DESCRIPTION: Adoption of the attached resolution will finalize the action taken by the City Commission at the December 20, 1994 City Commission meeting. At that meeting, the city Commission approved the abandonment of a portion of a twelve foot wide utility easement that is located approximately 200 feet east of S.W. 8th street and within the proposed vinings development. Abandonment of the easement is necessary so that the apartment buildings which have been site plan approved and within the permitting process, will not encroach the easement. Since there was an active utility line within the subject easement, this approval was subject to Palm Beach County Health Unit clearance of a replacement force main system. RECOMMENDATION: The Planning and Zoning Department recommends approval of this resolution. DESCRIPTION: This request is for abandonment of a twelve (12) foot wide utility easement located approximately 200 feet east of S.W. 8th Street and within the proposed Vinings rental apartment project. The force main within the easement is being rerouted as part of the installation of infrastructure to serve the Woolbright Place PUD, of which the Vinings is a part, and the Shoppes of Woolbright PCD to the south. RECOMMENDATION: The Planning and Development Board unanimously recommends approval of this request, subject to the attached staff comments (Utility Department memorandum dated November 21, 1994) being satisfied prior to Commission adoption of the resolution finalizing the abandonment. Scharlin, trustee for the Woolbright Place PUD, is requesting abandonment of a portion of a twelve (12) foot wide utility easement that contains a city sewer force main which services an area south of Woolbright Road. Only that portion of the easement that is located approximately 200 feet east of S.W. 8th Street and within the proposed Vinings development is included in this abandonment request. The Vinings is an apartment complex to be constructed within Pods 2A and 2B that has received City Commission approval for construction and is located on the east side of S.W. 8th Street, approximately 1,400 feet north of Woolbright Road (see attached location map). The attached, Exhibit "A", shows the location of the easement in relation to the Vinings project. BACKGROUND The easement, including the portion to be abandoned, was dedicated across the undeveloped land of the former Lake Boynton Estates Plat No. 1 (replatted as Woolbright Place Plat No.1) to provide city sewer to the developments south of an existing pump station, which is no longer operable. This old pump station is located near the northeast corner of the future Vinings Phase II project. The easement extends from Mortons Way north, along S.W. 8th Street, through the single-family planned portion of the Woolbright Place PUD and then east where it terminates at the old pump station and at a new pump station, 120 feet north of the old pump station. The old pump station was shut down and replaced with the new station. The new station has been operating since it was built several years ago when much of the infrastructure for the Woolbright Place PUD and Shoppes of Woolbright PCD was installed. ANALYSIS The portion of the easement to be abandoned is located near or within the footprint of several apartment buildings proposed within the Vinings project. The force main within the easement is being rerouted as part of the installation of new infrastructure to serve the Woolbright Place and Shoppes of Woolbright proj ects while maintaining existing service. The subject easement will no longer be needed once the force main is rerouted. The Utility Department is in agreement that the approval of the abandonment can be made by the Planning and Development Board and City Commission provided that the adoption of the abandonment resolution by the city Commission does not take place until after construction and city approval of the diversion of the new force main is completed. I page 2 The Vinings P & Z Dept. Memo #94-346 The city departments involved in review of a request for abandonment and the parties that were given public notice of the requested abandonment are identified below. Public notice is given to the property owners that abut the easement to be abandoned. The notice of this public meeting was published on November 24, 1994. The newspaper advertisement published on November 24, 1994 for notice of the December public meetings included an error in the legal description that was provided by the applicant. The error is circled on page 1 of Exhibit "A" and consists of a mislabeled direction. "South 88026'13" East" should be "South 88026'13" West" as corrected and shown on page 2 of Exhibit "A". The Engineering Division notifies the various utility companies that may have a potential interest in the easement. The area of the proposed abandonment is located entirely within the property owned by the applicant. The applicant I s reasons for requesting the abandonment and the grounds that support the request are shown on the enclosed copy of the last page of the abandonment application form.
