Dear Ms. Edwards:
This letter is to verify infonmation that you have requested regarding the
Woolbright Place PUD.
The Woolbright Place PUD is zoned as a Planned Unit Development district,
which pursuant to the City's PUD zoning regulations, must be accompanied by
an approved master plan. The approved master plan allows construction of
640 apartment units (multi-family units) and 16 duplexes. However, since
the City's PUD zoning regulations penmit single-family, two-family and
multi-family dwellings (including townhouses, condominium, apartments and
cluster housing), any change to the master plan as approved, would require
submittal of a modification to the master plan.
Water and sewer service are available to the site and the site is
accessible to Woolbright Road by way of Southwest 8th Street.
In reviewing this site the_City uses impact fee rates that were effective
in 1986 as opposed to present day fee rates. In addition many of the
impact fees in place today were not in place in 1986 and we will not impose
these fees.
Review of the plans for this site is done in an expedited matter as
outlined in the attached City Commission resolution.
By interlocal agreement we have joined with Palm Beach County to provide
various initiatives for affordable housing in the City (see Table 1) in
some cases these initiatives are City efforts and are indicated as such on
the list.

AFFORDABLE HOUSING INITIATIVES
Initiatives currently in place in Palm Beach County and Boynton Beach
include:
1. The Palm Beach County Affordable Housing Ordinance 93-8 was adopted
5/18/93 to meet F.S. 420.
2. Palm Beach County has a Local Housing Assistance Plan as specified in
S.420.9072(2).
3. Palm Beach County has not adopted its Incentive Plan but has already
acted to address provisions as required under the Incentive Plan as
required by the 1989 Palm Beach County Comprehensive Plan.
4. Palm Beach County has adopted the Traffic Perfonmance Standards Special
Methodology for Affordable Housing which allows a reduction in the
level of service that must be met for development meeting specified
criteria.
5. In accordance with the policies and objectives contained within the
City's Comprehensive Plan, a full range of housing choices is allowed
within the City in order to accommodate the number and type of
dwellings for which the demand has been projected.
6. The City maintains an inventory of City owned land and sites are made
available for affordable housing development. The County also main-
tains its own inventory of county owned sites.

This letter is a response to your inquiry regarding the Woolbright
Place PUD.
The acreage of the site includes a drainage retention area, church,
and a mul ti-family pod which is 81.1 acres. The multi-family
section has 49.75 acres and allows a maximum of 640 apartment units
and 16 duplex units. The units per gross acre are considered to be
5 but with various negotiations and court settlements, the overall
density is unknown.
There was at one time a site plan for the residential portion of
the PUD but that has expired. I would suggest not using it except
for review purposes because the plan was approved with comments
that have never been rectified.
In order to have a development approved on the site, a new site
plan and building plans must be approved. In addition, if changes
are made that affect the master plan, a master plan modification
must be filed as well.
The development standards in the PUD ordinance (see attached) will
be used to review the development. Please note that there isa
berm requirement on the north side of the property for which an MPM
will have to be filed.
Sanitary sewer, water, electric are all available to the site. It
is my understanding that some of these have been put in place, but
not completed or are subject to relocation (i.e. FPL power poles
and a sanitatlon force main). However, from a concurrency point of
view, water and sewer are available.

Drainage and retention areas have been provided as part of the
master plan, but no structures or pipe are in place.
Open space requirements have been met. There is an outstanding
item between the owner of the property and the City of a $50,000
credit to be given for preparing the park site which has not been
cleared. Since the open space requirements have been met, any
recreation areas are options for the developer to provide.
S W 8th Street has to be completed in the PUD with a turnaround.
As far as other development commitments, I believe these have been
mentioned above, completion of the infrastructure, S W 8th Street
and the berm on the north side.
The project is vested for concurrency but payment of hookup fees,
and other fees are required. In addition, traffic impact fees may
be required by Palm Beach County.
It is my understanding that the site has been cleared of gopher
tortoises. There may be a scrub jay question (see attached).
Any easements that were needed were platted in 1990. There may be
some modification to these but no new ones are contemplated.
I know of no other issues (as if the above aren't enough) that
would affect the development of the parcel.

Dear Mr. Levy:
In response to your letter dated July 19, 1991, a meeting was called and
scheduled by this office after receipt of a letter dated July 2, 1991, from
Stella Rossi, Coalition for Wilderness Islands. I requested that the
following persons be present at this meeting, being Charles Frederick,
Parks & Recreation Director, Kevin Hallahan, Environmentalist, Chris Cutro,
Director of Planning, and Stella Rossi (if available). The purpose of this
meeting was simply to better educate myself as to the environmental issues
on this site historically, and to decide upon what action the City need
take, if any, reference the citing of Gopher Tortoises on this tract of
land.
As you are probably aware, Gary Lehnertz, Joanne Davis, and Rosa Durando
appeared at said meeting with Mrs. Rossi. Pursuant to the appropriate

the respective removal and relocation penmits issued in early 1990t and
based upon the content and/or conditions of said penmits the City shall
administratively decide what course of action the City need follow in this

mQmorandum of ~uly 5, ~99~ a meeting was held this week
among City Q.epar'bncmt heads and selected members of the
public re.gaJ:'ding the abovQ. captioned. These public
participants included Uo~a Dur4ndo, S~ella Rossi and
Joanne Davis.
On Ju~y 6, 199~ a newspaper article appeared in
the Sun Sentinel entitled IIGOPHER TORTOISES MAY STALL
PROJECT" and opened with '"Where an entire oity qovern-
ment taile~, a bandful of gopher ~ortoises may suoceed.
For rive years, city commissioner5 battled Tradewinde
developer Michael Morton...BY their own ~droission they
failed miserably". It then goes on to quote Ms. Rosa
Durando and Ms. Stella Rossi, in their environmental
capacities, demanding that the City do some't.hing to
preserve tortoise habitat.
As you are well aware, the entire issue of gopher
tortoises and our Project has been a joke. Kevin Hal-
lahan, City Forester, in February, 1986, Memorandu~ to
carmen Annunziato, city Plannetr wrote, ur walked the
property both by myself and with Mr. Kevin Henderson
from Metro Developlllent Corporation... There was no
avidenoQ on site of any endangered or threatened
wild~ife. There were no gopher tortoise holes or traeks

Fresh Water Fish Commission issued permits number HR~I001:j i~nd
WR90041 for the removal and reloc:ation of any tortoises foel: on
the site. Copies of those permits were supplied to the cL;:~ in
order to <;let the site clearing permit being withheld as pel rJur
letter to Brad Harbn.an. The capture and relocation was hi; nc.:led
by Mr. Ron Gaby. PhD. under his license with the sta':e to
spec.ifica.l.ly do same, a fact well known to the city. All the.: ~ ~r-
1aittQd 't:.ortoises wQre removed. I: one were to appear the permit.s
are valid into 1992. The tortoises were measured and marked and
none were anywhere naar the. size observe.d by the quoted

phone ca~l probab1y would have saved the time and. :money nece33ary
to assemble this meeting.
Since this company was not asked to attend a meetins that
specifically concerned it, I must. respect~U1ly request that you
supply us with a copy of the minutes and the outcome and direc-
tives issued. If the city has a new ordinance dealing witn
habitat protection on approve.d proj sets, a copy would be ap-
preciated.
