Shoppes of Woolbright PCD. The subject PCD is partially
developed. Existing uses conform to the approved sign program
with the exception of Cracker Barrel (evaluated independently by
the Commission) and RaceTrac. RaceTrac's signs have not ;y;et
been approved, do not meet the current sign program and are
pending approval of this modified sign program, to address the
signs of not only RaceTrac, but also Burger King and two
anticipated uses; Discount Auto and Walmart.
The sign program modification request includes:
. Two, 20 feet high pylon signs (for Walmart and Burger King)
and one, 30 feet high pylon sign (an additional one for Home
Depot);
. Four monument signs (one for RaceTrac, Discount Auto
Parts, Burger King, and one for an unspecified tenant);
. wall and building signs for Walmart, RaceTrac, Discount
Auto Parts and Burger King;
. readerboard and directional signs for Burger King; (see
Exhibits "B" - proposed signage).
The signs already approved are:
. three pylon signs (one for the Shoppes of Woolbright which
also advertises Home Depot, and two signs for Cracker
Barrel)
. wall signs for Home Depot and Cracker Barrel.
Traffic -
The request does not affect traffic concurrency.
Drainage - The request does not affect drainage.
There are no driveways included with the subject request.
There are no parking facilities included with the subject request.
The request does not trigger specific landscaping requirements.
There are no buildings included with the subject request.
Proposed signs violate the community design plan standards with
respect to: number of colors, number of sign styles and number of
lettering styles. The petitioner has submitted a concurrent appeal
application for relief from number of colors only.

12. No business identification (sign copy) was submitted for the monument sign
proposed for the northernmost portion of Parcel "C". Provide a note on the
master plan that the approval of this sign is limited to location only. A
subsequent submittal of the sign copy shall meet the conditions (regarding color
and helvetica letter style) of this sign program approval, otherwise a future
revised sign program (Major Site Plan MOdification) will have to be submitted for
review and approval by the City Commission.
13. On sheet 5 of 9, specifications for typical store signs are laid out. Clarify in
which locations these typical store signs are to apply.
14. All signs proposed must meet the minimum setback requirements of 10 feet. On
the master plan include all required setbacks. Also, proVide colored elevation
drawings of the missing sign elevations for Burger King and Discount Auto at
the Planning and Development Board meeting with color samples of all materials
to be used in manufacturing and constructing the signs.
15. City's LDR, Chapter 9 - Community Design Plan allows only two (2) colors,
(except for white and black) to be used for signs in shopping centers. On the
site plan, sheet 2 of 9 include a tabular summary of all colors proposed for the
sign age in this development. Mark with an asterisk colors already approved by
the City Commission.
16. If colored elevations of all proposed signs, as required by the LDR, Chapter 4,
Section D are not submitted for the Planning and Development Board meeting,
it is recommended that the elevations go back before the Commission as a
future site plan approval, prior to application for permit.
17. Chapter 9 of the LDR, Community Design Plan, Section 10.1.2 requires that a
single sign style shall be used for wall signage on all buildings on the site signs
are predominately channel. Therefore comply with this requirement of the city
code or file an application for a Community Design Plan appeal from this code
provision.
18. Chapter 9 of the LOR, Community Design Plan, Section 10.1.8 allows only one
lettering style, in addition to the lettering styles of the nationally registered copy,
to be used by all tenants/outparcel owners in the PCD. Signs are currently
helvetica. Comply with this requirement of the city code or file an application for
a Community Design Plan appeal from this code provision. (Burger King's letter
style must be changed. No letter style information was submitted for the
remaining uses.)
19. For the Home Depot property, two pylon signs are shown along the frontage of
Woolbright Road, approximately 220 feet apart. The sign code allows only one
freestanding sign for Home Depot, on the Home Depot property, therefore pylon
signs shall be limited to one. No business identification (sign copy) was
submitted for the easternmost sign. Provide a note on the master plan that the
approval of this sign is limited to location only.
20. Submit a rectified master plan for the Shoppes of Woolbright PCD showing
compliance with the conditions of all previous approvals, prior to permits being
issued for signage approved with this request.
21. All monument signs shall provide appropriate, unobstructed cross-visibility at all
points of access as described in LDR, Chapter 7.5, Article II, Section 5.H.
22. Two freestanding (one pylon and one monument) signs are proposed on the
Burger King property. The sign code allows only one freestanding sign for
Burger King. Therefore, freestanding signs shall be limited to one. Since
there are pylon signs existing and proposed along Woolbright Road, it is
recommended that Burger King's sign be located along S. W. 8th Street and
not Woolbright Road to minimize the number of signs in the short distance
between S.W. 8th and 1.95 alonq Woolbriqht Road.
23. Submit a rectified master plan for the Shoppes of Woolbright PCD, showing
compliance with the conditions of all previous approvals, prior to issuance of
anv further buildino Dermits within the PCD.

24. Since at this time it is unknown whether the remainder of the PCD will be
developed as one large commercial use or multiple stores within a shopping
center arrangement, a revised sign program application shall be submitted in the
future simultaneously with a site plan application for the remainder of the PCD,
to provide details for store wall signage (in-line tenants), if this type of use is
DroDosed in the future.
25. It is recommended that all monument signs (including RaceTrac, Burger King,
Discount Auto and future parcel tenants) be designed to match the monument
sign proposed for RaceTrac and that the size of monument signs be four feet

Master plan modlOcation
Please place the above-referenced item on the May 7, 1996 City Commiqion agenda under
Developme..t Plans.
DESCRIPrION: The above request was submitted by Louis R. Campanile, Jr, CCL
Consultants, Inc. agent for Bowar4 Scharlin, Trustee to amend the previously approved
master plan to reduce the building size of Outparcell from 6,920 square feet to 5,930
square feet; Increase the building size of Outparcel2 from 5,755 square feet to 6,745 square
feet; change the use of the 5.36 acre tract on the west side of S. W. 8th Street from a 28,000 ,
square foot commercial buDding to a 9,970 square foot (180 seat) sit down restaurant; and
expand the size and boundary of the PCD by reduction of the width of Morton's Way from
80 feet to SO feet. The PCD Is located on the north side of the intersection of Woolbright
Road and S. W. 8th Street.
RECOMMENDATION: The PlanniDl and Development Board, unanimously recommended I
approval 01 this request, subject to the Conditions of Approval in Exhibit "D", with the
exception 01 comment 13. Regarding this comment, as requested by the applicant, the
Board recommends that the permit plans for the landscape buffer be submitted prior to the
Certificate of Occupancy for Cracker Barrel rather than the issuance of a permit for

NATURE OF REQUEST
CCL Consultants, Inc., agent for Howard R. Scbarlin, trustee of the property, Is
requestlnl approval to modify the previously approved master plaD, for the Shoppes of
Woolbright PeD. The 31.99 acre planned commercial development, Is located on the north
side of Woolbright Road and east of the L.W.D.D. E-4 Canal (see Exhibit "A" - location
map). The proposed changes are shown on the proposed master plan and described in the
attached letter from CCL Consultants, dated March 19, 1996 (see Exhibit "B" - letter of
request and proposed master plan). The proposed cbanles are as fonows:

2-story buUding decreased from 6,920 square feet to 5,930
square feet.
l-story buDding increased from 5,755 square feet to 6,745
square feet.

feet from 286,320 to 268,290 square feet.
BACKGROUND
The Shoppes of Woolbright Is part of a November 6, 1986 and January 24, 1990 stipulated
settlement ap'eement between the City and tradewlnds Development Corporation. The
City Commission ratmed the settlement agreement by approving a master plan modincatlon
on May 15, 1990 that depicted the appDeable conditions of the January 24, 1990 stipulation
and settlement agreement (see Exhibit "C" - master plan pursuant to the 1990 stipulated
settlement agreement). The agreement vested the project for traffic, water and sewer, 50
that no time extensions for concurrency would ever be required, prior to build-out of the
property, so long as the total number of trips and peak hour of trips did not increase. The
settlement agreement approved a maximum of 320,000 square feet, to include the uses and
layout depicted on Exhibit "C", however, the master plan reflects only 315,580 square feet.

between THE CITY or BOYNTON BEACH and HOWARD SCHARLIN, TRUSTEE 'FOR
WOOLBRIGHT PLACE, JOINT VENTURE (the expedited review schedule Is part of this
agreement). This document was amended to Include the off-premise sip for Cracker
Barrel restaurant which occurred, as Resolution R96-15.
Since the original settlement qreement, the foUowlnl master plan modlftcations have been
submitted for reviewI
1. October of 1989 - request to Include the addition of a buDding materials store (Home
Depot) which Included 102,250 square reet of retail and a 19,375 square foot garden
center. The total square footale for the PCD remained unchanged at 315,580

2. May of 1991 - request to Include the fonowing:
a. Addition of a new driveway onto Woolbright Road, located west of S. W. 8th
Street;
b. Change in use and size of the outparcel at the northwest corner of
Woolbright Road and S. W. 8th Street from 4,000 square reet or retail
commercial to a 1,250 square foot gas station (thJs portion of the request was
withdrawn by the appUcant, from the submittal);
c. Change in size, number of stories and d~gnation of use of the outparce) at
the northeast comer of Woolbright Road and S. W. 8th Street from a 4,300
square foot retail buUdinl to a two-story, 6,000 square foot bank with drive-
throu"';
d. Addition of another driveway from S. W. 8th Street to the shoppina center
outpareels located on the east side of S. W. 8th Street;
e. Relocation southward of the approved driveway located on the east side of
S. w. 8th street that leads to the shopping center outparcels; and
f. Elimination of -the north access aisle connection between the outparcels
located on the east side of S. W. 8th Street and the Home Depot site.
The modifications to square footage resulted in a net increase of 1,700 square feet,
thereby increasing the total square footage for the PCD from 315,580 to 317,280
square feet (within the limit allowed by the 1990 settlement agreement). This request
was presented to the Planning and Zoning Board (now known as the Planning and
Development Board) on August 13, 1991. The Board recommended approval of the
request, with the exception of the additional driveway on Woolbright Road. The
minutes from the August 20, 1991 and September 19, 1991 City Commission
meetings state that the request was tabled at the request of' the City Attorney
because of a pending motion In the Tradewlnds case and that the City Attorney
wished to confer with counsel for Tradewlnds on the Issue. A review of City
records indicate the request was Dot removed from the table.
3. Marcb of 1993 - request to include tbe addition of 8,745 square feet to tbe garden
center at the Home Depot. The garden center increased from 19,375 square feet to
28,120 square feet. Pursuant to the 1990 settlement agreement, the square footage
of the garden center is not included as part of tbe retail gross leasable area. The
request included adjusting property lines to accommodate the expansion and the
total square footage of the project remained at 315,580.

4. March ot 1993 - request to Include the foUowlnl:
a. Subdivision of Tract B to create a .957 acre outparcel. Tract B Is that
portion of the PCD that II located on the west side of S.. W. 8th Street;
b. Cbange In use and size of the outparcel at the northwest corner of
Woolbright Road and S. W. 8th Street from 4,000 square feet of retail
commercial to a 3,040 square foot gas station (resurrection of the portion of
the May 1991 request that was withdrawn by tbe appU~t);
c. Add two Dew driveway. into tbe proposed senlce station outparcel- one on
S.W. 8th Street and the other on Woolbrllbt Road;
d. Allow a canopy over the gasoline pumps to encroach the setbacks due to a
difference In the senlce station regulations In effect In 1986 vs. the service
station regulations In effect In 1993; and
e. Reduce the buDding square footage speclt1ed on the master plan for Tract B
from 62,000 to 55,040 square feet.
With this request, the total square footage of the PCD decreased 6,960 square feet
from 315,580 to 308,620. On April 20, 1993 the City Commission approved the
request, subject to staff comments. As a result of the tramc evaluation of the
proposed senlce station use, the square footage on Tract B decreased 24,000 square
feet from a total of 55,040 square feet (52,000 commercial/retail plus 3,040
convenience store/lssoUne sales) to 31,040 square feet (28,000 commerclal/retall plus
3,040 convenience store/gasoline sales). Therefore, the total square footage of tbe
PCD decreased 24,000 square feet from 308,620 to 284,620 square feet.
5. February 14, 1995 - request to Include the foUowing:
a. Subdivision of Tract C to make outbuilding 3 a separate .895 acre outparcel.
Tract C is located at the Dortheast comer of S. W. 8th Street and Woolbright
Road and south of the main entrance into the Home Depot.
b. Change in the size of the outbuilding 3 from a one-story, 4,300 square foot
buDding to a one-story, 2,625 square foot drive-through, fast food restaurant.
c. Change in the buDding area of outbuilding 2 from 5,000 square feet to S,755
square feet. .
d. Change in the buDding area of outparcell from 4,300 square feet to 6,920
square feet.
e. Relocation of the existing driveway located on the east side of S. W. 8th
Street.. 30 feet south, from' 290 feet to'160 from the south property line of the
PCD.
f. Addition of a driveway on the east side of S. W. 8th Street, approximately 400
feet north of the south property line of the PeD. This driveway was
requested on a previous master plan modification (May 1991) that was tabled
by the City Commission; therefore it has been added to this request.

ANALYSIS
Chanles in Planned Commerdal Development (PCD) master plRDI are reviewed consistent
with Section 6.r.13.b. of Appendix A. Zonlnl u foUows:
b. "Modifications to approved plans which result in an increase of less than ten (10) per
cent In measurable Impacts u determined by includinl any changes in traffic
generated, water consumed or sewage to be collected will require review and
recommendation the planning and zoning board and final approval by the city
commission. The city commission decision to approve, approve with modifications
or deny, shall be predicated upon a ftndlnl of consistency with the comprehensive
plan and a findlnl that any such increase wUI not result in a negative impact on
Infrastructure delivery systems or the surrounding area In general. It Is the Intent
of this section that all addJtlonallmpac:ts be mitigated..."
Based on the documentation provided, the use and square footage change to the west
commercial parcel would generate In excess of a ten (10) per cent increase in water
consumed and sewage collected. However, If the increase in water consumed and sewage
collected are evaluated against the entire PCD the water and sewer impact would be below
ten (10) percent. In either scenario, the Utility Department does not have an objection to
the analysis provided and has not indicated that the increase will have a negative impact
on the utility systems. A slight increase in pervious area wUI result In a minimal, positive
impact on the PCD drainage system. With respect to traffic, to date no traffic information
has been submitted to evaluate whether there Is an additional Impact regarding traffic
generated as a result of the proposed changes to the west commercial parcel and the shift
in area of outparcell and 2 (see Exhibit "D" . Conditions of Approval). However, staff
has obtained the following Information from the Palm Beach County Traffic Division
regarding standard trip generation rates:

The following Is an evaluation of each of the proposed changes listed on page one of this
report:
1. The 990 square foot decrease In the size of outparcel 1 and the 990 square foot
increase in the size of outparcel 2 have no impact and are acceptable, however, as
previously stated no traffic information bas been provided for the sp~e use.
2. The omission of the drive-thru lane from outparcel 3 is acceptable, however, as
previously stated no traffic information has been provided for the specifie use.
3. The 18,030 square foot reduction In size of the west commercial area from 28,000
to 9,910 square feet Is acceptable, however, as previously stated no traffic
information has been provided for the specific use.
4. The reduction in width of the Industrial Access Road from 80 feet to 50 feet was
recently approved as part of Resolution No. R95-65 - agreement between the City
of Boynton Beach and Howard Scharlin, Trustee for Woolbright Place, Joint
Venture.

13. Show on the master plan, the five (5) foot tall
landscape berm with ficus hedge (located at the
highest point of the berm) that is identified in
resolution R95-65 as required along the west
boundary line of the PCD. Also, list on the
plan the landscape and berm specifications that
are described in the resolution. Indicate on
the plan that the berm shall be completed by
February 7, 1996. Specify on the plan that the
landscape material will be irrigated and comply
with landscape material specifications listed in
the landscape code.
Considering that the landscape berm was not
completed within three months of the November 7,
1995 date as described in Resolution No. R95-65,
it is recommended that permit plans for the
landscaping and berm be submitted to the
Building Division of the Development Department
prior to permit approval of the Cracker Barrel
facility or any other permit being issued for
the PCD. The permit, plan submitted to the
Building Division shall depict the berm and
material consistent with Resolution No. R95-65
and the other required landscape specifications
identified in Chapter 7.5, Article II -
Landscape Code of the City's Land Development
Regulations.
14. As approved with the previous master plan
modification, add a deceleration lane in S.W.
8th Street to allow north bound traffic to turn
east at the first curb cut north of Woolbright
Road. Also, add a deceleration lane in S.W. 8th
Street to allow south bound traffic to' turn east
at the first median cut north of Woolbright
Road.
15. Modify the layout of the access aisle at the
first curb cut on the east side of S.W. 8th
Street north of Woolbright Road, to. show on both

efficient traffic flow, install a left turn
deceleration lane in S.W. 8th Street to allow
north bound traffic on S.W. 8th Street to turn
west at the first median cut north of Woolbright

17. Amend the location of the north boundary of the
Shoppe. of Woolbright POD on the west side of
S.W. 8th Street to correctly identify the
property line that separates the Shoppes of
Woolbright PCD from the Woolbright Place POD as
defined in Ordinance 89-39. Ordinance 89-39 is
the ordinance that established the PCD. Rectify
the Shoppes of Woolbright Place PCD plat
documents to correspond with Ordinance 89-39.

Label on the master plan the zoning district
classification of the land located to the east,
west and south of the PCD.

24. It is recommended that the following method be
used to determine whether the proposed changes
in use and building square footage create an
additional impact in traffic generated with
reapect to the vested daily trips for the
project:
Analyze the developed or undeveloped land within
the PCD or PUD that has been sold fee simple or
land owned and developed by the applicant and
apply the trips generated for the specific
existing use or use being requested (note; all
u... .ball b. either donsi.tent with those
listed in Resolution R95-65 as amended or as
approved with the original 1990 stipulated
agreement or as approved by the City
Commission). The trips generated shall be
obtained by using the trips listed in the
current Palm Beach County fair share fee road
impact fee schedule. Combine the total
generated trip count and compare it to the total
daily trip count vested for the project as
identified in the 1990 Barton-Aschman traffic
analysis. It should be noted that 320,000
square feet of building area for the PCD and 656
multi-family units for the PUD shall not be
exceeded. These maximums were identified in the
1990 stipulated settlement agreement.
The result of the traffic analysis shall show 00
additional total trips or additional pe~k hour
beyond the daily vested trips identified in the
1990 Barton-Aschman report.
25. It is recommended that the landscaping for all
proposed site plans within the PCD show
uniformity with regards to landscape material
for visual connection and that a note be added
to the master plan referencing this
recommendation.
26. Submission of a rectified master plan showing
compliance with the conditions of approval for
the project will be required to be submitted to
the Planning and Zoning Department, in
triplicate, prior to platting and/~r site plan
review for the PCD.
