PUD Processin9 of Countv ImD8ct Fees Dear Mr. Kino: I am in receipt of your August 6, 1997 letter to Jim Cherof wherein you request his assistance in ensuring that the County impact fees are properly handled and remitted to the escrow agent. The recurring theme of your letter is that because the City's role in the collection of such fees Is ministerial, the City should comply with the procedure formulaled by the County. In an effort to resolve this matter, the City has been in contact with Willie Swoope, Impact Fee Coordinator for Palm Beach County. In a letter dated August 6, 1991, Mr. Swoope indicated that developers wishing to pull building permits for development in Woolbright Place should be instructed to deposit impact fees, with United National Bank, the escrow agent. To that end, and with the County's input, the City intends, to utilize the following procedure: 1, Each developer will be 'given a copy of the County impact fee schedule and the certified receipt form. The City wilt provide whalever instruction is necessary for the developer to complete the form. ' 2. The developer will submit payment, with the receipt form, to United National Bank in West Palm Beach, The receipt will be filled out by the developer, including the property identification number . The County Impact Fee,C{)ffice will then be responsible to make deposits with the escrow agent, as may be required. The City intends to implement this procedure shortly. There are statements in your letter that need clarification. The 1990 Barton Aschman Traffic Analysis does include trips for the church, therefore, as stated at our most recent meeting, any proposal (master plan modification, site plan, conditional use, etc,) that indicates a use or density/intensity of use not anticipated in the 1990 study, must be accompanied by a revised traffic study, which analyzes differences in traffic to be generated. It is not permissible to transfer trips to other "land uses", as you refer to it, within a master plan, if doing so renders the portion of the master plan, from which trips are transferred, undevelopable due to no associated traffic capacity. Also, it was discussed that a traffic letter, stating simply the number of trips generated by a proposed use, would be turned in with each request for approval, such as the Taco Bell application in progress, for staff to monitor the build-out of both master plans, as determined by the 1990 study. This has not yet been received for the Taco Bell application, as was agreed. The modifications to the plan are to comply with the conditions outlined in the Stipulation and Settlement Agreement approved on January ,24, 1990. These modifications are as follows: 1. The total lot area of the commercial development is increased by 5.1 acres, but will not exceed 32.0 acres, exclusive of dedications. 2. Total gross leasable floor area shall be less than 320,000 sq. ft. 1. Retail/Commercial uses shall be permitted in all proposed facilities within the development. 4. An additional curb cut on SW 8th Street located between Woolbright Rd., and the primary shopping center entrance has been added into the outparcel site. This Master Development Site Plan reflects the approved layout of Home Depot, its garden center and a conceptual layout of the balance of the center, including three outparcels. The building setback lines are denoted as the "building envelope". Changes to the conceptual building configurations to conform to final building layout will be allowed without further approval within this "building envelope."
