As requested by your Memorandum No. 93-398, which was initiated due
to your receipt of Michael Morton's submittal of a written synopsis
of the issues he presented at the November 2, 1993 City Commission
meeting, I have revised my previous response (Planning and Zoning
Department Memorandum No. 93-306) as follows:
1. Vestinq Issue
My previous response (provided under response #1) still
stands. Our department has been charging current fees for
development applications submitted by Tradewinds. In my
opinion the city Attorney needs to advise.
2. Environmental Issue
My previous response (provided under response #2) still
stands.
3. S.W. 8th Street
My previous response (provided under response #6) still
stands. For your information, I met with a gentleman
approximately two weeks ago who was interested in developing
the multi-family portion of the PUD. He told me that no
developer, especially one who builds affordable housing, would
be able to build all the units allowed within the PUD because
of the traffic situation. Therefore, I would think allowing
just a two lane right-of-way would make developing the PUD
even more difficult.
4. Industrial Access Road
My previous response (provided under response #8) is
heretofore revised. Mr. Morton's synopsis included a sketch
which I did not receive, however he provides information of
which I was not aware. In researching our files on this
topic, there is a substantial amount of correspondence. If
the access road is moved farther south, the anticipated
connections to Mr. Winchester's property will not meet the
subdivision regulations (if copies of this correspondence are
needed, please let me know). In addition, as discussed in my
previous response (#4 regarding filing master plan
modifications), I would strongly recommend that necessary
master plan modifications not be delayed to the time of
submitting site plans for the reasons discussed in this
previous response.
5. Uses in the PCD

My previous response (provided under response #10) is
heretofore revised. In researching again the sign code that
was in effect in 1986, a second (additional) freestanding sign
would be allowed. If relief from the 1986 sign code is
desired, the proper mechanism is a Board of Adjustment
variance. This is not a city commission duty.
7. Master Plan Modifications
My previous response (provided under response #4) still
stands.
8. Landscape Buffer vs. Wall
My previous response (provided under response #5) still
stands.
9. Reservation of Sewer and Water Capacity
My previous response (provided under response #3) still
stands.
10. Expedited processina
My previous response (provided under response #7) still
stands. However, I would like to add that staff believes
there is clarification needed for processing amended plans.

stands. However, I would like to add that the process Mr.
Morton refers to would be a rezoning and possible a land use
amendment, depending on the use desired. No such application
has been filed with our office.

Wall at the Shoppes of Woolbright PCD
When you hired me to work for the City three years ago, I
specifically asked you to have Tradewinds cleared up before I
started working. Guess what? It just keeps going.
When Acme Plastics was approved by the Planning and Development
Board and City Commission, I informed them a buffer wall was not
needed because a requirement for berming had been included in the
negotiated settlement.
At this point, members of the Staff, as well as Don Jaeger are
holding to the requirement for such a wall, and Mike Morton is
insisting he does not have to build it. Don I t ask me what I think.
I hate to do this to you, but someone needs to decide if a wall is
required at the rear of Acme Plastics. I would suggest discussing
this with the City Attorney in light of the stipulated settlement
that exists for Tradewinds.

Woolbright Place PUD, Status of Development
I have limited knowledge of the construction status of the Woolbright Place PUD because
the owner has not submitted monthly progress reports since approximately Nov. 1992.
Nevertheless, the answers to questions contained in the R.W. Realty Sales, Inc. letter of
inquiry dated Aug. 18, 1993 can be summarized as follows:
1. The sanitary sewers, water mains and storm sewers for this PUD have been
partially installed. They have not been accepted by the City.
2. The lake has been partially constructed.
3. S.W. 8th Street has been partially constructed.
It would take an extensive survey to determine exactly what remains to complete the
infrastructure for this PUD.
I would suggest that the owner's engineers be consulted regarding work remaining to
complete this project.

If this is not possible for business reasons, then it may be necessary to engage an
engineer to evaluate the status of this project.
The City engineering staff is currently researching the status of approximately seven
letters of credit for various aspects of this project which will have to be renewed. It would
appear that sufficient infrastructure was built to service the Home Depot store and little
else.

With respect to completed improvements at the above referenced
project I can find no record of completed and approved line items
(clearing, excavation, roadwork, drainage etc. ). It appears that any
work done on the site was done to accommodate the drainage
facilities on the adjacent commercial site. There has been some
clearing activity on the site recently and some further excavation
of the lake was done after the PCD became operational but as of
this date it has not been completed.

WOolbright Place Apartments - Tree Management Plan

This memorandum is in reference to the above project requirement
for a tree management plan. The basis for this requirement is
from the Tree Preservation Ordinance Chapter 7.504b p. 595 which
pertains to all vacant or undeveloped property (Ord. No.81-21,
7-7-81). The specific requirements are from section 7.5-7d p.
597. This information has informally been called the tree
management plan, although it is not addressed as such in this
section.
The requirement of a document addressing the eventual status of
all trees on the site is in conjunction also with section 7.5-12
A-E. Section 7.5-13 speaks to the permit to relocate trees, one
of the components usually included in a "document" addressing the
eventual status all trees on the site. All these requirements
have been in effect since 1981.

Dear Mr. Gomez:
We are in receipt of your recently faxed layout for an alternate
access road for the Woolbright P.D.D. apartments. Engineering
Department Comment No. 10 (TRB Memo) indicates that an alternate
access will be necessary should the Morton's Way/Industrial Poad
not be constructed due to the pending court case. The alternate
access discussed at the Techllical Review Board meeting was an
all-weather service road within the right-of-way of Morton's
Way/Industrial Road. This neu proposed alternate access road is
not the same as the one contemplated by Comment No. 10.
Engineering Department will review and comment as appropriats.
I request that you independently contact other city Departments
that may be affected by this proposed access road such as fire,
police, etc. to receive their comments. We will be forwarding
engineering comments on this alternate access road alignment to
Mr. Chris Cutro, Planning Director. Our comments will be a
determination whether or not this access road will meet the
conditions of our Engineering Memo Comment No. 10.

REMARKS: Gopher Tortoise Relocation Plan - Woolbright Place
Attached hereto please find copies of correspondence including Recreation &
Park memorandum No. 92-119 and a letter dated March 24, 1992 from the
Florida Game and Fresh Water Fish Commission, indicating that the relocation
of the gopher tortoises from the Woolbright Place PUD site has been
completed in accordance with the applicable provisions and conditions of
the permit issued by the Florida Game and Fresh Water Fish Commission. Land
clearing and site preparation activities by the developer are now in order
pending the receipt and subsequent approval of all applicable permits to be
issued by the City of Boynton Beach.
This correspondence is being provided to you for informational purposes
only; however, should you have any questions relative to any portion

The attached letter completes the developer's obligation to
relocate the existing gopher tortoise populations from the site
prior to receiving a land clearing permit. The developer's
representative Joseph F. Colb., Jr. of CCL Consultants, is
completing the Tree Management Plan for the site. This is the
second item still outstanding prior to issuing a land clearing
permit.

1991.

The attached letter describes how the Florida Game and Fresh
Water Commission is re-reviewing the gopher tortoise permit
application from the above applicant. It appears that the
on-site preserve for Woolbright Place Apartments will not be
required if the tortoises are relocated off site. This letter
also indicates that the City must wait for a final outcome prior
to issuing a clearing permit.
