In response to your inquiry regarding the above-referenced planned unit development, please be informed that due
to the limited extent of our records, I am only able to indicate that land on which this project is located became a
part of the incorporated city limits some time before June 18, 1962. The property I am describing, is located on the
west side of 1-95, north of Woolbright Road, and is the location of The Vinings apartments.

Dear Ms. Heyden:
The Palm Beach County Traffic Division has reviewed the trip
generation comparison for the project entitled Woolbright Place
PUD/PCD, pursuant to the Traffic Performance Standards in Article 15
of the Palm Beach County Land Development Code. The analysis is
intended to address a change at one out parcel from 4,000 square feet
of retail to 3,710 square feet of high turnover restaurant. The analysis
compares the total traffic for the land uses in the original approval to the
total traffic for the proposed land uses. It shows a decrease in net trips
from 16,117 to 16,114. The land uses and the trips associated with
them are show in the attached table.
The Traffic Division has determined that the project meets the Traffic
Performance Standards of Palm Beach County. If you have any
questions regarding this determination, please contact me at 684-4030.

impact resulting from the proposed change.

WOOLBRIGHT PLACE, PLAT I AND; BEING MORE
PARTICULARLY DESCRIBED HEREIN;
AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE A DISCLAIMER FOR SAID PORTION OF
THE UTILITY EASEMENT; PROVIDING THAT THE
ATTACHED DISCLAIMER BE RECORDED IN THE
PUBLIC RECORDS OF PALM BEACH COUNTY; AND
PROVIDING AN EFFECTIVE DATE.
WHBRBAS, Howard R. Scharlin, Trustee for the Woolbright
Place PUD, has requested the abandonment of a portion of a
temporary utility easement and reserving a portion thereof as a
temporary easement, as depicted on the attached Exhibit .A.

WHBRBAS, comments have been solicited from the appropriate
City Departments, and public hearings have been held before the

the proposed abandonment; and

Dear Mr. Joslyn:
I am in receipt of your letter dated July lS, 1997. I have
forwarded a copy to the City Manager,' AI Newbold, and the City
Clerk so that they can provide the appropriate documents that you
request. I will respond more fully to each of the issues that you
raise in your letter when the City staff provides me with their
impressions regarding the TRC meeting.
I feel compelled to address the issue regarding the recording
of the Plat to some degree. I for one, felt that Mr. Morton made
a clear and unequivocal demand ~t the meeting on Monday, July 14,
1~97 that the Plat be recorded. It seems disingenuous for you or
Mr. Morton to now suggest that the staff should ha.ve inferred
something in direct contradiction to that express demand.
Nonetheless, if you fell abandonment or vacation of the Plat is
necessary, I would be happy to entertain your suggestion on how the
City can assist your client in doing so.
1 am responding to the proposed Second Addendum to Settlement
Agreement drafted by. your associate, Greg Kino. I am submitting
the proposed Agreement to the City Commission for consideration at

workshop meeting. It is my intent that you and your client be
available for that workshop so that the full Commission can
consider the status of this development and any proposals you have
for bringing it to fruition.
I need to advise the Commission in advance of the workshop
meeting of the status of Mr. Morton's negotiations with the County
regarding the impact fees as the County has linked the City in that
dispute. I am requesting that you provide me with that information
so that I can request a workshop meeting with the City Commission
to discuss a comprehensive settleme of the issues raised in the
Second Addendum.

MTP Group, Inc. has prepared the attached trip generation comparison of the approved versus the
proposed land uses at Woolbright Place PCD/PUD. The analysis has been performed using the trip
generation rates included in the Palm Beach County Land Development Code Section 10.8: Fair Share
Road Impact Fees. This analysis is a revision of our previous analysis to incorporate the proposed 3,710
square feet restaurant in one of the out-parcels previously assumed as a 4,000 square feet retail.
Weare attaching tables 6, 7, 8, 9 and 10 which summarizes the trip generation comparison using Palm
Beach County standards. We have used the same table numbers for purpose of comparison with our
previous study. As shown in these tables, the net external trip generation potential of the proposed
development is lower than that of the approved development. Therefore, there is no additional traffic
impact resulting from the proposed change.

so as to prevent encroachment by future structures including pools, screen rooms, etc.

plans should be reviewed and approved by the Technical Review Committee (TRC) for any possible conflicts. The
plans should show quantities, specifications and species of trees with any understory plantings. A note should be
on the plans that the maintenance of the landscapelirrigation improvements will be provided by the applicanfs
commercial association.

31. The undisturbed open area portion of the site can be evaluated as a vegetative, visual barrier only after all of the
exotic vegetation has been removed from the site. There may be voids in the visual buffer after the clearing of
exotics ~hat will have to be landscaped with native species and receive water until established. The present
elevation of this open area is higher than S.W. 8th Street and may change as part of the project. These activities
may affect whether the undisturbed open area can be used as a visual buffer rather than the applicant
plantinglirrigating anew buffer along the western perimeter of the project. The project should continue in the
normal review process.
Based on the City Council meeting the area referred to as the undisturbed open area will be cleared of
all exotic vegetation. After the area has been cleared of exotic vegetation the Urban Forester will have the
opportunity to review the property to determine whether additional buffering through vegetation or berming will be
necessary. In the event that the Urban Forester notifies the applicant that no additional work is required, then this
will serve as the buffer between 8th Street and Lake Boynton Estates. In the event that the Urban Forester feels
that additional work will be required, the applicant will be obligated to add the additional buffering materials.
PARKS AND RECREATION
Comments:
32. As the developer has chosen not to provide five private basic park requirements, the submittal does not qualify for
one-half credit for private recreation.

33. Based on the number of singly family units, the following recreation fee applies:
84 single-family units x .0180 = 1.512 acres
As the developer has already paid one-half of the fee, his dedication is: 1.512 divided by 2 = .756 acres. Fee in
lieu of land is recommended.

PLANNING AND ZONING
Comments:
34. To provide a more efficient layout of the project regarding street design for services provided by the city such as
fire rescue, emergency services and sanitation pick-up, it is recommended that the lot design in the northeast and
southwest portions of the project be redesigned by omitting lots or creating pie shaped lots on a street radius rather
than allowing the short dead end streets that do not have a cul-de-sac turn-around.
Item is acknowledged. We believe that modifications required by City Council and based on meetings
with their staff are adequately shown on Sheet MP2.
35. Submit a landscape plan for the area identified as open parcel (undisturbed). The plan shall include grading
elevations, type of landscape material, plant material specifications including type of lawn grass and irrigation
requirements.
As described in Item 31, after the clearing of the exotic materials has been done, the applicant will work
with the Urban Forester to determine if any additional landscaping is required. In the event that the Urban Forester
requires additional landscaping or berming, a plan will be prepared and submitted for his approval prior to the
installation.

36. All parking spaces provided or required for the recreation pool area shall be designed to comply with the city
regulati9ns specified in the City's Land Development Regulations, Chapter 23 - Parking Lots. Amend the plan
accordingly.'

37 . To maintain consistency regarding the building setback for the perimeter of the project it is recommended that the
proposed forty (40) foot building setback remain around the perimeter of the portion of the site titled Open Parcel
Area (Undisturbed), including the south property line for the proposed tract.
The forty (40) foot building setback has been added to the Open Parcel Area (Undisturbed) on Sheet
MP2.
38. On sheet MP1 of 2, identify the new name of Morton's Way, as specified in Resolution R96-112.
Morton's Way has been shown on the plan as Purple Heart Way in accordance with Resolution R96-112.
39. On sheet MP1 of 2, change general note 1 and 3 to reflect the method the developer is or has complied with the
city's recreation requirement for the entire PUD. In describing the approved or proposed method, delineate the
compliance by showing the computations per each pod or parcel within the PUD.
We have modified general note 1. POD 2A is no longer pertinent since it has been completed and the
site plan improvements were done in accordance with the city code. This also applies to POD 2B. On POD 1 it
is acknowledged that the developer of POD 1 will not provide the required amenity package to eliminate half of the
recreation fee and will pay the required fee. It was determined that it was unnecessary to modify Sheet MP1.
40. It is recommended that a twenty (20) foot setback be established around the recreation pool area. Show and
dimension on sheet MP2 of 2, the 20 foot setback for structures and all recreation amenities.
The twenty (20) foot setback around the recreation pool area has been shown. It is felt that the
requirement applies to specifically the building and the pool area, but that the deck area may be closer to the lot
line and somewhat in accordance with the minimum setback standards shown on Sheet MP2. Shown on the
draINing is the pool and the deck area being twenty (20) feet away from any lot line, with the deck being within five
(5) feet of the same.
41. It is recommended that the depth of lots 71 through 77 be reduced 0.5 feet to allow the depth of lots 78 through
84 to be increased from 95 feet to 95.5 feet which would establish a minimum lot size for the development of
4,037.5 square feet rather than the proposed 3,990 square feet. The present minimum lot size, in the city for
single-family detached units, is 4,000 square feet.
Lots have all been revised in accordance with this recommendation, providing for a minimum square
footage of 4,053 square feet. These changes are all reflected on Sheet MP2.
42. To clarify the minimum standards for the PUD, amend the project summary note 7 found on sheet MP2 of 2 as
follows:
Minimum lot size: 42' x 95.5' (4,037.5 square feet)
Minimum lot frontage 42'.
Lot frontage shaD be measured at the 15 foot setback line for the following irregular shaped lots; 1-8 and
45-48.
The lots have been modified. The 42' frontage have been shown on the pie-shaped lots with their

44, Add to the master plan submittal the previously approved landscape plans for S.W. 8th Street, the water
management area, lake plantings and the preservation area requirements.
It was agreed to at the City Council meeting that the applicant will provide the City with the current
approved landscape plans for 8th Street, water management area, lake plantings and the preservation areas.
These will be submitted under separate cover.
45. Add to the site data found on sheet MP1 of 2, the density (number of dwelling units per acre) represented for the
gross acreage of the PUD. Also identify the land use classification of the PUD as defined on the City's Future Land
Use Map.
The number of dwelling units per acre represented for the gross acreage of the PUD have been added
to Sheet MP1. Also the City's Future Land Use designation has been added to this sheet.
46, On sheet MP1 of 2, amend the south border of the Woolbright Place PUD on the west side of S.W. 8th Street to
correctly identify the property line that separates the Woolbright Place PUD from the Shoppes of Woolbright PCD
as established by Ordinance 89-16. Ordinance 89-18 is the ordinance that established the PUD. Rectify the
Woolbright Place PUD plat documents to correspond with Ordinance 89.18. It is recommended that the land
shown on the master plan within the Church Parcel that is not zoned PUD be rezoned, by the applicant, from PCD
to PUD, unless otherwise determined unnecessary by the city attorney. Amend the legal description, plans and
site data on sheet MP1 of 2 accordingly.
It is felt that the requirements for PCD and PUD have been cleared up and that the current legals shown
on the PCD and PUD are in keeping with the actual conditions. The modifications have been approved both by
the PCD and PUD.
47. Sheet MP1 of 2 indicates that POD 1 will have 5 common recreation amenities; however, the plans only reflect a
pool. Correct the plans accordingly.
This has been modified to show that only a pool is provided.
48. On sheet MP2 of 2, modify general note 1 to indicate the 0,32 acre private recreation tract, the 1.47 acre open area
parcel and the 2.64 acre private road tract located within POD 1 are owned, operated and perpetually maintained
by the projects homeowner's association. Include any other land area that is proposed to be common land for the
development.
On Sheet MP2, we have modified the general note to show that the point .32 acre private recreation and
the 1.47 open area and the 2.64 private road tract within the POD 1 are owned, operated and perpetually
maintained by the projects homeowner's association.
49. To clarify note 4 found on MP2 of 2, move the note to sheet MP1 of 2 and show on the plan the location size, and
shape of the medians adjacent to the street frontage of the subject PUD. It is recommended that the last three
words of note 4 be changed from homeowner's association to Woolbright Place Master Association, Inc,
The general note 4 on MP2 of 2 has been moved to Sheet MP 1 of 2 and has been modified to reflect that
Woolbright Place Master Association, Inc. will be the responsible entity for the maintenance of the medians. It
needs to be noted, however, that there are no medians adjacent to POD 1; that the medians cease to the south
prior to reaching the POD 1 property line.

50. Prior to plat approval of POD 1, Homeowner's Association documents will be required to be submitted for review
by staff. .The documents shaD comply with the specifications identified in Chapter 2.5 - Planned Unit Development,
Section 6 and Chapter 5 - Platting, Article V, Section 1 D 11 of the City's Land Development Regulations.
It is acknowledged that the Homeowner's Association documents will be submitted for review by the staff
prior to the approval of plat for POD 1.
51. On sheet MP1 of 2 modify general note 9 by omitting the last sentence and adding the words "as defined on each
plat within the PUD" before the period at the end of the first sentence.
We are not sure what note 9 is referring to. We will contact the city to determine what needs to be
changed and will make the modifications as required.
52. To clarify the issue regarding location of fences on perimeter lots within POD 1, move general note 9 found on
sheet MP1 of 2 and place it below the typical lot drawings depicting lots with perimeter landscape buffer easements.
General note 9 has not been moved and left under the general landscape planning notes for the overall
project. We feel that it is pertinent not only to POD 1 but to the rest of the project, and more appropriately left at
this location.
53. To clarify the areas of the project that will require site plan review, add text to general note 12 found on sheet MP2
of 2 indicating that site plan review is also required for the site wall or fence, landscaping for the open parcel and
project signage located at the entrance to the site.

54. To provide privacy for lots 1 and 48, it is recommended that a common ground tract of land be shown on both sides
of the entrance road. This can be accomplished by moving the adjacent row of lots to the north and south.
Additional buffering through wallsl fencing or landscaping will be included to provide privacy for lots 1 and
47, previously 48.
55. To provide privacy for lot 84 which is abutting the east side of the proposed private recreation pool, it is
recommended that either the pool and cabana exchange locations or the cabana and pool be rotated ninety (90)
degrees in a clockwise direction.
The site plan has been modified by moving the pool and rotating the cabana for lot 83, formerly lot 84.
This adjustment should provide additional privacy.
56. Specify on sheet MP1 of 2, the approved total peak hour trips that are allocated for the PUD and indicate how many
trips are generated for the existing and proposed development for each parcel or pod identified on the master plan.
The peak hour trips calculated on each pod for review and process with the traffic study have already
been approved for this project. Given the complexity and the lengthy nature of this information, it is not shown on
the plans but has been specified in the report.

57. To install the buffer plan proposed by the applicant (25 feet wide abutting the north property line of the PUD) in
compliance with the FPL guidelines regarding planting trees near overhead power lines, the tree materials identified
on the plan would have to be changed. The reason the tree material should be changed is that the north portion
of the proposed buffer overlaps a five foot wide utility easement that has overtiead power lines. One-half of the five
(5) foot wide utility easement occupies the north 2.5 feet of lots 8 through 22. It is recommended that prior to plat
approval the applicant submit a site plan review request that depicts the buffer planting plans for all areas of the
project that include buffer plantings on single-family platted lots. The submittal shall include planting plans for the
north buffer that have been reviewed and approved by FPL. If the FPL approval requires the omission of trees,
reduction in tree size specifications or change in location of tree material, the north buffer easement and plantings
shall be moved into the site a distance that would allow FPL to approve the proposed planting scheme and
recommended planting specifications. The below listed planting changes and specifications are recommended
to be added to the proposed plan to describe a typical 1 00 foot section of the buffer.
Trees: Specify the two (2) Red Cedar trees, three (3) Slash Pines, one (1) Live Oak, two (2) Gumbo Limbo and
three (3) Sabal Palm trees shall be twelve (12) feet tall at time of planting.
Hedges: Show fifty-one (51), twenty-four inch to thirty-six (24 to 36) inch tall Coco Plum plants along the top of
the four foot tall berm and space the plants 2 feet on center. The plants shall form a continuous hedge row the
entire length of the buffer.
Shrubs: The 24 Scm Palmetto plants shown on the plan shall be thirty to thirty-six (30 to 36) inches tall (15 gallon)
at time of planting. Install forty-eight (48), thirty-six inch to forty-eight (36 to 48) inch tall Myrsine plants, spaced five
(5) foot on center, alternating 12 plants each side of the top of the berm 25 foot intervals. For each 100 lineal feet
of buffer alternate Myrsine, Randia, Wax Myrtle, Florida Privet, Wild Coffee and Necklace Pod plants. The shrubs
shall be placed in a manner to form a meandering shape of the buffer as viewed from the plan view.
Ground Cover: Omit the Purple and Yellow Lantana plants (deciduous) and replace with a total of two hundred
(200),12 to 18 inch tall Liriope plants (evergreen). The Liriope shall be planted on 12 inch centers with 100 plants
instaned on each side of the benn for each 75 or 100 foot section of the buffer. The Liriope plants shall be installed
to accentuate the meandering shape of buffer.
It is recommended that this entire buffer be installed prior to the issuance of the Certificate of Occupancy of any
recreation structure, sales model facility, or of a residential unit, whichever comes first.
This item has been complied with, with the qualification that in the area near lots 8 and 9 by utility
easement, palms in lieu of the trees specified on the plan view of the buffer on Sheet MP1, will be utilized.
58. To install the approved 25 foot wide landscape buffer plan, as identified in Resolution R92-210, in compliance with
the FPL guidelines regarding proximity of large trees to overhead power lines, the location of the buffer, berm and
large trees within the buffer will have to be relocated so that the row of large trees shown on the north side of the
plan are 30 feet away from the power lines. The Slash Pine, Live Oak and Gumbo Limbo trees identified on the
approved plan are listed as large trees in the FPL brochure. It is recommended that prior to plat approval the
applicant submit a site plan review request that depicts the buffer plans for all areas of the project that include buffer
p1antings on single-family platted lots. The submittal shall include planting plans of the north buffer that have been
reviewed and approved by FPL. If the FPL approval requires trees to be omitted or a reduction in size
specifications or change in location of tree material the north buffer easement and plantings shall be moved into
the site a distance consistent with FPL specifications. The below listed planting changes and specification are
recommended to he added to the approved buffer plant to clarify a typical section of buffer plan.

Trees: First one hundred lineal feet of buffer plant three (3) (fifty foot on center), 12 to 14 foot tall Live Oak trees
placed three feet from the north side of the 25 foot wide buffer easement and plant two (2) (fifty foot on center
altemating spacing from the oaks located on the north side of the buffer), 12 to 14 foot tall Live Oak trees placed
three feet north of the south side of the buffer easement. The next seventy-five feet of the buffer install a grouping
fourteen (14) (ten feet on center), 12 to 14 foot tall Slash Pines (7 on each side of the top of the berm). For the
next one hundred feet of buffer plant three (3) (fifty foot on center), 12 to 14 foot tall Gumbo Limbo trees placed
three feet from the north side of the 25 foot wide buffer and plant two (2) (fifty foot on center alternating spacing
from the Gumbo Umbo located on the north side of the buffer), 12 to 14 foot tall Gumbo Limbo trees placed three
feet north of the south side of the buffer. The previous three sections of tree p1antings shall be repeated the entire
length of the landscape buffer easement.
Hedges: Install, fifty-one (51), twenty-four inch to thirty-six (24 to 36) inch tall Coco Plum plants along the top of
the four foot tall berm and space the plants 2 feet on center. The plants shall form a continuous hedge row the
entire length of the buffer. For each 100 foot or 75 foot section of the buffer Coco Plum and Wax Myrtle plants
shall be alternated.
Shrubs: Spot plant forty (40), forty-eight to sixty (48 to 60) inch tall, at time of planting, containerized Saw Palmetto
palms around each group of 14 Slash Pine trees (20 palms on each side of the top of the berm). Install, forty-eight
(48), thirty-six inch to forty-eight (36 to 48) inch tall Randia plants, five (5) foot on center, alternating 12 plants each
side of the top of the berm at 25 foot intervals. For each 75 or 100 foot section of the buffer alternate Randia,
Myrsine, Florida Privet, Wild Coffee or Necklace Pod plants. The shrubs shall be placed in a manner to form a
meandering shape of the buffer as viewed from the plan view.
Ground Cover: Omit the Lantana plants (deciduous),and replace with a total of two hundred (200), 12 to 18 inch
tal Uriope plants (evergreen). The Liriope shaD be planted on 12 inch centers with 100 pants installed on each side
of the berm at each 100 foot or 75 foot typical section. The plants are to be placed to accentuate the meandering
shape of the buffer. One hundred (100) Fakahatchee grass or Liriope plants may be alternated each 100 foot or
75 foot section of the buffer.
It is recommended that this entire buffer be installed prior to the issuance of the Certificate of Occupancy of any
recreation structure, sales model facility or of a residential unit, whichever comes first.
This item has been deleted.
59. To ensure that the north property line landscape buffer is continuous at the rear of lots 8 and 9, either move the
proposed city utility easement six (6) feet to the south so that the city utility easement does not encroach the
landscape buffer easement or re-route the utility easement to run north and south between lots 9 and 10.
The utility easement has been left in place with the modification per Item 57 above. The applicant will work
with the City to provide necessary buffering between the two projects and work with Utilities as to the location of
any impacted vegetation around the force main.
60. It is recommended that the approved landscape buffer easement and planting be continued along the east and
north sides of the land identified on the submitted plans as Open Parcel Area (Undisturbed). The buffer should
terminate at the east site of S.W. 8th Street at the northwest corner of the PUD. This recommendation may be
omitted if the City ForesterlEnvironmentalist determines that the existing landscape material located on the open
parcel creates a buffer equal to the approved buffer.
The buffer will end with the landscape berm at the extension of the rear of the building for lot 7 which is
approximately twenty five (25) feet west of the last lot in the Lake Boynton Estates Plat 2as shown on Sheet MP2.

61. To clarify the specie and spacing of the planting proposed for the south and east landscape buffer easement,
indicate on the plans that the trees, hedges and shrubs shall be native and the hedges shall form a continuous row
installed two (2) foot on center. Further specify on the plan that the mass planting shall be installed two (2) foot on
center aM at least 10 plants shall be installed for each forty-two (42) lineal feet of buffer. Also, specify on the plan
the height and slope of the berm,
This note will be modified in accordance with the plan.
62. Lots 22 and 44 are nonconforming lots with regards to the minimum frontage of 42 feet, specified on the plan.
Correct the plans to show no less than a 42 foot frontage on all lots.
Lots have been modified on Sheet MP2. The lots 42, 43, 20 and 21 have been dimensioned to show the
distance for the 42 foot frontage which will be measured at the respective setbacks.
63. Add to the plan a continuous sidewalk within the right-of-way between lots 4 and 8.
A sidewalk has been added on the cul-de-sac adjacent to Lots 4 through 7.
64. To provide a street system that will allow proper access by city services to the development that is I()cated north
of the subject site, it is recommended that the developer buHd a cul-de-sac to city standards at the east end of S.W.
4th Avenue. Following city approval of the street construction, the developer shall dedicate the right-of-way to the
city.
A cul-de-sac has not been added, nor is it a requirement to be added to this master plan.
65. Show on sheet MP1 of 2 the five (5) foot tall landscape berm with ficus hedge (located at the highest point of the
berm) that is described in resolution number R95-65 as required along the west property line of the PUD with the
exception of the church parcel. Also, list on the plan the landscape and berm specifications that are described in
the resolution.
The hedge and berm described in R95-65 has been shown on Sheet MP1.
66. On sheet MP1 of 2, add the typical cross section drawing of Morton's Way, as it is depicted in resolution number
R95-65. Also add to the drawing the approved configuration of the pavement for the Industrial Access Road
including the landscaping and sidewalk referenced in the resolution. If the location of the three (3) curb cuts
proposed for the south side of the road are not known at this time, place a note on the plan referencing that three
curb cuts are proposed and they will be installed to city standards.
The cross section for Morton's Way in Resolution R95-65 has been added to Sheet MP1. That section
depicts the approved pavement configuration and sidewalk, as well as the required Landscape Improvements.
67. On sheet M P1 of 2 revise site data note B to reflect the title of the pods where the multi-family units are located.

68. To provide clarity in determining all the setbacks for the project, it is recommended that typical lot/unit detail
drawings be added to sheet MP2 of 2. The drawings shall include dimensioned setbacks for the building, screen
enclosures, pools and easements. The detail drawing shall include a typical lot, corner lot, perimeter lots for each
border of the project, cuk:le-sac lots and any other special or irregular shaped lot Include within the typical drawing
the location of proposed or easements of record. Below the drawings identify the specific lot number(s) that the
detail drawing represents. Ensure that the detail drawings represent all lots proposed for the development

69. Modify the temporary model center area to show no less than three (3) parking spaces per each residential model.
. The temporary models as well as the details of the sales trailer, will be subject to a site plan and submitted
under separate cover. This information acknowledges, however, that a minimum of three (3) parking spaces per
model will be required.
70. It is recommended that the maximum height of the single-family structures be established at 25 feet This height
is consistent with the height limitation on the homes that are located to the north in the R-1A (Single-Family
Residential) zoning district. Amend the site data on sheet 2 of 2 accordingly.
It is understood that the requirement for the building height has now been set at 30 feet. This is shown
as note 6 on Sheet MP2.
71. With a distinguishable symbol, identify on sheet MP2 of 2 the front of the following lots; 1, 8, 23, 45, 48, 57, 58,
66,67, 77 and 78.
The lot widths in front of the non-standard 42 foot lots have been added dimensionally.
72. It is recommended that a ten (10) foot wide landscape buffer easement, located along S. W. 8th Street be extended
to the north limit of the PUD. The entire buffer shall include a two (2) foot tall berm (centered in the new landscape
buffer easement) and the material planted in the easement shall match the landscape scheme of the landscaping
along the south border of the subject project. The landscape material shall be located in a landscape easement
and the easement dedication shall place the maintenance of the landscape material and irrigation as the
responsibility of the H.O.A.
The ten (10) foot landscape buffer has been added on Sheet MP2 in accordance with this request.
73. Submit for permit review plans showing the S.W. 8th Street approved landscaping (plans located in the
Development Department) that abuts the Woolbright Place PUD. The landscaping shall be installed and approved
by the city landscape inspector prior to the plat being recorded for Pod 1 or 90 days following the planning and
Development Board approval of the subject master plan modification, whichever comes first

74. To establish a minimum floor area for the proposed units that is comparable to the minimum floor area required in
the single-family homes abutting the project to the north, it is recommended that additional information be added
to project summary note number 5 found on sheet MP2 of 2 indicating that 1,250 square feet is the minimum floor
area. Also add to note 5 the required square footage regulations listed in Section 4. K. of Chapter 2 - Zoning of
the City's land Development Regulations.
The minimum alc area has been increased to 1,250 square feet. This is shown on note 5 project
summary on Sheet MP2.
75. Provide proper authorization for the subject request, by submitting written verification from the board of directors
of Woolbright Place Master Association, Inc. indicating that Richard C. Wohlfarth, P.E., of CCl Consultants, Inc.
is their representative.

Although not required by city codes, as a courtesy since you own property within 400 feet
of Pod 1 of the above-reference project, you are being notified of changes proposed to this
approved master plan. Richard C. Wohlfarth, P.E. of CCL Consultants Inc. has requested
the amendment, which in part, includes the following changes to this approved master plan:
1) change the dwelling units within Pod 1 from 90 multi-family dwelling units to 84 single-
family, detached dwelling units; 2) reduce the northern boundary setback from 60 feet to 40
feet and reduce the perimeter building setback along S. W. 8th Street from 40 feet to 25 feet;
3) establish a 15 foot south perimeter building setback and a 20 foot east perimeter building
setback; and 4) the addition of private recreation facilities on 14.05 acres.
This request will be considered by the City Commission on Tuesday, September 4, 1996 at
7:00 P.M. at the City Commission Chambers located at 100 E. Boynton Beach Boulevard,

Dear Mr. Haag:
Please fmd enclosed (12) copies of our modified Master Plan for the above-referenced project
along with a check in the amount of $500.00 for the review fee. Pursuant to our recent
conversations, this is a revision to the previously submitted plans that were reviewed by DRC
and City Council over the past four months. The primary revisions to the plans are as follows:
1. The 25' landscape buffer located on the north end is now shown on the plans.
2. Pursuant to an agreement with the City Utilities Department, we have rerouted the force
main to be within the 25' landscape buffer (see sheet 2 of2).
3. The smallest lot on the plan is now 42' x 95' which are the seven (7) lots adjacent to the
recreation area.
4. The recreation area has been internalized pursuant to comments from the City Council.
5. The landscape buffers and the building setbacks are detailed on the plan and we believe
are in keeping with discussions that took place during the review process.

While this letter is trying to identify the major changes and points of interest to aid your review,
there may be other changes that will come out during the review process.
As we discussed, Mr. Morton is making a presentation to the County Commission on August 6th,
to show them the proposed changes and how we have reacted to some of their comments. It is
our hope that at this meeting we can get the Commission to acknowledge, subject to the review
process, that they are at least reasonably in favor of this new concept in order to allow us to
proceed.
At this time it is our hope that by making the submission today that we will be on the August
13th Development Review Committee meeting agenda. Given the history of this project, Mr.
Morton would like to go to City Council on August 20th so that we can proceed to the Planning
Commission on September 10th for approval.

Dear 'Ir. Morton:
I have received your July 24, 1996 response to my July 24, 1996 letter to you. Briefly my
letter states that the most recent drawing you've submitted can not be formally reviewed
hy the Commission on August 6, 1996, as it is a new, incomplete application that has not
heen reviewed by the Technical Review Committee (TRC). I continue to stand behind this
position. The assumptions in your July 24th letter do not meet "Roberts Rules of Order".
There is no approved plan. The Commission made a decision on your plan, which did not
make it to the next step in the process (Planning and Development Board review) because
of the Commission's subsequent action to reconsider their decision on your plan.
Reconsidering opened up the request for rediscussion and renlaces the previous action.
Your agent then withdrew your plan prior to a formal action by the Commission.
If it was your desire at that meeting to resubmit a plan at a later date due to the
Commission's reconsideration remarks, the request should have been tabled. The
Commission would have then directed you to submit your revised plan to staff for new TRC
comments prior to your revised plan being considered by them, as they've done in the ~.
This aside, an application fee covers two TRC reviews, which has already occurred on the
plan you withdrew. New plans incur new plan review costs and require re-review by the
TRC before forwarding to the Commission. Since neither of these has occurred with your
latest plan, I can not fonvard your plan to the City Manager's office for formal
consideration by the Commission. Your option to receiving more than just my staff's
cursory verbal comments is to request the same from the Commission on August 6th by

As we discussed during our meeting at City Hall on Monday. I have enclosed the revised
sketch for our (14) acre resident parcel. We were able to accommodate the Lake
Boynton Estates residents by incorporating the 25'-0 landscape buffer area, and further
satisfy Commissioner Jaskiewicz by locating the recreation parcel within our community.

MTP Group, Inc. has prepared a trip generation comparison of the approved versus the proposed land
uses at Woolbright Place PCDIPUD. This development is located north of Woolbright Road and west
of Interstate 95 in the City of Boynton Beach, Florida. Main access to the development is through SW
8th Street which connects to Woolbright Road to the south and Boynton Beach Boulevard to the north.
The following methodology was used to perform the analysis:
1.- As directed by City staff during the meeting of May 1, 1996, the trip generation potential
of the approved development was determined based on land uses included in the 1990 site
plan. Since this site plan shows three out-parcels without specific land use designation, we
included two restaurants and a bank, per your direction. These land uses are permitted by
zoning code and are usually located in out-parcels.
2.- The approved residential development includes 640 multi-family dwelling units and 16
duplex dwelling units.
3.- Trip generation rates and/or equations were obtained from the latest edition of the Institute
of Transponarion Engineers (lTE) Trip Generation Repon. The 1995 updated version was
also used in the study. Table 1 shows the ITE land uses and land use codes used in the
study.
4.- Passer-by percentages were obtained from Palm Beach County Land Development Code,
Ankle 10, Section 10.8 Fair Share Road Impact Fees with the following exemptions:
Bank. Palm Beach County applies 46% for Drive-In Banks. We have assumed
a Walk-In Bank. Therefore, passer-by was reduced to 30%.
Fast Food Restaurant without Drive- Throue:h. Palm Beach County applies 30%
for Fast Food Restaurants with Drive-Through. Passer-by was reduced to 20%
since the restaurant does not have a drive-through.
Gas Station with Convenience Store. Palm Beach County applies trip
generation rates for both gas station and convenience store. Therefore, the
County applies 58 % passer-by for a gas station and 45 % passer-by for a
convenience store. To be conservative, this study utilizes 45% for the gas station
with convenience store.

general commercial retail which follows:
Passer-by % = 45.1 - O.0225(A) where A = 1,000 SF GLA
5.- As directed by the City Director of Development, Mr. William Hukill. we have made a
~omparison of "net external trips" for both the appro~ed and.p.r.Q,p,osed land uses.
Tables 2 and 3 present the trip generation potential of the approved and proposed land uses. As shown
in these tables, there is a considerable amount of traffic which is assumed as passer-by utilizing Palm
Beach County allowed passer-by. In addition, Palm Beach County limits the amount of passer-by to 25 %
of the traffic on the adjacent street. Since the amount of passer-by for the proposed uses is lower than
the amount of passer-by for the approved uses. any revisions to these figures. if warranted, would result
in higher new trips for the approved uses. Therefore. in order to be conservative, the amount of passer-
by has not been revised. As shown in these tables,_ the trip generation potential of the approved uses is
higher than that of the proposed uses by approximately 650 daily trips.

A certain amount of traffic generated by this development will stay within. This traffic is referred to as
"internal capture". The following assumptions have been used to determine the amount of internal
capture:
· Twenty percent (20%) of the residential traffic will be attracted to the out-parcels and
commercial development within the property.
· Twenty-five percent (25%) of the out-parcel traffic will be attracted to the commercial
development within the property.
Tables 4 and 5 present the net external trip generation potential of the approved and the proposed land
uses respectively. As shown in these tables, tbe net external trip generation potential of the proposed
development is lower than that of the approved d~ent by approxiInately seventy (70) daily trips.

comments. We have also included twelve (12) copies of the revised plans.

Comment #1 We have included a Paving, Drainage, Water and Sewer Master Sheet for review
by the Utilities Dept. On this sheet we have shown the connections for the sewer
and the water along with the drainage. Items 2 and 3 have been deleted. In
discussions with the Utility Dept., we have agreed to re-route the Force Main
northerly from the existing pump station down 4th Avenue to 7th Street.
FIRE None.
POLICE None.

No building structure, screen enclosure, pool, or portion thereof will be

A temporary Sales Center is shown on Sheet #2 of #2. The intent is to
utilize this temporary sales center to facilitate the selling of all the units
and will remain in place until such time as all units have been sold and
just prior to the construction of the units on the lots where the Sales Center
has been located. The Sales Center will be fully removed along with all
the other appurtenances.

A copy of the Storm Water Permit is on file with The Vinings project,
which covers the entire PUD. As you can see we are utilizing the existing
drainage that has been stubbed to the property; and therefore, only a permit
modification will be required, through South Florida and Lake Worth
Drainage District.

It is acknowledged that a Site Plan Review and approval will be required.
Item #9
It is acknowledged that a Plat Review and approval will be required.
Item 10
We believe that the providing of the sidewalks on one side is a reasonable
request. As discussed in the past, the existing property can be built as a
three-story walk-up apartment. We are trying to provide an alternative
housing type; single family adjacent to the existing single family and in
doing such provide an alternative housing type for this area. In order to
do this, it is necessary to provide a modification to the existing plans. We
feel that sidewalks on the single side adequately provides for pedestrian
circulation for this product type.
Item # 11
An Engineer's Certification stating that the drainage plan complies with all
City codes and standards will be provided, as requested.
Item #12
We have located the drainage easements on the plan and also highlighted
on the Master Engineering drawing, the location of the drainage itself.
Item # 13
We are requesting the use of a 40-foot right-of-way, and again as
mentioned in Item #10, above that by providing alternative housing type
in an area that could be multi-family 3-story apartments, we would like to
have some consideration for the use of this revised section. We believe
that this section provides adequate fire and police access; and as seen in
the Police and Fire Comments, they appear to have no objection for that
purpose and do feel that section provides adequate ingress/egress and
service to the property.

We acknowledge that the mmlmum cul-de-sac is a 100 foot radius.
However, there are no cul-de-sacs within the property.

PLANNING AND ZONING
Item
A note has been placed on the Master Plan Sheet # 1 of #2 and #2 of #2
indicating that the project is subject to conditions documented in the City
of Boynton Beach, Resolution #95-65.
Item #30
A 5-foot high tall landscape berm with a hedge located at the highest point
of the berm has been provided as an exhibit to this letter. In addition, it
is indicated that the berm shall be completed by August of 1996. This is
different than the note shown on Item #30 which says February 7, 1996
since that time has come and gone. It is recommended that this be
considered by the Planning Commission and that we be able to get this
extension granted so that the berm can be built in this time frame. It is
also agreed that the plan for the berm will be submitted to the City within
30 days upon approval of the Master Plan. This gives ample time to meet
the above August deadline for the construction of the berm. It is also
requested that the landscaping of the water management tract, 8.69 acre
gross, be completed prior to the first C.O. within the 14 acre P.U.D.

It is believed that the Master Plan for the P.C.D. and the P.U.D. are in
agreement with each other. This plan and legal description have been used
for the past five (5) years. A review of Resolution #89-18 is being
conducted at this time, and it is possible that in the resolution resolving the
changes mentioned in this request, that the acres and legals could be
revised accordingly.

A note has been placed on the industrial access road, Morton's Way, that
is will be constructed by November 7, 1997. Also the typical section as
shown on Resolution #95-65 has been included. Also a note that three (3)
curb cuts are proposed and will be installed to City standards will be
placed along Morton's Way. Also the note on the proposed S.W. 8th
Street has been changed to existing S.W. 8th Street.

MTP Group, Inc. has been retained by Morton Group to perform a traffic impact study for the above
referenced project. The purpose of the study is to compare the trip generation of the approved land uses
in the property with that of the proposed land uses. This study will be performed in compliance with the
Palm Beach County Traffic Performance Standards Ordinance. The study will be submitted to both the
City of Boynton Beach and Palm Beach County. As required by the Ordinance, Palm Beach County
needs to review and approve the traffic study.
The developer is requesting changes to the master plan. These changes will be addressed in the traffic
study. The study will address the overall trip generation of the master plan. The mixed use nature of
this project provides for internalization of trips which will not add traffic to the external roadway
network. For this r~o.Il.,__'!.~~!!1p.cu.-ison_()fjndividualtrip generation for each of the permitted uses does
not represent an-appropriate assessment of project traffic impact.
The approved master plan is being revised to replace 92 multi-family dwelling units for 85 single-family
dwelling units. Since building permits have not been received for the full development of the project,
there is enough traffic approved for this project to allow for the changes above to take place. Once more,
our traffic study will address this and any other land use changes proposed for this development.

PROPER TREE SELECTION
Often, we take our utility service for granted because it has
become "part of our daily lives." For us to enjoy the convenience
of reliable, uninterrupted service, distribution systems are
required to bring electricity to our homes.
The location of these utility lines should have a direct impact on
your tree and planting site selection. The ultimate, mature height
and width of a tree to be planted must be within the available
overhead growing space. It's extremely importantthat the "right
tree" be put in the "right place," Propertree selection will help to
ensure trouble-free electrical service for years to come.
The selection of trees to plant requires careful consideration.
Trees planted in the wrong place can cause serious problems
such as clogged sewers, cracked sidewalks, and power service

WHY WE TRIM TREES
Not all trees are planred in "the right place." Often large
trees growing into powerlines will require periodic trimming
to maintain proper clearance.
Powerline maintenance, including tree removal and trim-
ming, benefits everyone by reducing power outages. A sin-
gle tree that contacts a powerline can interrupt electrical
power to many people in an area, Overhanging limbs. or
trees too close to the powerlines can break or fall off. This is
especially critical during storms or periods of high winds.
FPL utilizes professional tree crews trained to trim trees in a
safe and technically correct manner. The National Arborists
Association standards (NAA) and local tree trimming codes
are used as guidelines.
