Golden Senior City Planner DATE: May 15, 1990 SUBJECT: Woolbright Place - Land Use Element Amendment for Poinciana Park - File No. 471 Kilday and Associates, agent for Tradewinds Development Corporation property owners, is requesting that the Future Land Use Element for a 1.1019 acre tract of land be amended from "Recreational" to "Moderate Density Residential". The parcel is located within the Woolbright Place Planned Unit Development, approximately 1,800 feet north of Woolbright Road and was originally dedicated to the City as a public park site in connection with the platting of Lake Boynton Estates. The land use change from "Recreational" to "Moderate Density Residential" has been submitted in connection with a Stipulation and Settlement Agreement for Tradeswinds Development Corporation vs. The City of Boynton Beach, as outlined in Area 8.a of the Comprehensive Plan Future Land Use Element Support Documents and Attachment "D" of the Future Land Use Element Support Documents (see attached). This acreage will be relocated to a 3.5 acre parcel to be dedicated by Tradewinds Development Corporation adjacent to the northwest corner of Lake Boynton Estates, in accordance with the most recently approved master plan for the PUD. Pursuant to Section 9.c.2(2) of Appendix A-Zoning, staff analysis of the proposed land use change is not necessary where the pro- posed zoning would be consistent with the land use recommenda- tions contained in the City of Boynton Beach Comprehensive Plan. ~J~. The City should permit Local Retail Commercial on the northern 225 of this property, in accordance with the adopted Boynton Beach Boulevard plan. The remainder of the property should be placed in the Moderate Density Residential land use category. Building heights on this property should be limited, however, to 2 stories (25 feet), since 1- and 2-story residences lie in close proximity to the south and southeast. 7.k. Unincorporated Parcels on south Side of Bovnton Beach Blvd. These parcels constitute an unicorporated pocket which should be annexed. The first row of lots lying to the west of the present City limits, having an east-west dimension of approximately 300 feet should be placed in the General Commercial land use category and C-4 zoning district. These parcels should be required to dedicate right-of-\~ay and construct the adjacent street consistent with the requirements that were placed on the U.S. Post Office. The commercial parcels should be developed so as to be compatible with the future residential use of the property which lies to the west. Those parcels which lie further west should be placed in the High Density Residential land use category. Commercial development on this parcel should not be permitted since a single-family subdivision lies immediately to the west and adequate commercial property exists elsewhere in the Vicinity. Furthermore, building heights on this parcel should be limited to 2 stores (25 feet) within 150 feet and 3 stories wlthin 400 feet of these Single-family lots. The use and development of this property shall be construed to be governed by the comprehensive plan in effect on November 6,1986 (i.e., the 1986 Evaluation and APpraisal Report), Code of Ordinance requirements, and other development regulations which were in effect at that part1cular date, except to the extent that the comprehensive Plan, Code of Ordinance requirements, and development regulations are specifically superceeded by the settlement stipulations. Therefore, the public parks dedication, private recreation facilities, natural area preserves, road improvements, utilities, and other public facilities which are require,d shall be those which are specified in ~he settlement stipulations, and the impact fees which are to be collected will be equivalent to the fees which were in effect at the time that the settlement stipulations went into effect.
