DESCRIPTION: This is a request to subdivide Tract C of Woolbright Place, Plat No.1, located on S.W. 8th Street, 1300 feet north of Woolbright Road, zoned PUD, without requiring replatting. It is proposed to subdivide Tract C into three parcels; one 33.87 acres in size to construct the Vinings at Boynton Beach (a future 548 rental apartment project), one 14 acre parcel for 92 future multi-family units and a .94 acre parcel for 16 duplexes (to be replatted in the future). RECOMMENDATION: The Planning and Development Board, with a vote of 3 - 1, recommended approval of this request, as submitted. As a point of information, to complete the exception to platting process after Commission approval, a survey which properly describes the three new parcels (without phase lines) must be submitted to the City. Heyden J~ 9'~ Planning and Zoning Director TO: DATE: August 5, 1994 SUBJECT: The Vinings at Boynton Beach - EXPL #94-002 Exception to platting - subdivision of Woolbright place NATURE OF REOUEST Richard Wohlfarth of CCL Consultants, Inc., agent for Howard Scharlin, trustee for property owner of the Woolbright Place PUD, located on S.W. 8th Street, 1300 feet north of Woolbright Road (see attached location map - Exhibit "A"), is requesting approval to further subdivide the Woolbright Place PUD, without requiring replatting (see attached letter, dated July 20, 1994 - Exhibit "Bll). The subdivision requested would split off a 33.87 acre parcel from Tract C of the Woolbright Place, Plat No.1. BACKGROUND Pursuant to the approved Woolbright Place PUD master plan, Tract C of the Woolbright Place, plat No. 1 is comprised of three residential pods (see attached plat and master plan - Exhibit "C"). On pod 1 (23.296 acres), 320 multi-family units are allowed. On pod 2 (21.25 acres), 320 multi-family units are allowed. On pod 3 (.94 acres), 16 duplexes are allowed. When the Woolbright place PUD was platted in 1990, a boundary plat was approved which established Tract C as encompassing all three residential pods. Mr. Wohlfarth, in connection with this request, is requesting site plan approval of 548 rental apartments on 33.87 acres within Tract C. As a result of this request, Tract C would be subdivided into a 33.87 acre parcel, a .94 acre parcel and a 14 acre parcel, by survey and without requiring replatting through the City's subdivision process. ANALYSIS Article VI, Section 1, "Requirement and exception of plattingll, of Appendix C - Subdivisions, platting of the Code of Ordinances, states that "recording of a plat may not be require if: A. The land to be subdivided is to be divided into no more than three (3) continguous lots and because: 1. Unusual conditions are created by ownership or development of adjacent lands, or 2. The land concerned is isolated or remote in its relationship to other platted or improved lands, or 3. The improvements and dedications existing on the land are substantially in accordance with the requirements of this ordinance and if the waiving of the requirement for platting, as determined by the planning and development board and the city engineer, would not conflict with the purpose and intent of this ordinance. B. The resubdivision of land heretofore platted is of such unusual size and shape or is surrounded by such development or unusual conditions as may be determined by the planning and zoning board, the city planner and the city engineer to justify the waiving of the requirements for preparing a replat." TO: Planning and Development Board -2- August 5, 1994 In reviewing a request for an exception to platting, it shall be determined that in fact one of the foregoing conditions does exist in order to delete the requirement for platting. In addition, Objective 1.20 of the Boynton Beach Comprehensive Plan states that, "By June 1, 1990, or when mandated by state statute, regulate subdivision of land by continuing to require that the creation of more than three parcels either at one time or cumulatively since 1978 be platted and developed in accordance with the Subdivision and platting Regulations". with the proposed subdivision, only three parcels will be created, at this time, from the aforementioned Tract C. Also, development of the 33.87 acre parcel for rental units does not require any additional easement or right-of-way dedications than have already been established with the boundary plat. An existing drainage easement on the subject parcel is desired by the applicant to be extinguished, however this can be done through the city's abandonment process. It should be noted that a statement appears on the Woolbright Place Plat No. 1 document that Tract C is subject to replatting prior to development. It is believed that this statement refers to the duplex portion of Tract C, master planned for 16 units, which would require creation of duplex lots and consequently replatting. RECOMMENDATION The city Engineer (see attached Engineering Department Memorandum No. 94-229 - Exhibit liD") and the Planning and Zoning Department recommend approval of this request. This recommendation is based on the above conclusions. The land to be subdivided is to be divided into no more than three (3) contiguous lots and because; B. The improvements and dedications existing on the land are substantially in accordance with the requirements of this ordinance and if the waiving of the requirements for platting, as determined by the Planning and Zoning (sic) Board and the City Engineer, would not conflict with the purpose and intent of this ordinance. As City Engineer, I have determined that The Vinings qualifies for waiver of the requirements for platting, and if the Planning and Zoning (sic) Board concurs, recommend waiving the requirement for platting.
