WHEREAS, CCL Consultants, Inc., agent for Howard R.
Scharlin, Trustee for the Woolbright Place PUD, has requested
the abandonment of a 12 foot utility easement, running
approximately 200 feet east of and along SW 8th Street,
hereinafter described; and
WHEREAS, comments have been solicited from the appropriate
City Departments, and public hearings have been held before the
City's Planning and Development Board and the City Commission on
the proposed abandonment; and
WHEREAS, based on the foregoing information, the said
utility easement no longer serves any useful purpose,
NOW, THEREPORB, BB IT RESOLVED BY THE CITY COMMISSION OP
THB CITY OP BOYNTON BEACH, PLORIDA THAT:
Section 1, The City Commission of the City of Boynton
Beach, Florida by and through its City Commission, does hereby
abandon a 12 foot utility easement running approximately 200
feet east of and along, SW 8th Street, located in the City of
Boynton Beach, Florida and more particularly described in
Exhibit "A" attached hereto.
Section 2. The Mayor and City Clerk are hereby
authorized and directed to execute and deliver the attached
Disclaimer and cause the same to be filed in the Public Records
of Palm Beach County, Florida.
Section 3, This Resolution

Mayor Pro Tem Bradley moved approval of Proposed Resolution No. R95-27.
Commissioner Aguila seconded the motion, which carried 5-0.

This item was dispensed with earlier in the meeting.
4. PropOSed Resolution No. R9S-29 Re: Authorize acceptance of one
(1) acre of property located on Martin Luther King, Jr. Boulevard
(N. E. 10th Avenue) from Palm Beach County
City Attorney Cherof read Proposed Resolution No. R95-29 by title only.
Motion
Vice Mayor Matson moved approval of Proposed Resolution No. R95-29.
Commissioner Katz seconded the motion, which carried 5-0.
5. Proposed Resolution No. R9S-30 Re: Authorize execution of
agreement between the City of Boynton Beach and Hypoluxo Harbor
Inc., granting them a commodity-only rate and establishing con-
ditions related to transport of sewage into the City's sewer
sys tern
City Attorney Cherof read Proposed Resolution No. R95-30 by title only.
Motion
Mayor Pro Tem Bradley moved approval of Proposed Resolution No. R95-30.
Commissioner Aguila seconded the motion.
Commissioner Katz asked how the rates are set. City Manager Parker advised that
they are set by ordinance. They are set annually, usually during the budget
hearings.
Mr. Mazzella added that the commodity rate is set by Code. Per this agreement,
the City will not charge the base rate per dwelling unit.
Mr. Eckler, the Project Engineer, asked the Commission to make the effective
date of the resolution December 31, 1994, which was the date the system was con-
nected to the City.
Mayor Hanmening asked if he has been paying a different rate in the meantime.
Mr. Eckler said there is one months' billing that is at a different rate. It
includes the unit rate. It was the intent to have the agreement done. The
paperwork did not get accomplished in time.

approximately 200 feet east of and along SW 8th Street,
hereinafter described; and
WHEREAS, comments have been solicited from the appropriate
City Departments, and public hearings have been held before the
City'S Planning and Development Board and the City Commission on
the proposed abandonment; and
WHEREAS, based on the foregoing information, the said
utility easement no longer serves any useful purpose,
NOW, THEREFORE, BB IT RESOLVED BY THB CITY COMMISSION OF
THB CITY OF BOYNTON BBACH, PLORIDA THAT:
Section 1. The City Commission of the City of Boynton
Beach, Florida by and through its City Commission, does hereby
abandon a 12 foot utility easement running approximately 200
feet east of and along SW 8th Street, located in the City of
Boynton Beach, Florida and more particularly described in
Exhibit "Aft attached hereto.
Section 2. The Mayor and City Clerk are hereby
authorized and directed to execute and deliver the attached

1. Sears Auto Center - This project went before the City Commis-
sion on December 20th. With four Commissioners in attendance,
a 2-2 vote resulted, which is neither considered a denial or
an approval. The project did not move forward. At the
January 3rd City Commission, Mayor Pro Tem Bradley requested
that the project be reconsidered. With five Commissioners
present, the project was approved subject to staff comments,
with the exception of construction of the wall. In lieu of
the wall, additional landscaping along the north property line
and the northeast property line were required. Further, the
City Commission has required that the dumpster enclosure be
widened to accommodate the second dumpster.
2. Abandonment for the V1n1ngs - This abandonment was unanimously
approved by the Commission subject to staff comments.
3. C1trus Park T1me Extens10n - The City Commission approved the
six-month time extension subject to staff comments.

Request for abandonment of a 12 foot wide
utility easement that runs approximately
200 feet east of and along SW 8th Street.

Mr. Haag made the presentation. This easement is located in the Woolbright
Place PUD. Mr. Haag used the overhead projector to display drawing$ of this
site.
A City sewer force main was put in place when the' property was platted for
single-family homes. The easement worked its way north and over to Lift Station
#603 which is a major part of the force main for sewage for all of the property
to the south and west of it. There are connections at Woolbright Road entering
the force main which lead to the Lift Station. During the development of the
Tradewinds project, a new Lift Station was recommended and the City and devel-
oper shared the cost of construction for a new Lift Station which is very close
to the old Lift Station.
The new force main will eventually connect into the existing force main at
Woolbright Road. The sewage coming trom the development to the southeast has
been rerouted into existing Lift Stations on the property to the south. The
sewer and force main which goes along Woolbright Road and was feeding the old
Lift Station is no longer needed. .
Staff recommends approval of the request for abandonment of the easement. There
were no objections from Engineering, Utilities, or Planning and Zoning. The
easement is located within the property owned by the applicant. There were no
objections by the outside utility companies. The only requirement placed on
this is that prior to the abandonment receiving City Commission resolution
approval, the City Utilities Department must receive the Health Department
approval that the new force main in the south end is ac~eptable to City
standards as well as Palm Beach County Health Department. This should occur
within the next three or four days. When that happens, the applicant can remove
all of the old force main. The old Lift Station will be removed when Phase II
is developed.

Mr. Haag pointed out that there is an error in the legal Description. He
questioned whether or not Mr. Campanelli was aware of the error.
Mr. Campanelli said he saw it on the plans and does not know how that came to
be. They probably pulled an east off rather than a west.
Mr. Haag said staff feels this can go forward even though the advertisement was
incorrect because this is well within the applicantls property. The drawing,
which went along with the legal ad, was published in the newspapers and went to
the utility companies.
Motion
Vice Chainman Dube moved to approve the abandonment by CCl Consultants for
Howard R. Scharlin for The Vinings at Boynton Beach of a 121 wide utility ease-
ment that runs approximately 200' east of and along SW 8th Street. Mr. Golden
seconded the motion.
Mr. Weigle suggested adding something to the motion regarding the ~gal
Description.
Mended Motion
Vice Chainman Dube amended his motion to include the revised legal Description
changing east to west on line 112. Mr. Golden seconded the amended motion,
which carried unanimously.

the multi-family portion. The purpose of this modification is to further sub-
divide the PUD. Using the overhead projector, Ms. Heyden pointed out that what
was the phase line is now becoming a property line.

RE: Vinings At Boynton Beach - Request for easement abandonment
Dear Ms. Scherer:
We have received a copy of the request you transmitted for abandoning the portion of an existing
force main easement located on phase 1 of the Vinings at Woolbright Place. As you discussed
with Peter Mazzella of my staff on this date, we have seen very little progress on the replacement
force main project over the past several weeks despite repeated meetings, and assurances from
the engineer and contractor.
As you are also aware, the easement for which you are requesting abandonment contains an active
force main which transmits all of the sewage from the south part of Leisureville, and all of the
Golfview Harbor development. We cannot approve any measures leading to the abandonment of
this main until the replacement main is fully completed (including all restoration), cleared for use
by the Health Department, and under full control of the City. Only then could we re-direct the flow
from the existing main to the new main.
We regret any delay that our disapproval may cause your project, however we think you can
appreciate how the matter is out of our hands until the replacement force main is fully operational
and under our complete control. Getting the replacement main to that juncture is still the
responsibility of the site developer/applicant, for which Mr. Morton is the agent.

Mended Motion
Mr. Golden amended his motion to include a recommendation for additional land-
scaping along the north property boundary if the City Attorney ascertains that
the buffer wall is not required. Vice Chainman Dube seconded the amended
motion, which carried unanimously.
ABANDONMENT

Request for abandonment of a 12 foot wide
utility easement that runs approximately
200 feet east of and along SW 8th Street.
Mr. Haag made the presentation. This easement is located in the Woolbright
Place PUD. Mr. Haag used the overhead projector to display drawings of this
site.

Description:
A City sewer force main was put in place when the' property was platted for
single-family homes. The easement worked its way north and over to lift Station
#603 which is a major part of the force main for sewage for all of the property
to the south and west of it. There are connections at Woolbright Road entering
the force main which lead to the lift Station. During the development of the
Tradewinds project, a new lift Station was recommended and the City and devel-
oper shared the cost of construction for a new lift Station which is very close
to the old Lift Station.
The new force main will eventually connect into the existing force main at
Woolbright Road. The sewage coming from the development to the southeast has
been rerouted into existing Lift Stations on the property to the south. The
sewer and force main which goes along Woolbright Road and was feeding the old
Lift Station is no longer needed.
Staff recommends approval of the request for abandonment of the easement. There
were no objections frbm Engineering, Utilities, or Planning and Zoning. The
easement is located within the property owned by the applicant. There were no
objections by the outside utility companies. The only requirement placed on
this is that prior to the abandonment receiving City Commission resolution
approval, the City Utilities Department must receive the Health Department
approval that the new force main in the south end is acceptable to City
standards as well as Palm Beach County Health Department. This should occur
within the next three or four days. When that happens, the applicant can remove
all of the old force main. The old Lift Station will be removed when Phase II
is developed.

Mr. Haag pointed out that there is an error in the legal Description. He
questioned whether or not Mr. Campanelli was aware of the error.
Mr. Campanelli said he saw it on the plans and does not know how that came to
be. They probably pulled an east off rather than a west.
Mr. Haag said staff feels this can go forward even though the advertisement was
incorrect because this is well within the applicant's property. The drawing,
which went along with the legal ad, was published in the newspapers and went to
the utility companies.
Motion
Vice Chainman Dube moved to approve the abandonment by CCl Consultants for
Howard R. Scharlin for The Vinings at Boynton Beach of a 12' wide utility ease-
ment that runs approximately 200' east of and along SW 8th Street. Mr. Golden
seconded the motion.
Mr. Weigle suggested adding something to the motion regarding the legal
Description.
Mended Motion
Vice Chainman Dube amended his motion to include the revised legal Description
changing east to west on line '12. Mr. Golden seconded the amended motion,
which carried unanimously.
B. SUBDIVISIONS
MASTER PLAN MODIFICATION

Request to amend the previously-approved master
plan to subdivide Pods 2A and 2B and establish
building, pool and dock setbacks from the new
property line.
Ms. Heyden made the presentation. This PUD is located on SW 8th Street,
approximately 900' north of Woolbright Road. The modifications are limited to
the multi-family portion. The purpose of this modification is to further sub-
divide the PUD. Using the overhead projector, Ms. Heyden pointed out that what
was the phase line is now becoming a property line.

the penmanent setbacks from that property line. Those setbacks are being
established at twenty (20) feet. The side setback for a pool has been set at
