We have received the attached J\1arch 20, 1997 mernQ from John Guidry regarding the V wings Phase [J City
water/sewer impact fees. It is clear that Trammel Crow paid the City water/sewer impact fees based en
current ratei pursuant to your written request and it is clear that my client is entitled to the 533,580.80
differential between the current rates and th~ 1986 rate. The City previously paid that differential to my
client for Vinings Phase I as was agreed upon.
Mr. Guidry mggests that this differential be paid over to Trammel Crow and we should seek collection of
the differential from them. By making the additional water/sewer impact fee payment to the City'tttyour
request~ it is clear that Trammel Crow understands that they are not the beneficiary of my client's settlement
with the City and they have fulfilled their obligatiOlllo pay current rates. We are hopeful that we do not
need to result to further litigation in order to instlre that the City upholds their agreement with my client.
To the extent that the City wants to insure that they will not be subject to any claim by Trammel Craw f)r
tbis differeotial, we would consider agreeing to indemnify and hold harmless the City from any such claim..
We urge you to re.lease this money to my client immediately.

With regard to the County impact fee issues, we appreciate the City's placement in escrow of the
$301,708.43 paid by Trammel Crow. We are awaiting confirmation from Palm Beach County that this is
the correct amount'ofimpact fees due to them and also their deposit ofilie Burger King impact fees whic11
were paid to the County directly, as opposed to being placed in the escrow account. Once that is done we
will move forward and establish our road-construction credits with the County an.d we will be in a. position
to propose a modification of the existing settlement agreement to accurately reflect our respective clients'
positions on the payment of impact fees.

Yesterday we were informed that Mike Haugh would not release Building #5 (the 8th building
to receive a e,o. tn this project per \:onditlon of approval) as he felt he could not make ~l ruling
on the adequacy (If the height of the berm on the north side of our property wh~r~ it ahuts thl:
!<lingle family h()rlles.
The berm has be~n c~)mple(cd and measures in excess of 4' from (he grade of the single tamily
hOllies. The berm is intended to block OUI' project from the view of the 'lingle family homes and
the homeowners have not appeared to be displeased by the installation. Mr. Haugh, hOWCVCI',
is UI1SlIl'C from what point the height of the berm should be measured and has requested Utl to
provide ~ln engineering cross section, which we are working on.
While we are compiling this additional infonnation for Mr. Haugh. thi~ should not hold up our
C.O. and we would ask you allow us [0 co. Building #5, and simple make this ~l condiliun on
the nt:Xl building relcasc.

Gentlemen:
Please be advised that on Tuesday, February 19, 1991, the
City Commission approved the above-referenced site plan, subject
to staff comments, copies of which are attached. Furthermore,
the Community Appearance Board is requiring the following
stipulations:
a. Trees planted within the perimiter buffer areas are to
be 12-14 feet in height and spaced 40 feet on center.
b. All other trees planted on the site are to be a minimum
of 12 feet in height.
c. All ground mounted air-conditioning units are to be
screened by shrubs.
d. The relocation of existing on site landscaping is to be
handled by City Staff.
These plans were approved subj ect to your compliance wi th the
attached stipulations and must now be modified to incorporate
same. To initiate your sign-off procedure, please submit two (2)
sets of modified plans to the Office of the site Development
Division of the Building Department, which will record the
required identification markings on each set of the modified
plans. '

After both sets of modified plans have the appropriate markings,
you should proceed with your sign-off on both sets of plans from
each Technical Review Board member. The sign-off procedure
requires that the Engineering Department sign-off first, followed
by all other departments with the exception that the Planning
Department sign off next-to-Iast and the Building Department
sign off last. The Zoning & Site Development Administrator will
provide the Building Department sign-off. One (1) set of final
signed-off plans will remain with the Building Department and the
other set of plans will be returned to you to be retained at the
job site.
To help facilitate the sign-off process, appointments should be
made to meet with each Technical Review Board member to allow
them sufficient time to review and sign-off the modified plans.
After securing all the required Technical Review Board member
signatures and completing processing by the Site Development
Division, you may apply for building permits by sUbmitting the
appropriate documents and fee to the Plan Review and Permitting
Di vision of the Building Department. The Building Department
will advise you as to any additional permits which may be
required, such as Palm Beach Health Department (water and sewer),
clearing/grubbing, excavation/fill, drainage, paving, site
lighting, landscaping and irrigation.
The approval of the City entitles you to construct only the
improvements shown on the site plan. The site plan wil:).. be
viewed procedurally as an as-built or record drawing. If you
have any questions concerning this matter, please do not hesitate
to contact me.

the Vinings PUD has been recorded with the County Clerk of Court.
That allows us to, and we hereby do, issue a Land Development Order
as outlined in Appendix C, Boynton Beach Code of Ordinances.
Issuance of a Land Development Order allows you to proceed with
construction o~ required improvements. You are reminded that all
required improvements must be completed by December 9, 1996 as
stipulated in Appendix C, Article XI, Section 5. (twenty-one months
from today). Failure to complete the required improvements by that
date and absent an approved time extension the City Commission may
call upon your surety to complete the work.
Appendix C, Article XI, Section 5 requires monthly progress reports
from your Engineer of Record, and we suggest that you schedule a
pre-construction meeting with City Development and Utility
Department staff to discuss scheduling, permitting, inspecting and
other appropriate topics. This Land Development Order also allows
you to enter the building permit process. For information on that
process, please contact Chief Plans Reviewer Milt Duff (375-6352).

Dear Ms. Scherer:
The city of Boynton Beach has completed its first review of the
documents submitted for the above-referenced proj ect. Attached are
comments made by the reviewing departments during their initial
review of your project.
The developer and agent agreed with staff at the time of initial
drawing submittal to slightly modify the court ordered review
process to coincide with previously scheduled staff, board and
commission meetings. It was further agreed that a second submittal
in response to the staff comments attached in this document would
be made approximately August 18th for staff's review of the revised
documents prior to the August 23rd Technical Review Committee
meeting.
The following paragraphs and attached checklist refer to the normal
si te review procedure which is approximated by submitting 2nd
review drawings on August 18th.
Adherence to the following paragraphs and check list will more
easily facilitate the approval process as staff and board members
are familiar with the process.
After amending the plans and documents, please submit twelve (12)
complete sets (including surveys) of the plans to the Planning and
Zoning Department. When the amended plans and documents have been
submi tted to the planning and zoning Department, they will be

Trammell Crow has never been asked to bond for recreation features.
As this is a privately owned and operated rental community, it is
our business strategy to include high quality, long lasting and
state-of-the art equipment, as evidenced at all our properties.
Bonds are expensive to secure, and I would respectfully request
that you consider the tactic used by other municipalities-- and
that is to withhold the last c.o. if these items are not fully
completed or installed.

the Vinings at Boynton Beach Phase I, and we are currently pulling
building permits for this project. As a part of our construction
loan closing, one title matter which presented itself as a
confusing matter is that of the Stipulation and Settlement between
the City and Tradewinds.
Since we have been approved for development and paid all fees as
have been required to move forward on our site, we ask that the
City release the Phase I land from the provisions of the Settlement
Agreement. In addition, we have provided that upon a site plan
approval of Phase II, the Phase II portion would also be released
from the Settlement Agreement.
Due to the very tight time frame we are under, I have included an

1638-AE (collectively the "Cases"), which stipulation was recorded
in Offic1al Records Book 6416, paqe 987 of the Public Records of
pailn Beach County, Florida on April 8, 1990.
3. Attached to the recorded stipulation was that certain
Stipulation and Settlement in the Cases, together with various
exhibits and correspondence, the recorded copy of which beqins at

Beach County, Florida (the "Second stipulation"). The stipulation

As we are following a slightly modified submittal schedule and in
trying to keep within your normal processing schedule, I have taken
the time to address each comment in writing to facilitate your
review.
(Please note that we changed the numbering system of the buildings
in each phase to better reflect what we believe will be an actual
building construction sequence.)
I. COMMENTS AND RECOMMENDATIONS PLANNING AND ZONING DATED AUGUST
16, 1994.
1. Survey shows phase line. Please call me Monday to discuss.
2. Construction may not be continuous. It is planned that the
entire entry and lake with full landscaping as shown on the
plan, will be constructed as part of Phase I.
3. Leasing Office buildings are shown and labeled on the Site
Plan and Landscape Plans. We have re-addressed the parking
for leasing office, recreational buildings and recreation
areas including pool, tennis and fitness. The Code does not
specify that any additional parking is required for a tot lot
or barbecue area. A new tabulation indicating these items is
shown on the Site Plan. We have indicated the approximate
square footages of water area and tennis court. We have also
added additional spaces to provide for 2 spaces for each of
the one-bedroom units on the entire site,
4. Landscape Comments.
a. This item was brought up in the City Commission meeting
and addressed as part of the Master Plan. It is my
understanding that the landscape buffer would be
installed at the time of first C.O. of either the single
family development or in conjunction with the second
phase construction.
b. We have modified the entire Landscape Plan to include all
shrubbery and hedging detail on the plan.

e. (1) We don't understand what is meant by this comment.
(2) A note as to the amount of plant material has been
added to the Plan.

g. Ficus Benjamina has been removed from areas of concern.

1. Palm Tree clear trunk height has been indicated on the
plan at 8-10'.
j. Profiles of the north and east landscape buffers have
been included on the Landscape Plan. We believe these
sketches are consistent with the buffer requirements
instituted by the court order stipulation.
k. Contour lines will be included in the final drainage
plans. (There is little room on landscape drawing for
contour lines.)
1. Grass types have been specified on the plan. Method of
installation would be either hydromultch or sod depending
on season at time of installation.
m. Easements have been added to the Landscape Plan.
n. Fire hydrants have been located on the landscape plan.
Entrance sign height, color, etc. is shown on the Signage
Plan.
5. Project Signage plan depicts everything except for the
location of building, directional and amenity signage.
Building signs would be placed in the green area in the front
of each building. Where a side of a building is easily viewed
from the road, such building would have two signs. Recreation
area signs would be placed near the recreation area. Traffic
signs would be placed at locations as shown on the Site Plan.
Unit door signs would be placed to the left or right of each
entry door. Restroom signs would be placed at the cabana bath
entry doors. Directional signs would be placed at strategic
locations around the site to assist residents and visitors.
6. The recorded copy of the Plat (Plat Book 67, pages 47-49
recorded on December 28, 1990) that I have obtained from your
office does not reference a Tract D. I have pulled from the
archives a copy of an old unrecorded plat dated September
1990, which does show a Tract D drainage ditch. Please see
the recorded document.
7. Amenity data is shown on Site Plan. As you requested,
attached are the floor plans and elevation plans for the
leasing office and fitness area.
8. Dumpster Screening would consist of concrete masonry walls
with stucco finish. We have had discussions with Bob
Eichorst. Details of the dumpster enclosures are shown on the
plans.
9. Handicapped parking tabulations have been revised. See Plan.
10. Elevation plans indicate paint colors, materials, etc.
11. Elevation height is indicated on architectural renderings.
12. Sidewalks will be of concrete; docks will be of pressure
treated wood; pool decks will be imitation coral pavers.

18. As I received this comment on August 17 and it is the first
mention we have had regarding your requiring cost estimates
for recreational facilities and bonding. I would need
additional time to review the criteria and put this together
for you.

19. The recreational facilities located on Phase I would be
constructed during Phase I.
20. The first statement regarding the amenities for the two phases
of the multifamily developments not being shared with the
future single family is correct.
21. There is no plan to provide for a sub association of any kind
that would affect the Phase I or Phase II parcels. The owner
of the developments will be responsible for all maintenance.
22. A 20' buffer between the multifamily Phase II parcel and the
single family parcel was approved by council. This 20' buffer
includes 10' feet of buffer on either side of the boundary and
a 5' chain link fence to be placed at the center of the buffer
(property line). Ficus type hedging would be installed on
both sides and properly maintained.
II. COHMENTS FROM PUBLIC WORKS DATED AUGUST 5. 1994.
Dumpster locations have been adjusted. Some dumpsters have been
consolidated for ease in sanitation truck pick-up.
III. COMMENTS FROM ENGINEERING DATED AUGUST 11. 1994
1. Revised documents are attached.
2. Excavation permits will be secured prior to construction.
3. The survey should be complete.
4. Calculations will be provided along with final engineering.
5. All SFWMD permits and modifications will be obtained if
required. (See copies of permit and modification attached)
6. Drainage abandonment and relocation is in process. It is my
understanding that this will be constructed during the
installation of S.W. 8th Street.
7. Certificate by Engineer is on the Plan.
a. All drainage outfalls from parking areas will be routed
through grassed and landscaped areas for filtration prior to
discharge into the lake.
9. 15" pipe is called out on the Drainage Plan.

liable for any damages sustained to the dumpster enclosures along

customary maintenance and/or repairs required to be performed by

On February 15, 1990 the Governing Board of the District issued Surface Vater
Management Permit No. 50-02146-5. The permit is for individual conceptual
approval of the 115.32 acre development with construction and operation of a
water management systell serving 16 acres of residential' lands (Phase 1)'
discharging to the C-15 canal via lake Worth Drainage District's E-4 canal. .
MODIFICATION
The lake area will be increased froll 5.3 acres to 5.5 acres. The additional
volume necessary for water quality in the previously permitted dry detention
areas will now be provided 1n the wet detention area. The proposed commercial
areas will be used for retail, office and church use.

RIDER TO SITE PLAN APPLICAT~ON
The undersigned as applicant for Final Site Plan Approval does
hereby acknowledge, represent and agree that all plans,
specifications, drawings, engineering, and other data
submitted with this application for review by the City of
Boynton Beach shall be reviewed by the various boards,
commissions, staff personnel and other parties designated,
appointed or employed by the City of Boynton beach, and any
such party reviewing the same shall rely upon the accuracy
thereof, and any change in any item submitted shall be deemed
material and substantial.
The undersigned hereby agrees that all plans,
specifications, drawings, engineering and other data which may
be approved by the' City of Boynton Beach, or its boards,
commissions, staff or designees shall be constructed in strict
compliance with the form in which they are approved, and any
change to the same shall be deemed material and shall place
the applicant in violation of this application and all
approvals and permits which may be granted.
The applicant agrees to allowing the City of Boynton
Beach all rights and remedies as provided for by the
applicable codes and ordinances of the City of Boynton Beach
to bring any violation into compliance, and the applicant
shall indemnify, reimburse and save the City of Boynton Beach
harmless from any cost, expense, claim, liability or any
action which may arise due to their enforcement of the same.

The undersigned as applicant for Final Site Plan Approval does

specifications, drawings, engineering, and other data
submi tted wi th this application for review by the City of
Boynton Beach shall be reviewed by the various boards,
commissions, staff personnel and other parties designated,
appointed or employed by the City of Boynton beach, and any
such party reviewing the same shall rely upon the accuracy
thereof, and any change in any item submitted shall be deemed
material and substantial.
The undersigned hereby agrees that all plans,
specifications, drawings, engineering and other data which may

Regarding the above referenced project, I recommend the following:
1. The sidewalks along SW 8th Street, at the main entrance to
this project, be continued along the internal roadway to a
point south of the recreation area (where the roadway meets
the parking facility situated souths ide of project), and to a
point north of the recreation facility where the internal
roadway intersects with the first handicap parking stall.
Additionally, I recommend that an internal sidewalk system be
created which would link all buildings to the recreational
area via a pedestrian sidewalk system geared to assist
handicapped individuals in accessing these required amenities.
2. Regarding CCL's notation on sheet 1 of 2 wherein the plans
indicate II all mailboxes to be located in breezeways ", the
applicant shall coordinate with the u.s. Postal Service in
depicting upon these plans, a location for general mail
delivery. The plans should then be revised to depict the
location of the mail delivery facility as well as provisions
for some form of organized parking or staging area for persons
picking up their mail.
3. The plans should depict the construction of grassy swales
which are fully irrigated and maintained within the public
rights-of-way of SW 8th Street and Morton's Way.
4. The pedestrian sidewalk along SW 8th Street should continue
thru the ingress/egress approach and be so transitioned as to
facilitate the movement of handicapped individuals thru this
area.
5. The 5' pedestrian sidewalk at the extreme southwest corner of
the property (intersection of Morton' Way at SW 8th Street),
should be extended to provide handicap accessibility from this
site to the pavement area of Morton's Way (City standard -
Handicap connections at intersections).

The Building Department has reviewed the amended site plan and
offers the following comments:
1. Show all sidewalks and ramps on the plans to make the site,
pool and buildings handicapped accessible.
2. The modification from the South Florida Water Management
District does not address this project. We need
confirmation from them that the approval has been modified
for the proposed project.
3. The site plan does not reflect the sign locations. They
need to be identified on the plans and be in compliance with
the Sign Code.
Since the above comments can be addressed at time of building
permit submittal, we recommend that the plans be forwarded to the
Planning and Development Board. However, if there is any
deviation from this set of plans to coincide with comments made
by the applicant at the August 23, 1994 Technical Review

Staff has reviewed the above referenced project and offers the following comments:
The Utilities Department offers the following with respect to Item #7 of Utilities Memorandum
#94-265 dated August 11, 1994:
1. Indicate proper removal or abandonment of existing force mains, abandoned
sanitary sewer manholes and old lift station can.
2. The installation and Full Release for Service by the Palm Beach Health
Department of all water, sanitary sewer and force mains necessary to support
the proposed project prior to the Utilities Director's signature on the
HRS/DER. Applications for Permit to Construct the Domestic Water and
Waste Water Systems to this project (Sec. 26.12).
3. The minor relocations of water services and water mains as shown on these
preliminary drawings as required by the Utility Department Director. These
and other necessary changes must be incorporated into the plans submitted
for HRS permits (Sec. 26-12).
4. The capacity reservation fee for this project, based on 23, 2 inch meters, will
be $31,240.44. This fee will be due within thirty days of City Commission
approval or at time of HRS application submittal to this office. The
reservation fee is renewable after one year. As an option, capital facility
charges may be paid in full, in advance, in order to avoid the reservation fee
(Sec. 26-34[E]).
It is our recommendation that the request proceed through the review process.

The following is a list of comments regarding the second review of
the above-referenced project. It should be noted that the comments
are divided into two (2) categories:
The first category is a list of comments that identify unresolved
comments either from the first review or new comments as a result
of the second review, To show compliance with these comments will
not substantially alter the configuration of the site and the
design of the building.
The second category is a list of recommendations I believe will
enhance the aesthetics and function of the project.
All comments and recommendations can be rectified on the plans at
time of permitting if the site plan request is approved. The
applicant must understand that additional comments may be generated
upon review of the documents and working drawings submitted to the
Building Department for permits for the proposed project.
I, SITE PLAN REVIEW COMMENTS:
1. Submit a survey of the subject property that does not show a
phase line.
2. Specify on the plans the height of the dumpster enclosures and
identify the color of the walls for the single enclosure.
3. Specify on the elevation view drawings the manufacturer of the
colors proposed for the buildings. Add to the elevation view
drawings of the recreation buildings the color, color number
and manufacturer for each exterior finish material depicted on
the drawings,
4. Submit a cost estimate, to be reviewed by city staff, for the
five (5) required recreation amenities. A bond adjustment
shall be made, within 30 days of the City's approval of the
estimate, by phases, based on the value of these improvements.
Pursuant to condition 5D, page 6 of 7 of the october 17, 1990
agreement between Tradewinds and the City.
5. The total number of parking spaces, by phases, identified in
the parking calculations are in the wrong column, Correct

occupancy being issued for the first building in Phase I.

II. RECOMMENDATION(S):

Resolution of landscaping and utilities conflict
I would like to thank you both for the time you spent with members of my staff on resolving these
important issues. Following is our understanding of the changes which must be made in the landscaping
and/or utilities plans for these projects:
NAUTICA PLATS 1 & 2
80-foot wide ri~ht-of-way
1) Relocate proposed water main to the back edge of the bicycle path (Le. between bicycle path
and property line);
~
2) Eliminate trees proposed along the property/right-of-way line, and replace with shrubs as
desired,
50-foot wide ri~ht-of-way
1) Relocate trees to the back edge of the sidewalks along both sides of the street.
THE VININGS
1) Along the east landscape buffer which co-exists with a utilities easement, the cross-section plan
indicates a raised berm which is approximately centered over the proposed water main. We have
no objection to the plantings east of the water main being changed to scrub oak, installed via hand
digging. Landscaping west of the water main shall remain as shown or be reduced to hedges and
sod without any trees. Shrubs may be installed over the water main, but the scrub oak must be
offset a reasonable distance to avoid damaging the main during installation.
2) For the existing sanitary manhole adjacent to building no. 11, a stabilized access way will be
required from the pavement to the manhole, or the manhole may be relocated southward to a point
that is accessible from the pavement.
We would be pleased to meet with the developers of these two projects to discuss the changes if you agree
with them as stated. Please refer any further questions on this matter to Peter Mazzella of this office.

Staff has reviewed the above referenced project and offers the following comments:
The Utilities Department offers the following with respect to Item #7 of Utilities Memorandum
#94-265 dated August 11, 1994:
1. Indicate proper removal or abandonment of existing force mains, abandoned
sanitary sewer manholes and old lift station can.
2. The installation and Full Release for Service by the Palm Beach Health
Department of all water, sanitary sewer and force mains necessary to support
the propos~d project prior to the Utilities Director's signature on the
HRSIDER. Applications for Permit to Construct the Domestic Water and
Waste Water Systems to this project (See. 26.12).
3. The minor relocations of water services and water mains as shown on these
preliminary drawings as required by the Utility Department Director. These
and other necessary changes must be incorporated into the plans submitted
for HRS permits (Sec. 26-12).
4. The capacity reservation fee for this project, based on 23, 2 inch meters, will
be 531,240.44. This fee will be due within thirty days of City Commission
approval or at time of HRS application submittal to this office. The
reservation fee is renewable after one year. As an option, capital facility
charges may be paid in full, in advance, in order to avoid the reservation fee
(Sec. 26-34[E)).
It is our recommendation that the request proceed through the review process.

RE:
Pursuant to your request for me to review and comment on the above
referenced letter and the associated plat/development plan
attachments for SW 8th Street, I herein provide the following:
1. I have compared the plat document and the development plans
for SW 8th Street with City approved plans and I find that the
plat/plans for SW 8th Street coincide with plans previously
approved by this City with the exception of the most recent
driveway relocation for the Vinings, a matter you are familiar
with. I have initialed both the plat document and development
plans in order to identify them in the future, if necessary.
2. Relative to paragraph #2 of the CCL Consultants, Inc. letter
which inquires into the status of City permits for the
construction of the subject roadway, I can only offer you an
opinion based upon City Code of Ordinances and the
Comprehensive Plan, for as you know the normal 21 month time
period for construction of the infrastructure improvements has
long since passed.
My opinion is as Lollows:
A. The Land Development Order is and remains active based upon
this lay person's interpretation of Chapter 19, Section 19-83,
page 1399 of the City Code of Ordinances wherein this Code
states, "Any Development Order or permit which was the subject
of a court order regarding the land use, zoning, planning,
use, or development of a parcel, and litigation was initiated
prior to adoption of the Comprehensive Plan. Development
orders or permits which are the subject of such court orders,
or subsequent development orders or permits which are
consistent with such court orders shall be exempt for as long
as the court order remains in effect".

criteria set forth under (a), (b) or (c) below:

In any event, I recommend you consult with the City Attorney to

Please place the above-referenced request on the September 20,
1994 City Commission agenda under Development Plans, Non-Consent
Agenda.
DESCRIPTION: This is a request, submitted by CCL Consultants,
Inc., for site plan approval of 548 rental apartments and private
recreational amenities to be located within the Woolbright Place
PUD, more specifically on the east side of S.W, 8th street,
approximately 1,400 feet north of Woolbright Road. One gated
entrance is planned off of S.W. 8th street to serve all units to
be constructed in two phases. The apartment buildings vary in
height and no building exceeds 40' - 1".
RECOMMENDATION: The Planning and Development Board unanimously
recommends approval of this request, subject to the attached
staff comments (Public Works Department Memorandum No. 94-214,
Utilities Department Memorandum No. 94-280, Fire Department
Memorandum No. 94-268, Engineering Department Memorandum No, 94-
265, 262, 259 and 245, Building Department Memorandum No. 94-200,
Parks and Recreation Department Memorandum No. 94-321, 293, 312
and 292 and Planning and Zoning Department memorandum dated
August 31, 1994), with the exception of Planning and Zoning
Department comment 7,i. Regarding comment 7.i., the Board
recommends that it be reworded to read, "Indicate on the
landscape plan that the landscaping and fencing required between
the Vinings project and the 14 acre parcel shall be completed
prior to a certificate of occupancy being issued for the first
building in Phase II. The Board further recommends that one-half
of the Black Olive trees proposed be substituted with a native
tree species and that Cocoplums be used as the hedge material
within the buffer.
As a point of information, the applicant agrees to comply with
comment 7.11, of the August 31, 1994, Planning and Zoning
Department memorandum which states, "Add to the plans the hedging
required on the north side of the property line that separates
the Vinings project from the 14 acre parcel, This material shall
be installed with the vinings landscaping," Staff made this
comment based on a misunderstanding of the Woolbright Place PUD
master plan modification discussion at the August 16, 1994, City
Commission meeting. Compliance with this comment would require
the applicant to install and irrigate the half of the buffer
located on the 14 acre parcel (not his property), if his project
is under construction prior to construction commencement of the
14 acre parcel, A question of maintenance then arises since the
buffer is not within a tract dedicated to a master PUD,
homeowners' association.

Staff has reviewed the above referenced project and offers the following comments:
The Utilities Department offers the following with respect to Item #7 of Utilities Memorandum
#94-265 dated August 11, 1994:
1. Indicate proper removal or abandonment of existing force mains, abandoned
sanitary sewer manholes and old lift station can.
2. The installation and Full Release for Service by the Palm Beach Health
Department of all water, sanitary sewer and force mains necessary to support
the proposed project prior to the Utilities Director's signature on the
HRSIDER. Applications for Permit to Construct the Domestic Water and
Waste Water Systems to this project (Sec. 26.12).
3. The minor relocations of water services and water mains as shown on these
preliminary drawings as required by the Utility Department Director. These
and other necessary changes must be incorporated into the plans submitted
for HRS permits (Sec. 26-12).
4. The capacity reservation fee for this project, based on 23, 2 inch meters, will
be $31,240.44. This fee will be due within thirty days of City Commission
approval or at time of HRS application submittal to this office. The
reservation fee is renewable after one year. As an option, capital facility
charges may be paid in full, in advance, in order to avoid the reservation fee
(Sec. 26-34 [E]).
It is our recommendation that the request proceed through the review process.

Based on the change of direction of the applicant towards
submitting two separate plats for subject P.U.D., our earlier
comments are incomplete. with respect to the twenty specific items
enumerated in our August 22, 1994 memo and the comments of Mr.
Finizio, all still generally apply. We have the following
additional comments:
21. Parking islands must have a minimum of 5 feet of landscaping
between backs of curbs.
22. Provide an impact statement from the Palm Beach County School
Board.
23. Parking stall length is minimum 16' from curb stop to drive.
These comments are incomplete with respect to the new subdivision
proposal, particularly with respect to the entry road, cross-
agreements, sidewalks, etc.

Regarding the above referenced project, I recommend the following:
l. The sidewalks along SW 8th Street, at the main entrance to
this project, be continued along the internal roadway to a
point south of the recreation area (where the roadway meets
the parking facility situated southside of project), and to a
point north of the recreation facility where the internal
roadway intersects with the first handicap parking stall.
Additionally, I recommend that an internal sidewalk system be
created which would link all buildings to the recreational
area via a pedestrian sidewalk system geared to assist
handicapped individuals in accessing these required amenities.
2. Regarding CCL's notation on sheet 1 of 2 wherein the plans
indicate II all mailboxes to be located in breezeways ", the
applicant shall coordinate with the u.s. Postal Service in
depicting upon these plans, a location for general mail
delivery. The plans should then be revised to depict the
location of the mail delivery facility as well as provisions
for some form of organized parking or staging area for persons
picking up their mail.
3. The plans should depict the construction of grassy swales
which are fully irrigated and maintained within the public
rights-of-way of SW 8th Street and Morton's Way.
4. The pedestrian sidewalk along SW 8th Street should continue
thru the ingress/egress approach and be so transitioned as to
facilitate the movement of handicapped individuals thru this
area.
5. The 5' pedestrian sidewalk at the extreme southwest corner of
the property (intersection of Morton' Way at SW 8th Street),
should be extended to provide handicap accessibility from this
site to the pavement area of Morton's Way (City standard -
Handicap connections at intersections).
6. Engineering plans & Architectural plans do not compliment one
another regarding sidewalk location. Resolve plan conflicts.

The Building Department has reviewed the amended site plan and
offers the following comments:
1. Show all sidewalks and ramps on the plans to make the site,
pool and buildings handicapped accessible.
2. The modification from the South Florida Water Management
District does not address this project. We need
confirmation from them that the approval has been modified
for the proposed project.
3. The site plan does not reflect the sign locations. They
need to be identified on the plans and be in compliance with
the Sign Code.
Since the above comments can be addressed at time of building
permit submittal, we recommend that the plans be forwarded to the
Planning and Development Board. However, if there is any
deviation from this set of plans to coincide with comments made
by the applicant at the August 23, 1994 Technical Review
Committee meeting, another review will be required.

2, The Vinings has indicated that they wish to apply for 1/2 credit towards the Recreation &
Park dedication requirement. It appears there is sufficient private recreation to qualify. Five
(5) private recreation elements provided are listed on the site plan:

2. The amenities are listed on the site plan. Please note that
in the original submittal, shade structures and barbecue areas
were included on the landscape plan. This was omitted from
the Site Plan and has been included at this time.
3. All items provided at recreation areas i.e playground
equipment, fitness, benches, etc., is top quality and
commercial grade. In comments made by Mike Haag above, he has
requested cost estimates for this equipment. I will need some
time to put this together.

These comments pertain to the requirements of the City's Tree
Preservation Ordinance.
1. There are existing trees on the site which in part were
approved for management under the Tree Management Book
document prepared by Stanley Consultants of Florida, Inc.
January 30, 1990. This document addresses the thirty-two (32)
acre commercial parcel immediately north of the Home Depot
site to the industrial access road. The applicant should
review this document and agree to comply with the contents in
full. The included aerial map indicates fifteen areas
(letters B-P) of existing trees with varying quantities of
tree preservation, relocation and clearing.
2. A similar document to #1 above has not been submitted to the
City for approval for the residential portion of this project.
This document is required under the Tree Preservation
Ordinance, [chapter 7.5, 4b, pg. 595] which pertains to all
undeveloped property in the City. The specific requirements
are from section 7.5-7d, pg. 597]. This item was previously
addressed in April 1992 when the site was called Woolbright
Place Apartments. (See attached memo).
3 . I have not been made aware of the results of a Tradewinds
Draft Agreement between the City and Tradewinds (memo #94-185
Ci ty Manager) regarding any other environmental inquiries
about this portion of the Tradewinds sites.

This memorandum is in reference to the above project requirement
for a tree management plan. The basis for this requirement is
from the Tree Preservation Ordinance Chapter 7.504b p. 595 which
pertains to all vacant or undeveloped property (Ord. No.81-21,
7-7-81). The specific requirements are from section 7.5-7d p.
597. This information has informally been called the tree
management plan, although it is not addressed as such in this
section.
The requirement of a document addressing the eventual status of
all trees on the site is in conjunction also with section 7.5-12
A-E. Section 7.5-13 speaks to the permit to relocate trees, one
of the components usually included in a "document" addressing the
eventual status all trees on the site. All these requirements
have been in effect since 1981.

dedication issues and payment of money due from Tradewinds which
you and I have discussed previously.
Has this been mistakenly left out or do you plan to pursue this in
another way?
Item #4 regarding environmental inquiries is interesting. Is this
being suggested by Tradewinds or by us. I would think such
outlined procedure isn't appropriate for an agreement, but would
simply be issued as a direction to staff from the City Manager's
Office if the City agrees with this policy. I do not know why
Tradewinds should dictate to us how and when responses to
environmental inquiries are handled.

The following is a list of comments regarding the site Plan Review
of the plans for the above-referenced project. It should be noted
that the comments are divided into two (2) categories; the first
category is a list of comments that identify deficiencies that are
required to be corrected and shown in compliance on the plans
and/or documents submitted for second (2nd) review in order for the
project to continue through the site plan review process. The
second set of comment(s) are recommendations that the planning and
Zoning Department staff believe will enhance the proposed
development. The applicant shall understand that all
documents/plans submitted for site plan and/or permit review are
subject to additional comments. I recommend that the applicant/
agent contact me regarding questions related to the comments. If
the applicant is not intending to correct code deficiencies they
should contact me regarding the procedures, application forms, fees
and submittal deadline dates for seeking relief from the code
requirement.
I. SITE PLAN REVIEW COMMENTS:
1. Submit a survey of the subject property. The survey shall not
depict a phase line (Chapter 4 section 7.1).
2. On the site plan indicate the limits of construction. If
construction is not planned to be continuous (non-stop) show
all of the construction activity proposed for the first phase.
3. Specify on the plan the areas for the leasing office
buildings. It appears that there will be a deficiency in the
number of required parking spaces and approval of a variance
is required prior to forwarding the proj ect to the City
Commission. Add to the parking calculations the required
parking for the leasing office buildings, recreational
buildings and all recreational amenities. Indicate on the
site plan drawing the dimensions of the water area of each
pool and the improved surface area for each tennis court. The
total parking provided for the entire project shall not be
less than the parking spaces required by the code. (Appendix
A Zoning Section 11 H and Appendix B Section 9 C). Note that
Appendix B section 9 C requires two (2) parking spaces per
dwelling unit including the one bedroom units.

2. In the absence of a detailed drawing of the leasing office, the
swimming pool and the tennis court area, we have no comments but would
like to mention that these areas must also be handicapped accessible.
3. The plans show site wall signs as well as a free-standing project sign.
Section 21-24(d) of the Boynton Beach Sign Code only permits one or the
other. Sign details will be required for whichever one is chosen.
4. There is a proposed off-premises community monument sign shown on the
plans. This sign will require approval from the Engineering Department
and possibly Palm Beach County and/or the Department of Transportation.
Section 21-31(c)(5) of the Boynton Beach Sign Code permits one sign,
with a maximum of two faces and sixteen square feet per sign face, in
the public right-of-way.
5. A modification to the South Florida Water Management District permit is
required at time of building permit submittal.
6. The plans show light poles designed to withstand 200 mile per hour
winds. The minimum code requirements dictate that light poles
withstand winds of 120 miles per hour. Please verify if 200 is an
accurate number.
7. The entry driveway needs to be constructed in its entirety with phase I
of the project.
8. There should be a sidewalk along the main entrance from the right-of-
way into the project.

Staffhas reviewed the above referenced project and offers the following comments:
1. Show water meter sizes - Reservation Fee is based on meter
size, (Sec. 26.16[cD.
2. A Hold Harmless Letter will be required on dumpsters located
in Utility Easements.
3. This Department recommends shifting building 8 and 11 west
to provide a minimum of 25' from an existing sanitary sewer
main or replace that portion of sanitary sewer pipe with
polylined ductile iron pipe.
4. Provide a minimum of 10' separation from structures and their
appurtenances to the center of proposed water mains (Sec.
26.33 [aD.
5. Copper water services (11/2" and 2 ") should be limited to 40'
due to availability of "K" copper in rolls.
6. Trees in utility easements to be "Palms" only, offset from the
main line pipes, (Sec. 7.5-18.1.).
7. Utilities recommends we meet with the design engineer to
review Utility Department Standard Criteria for water and
sanitary sewer.
It is our recommendation that the request proceed through the review process.

These comments pertain to the requirements of the City's Tree
Preservation Ordinance.
1. There are existing trees on the site which in part were
approved for management under the Tree Management Book
document prepared by Stanley Consultants of Florida, Inc.
January 30, 1990. This document addresses the thirty-two (32)
acre commercial parcel immediately north of the Home Depot
site to the industrial access road. The applicant should
review this document and agree to comply with the contents in
full. The included aerial map indicates fifteen areas
(letters B-P) of existing trees with varying quantities of
tree preservation, relocation and clearing.
2. A similar document to #1 above has not been submitted to the
Ci ty for approval for the residential portion of this project.
This document is required under the Tree Preservation
Ordinance, [chapter 7.5, 4b, pg. 595] which pertains to all
undeveloped property in the City. The specific requirements
are from section 7.5-7d, pg. 597]. This item was previously
addressed in April 1992 when the site was called Woolbright
Place Apartments. (See attached memo).
3. I have not been made aware of the results of a Tradewinds
Draft Agreement between the City and Tradewinds (memo #94-185
Ci ty Manager) regarding any other environmental inquiries
about this portion of the Tradewinds sites.

Item #4 regarding environmental inquiries is interesting. Is this
being suggested by Tradewinds or by us. I would think such
outlined procedure isn't appropriate for an agreement, but would
simply be issued as a direction to staff from the City Manager's
Office if the City agrees with this policy. I do not know why
Tradewinds should dictate to us how and when responses to
environmental inquiries are handled.

This memorandum is in reference to the above project requirement
for a tree management plan. The basis for this requirement is
from the Tree Preservation Ordinance Chapter 7.504b p. 595 which
pertains to all vacant or undeveloped property (Ord. No.81-21,
7-7-81). The specific requirements are from section 7.5-7d p.
597. This information has informally been called the tree
management plan, although it is not addressed as such in this
section.
The requirement of a document addressing the eventual status of
all trees on the site is in conjunction also with section 7.5-12
A-E. Section 7.5-13 speaks to the permit to relocate trees, one
of the components usually included in a "document" addressing the
eventual status all trees on the site. All these requirements
have been in effect since 1981.

Find attached for your review the plans and exhibits for the above-
referenced project. site Plan Review approval for this project
will be granted by the City Commission. To ensure that the project
stays on line with the review time frame, I request that the plans
and exhibits be reviewed and formal written comments transmitted to
the Director of the Planning and Zoning Department no later than
5:00 P.M. on AUGUst 11. 1994. Do not return plans and exhibits.
Retain same for future review. This project is under accelerated
court ordered review procedures and will be discussed at the August
23rd TRC meeting.
Adhering to the following review guidelines will promote a
comprehensive review and enable the applicant to efficiently obtain
Technical Review committee approval:
1. Use the review standards specified in Part III, Land
Development Regulations, Chapter 4, Site Plan Review, Section
8 of the Code of Ordinances to review and formulate comments.
2. The documents submitted for the project were determined to be
substantially complete based on the submittal requirements
identified in Section 7 of the site Plan Review Ordinance.
However, if the data provided to meet the submittal
requirements is insufficient to properly evaluate and process
the project based on the review standards or the documents
show code deficiencies, additional data and/or corrections
should be requested by the reviewer through the Planning and
Zoning Department.
