UNRESOLVED STAFF COMMENTS
This memo serves to reiterate conversations held during the Technical Review
Board meeting of June 13, 1991, wherein Mr. Mike Haag, Site Development Compliance
Administrator, notified the Technical Review Board that the previous master plan
modification, submitted by Kilday and Associates, has not received final T.R.B.
sign-off.
Apparently, Mr. Kilday received staff comments and conditional approvals from
the governing bodies and to date has not yet complied with the staff comments
previously provided him. Mr. Kilday shall resolve all staff comments relative to
the prior submittal and submit the master plan for T.R.B. sign-off and final
approval.
As the previous master plan was never corrected in accordance with staff comments,
the Engineering Department reviewed the most recent master plan modification
against the original City Commission/Tradewinds approved master plan, therefore,
the Engineering Department, for the City of Boynton Beach, Florida reserves the
right to submit to your office additional comments regarding the most current
master plan modification, once the previous master plan modification has been
finally approved by the Technical Review Board.
As you are aware, the master plan reviewed during the June 13, 1991 meeting
depicted a service station within 1,000 feet of a church parcel dedicated on the
face of the plat documents and within the actual plat boundary sheets approved by
the City of Boynton Beach, Florida. Prior to submitting the master plan modifica-
tion to the governing bodies, I recommend that the applicant be required to enter
into a variance procedure for the 1,000 foot distance separation, prior to further
consideration in this matter. Additionally, it is my understanding that your
office will transmit the master plan modifications to the City Attorney for his
review and comments.

Master Plan Modification (driveways)
Kilday and Associates, agent for Tradewinds Development, has
requested a modification to the previously approved master plan
for the Shoppes of Woolbright P.C.D., as outlined in Exhibit "A".
The amendments requested are illustrated in Exhibit "B" and are
as follows:
1. Addition of a driveway onto Woolbright Road,
2. Change in use and size of the outparcel at the northwest
corner of Woolbright Road and S.W. 8th Street from 4,000
square feet of retail commercial to a 1,250 square foot gas
station (the request to use this outparcel for a gas station
was withdrawn - see revised proposed master plan),

The procedure for approving master plan modifications in Planned
Commercial Developments is outlined in Section 6.F.13 of Appendix
A-Zoning, of the Code of ordinances. subsection "b" states that
modifications to approved plans which result in an increase of
less than ten (10) percent in measurable impacts may be approved
by the Planning and Zoning Board; however any changes in traffic
generated, water consumed or sewage to be collected will require
approval by the City commission. Since the modifications
requested involve an overall net decrease of 1,050 in total
square footage for the planned commercial development from
315,580 to 314,530 square feet, which will result in a neglible
decrease in traffic generated, water consumption or sewage
collection, final disposition (appealable to the City Commission)
rests with the Planning and Zoning Board.
with respect to the changes requested by Kilday and Associates,
the Technical Review Board (TRB) met on June 13, 1991 and June
25, 1991 to review the documents submitted, and they are
recommending that this request be approved, with the exception
that changes #1, #4 and #5 above relative to driveways, be
denied. The basis for this recommendation is outlined in the
attached staff comments in Exhibit "C" from the Fire, Engineering
and Planning Departments.

application for a minor site plan amendment to the Shoppes of
Woolbright PCD. As you know, the master site development plan
for this project was approved by the Boynton Beach Ci ty
Council on June 17, 1990 and a portion of the site is
developed.
This letter is to request an administrative approval of new
uses and a revised layout of the outparcels along SW 8th
street. Also included in this application are amended access
points into the outparcels. The number and general location
of the outparcels has not changed.
Enclosed are seventeen (17) copies of the proposed site plan
amendment for your review and approval. Please feel free to

Dear Chris,
Pursuant to our meeting this morning, attached please
find seventeen sets of the amended overall master plan
for the Shoppes of Woolbright with the proposed changes
attached. I do feel that these plans have been revised
to reflect all of the plan amendments that were agreed
upon at this morning's meeting, with the exception of
the service drive to the commercial center.
Upon reviewing my notes from the May 1, 1990 Technical
Review Board and discussing the item with David Levy,
it seems that Joel Wantman of American Environmental
Engineering (formerly of The Stanley Consultants)
reviewed this layout with Vince Finizio and received
his approval for the proposed layout. A written
confirmation of that is forthcoming. Therefore, I
request that this item be left open for discussion at
the upcoming meeting as we do not agree that it should
be eliminated at this time. The attached plans reflect
the access per our discussion this morning but we
reserve the right to modify it if it can be shown that
previous approval was given for its location and
layout.

WOOLBRIGHT PLACE MASTER PLAN MODIFICATION
Pursuant to your request for comments relative to the above referenced master
plan modification, the Engineering Department, for the City of Boynton Beach,
Florida, submits the following comments in accordance with the City of
Boynton Beach Code of Ordinances:
1. Attached and made a part hereof, find Engineering Department Memorandum
No. 91-l00CC, dated June 14, 1991, indicating that the previous master plan
modification has not yet received final sign-off, as the applicant has not
resolved staff comments for the previous master plan modification as of this
date. Additionally, Engineering Department Memorandum No. 9l-l00CC, dated
June 14, 1991, indicates that the applicant should proceed thru the variance
procedure prior to the City's consideration of this master plan modification,
as the proposed service station is within 1,000 feet of a platted church parcel.
2. The square footage for the commercial parcel depicted upon this submittal, does
not mirror the original approved master plan submitted by Tradewinds and approved
by the City of Boynton Beach in accordance with the Stipulation Settlement
Agreement. It is at least twice the amount of square footage provided for in
the original master plan, as the prior master plan modification was approved
subject to comments. and as of yet, said comments have not been resolved, the
Engineering Department reviewed the most recent submittal in accordance with
the original master plan for lack of a formally approved master plan signed
off by the T.R.B.
3. With respect to the proposed driveway on Woolbright Road, approximately 200 ft.
west of the intersection of SW 8th Street and Woolbright Road, I do not recommend
approval for the following reasons:
a) City of Boynton Beach, Florida, Code of Ordinances, Page 1924.9 - Section 6,
"Commercial District Regulations and Use Provisions", including Paragraph F,
"Planned Commercial Development District" and Item 4A, "Relation to Major
Transportation Facilities". This item requires a PCD to have access to
major transportation facilities in such a manner as to not create or generate
unacceptable levels of traffic along streets in residential areas or districts
outside of the PCD. The present master plan accomplishes this by providing
access to the PCD via an intersection (to be signalized) at Woolbright Road
and SW 8th Street. The modification proposed (adding driveway to Woolbright
Road directly) circumvents the intent of the originally approved traffic flow
pattern of channeling all PCD traffic north on SW 8th Street to appropriate
internal access roadways and driveways.
b) The City of Boynton Beach, Florida, Code of Ordinances, Page 2021 - Appendix
"B", "PUD Standards", Section 9D, "Commercial Standards". Areas designated
for commerical activities shall not generally front on exterior or perimeter
streets and shall be preferably centrally located within the project. This
shows an intent of the code to have commercial areas impact adjacent parcels
as little as possible, as noted in comment (a) above for master plan projects.
4. Woolbright Road is an arterial street (120 ft. R.O.W.) while SW 8th Street is a
collector (80 ft. R.O.W.). Under Appendix "C", Article X, Section 1, "Access",
for double frontage lots (SW 8th Street and Woolbright Road) adjacent to an
arterial street, the side lots shall be the side which abuts the arterial street
(the higher classification of the two). The side lots shall be buffered and
would have no access allowable to the arterial street.

with regard to your letter of July 3, 1991, I appreciate your
concern about the proposed driveway not affecting the capacity of
Woolbright Road by FDOT's guide lines manual for Planning.
However, capacity concerns were not mentioned in the engineering
department memorandum outlining TRB comments for this submittal
(Engineering Department, Memo 91-104CC, June 19, 1991).
The Planning Department, however, has commented upon both the
location of the driveway with respect to the SW 8th street
intersection and the potential effect of the driveway on the
capacity of Woolbright Road. If the master plan modification is
approved to allow such a driveway, I suggest you may wish to

incorrectly states that Mr. Joel Wantman, "reviewed this layout with Vince Finizio and
received his approval for the proposed layout".
Be advised that this is a false statement made by Collene Parker as it is not within
my pervue to unilaterally approve proposed layouts nor have I ever approved a layout
without the benefit of a Technical Review Board meeting and a formal fee submittal as
specified within our Code of Ordinances.
Please attach this memorandum to the staff comments sent to the Planning and Zoning
Board and to the City Commission (if the Kilday letter is sent to the Boards), so they
may read my response to this incorrect statement.

Master Plan Modification (driveways)
This request was placed on the agenda for the August 1, 1991
special meeting of the Planning and zoning Board, rather than the
next regular meeting ( August 13, 1991) to accommodate a
scheduling problem that arose. Originally, the applicant was
informed by staff that the procedure for processing this request
was the same procedure required for master plan modifications to
Planned Unit Developments (PUD). The differences in the
procedures as they relate to this request (a less than 10%
increase in measurable impacts) is the order of Planning and
Zoning Board and City Commission review and that City Commission
review is only conducted if the applicant appeals the decision of
the Planning and Zoning Board. When applied to the regular
meeting dates of the Planning and Zoning Board, these differences
resulted in an additional week of processing time than originally
anticipated. Placement of this request on the special meeting
agenda will reduce the original processing time by one week.
The Planning Department has reviewed this request and recommends
the following comments as conditions of approval:
1. If this request is approved, three copies of the full-sized
master plan (Kilday and Associates drawing no. 85-34, last
revision 6-19-91 and drawing no. O.S., last revision 4-25-90
showing the PCD and the Woolbright Place PUD) shall be
submitted to the Planning Department, prior to the submittal
of any future applications, which has been revised to
reflect all approved changes associated with this request
(e.g. - driveway locations, outparcel square footages and
designations) and which addresses the outstanding condition
of approval from the June 1990 master plan modification (see
attached comment from the Building Department).
If this request is not approved, three copies of the
drawings specified above shall be submitted to the Planning
Department, prior to the submittal of any future
applications, which addresses the attached BUilding
Department comment.
2. The southward relocation of the driveway onto S.W. 8th
Street serving the outparcels is not recommended. This
driveway will function as a "pass-through" to Home Depot and
encourages vehicles to circumvent the main access drive to
the shopping center designed to efficiently direct traffic.
In addition, a drive-through could potentially be requested
at outparcel #2, adjacent to the proposed "pass-through".
Construction of a drive-through will significantly alter the
traffic circulation around this outparcel and could conflict
with traffic using the "pass-through". While shifting the
driveways on the master plan could eliminate this problem,
staff feels the driveway locations should be finalized at
the time specific plans are filed for the outparcels.
3. It is anticipated that the additional driveway proposed onto
Woolbright Road may be used as a shortcut to the 58,000
square foot commercial building. This type of access design
would not meet the intent of requiring internal access roads
and driveways to serve parcels within a planned development

3. subdivision. At this time, the Planning Department staff
can neither recommend for or againt this driveway until a
specific plan for the outparcel is provided to the city for
review.
4. Revisions to the original traffic study, submitted in
conjunction with the settlement plans, including turn
movement analysis, may be required depending on the type of
use requested at the outparcel at the northwest corner of
Woolbright Road and S.W. 8th street. If the proposed
driveway onto Woolbright Road is approved, the city's
engineer is recommending construction of a deceleration and
right turn lane into the driveway and an acceleration lane
out of the driveway (see attached letter from Richard
Staudinger, dated July 9, 1991, to Ken Rogers).

property line of the project.
NOTE: The peripheral green-belt shown on the plans does not
preclude the installation of other code buffer and/or
screening requirements for the project.
