Dear Ms. Scherer:
You informed me yesterday that a July 20, 1994 memo Wohlfarth to
Heyden had not been fully responded to, and later that day you
forwarded a copy to me. Our comments are as follows:
1. A zoning issue which I believe has been answered.
2. If the initial 14 acre parcel were to be removed and
replatted, three parcels would remain based on the drawings
most recently submitted.
3. With or without replatting applicants are subject to
applicable fees outlined in the City's Code of Ordinances.
4. The street lighting fee listed in Code Chapter 19, Section
19.15 under Subdivision Final Plat, Type of Activity (page
1373) is currently "125% of cost for street lighting
installation ". Mr. Finizio has reported to me that the
multiplier in 1986 was 115%, and we will verify that. In any
event, it is a fee, not a bond.

Dear Tambri:
This letters serves as our application for exemption to plat the above described
projects, The City of Boynton Beach presently has before them a site plan for
construction of two projects on a portion of the Woolbright Place Plat 1, The first
project involves 252 multi-family units (Phase I) and the second project involves 296
units (Phase II), The site plan has been submitted for a proposed development by two
Trammell Crow Partnerships ("TCR").
Pursuant to our meeting today, by and among yourself, Carrie Parker, Jim Cherof,
Mike Morton and I, we discussed among other things, the platting processes and
general history of this site, Our mutual conclusions provided that TCR could be
exempt from platting and that the remainder of the property outside of Phase I and
Phase II could be subject to platting in the future, Further, we believe that
improvements and dedications existing on the land are substantially in accordance
with the ordinance,
Enclosed is a check in the amount of $400 to cover the fee and a marked-up survey,
as you requested, You have indicated that this request may go before the Planning
and Development Board this coming Tuesday, September 13th,

Dear Tambri:
Pursuant to OUf meeting last week, it is our intention ro gel a legal opinion from me CIlY
attorney relating to the need of Ieplatting the property. As we discussed, we intend to
submit and process a modification to the pun that will change the site plan by showing a
new multifamily product for use of apaItn\en.ts over the majority of the property, The
14-acre parcellQcated in the northwest quadrant will have some other use and at this time it
mayor may not be part of our application. The parcel in the northeast quadrant for the
duplex lots (as we refer to them) would remain the same. It is my understanding and hope
that under this scenario seeiI12' that rhere will only be three pareels during the subdivision that
a plat '.:v01.lld not be required. The only complication in this matter is that we would be
utilizing a phasing line ill the multifamily area. bur it is our understanding t.his does not
consrtmre a parcel line under YOW' ordinances,

Dear Tambri:
Pursuant to our meeting last week, it is our intention to get a legal opinion from the City
attorney relating to the need of replatting the property. As we discussed, we intend to
submit and process a modification to the PUD that will change the site plan by showing a
new multifamily product for use of apartments over the majority of the property, The
14-acre parcel located in the northwest quadrant will have some other use and at this time it
mayor may not be part of our application, The parcel in the northeast quadrant for the
duplex lots (as we refer to them) would remain the same. It is my understanding and hope
that under this scenario seeing that there will only be three parcels during the subdivision that
a plat would not be required. The only complication in this matter is that we would be
utilizing a phasing line in the multifamily area, but it is our understanding this does not
constitute a parcel line under your ordinances,
We would appreciate your clarification on the following:
1. Could we utilize the 14-acre parcel for single family housing?
2. In the event we would subdivide the 14-acre parcel and remove it from the initial plat
would this then give us the capacity of having three parcels in the remaining portion
of the originally platted area? This may also assist us in the phasing line referenced
above.

3, In the event that platting is required our client would only be responsible for the fees
outlined in the City's fee schedule.
4, The 125% value that was referenced by Mr, Finizio is for bonding only as required
under the ordinance.
