VININGS PUD - RECLAMATION REQUEST
The Developer of subject PUD has requested permission to remove
excess fill from the vinings property. A Land Development Order
allowing construction of required improvements to proceed was
issued upon proper recording of the plat, thus allowing excavation
and fill to commence. Although construction drawings were
submitted, no mention was made of removing fill from the site.
Please be reminded that the Boynton Beach Land Development
Regulations (Chapter 8, Article III, Section A, paragraph 2a(1),
page 8-3) require an applicant to "secure approval of the City
Commission for all work which includes the moving of materials
beyond the project property lines". Comes now the Vinings request
for such approval.
Documents, including but not limited to a reclamation plan, have
been submitted in compliance with Chapter 8. Drawings depict a
topography which includes a fairly substantial hill near the
southwest corner of the property. That hill, plus the two and one-
half acre lake will provide much of the fill to be removed. The
floor elevations of the buildings range from 16.5 to 17 feet above
sea level. That compares favorably to the nearby Home Depot which
is at elevation 16.5. From a technical standpoint, engineering
criteria are acceptable, and we recommend approval subject to the
provision of a $20,000 restoration surety.
That is the easy part. The LDR defines mining (Chapter 1, Article
II, page 1-24) as "removal of materials from a site in quantities
exceeding what is physically necessary to develop the site. Mining
is prohibited in the City of Boynton Beach." The Developer's
Engineer has written to us (attached April 4 letter from Campanile)
that this project does not involve mining because removal of
materials is physically necessary to develop the site. That is
correct insofar as the present design elevations cannot be
successfully executed without disposing of materials. Whether the
entire site could be raised a foot or two to absorb the excess is
arguable.
Please place this matter on the May 2, 1995 agenda for City
Commission action.

8. Tabulation of materials moved:
100,000 cy of fill material will be moved on site.
54,000 cy of fill material will be used on site for
both phases of the project
46,000 cy of fill is needed to be removed from the
site in ord~r to develop it according to the plans.
This excavation tabulation was/is also evidenced on the
original engineer's cost estimate provided in December,
1994. This is also enclosed.
9. A daily sweeping program to keep 8th street clear of dirt
will be in place. A watering truck along with a
temporary fire hydrant meter will be in place to water
down the roads should excessive dust occur.
10. steps to protect water resources are not applicable to
this job.
11. Any stockpile that will be required during the excavation
and removal of the fill material will be temporary and
will be located on the adjacent Phase II site. No pile
will be greater in height than 12' and shall not be over
50'x50' in size. We will make every effort to remove
excess fill as it is excavated.
12. See 111 above.
13. The excavation and removal of the excess fill materials
will take approximately 4 weeks to complete. This work
will be done on a Monday through Saturday basis between
the hours of 7 a.m. and 6 p.m.
14. The routing of the trucks for this fill removal shall be
south on 8th Street to Woolbright. East on Woolbright to
the South entrance to Interstate 95. South out of the
City of Boynton Beach.
15. Points of ingress and egresS to the site will be at the
entry of the project (approximately 640' north of
Morton's Way.) as well as Morton's Way.

Resolution of landscaping and utilities conflict
I would like to thank you both for the time you spent with members of my staff on resolving these
important issues. Following is our understanding of the changes which must be made in the landscaping
and/or utilities plans for these projects:
NAUTICA PLATS 1 & 2
80-foot wide ril:ht-of-way
1) Relocate proposed water main to the back edge of the bicycle path (Le. between bicycle path
and property line);

2) Eliminate trees proposed along the property/right-of-way line, and replace with shrubs as
desired.
50-foot wide ril:ht-of-way
1) , Relocate trees to the back edge of the sidewalks along both sides of the street.
THE VININGS
1) Along the east landscape buffer which co-exists with a utilities easement, the cross-section plan
indicates a raised berm which is approximately centered over the proposed water main. We have
no objection to the plantings east of the water main being changed to scrub oak, installed via hand
digging. Landscaping west of the water main shall remain as shown or be reduced to hedges and
sod without any trees. Shrubs may be installed over the water main, but the scrub oak must be
offset a reasonable distance to avoid damaging the main during installatiolL
2) For the existing sanitary manhole adjacent to building no. 11, a stabilized access way will be
required from the pavement to the manhole, or the manhole may be relocated southward to a point
that is accessible from the pavement.
Vole would be pleased to meet with the developers of these two projects to discuss the changes if you agree
with them as stated. Please refer any funher questions on this matter to Peter Mazzella of this office.
