Use approval - SP Farms (fruit & vegetable market)
Bradley Morton of the Prudential Barclay Group Realty is requesting
use approval of a fruit and vegetable market at the Shoppes of
Woolbright, zoned Planned Commercial Development (PCD); see
attached correspondence. section 6.F.5 "Uses Permitted" of the
zoning code, states, among other things, that all uses listed in
section 6.C.l of the zoning code (the C-3, Community Commercial,
district regulations) are permitted wi thin a PCD. It further
states that commercial uses not listed in section 6. C.1 are
permitted, provided such uses are approved by the planning and
Development Board.
The C-3 permitted uses include, by reference and without specific
limitation on floor area, the C-2, Neighborhood Commercial,
permitted uses. Section 6.B.l.ii of the C-2 regulations list the
only use related to the proposed use. This section states the
following:
"Grocery, food, ice cream, confectionary, and health food
stores; delicatessans, butcher shops and seafood stores,
veaetable and fruit stores, convenience food stores, and
bakeries; catering service."
Within Mr. Morton's letter of request, the proposed fruit and
vegetable "market" is described as a use that will be partly (one-
third) enclosed wi thin a CBS building and partly (two-thirds)
contained under an open, temporary awning. Buildings and
structures are defined in the zoning code as anything constructed
or erected which requires permanent location on the ground or is
attached to anything having a permanent location on the ground.
Furthermore the word "store", as used in section 6.B.1.ii, implies
a retail use permanently and fully enclosed. Therefore, it can be
stated that there is a distinction between the proposed "market"
and a store as conceived and traditionally applied under the C-2
regulations.
If a fruit and vegetable market is determined not to be a vegetable
and fruit store, then the proposed use could be permitted in the
Shoppes of Woolbright PCD if determined appropriate by the Planning
and Development Board. A planned commercial development is defined
in the zoning code as:
a) Land under unified control, planned and developed as a
whole in a single development operation or a programmed
series of development operations for commercial buildings
and related uses and facilties;
b) Provides for a commercial district of efficient and
harmonious desian so arranaed to create an attractive
proiect readilv intearated with and havina no adverse
effect on adioinina or surroundina areas and
developments;
c) Is developed according to comprehensive and detailed
plans for streets, utilities, lots, building sites, etc.,
and site plans, floor plans and elevations for .all
buildinas intended to be located, constructed, used and
related to one another, and detailed plans for other ~
and improvements on the land related to the buildinas:

d) Includes a program for full prOV1S10n, maintenance, and
operation of such areas, improvements, facilities and
services for common use by the occupants of the planned
commercial development.
The underlined verbiage in b) above is especially relevant to this
request in light of the uses, and their design, that exist and have
been approved to date within the vicinity of the proposed market.
These include a service station (Racetrac) and retail store (Acme
Plastics) within the PCD and a single family residential
development (Palm Beach Leisureville) immediately west of the PCD.
The proposed open, temporary market is not harmonious or related to
these surrounding developments. Therefore, it is recommended to
allow retail sale of fruits and vegetables within the Shoppes of
Woolbright PCD subject to the sales occurring within a permanent,
fully enclosed store. The applicant has informed me that he does
not have a problem with erecting a metal building to contain all
the produce sale activity. At time of site plan approval, the
specific building design details can be evaluated to ensure
attractiveness and harmony with the PCD. Also, if approved, it is
recommended that the applicant add the proposed use to the master
plan when the modification required pursuant to the Acme Plastics
approval is submitted.
