Heyden '7jt I Plannlng and Zoning Director FROM: DATE: November 22, 1994 SUBJECT: Woolbright Place PUD - MPMD ~94-005 Pods 2A and 2B; subdivide and establish setbacks NATURE OF REOUEST Richard Wohlfarth, agent for Howard Scharlin, trustee/property owner of the Woolbright place PUD, located on S. W. 8th street, approximately 900 feet north of Woolbright Road (see locator map), is requesting approval to modify the previously approved master plan for the Woolbright Place PUD (see Exhibit "A" - letter of request, Exhibit "B" - approved master plan and Exhibit Itclt proposed master plan). The requested modifications are limited to that multi-family portion of the PUD entitled Pods 2A and 2B and are as foJ,,lows: 1. Re-configure pods 2A and 2B and establish a property line between both pods. 2. Create a twenty (20) foot building setback on each side of the new property line. 3. Create an eight (8) foot side setback for a swimming pool associated with the required recreational amenities for Pod 2B, located on the north side of the new property line at the north perimeter of the lake. 4. Create a zero ( 0) foot s ide setback for a dock (a required recreational amenity for Pod 2B), located on the north side of the new property line at the north perimeter of the lake. BACKGROUND The Woolbright Place PUD master plan was approved by the Planning and Zoning Board on May 8, 1990 and ratified by the city Commission on May 15, 1990 as be~ng consistent with the January 24, 1990 stip'J.lation and settlement agreement between the City and the property owner. On August 16, 1994, the city Commission determined that a master plan modification for the project was a nonsubstantial change and on September 13, 1994, the Planning and Development Beard 3pproved the modification. The current approved master plan is depicted in Exhibit "Bit - approved master plan. The requested modifications are limited to the 33.87 acre property proposed to be subdivided into Peds 2A and 2B. The modificaticns are being processed in conjunction with proposed modifications to The Vinings site pla,n. The Vinlngs site plan is a 543 unit apartment project located on Pods 2A and 2B and was approved by the city Commission 0,1 September 20, 1994. The apartment project was planned to be developed in two phases, Phase l-Pod 2A and Phase 2- ?od 2B (see E:{hibi -: "D"). d- page 2 Wco:bright Place PUD Append1X B: Planned Unit Development, of the city Code of Orjil1anc~s states ~hat changes in planned unit developments shall be precessed as f~llows: Section 12. Changes in plans. "Changes 1n plans approved as a part of the zoning to PUD may be permitted by the Planning and Zoning Board upon application filed by the developer or his successors in interest, prior to the expiratIon of the PUD classification, but only (after) a finding that any such change or changes are in accord with all regu:ations in effect when the change or changes are requested and the intent and purpose of the comprehensive plan in effect at the time of the proposed change. Substantial changes shall be proposed as for a new appl ication of pun zon:.ng. The determination of what constitutes a substantial change shall be within the sole discretion of the city Commission. Nonsubstantial changes as determined by the city commission in plans s~all not extend the expiration of the eighteen month approval for the pun classification." ANALYSIS The requested master plan modification will establish two properties and therefore, requires the site plan to be modified so that each property is self-sufficient with regards to all applicable development standards. The applicant is aware that modifications are required to be made to the approved site plan. Eased on the number of resubdivisions within the pun since the last plat, this further subdivision also requires the property to be replatted. Staff has reviewed this request for consistency with the PUD development standards, and the intent and purpose of planned unit developments as stated in the following sections of appendix B, Planned Unit Developments of the Code of Ordinances: Section 1. Intent and Purpose. ".n.. Planned Uni t Development District (PUD) is established. It is intended that this district be utilized to promote efficient and economical land use, improved amenities, appropriate and harmonious variety in physical development, creati-"e design, improved living environment, orderly and economical development in the city, and the protection of adj acent and eXisting and future city development. The district is suitable for development, redevelopment, and conservation of land. water and other resources of the city. Regulations for planned unit developments are intended to accomplish the purposes of zoning, subdivision regulations. and other applicable city regulations to the same degree that they intended to control development on a lot-by-lot basis. With respect to the changes requested, the reconfiguring of Fods 2A and 2E does not increase the allowable density of the project or c:113ong8 the type of l'esidential uni ts. Therefore, no change in imp3oc:ts on traffic, water and sewer will result. As previously stated, the proposed new property line will require the site plan to be modified to be consistent with the applicable land development and platting regulations. The proposed building se~back, 20 feet each side of the new property line is consistent with the side setback required for R-3 zoned, multi-family dwellings. staff finds the eight (8) foot side pool setback and the zero foot side dock setback to be acceptable based on the location of the pool and dock as it relates to the site plan for the entire proj eet (see Exhibit liD" site plan of the Vinings project). The eight (8) foot side setback proposed for the pool is consistent with pool setbacks established for other districts in the Zoning Code. As identified in the attached 'J:'RC comments, staff I s concern was foc:used on the effect further subdividing of the property might have on the completion of S.W. 8th street through to Ocean Avenue, therefore limiting response time for fire and emergency service to the proj ect. This issue is addressed in attached Engineering Division Memorandum No. 94-322 - Exhibit "E". RECOMMENDATION On Tuesday, October 11, 1994, the Technical Review Board (TRC) met to review the master plan modification. The board recommends that the city Commission make a finding of no substantial change for the proposed modification, and that the Planning and Development Board approve the request, subj ect to staff comments ( see Exhibit "E" Police Department memorandum dated October 21, 1994, Engineering ~ivlsion Memorandum No. 94-322, utility Department memorandum No. 94-324 and Planning and Zoning Department memorandum dated November 22, 1994. Create an eight (8) foot side setback for a swimming pool associated with the required recreational amenities for Pod 2B, located on the north side of the new property line at the north perimeter of the lake. 4. create a zero (0) foot s ide setback for a dock ( a required recreational amenity for Pod 2B), located on the north side of the new property line at the north perimeter of the lake. BACKGROUND The Woolbright Place PUD master plan was approved by the Planning and Zoning Board on May 8, 1990 and ratified by the City Commission en May P5, 1990 as belng consistent with the January 24, 1990 stipulation and settlement agreement between the City and the property owner. On August 16, 1994, the City Commission determined that a master plan modi~ication for the project was a nonsubstantial change and on september 13, 1994, the Planning and Development Beard approved the modification. The current approved master plan is depicted in Exhibi t "B" - approved mastel- plan, The requested modifications are limited to the 33.87 acre property proposed to be subdivided into Pods 2A and 2B. The modificaticns are being processed in conju~ction with proposed modifications tc The Vinings si te pla.n. The Vin:..ngs 5i te plan is a 543 unit apartment project located on Pods 2A and 2B and was approved by the city Commission o~ September 2J, 1994. Eased on the number of resubdivisions within the PUD since the last plat, this further subdivision also requires the property to be replatted. Staff has reviewed this request for consistency with the PUD development standards, and the intent and purpose of planned unit developments as stated in the following sections of appendix B, planned Unit Developments of the Code of Ordinances: Section 1. Intent and Purpose. "A Planned Unit Development District (PUD) is established. It is intended that this district be utilized to promote efficient and economical land use, improved amenities, appropriate and harmonious variety in phYSical development, crea t i've des ign, improved living environment, orderly and e'.::onomical development in the city, and the protection of adj acent and existing and future city development. The proposed building se~back, 20 feet each side of the new property line is consistent with the side setback required for R-3 zoned, multi-family dwellings. staff finds the eight (8) foot side pool setback and the zero foot side dock setback to be acceptable based on the location of the pool and dock as it relates to the site plan for the entire proj ect (see Exhibit liD" site plan of the Vinings project). The eight (8) foot side setback proposed for the pool is conslstent with pool setbacks established for other districts in the Zoning Code. As identified in the attached ~RC comments, staff' 5 concern was focused on the effect further subdividing of the property might have on the completion of S.W. 8th street through to Ocean Avenue, therefore llmiting response time for fire and emergency service to the proj ect. This issue is addressed in attached Engineering Division Memorandum No. 94-322 - Exhibit "Ell. RECOMMENDATION On Tuesday, october 11, 1994, the Technical ReVlew Board (TRC) met to review the master plan modification.
