SUBJECT: Woolbright place - Ordinance for Land Use Element
Amendment for poinciana Park
Attached please find, and consider on First Reading at the city
commission meeting scheduled for December 4, 1990, this ordinance
for a land use map amendment that is located within the
woolbright place PUD. The application is briefly described as
follows:
Kilday and Associates, agent for Tradewinds Development
corporation property owners, is requesting that the Future Land
Use Element for a 1.1019 acre tract of land be amended from
"Recreationalll to "Moderate Density Residential". The parcel is
located within the Woolbright place planned Unit Development,
approximately 1,800 feet north of woolbright Road and was
originally dedicated to the city as a public park site in
connection with the platting of Lake Boynton Estates. The land
use change from "Recreational" to "Moderate Density Residential"
has been submitted in connection with a stipulation and
Settlement Agreement for Tradewinds Development corporation vs.
The city of Boynton Beach, as outlined in area 8.a of the
comprehensive Plan Future Land Use Support Document and
Attachment "D" of the Future Land Use Element support Document
(see attached). This acreage is to be relocated to a 3.5-acre
parcel that was dedicated by Tradewinds Development corporation
adjacent to the northwest corner of Lake Boynton Estates, in
accordance with the most recently approved master plan for the
PUD.
The application was approved, subject to simultaneous transfer of
property, by the planning and Zoning Board on June 12, 1990,
followed by the city Commission on June 19, 1990. The land use
amendment application was subsequently forwarded to the Florida
Department of Community Affairs for review, and the city was
notified that the proposed amendment was approved without
comments in the Objections, Recommendations, and Comments report
dated October 24, 1990. The planning Department continues to
recommend that the application submitted by Kilday and
Associates for Tradewinds Development corporation be approved.

AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
REGARDING WOOLBRIGHT PLACE, P.U.D.,
AMENDING ORDINANCE 89-38 OF SAID CITY BY
AMENDING THE LAND USE ELEMENT OF THE
COMPREHENSIVE PLAN OF THE CITY BY
ADOPTING THE PROPER LAND USE OF CERTAIN
PROPERTY, MORE PARTICULARLY DESCRIBED
HEREINAFTER; SAID LAND DESIGNATION IS
BEING CHANGED FROM RECREATION TO
RESIDENTIAL (MODERATE DENSITY);
PROVIDING A SAVINGS CLAUSE; PROVIDING
REPEALING PROVISIONS; PROVIDING AN
EFFECTIVE DATE; AND FOR OTHER PURPOSES.
WHEREAS, the City Commission of the City of Boynton
Beach, Florida has adopted a Comprehensive Land Use Plan and
as part of said Plan a Land Use Element by Ordinance No.
89-38 in accordance with the Local Government Comprehensive
Planning Act; and
WHEREAS, a certain parcel of land more particularly
descr ibed hereinafter is being annexed in accordance with
the application by Kieran J. Kilday/Kilday & Associates,
Inc., agent for Tradewinds Development Corporation, the
owners of the following property, into the City by Ordinance
being adopted simultaneously herewith; and
WHEREAS, the procedure for amendment of a Land Use
Element of a Comprehensive Plan as set forth in Chapter 163,
Florida Statutes, has been followed; and
WHEREAS, after public hearing and study, the City
Commission deems it in the best interest of the inhabitants
of said City to amend the aforesaid Land Use Element of the
Comprehensive Plan as adopted by the City herein.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:

amended to reflect the following:

The land use zoning, and use and/or development en the remainder
of Lak~ Boynton Estates and the unplatted outparcels is ~he

effect for this area. The use and development of this property
