliance with code regulations.
10, It is also evident from reviewing the data found on the floor plan drawings and the
L.U.1. computations that some of the area that you identified as part of the FAR found
on sheet 1 of 23 includes area that could be deducted from the FAR computations.
Amend the FAR data to show the accurate total FAR area.
11. On sheet 2 of 23 specify the color and height of the dumpster enclosure.
12. You have indicated that the colors of the buildings in Phase II will match the colors of
the buildings in Phase I, however, the color of the porch railings identified on the plans
indicate the color of the porch railing will be forest green and the existing porch
railings in Phase I are white,
13. Change the location of the volley ball court shown on the site plan and preliminary
master plan to match the location of the court shown on the landscape plan,
14. Provide elevation view drawings including identifying types of material and colors of
the structure identified as BBQ. Also dimension the location of the structure
consistent with the approved setbacks,
15. Modify the north PUD boundary planting plan to match the buffer planting plan
approved by the City Commission (see Exhibit "D" - approved north PUD buffer
planting plan). Also modify the design of the landscape material shown on detail buffer
drawing titled Section A of the north buffer of the PUD to match the approved buffer
planting plan,
16. To ensure that the location of trees and structures do not encroach into an easement,
add to the site plan and landscape plan, where applicable, notes and symbols that show
the location, size and type of proposed and existing easements. Amend the plan
accordingly,
17. On the plant list and landscape plan delineate with a symbol the trees that are required
for the tree management plan,
18. Place a note on the site plan and landscape plan indicating that the buffer landscaping

required for the north property line of the Phase II project shall be completed prior to
the first e.o. being issued for a building in Phase II,
19. On the section view drawings of the berms, found on the landscape plan, indicate the
location of proposed easements and easements of record. Where applicable, modify
the location of the trees so that trees do not encroach into a utility easements, Also
specify on the detail drawing for the berm along the east property line that the
minimum height of the berm is five (5) feet,
20, Add to the landscape plan the elevations of the contour lines that form berms depicted
on the plan. Also show on the drainage plan the location of the berms,
21, To eliminate a conflict with the location of landscape material and fire hydrants and
drainage structures, show and identify the location of the fire hydrants and drainage
structures on the landscape plan. Relocate the landscape material accordingly,
22. Show on the landscape plan calculations to identify the total number of trees/hedges
and provide a distinguishable symbol that identifies the location of the trees and/or
hedges required to comply with the following code regulations (note; required material
shall meet the minimum size and spacing requirements of the code):

the view of the on-site vehicle use area from the abutting property lines to the:
south south property line of Phase II;
north property line north of buildings 16, 15, 6, 1, 2 and 5 and west of
buildings 16, 13, 12 and 8;
east property line east of buildings 15, 14, 11, 9 and 10 and
west abutting the right-of-way (S,W. 8th Street).
Note: unifying the title of Phase I with Phase II will eliminate the hedge
requirement along the south property line that separates Phase II from Phase I.

location and number of trees required to meet the general landscape
requirement. The total impervious area of the entire site divided by 1,500
equals the general landscape requirement. The site data indicates that there is
a total of 7.95 acres of recreation area, canal easement and open space located
in Phase II or clarify the numbers listed on the landscape plan.
Provide a separate plant list and planting plans to show compliance with the
foundation planting requirements for the front and sides of each building,

23. It is recommended that melaleuca mulch be specified on the landscape plan for the
planting beds.
24. Permit plans shall show compliance with all applicable codes, ordinances and
resolutions.
NOTE: If recommendations are approved, incorporate them into the working drawings required
for permits for the project.

The following is a list of 1st review comments regarding the site plan review of the plans
for the above-referenced project. It should be noted that the comments are divided into
two (2) categories. The first category is a list of comments that identify deficiencies from
the City's Land Development Regulations (L.D.R.) that are required to be corrected and
shown in compliance on the plans and/or documents submitted for second (2nd) review in
order for the project to continue through the site plan review process. The second set of
comment(s) lists recommendations that the Planning and Zoning Department staff believe
will enhance the proposed development. The applicant shall understand that all documents
and plans submitted for site plan review are subject to additional comments. I recommend
that the applicant/agent contact me regarding questions related to the comments. If the
applicant is not intending to correct code deficiencies and they request that the project
remain on the review schedule identified in the attached letter, they should contact me
regarding the procedures, application forms, fees and submittal deadline dates for seeking
relief from the code requirement.
I. SITE PLAN REVIEW COMMENTS:
1. Show on the site plan (sheet 1 of 2) a symbol that represents the boundary of Phase
I and Phase II, Either delineate on the site plan the areas of Phase I that are being
modified or indicate that Phase I is complete and there are no changes are proposed
for Phase I.
2. To properly determine if the parking areas and landscape areas comply with code
regulations, add to the sheet tilted "Site Plan" (sheet 1 of 2) the appropriate
horizontal control dimensions from the property lines to and through the parking
areas and landscape areas to the buildings. The dimensions shall include length of
parking spaces, width of the access aisle/back-up space and dimension of landscape
ares. The control dimensions shall cover all parking spaces and adjacent landscape
areas. Note: minimum back-up space for all parking spaces show as 27 feet,
Dimension the length of the parking spaces west of the leasing office. The typical
detail drawing included with the submittal identifies the length of the parking
spacers as 16 feet. It then appears as though some of the parking spaces west of the
leasing office will encroach the sidewalk area. Please clarify.
3. Relocate building #10 to comply with the 20 foot side setback required between
Phase I and Phase II. Also relocate building #5 to comply with the 40 foot front
setback along S. W. 8th Street.

4. Show, label and dimension on the site plan and landscape plan the established
perimeter building setbacks for Phase II and Phase I, if there are improvements
proposed for that area.
5. Dimension the width of the access aisle leading to Phase II. Minimum width for
two-way traffic is 20 feet. However, a 27 foot back-up space is required adjacent
to the parking spaces at the tennis court. Dimension the plan accordingly.
6. The survey submitted with the request is not accurate, revise the survey and
resubmit. Phase I was platted and submitting a copy of this plat will be acceptable
for that area of the project.
7. Omit from the Parking Calculations the following text (first 10 d.u.'s per bldg.).
8. Change the total parking required for the tennis court area from 1 to 2; change the
total number of parking spaces required for the pool from 14 to 15; and change the
total number of parking spaces required for the leasing office from 6 to 7. Please
note the required parking spaces may be rounded up at the total count of all
amenities rather than at each individual amenity. Show on the plan no less than the
required number of parking spaces. Modify the overall calculations accordingly.
9. Show and dimension, a nine (9) foot wide by eighteen (18) foot long parking space
on the floor plan drawings of each different size garage within each different
building type that has a garage. Also, show on the site plan drawing a nine (9) foot
wide by eighteen (18) foot long parking space in the driveway outside of each
garage.
10. Submit a cross access agreement document that describes legal access to the subject
site through the "The Vinings at Boynton Beach" - Phase I, PUD. This document
shall be submitted for review and not executed until it is approved by the city's legal
staff.
11, To ensure that the building overhang does not encroach into an easement or setback,
show and dimension on the site plan the location and width of the building
overhangs.
12. To properly evaluate the floor area ratio FAR, indicate on sheet how many and
which type of dwelling unit style is located within each of the three building types.
13. To provide the proper screening along the north property line of the PUD, modify
the location of the landscape material at the lift station. This comment will require
coordination with the Utility Department. Due to the surplus parking spaces for the
Phase, reworking the vehicle use area south of the lift station will allow the required
screening along the north border of the PUD to remain continuous in the area of the
lift station. A site visit to the lift station indicated there is land between the north
fence line of the lift station and the south lot line of the residential lot directly north
of the lift station. Show on the landscape plan berm, palms and hedges in this
area.
14. Modify the north PUD boundary planting plan to match the plan approved by the
City Commission (find attached north property line buffer plan - Woolbright Pace
PUD) .

15. To ensure that the location of trees and structures do not encroach into an easement,
add to the site plan and landscape plan notes and symbols that show the location,
size and type of proposed and existing easements. Amend the plan accordingly.
16. On the plant list and landscape plan delineate the trees required from the tree
preservation ordinance analysis.
17. Place a note on the site plan and landscape plan indicating that the buffer
landscaping required for the north property line of the Phase II project shall be
completed prior to the first C.O. being issued for a building in Phase II.
18. On the section view drawings of the berms, found on the landscape plan, indicate
the overall height and slope of each berm. Also add the berms to the preliminary
drainage plan sheet 2 of 2. Note: the heights of the berms shall not be less than
originally approved.
19. Identify the type of fence proposed for the buffer area that is shown in section view
C. As stipulated by the City Commission approval of the project, remove all of the
Black Olive trees along this buffer area and replace with a native tree.
20. As stipulated by the project approval, coco plum hedges are required along the
buffer line identified as section C, therefore, add a symbol to the landscape plan
drawing that represents cocoplum hedge material. Also change the spacing of the
cocoplum hedge, found in the plant list, from three (3) feet on center to two (2) feet
on center, to match the note shown on the plan north of building #5.
21. Add to the plant list for Phase II the height of the shrubs (note: minimum height is
18" unless otherwise specified).
22. Add to the landscape plan elevations of the contour lines that form berms depicted
on the plan. Also show on the drainage plan the location of the berms.
23. To eliminate a conflict with the location of landscape material and fire hydrants and
drainage structures, show and identify fire hydrants and drainage structures on the
landscape plan. Relocate the landscape material accordingly.
24. Show on the landscape plan calculations to properly identify the total number of
trees and/or hedges required to comply with the following code sections for Phase
II (note: use a symbol on the landscape plan that indicates the location of the
landscape material that is provided to meet the code specifications):

buildings in Phase I? The color code for the colors in Phase II do not match the
color code approved for Phase I. However, the colors depicted on the color
elevation. drawing submitted for Phase II are vary similar to the colors approved for
Phase I. Please clarify.
26. Specify on the elevation view drawing found on sheets AM-2, A- T1.3, A- T2.3 and
A- T3.2 the location of the colors referenced in the color selection chart. Also
incorporate the color chart found on sheet AM-2 onto the plan and omit the stick-
on. The elevation view drawings and color chart shall reference the color name,
color code and color manufacturer for the following exterior material:
i. roof tile
ii. fascia
ii. wall stucco
iv. window, door and arched raised stucco bands
v. mid wall raised stucco band
vi. columns
vii. column cap and base
viii. window frame
ix. door and door frame solid
x. door and door farm glass
xi. overhead door and frame

27. On sheet 2 of 2 specify the color and height of the dumpster enclosure.
II. RECOMMENDATION(S):
28. It is recommended that the volley ball court be relocated between the west end of
buildings 8 and 12.
29. It is recommended that melaleuca mulch be specified on the landscape plan for the
planting beds.
NOTE:
If recommendations are approved, incorporate them into the working
drawings required for permits for the project.

I would like to thank you both for the time you spent with members of my staff on resolving these
important issues, Following is our understanding of the changes which must be made in the landscaping
and/or utilities plans for these projects:

1) Relocate proposed water main to the back edge of the bicycle path (Le, between bicycle path
and property line);

THE VININGS
1) Along the east landscape buffer which co-exists with a utilities easement, the cross-section plan
indicates a raised berm which is approximately centered over the proposed water main, We have
no objection to the plantings east of the water main being changed to scrub oak, installed via hand
digging. Landscaping west of the water main shall remain as shown or be reduced to hedges and
sod without any trees. Shrubs may be installed over the water main, but the scrub oak must be
offset a reasonable distance to avoid damaging the main during installation.
2) For the existing sanitary manhole adjacent to building no. 11, a stabilized access way will be
required from the pavement to the manhole, or the manhole may be relocated southward to a point
that is accessible from the pavement.
We would be pleased to meet with the developers of these two projects to discuss the changes if you agree
with them as stated, Please refer any further questions on this matter to Peter Mazzella of this office.

Find attached for your review the plans and exhibits for the
above-referenced project, Site Plan Review approval for this
project will be granted by the City Commission, To ensure that
the project stays on line with the review time frame, I request
that the plans and exhibits be reviewed and for.mal written
comments transmitted to the Director of the Planning and Zoning
Department no later than 5:00 P.M. on April 12, 1996. Do not
return plans and exhibits. Retain same for the review of the
amended plans (second review) .
Adhering to the following review guidelines will promote a
comprehensive review and enable the applicant to efficiently
obtain Technical Review Committee approval:
1. Use the review standards specified in Part III, Land
Development Regulations, Chapter 4, Site Plan Review,
Section 8 of the Code of Ordinances to review and formulate
comments,
2, The documents submitted for the project were determined to
be substantially complete based on the submittal
requirements identified in Section 7 of the Site Plan Review
Ordinance. However, if the data provided to meet the
submittal requirements is insufficient to properly evaluate
and process the project based on the review standards or the
documents show code deficiencies, additional data and/or
corrections should be requested by the reviewer through the
Planning and Zoning Department.
3. Each comment shall reference the section of the code that is
incorrectly depicted on the documents.
4, Technical Review Committee member(s} shall identify iri their
comments when the plans depict or when the location and
installation of their departmental required improvements may
conflict with other departmental improvements,

his/her review responsibility, the comment and the specific

forward a memo, within the time frame stated above, to the
Planning and Zoning Director stating that the plans are
approved and they do not have any comments on the plans
submitted for review and recommend the project be forwarded
through the approval pro.cess.
All comments shall be typed, addressed and transmitted to the
Director of the Planning and Zoning Department for distribution to
the applicant, Please include the name and phone number of the
reviewer on this memo, Michael E. Haag will be the Planning and
Zoning Department staff member coordinating the 1st review of the
project,
The Planning and Zoning Department will send the applicant a cover
letter which includes the comment(s) and directions to amend the
plans to comply with the comments and the procedures for
resubmission, When the Planning and Zoning Department receives the
amended plans, they will distribute the plans with a cover memo to
all TRC Members for review and approval,

Dear Mr. Hallahan:
This letter serves as our Tree Management Plan for the above
referenced site as you requested.
INTRODUCTION: The proposed Vinings at Boynton Beach Phase I and
Phase II is located within the Woolbright Place PUD. The Phase I
site consists of 15.37 acres. The Phase II site contains 18.50
acres. The majority of the sites have been previously cleared.
The remaining vegetation, due to the condition of the deep sandy
soils, consists dominantly of scrub plant species with minor
invasions by the undesirable exotics.
EXISTING TREES ON SITE: On August 18, 1994, Gregory S. Mire,
P.L.S., made an inspection of the site and found no hardwoods,
122 Slash Pine (Pinus elliottii) and 2 Sabal Palms on the sites.
PRESERVATION PLAN: We will attempt to move and preserve the
Sabal Palms to the areas shown on the Landscape Plan at the
perimeter buffer area. Removal of the Slash Pines is
contemplated for two reasons (a) interference with proposed
improvements and (b) due to finish grade changes contemplated to
the site.
RELOCATION OF PALMS: The two Sabal Palms selected for relocation
will be tagged with colored surveyor's tape and marked. The best
method of relocation is believed to by tree spade or equivalent.
Fronds shall be carefully removed except for the young protective
growth surrounding the heart or bud at time of transplanting.
REPLACEMENT OF SLASH PINES: The Slash Pines will be removed and
replaced in equal quantity with differing species as shown on the
landscape plan. Please note the following tabulation:

MAINTENANCE PROGRAM: At the time of planting relocated material, an
earth berm shall be formed along the outside edge of the root ball to
create a basin for retaining water within the root ball area.
Irrigation of relocated plant material shall be administered in
adequate amount by means of an automatic or manual system in
conjunction with rain fall. The duration for the watering program is
intended to continue until the root system is established and the tree
can maintain itself on natural rain fall. Bracing of relocated trees
will be determined in the field as to size of the tree and site
conditions such as on a slope. Fertilization of relocated plant
material shall occur once at the time of transplanting.

RIDER TO SITE PLAN APPLICATION
The undersigned as applicant for Final Site Plan Approval does
