CONDITIONAL USE APPROVAL - WILLIAMS AUTO SALES
(1009 N. FEDERAL HIGHWAY)
Upon review of the above mentioned project, the following list of
comments must be addressed in order to conform with Boynton Beach
City Codes:
1. Remove all portions of the bUilding that were erected
without permits.
2. Revise the typical handicapped parking space striping
drawing to be consistent with city standards.
3. Show on the site plan drawing the handicapped accessible
route leading to the entrance of the bUilding from the
handicapped parking space. Drawing shall include the
following information:
i. show the required handicapped accessible walkway that
leads to the en~rance of the building from the five (5)
foot access aisle. Specify and show the following
walkway information:
a) slope for the entire length
b) texture of the finish
c) total length
d) cross slope
e) width
f) type of material
g) location, height, material and configuration of
handrail, where required
ii. show the location, width, length and elevation of the
level platform that is required at the entrance to the
building
iii. Identify the finish floor elevation of the building
4. Show on the site plan the appropriate number of required
parking spaces consistent with Appendix A-Zoning, Section
11.H.
5. Submit a copy of the recorded survey of the property showing
the land acquired by the abandonment including the
dedication of the required utility easement.
In order to facilitate the permitting process, the following
information should be included within your documents submitted to
the Building Department for required permits:
1. Provide detail drawings specifying that the site lighting
poles are designed to meet the windload requirements of
Chapter 12, Standard Building Code, 1988 Edition.
2. Acquire a demolition permit.

In accordance with the City of Boynton Beach, Florida, Code of Ordinances,
specifically Chapter 19, Section 19-17, "Plan Required", including Chapter 5,
Article X, "Boynton Beach Parking Lot Regulations", Section 5-142 inclusive,
the applicant for the above referenced project shall submit the following plan
revisions, information and technical data.
1. The applicant shall provide a photometric plan depicting the level of
illumination within the parking facility. Lighting systems shall be photo-
cell activated and plan submissions shall comply with the requirements as
set forth in Section 5-l42(a), "Required Lighting", including Section 5-l42(g),
"Lighting Standards".
2. Provide handicap stall striping details which conform to the requirements set
forth in the Department of Community Affairs Accessibility Requirements Manual
(lastest edition). Section 5-l42(k), "Handicap Requirements".
3. Provide raised continuous concrete curbing where parking stalls abut landscaped
areas in accordance with Section 5-l42(e) , "Required Curbing". Curbing shall
be interrupted to facilitate stormwater drainage into grassed areas.
4. Clearly depict upon the submitted plans, the proposed vehicle display area.
The display area shall not block the ingress/egress aisle nor encroach upon
the 27 feet free backup area for the designated standard and handicap stalls
as specified within Section 5-142 appendix.
5. Federal Highway shall be posted with standard Department of Transportation
approved (No Parking) signage in accordance with the State of Florida,
Department of Transportation's "Roadway and Traffic Design Standards",
Index 1117358.
6. The specified lighting system contains luminaires with the equivelent of
1,000 watts and in order to abate glare, the lighting system should be modified
in order to limit glare. Standards and luminaires types shall be modified to
utilize energy efficient fixtures with an approximate wattage of 400 watts.
Additionally, light poles should be located outside of the subject easement
area. Factors to be considered by committee in review.
7. The Engineering Department recommends that the applicant provide proof of a
Building Permit for the addition that is encroaching upon a public dedicated
rights-of-way. As the structure is constructed over a force main the Engineering
Department recommends demolition of the addition if proof of permits cannot be
provided to the City.
8. The pavement area, as depicted upon subject plans, encroaches upon a public
dedicated rights-of-way and a letter of indemification shall be provided to
the City of Boynton Beach to ensure that utility repairs, construction or
reconstruction, within the alley which may cause damage to the parking lot, will
result in the parking lot being repaired at the owners expense.
9. The drainage plans addresses water quality (2.5 inches) but has no positive
outfall, therefore a 3 year - 24 hour analysis is required.

10. Percolation test data and associated test location plans are required to
verify hydraulic conductivity, K.
ll. Separate the exfiltration trench system from the water main by a minimum of
lO feet and move the exfiltration system under pavement.

SUBJECT: TRB Review - Williams Auto Sales
We can approve this project, subject to the following conditions.
Show all existing water and sewer services.
A minimum 10' clearance between water main and
exfiltration is necessary (P.B. County Health Unit Tech
Memo 91 - 2 ) .
Unconditional abandonment of alley is not possible due
to existance of an active sanitary sewer. If the
building is removed, then the alley can be abandoned
subject to the area being converted to a utility
easement. This will allow for parking within the
easements.

Conditional Use (used car sales)
Please be advised of the following Planning Department comments
with respect to the above-referenced request for conditional use
approval:
1. The site plan rider must be notarized.
2. The zoning district on the conditional use application must
be corrected to C-4. (Section IV., No.2 of Conditional
Use Application)
3. Show the exact location of all utility lines (water and
sewer) on the site plan and/or legal survey. (Section ll.2,
F.5.i of Appendix A-Zoning)
4. Indicate on the site plan the use of the building (i.e.
sales office). (Section 11.2, F.5.f of Appendix A-Zoning)
5. Make any necessary correction to the conditional use
application which may occur as a result of modifications to
the site plan. (i.e. change in size of building, parking
space calculations, size of impervious area, etc.)
6. Clearly delinate the area that will be used for display
parking of automobiles and indicate the square footage
of the area on the site plan. Pursuant to Section 10.H
16.d.(8) and (10) of Appendix A-Zoning, parking spaces for
automobile sales must be provided at a rate of one (1)
parking space per five hundred (500) square feet of gross
floor area AND one (1) parking space per five thousand
(5,000) square feet of outdoor area used for storage
or display.
