UTILITIES
Comments:
2. All utilities easements shall be shown on the rectified landscaping X
drawings so that we may determine which trees may interfere with
utilities. In general, palm trees will be the only tree species allowed
within utility easements. Canopy trees may be planted outside of the
easement so that roots and branches will not impact those utilities within
the easement in the foreseeable future. LOR Sec. 7.5-18.1 gives public
utilities the authority to remove any trees that interfere with utility
services, either in utility easements or public rights-of-way.
3. Fire flow calculations will be required demonstrating the City Code X
requirement of 1500 g.p.m. as stated in LOR Chap. 6, Art. , Sec. 16, or
the requirement imposed by insurance underwriters, whichever is
greater. (See Sec. 26-16(a)).
4. Comp Plan policy 3C.3.4 requires the conservation of potable water. City X
water may, therefore, not be used for irrigation where other sources are
readily available.
5. Provide an engineer's written certification that drainage will conform X
with all rules of the City and the South Florida Water Management

6. The waste stream from any proposed or future manufacturing process X

the width of the route and provide sufficient data that will verify the
transition from the elevation of the accessible parking space to the finish
floor of the building is in compliance with the Accessibility Code for
Building Construction. Where applicable, identify the width, slope and
length of ramps that are designed for accessibility and, where applicable,
show and identify the location of handrails including providing detail
drawings depicting height, shape and location. Where applicable, show,
dimension and label the location of all landings that area required at the
top and bottom of each ramp. Place a note on the site plan drawing
indicating that the accessible route from the accessible parking spaces to

Mr. Currier requested that the motion include wording that the street right-
of-way be 40' with sidewalks on both sides of the street and that the motion
also include wording to delete staff comment #20.
Vice r-1ayor Jaskiewicz amended her original motion to include the requested

Item D-6 Storage Building (817 N. Railroad Avenue) - Request
for approval to construct two storage buildings each
at 2f960 square feet (5,920 square feet total)
[vIr. HarOld Blanchette, took the podium and stated that the property is olNned by AI
Pica and that he would be speaking for the owner. [\1r. Blanchette stated that Hr. Pica
has been collecting a petition of property ovvners in the area. Mr. Blanchette read the
petition to the Commission, which supported the project and stated that the project
would be an improvement to the area. Mr. Blanchette recited how the buildings would
look and would match the existing building. The style and shape of the buildings would
be aestheticaily pleasing. Mr. Blanchette stated over 60 people signed the petition.
Mr. Blanchette noted that the Planning and Development Board referred to the
buildir,gs as Quonset Huts, but said the buildings were not Quonset Huts and pictures
of the buildings were presented to the Commissioners. Mr. Blanchette stated the
buildings were structurally very sound and the landscaping would block a great deal of
the buildings. Mr. Blanchette stated that this area was developed in the mid-1950's and
is shabby and that the two proposed buildings would be a great improvement to the
area.
Vice f\'1ayor Jaskiewicz inquired if the structures were temporary. Mr. Blancrlette stated
the structures were not temporaryf but were removable. Mr. Blanchette also stated the
buildings are bolted, which means if the buildings ever had to be moved, the buildings
could be dismantled and taken to another location.
Mr. Pica stated that the buildings he intends to purchase will match the current building
and he has spent a year looking for the same type of building so that they would
match.

is a cement block budding with a brick base with five bay doors and W2S built in 1976,

stated that the applicant did not own t;1e adjacent parcels.
Vice rvlayor Jaskiewicz inquired if the project meets the City's construction codes and
was informed it would.
Commissioner Denahan asked i"1r. Pica why the people who signed his petition feel his
project would be an improvement to the immediate area?
Mr. Pica stated that there are vagrants who sleep on the property and leave beer
bottles, debris and old junk cars on his property. Mr. Pica stated there is a great deal of
crime in the area as well.
Mayor Taylor asked Mr. Pica what he intended to store on the property. Mr. Pica stated
he would be storing his personal boats, equipment and tools. Mr. Pica stated he would
like to rent one of the buildings, but only if the renter could meet the City's criteria for
rental. Mr. Pica stated when he was in the boating business on the property, his guard
dogs for protection of the property were poisoned. Mr. Pica stated that the area would
be very well lighted and there will be no fences on the property.
Mayor Taylor inquired if the applicant were to rent the buildings out would he have to
come back to the Commission for approval. Mr. Rumpf stated that the project was not
reviewed only for personal storage, but was reviewed for maximum impact of storage-
type use of a warehouse, which are used by other businesses.
Mr. Pica stated that the hedge has been increased to 2 '/2' and would be irrigated and
that the property is currently irrigated.
Mayor Taylor inquired if anyone in the audience wished to address the Commission.

Commissioner Titcomb moved to approve the Storage Building (817 N. Railroad
Avenue) Request for approval to construct t",/o storage buildings each at 2,960 squa:-e
feet (5,920 square feet total), subject to staff comments and landscaping.
Commissioner Denahan seconded the motion.
Motion carried 5-0.
VI. PUBLIC AUDIENCE:
Bruce Black, 229 SW 1st Avenue, Boynton Beach stated that he tvvo items of
concern. Mr. Black said that at the last CRA meeting some resldents indicated there
was a lack of public input and a person asked jf there were any new plans based on a
newspaper article regarding stage 2 of the marina project and rvlr. Jarvis. rv1r. Black said
that the response was that there were no plans in house or that they have not been
finalized. rv1r. Black stated the next day in the newspaper there was an article that rvlr.
Kastarlak had been let go over his objection to the lack of public access to the marina.
Mr. Black asked if anything has been finalized and will there be more publiC input to the
end of the project.
Mayor Taylor stated some drawings for phase 2 have been presented and are just being
reviewed by staff. The plans will have to go back to the architect and the developer to
bring them into code. The plans will have to go through the TRC Committee and then
presented to the Planning and Development Board. It will then come before the
Commission for two public hearings. At that time public input will be put into the
project.
Secondly, Mr. Black stated at the same meeting tvvo developers wanted to lease and/or
purchase the Intracoastal Park next to Wahoo's and one of the developers was
Wahoo's. Mr. Black said that the bond referendum in 1988 stated that the funds were
to be used For a public park and could that be arbitrarily changed or does it have to be
a public park/convention center/hotel.

Chairman Wische noted there were 18 staff comments and Mr. Sipula stated the
applicant agrees to comply with all staff comments.
Chairman Wische announced the public hearing portion of the meeting. There were no
comments and Chairman Wische closed the public hearing.
Chairman Wische inquired if any Board members had any comments. Mr. Rosenstock
asked if the air conditioning was on the roof. The applicant replied the air conditioning
is on the ground.
Ms. Frazier inquired if the building would be used for storage of rental equipment and a
small office. The agent did state that there would be some equipment on the property
for rental, but the equipment, which includes tables, chairs, and dishes, is mainly for
large parties.
Mr. Rosenstock inquired h.ow the applicant would deal with the outside storage. The
agent said there would be no outdoor storage and all equipment is stored indoors.
Motion
Mr. Myott moved to approve the site plan application to construct a 15,043 square foot
office/warehouse facility to be used for storage of party rental equipment and supplies
on a 1.099 acre parcel of land, subject to all staff comments. Motion seconded by Ms.
Frazier.

Chairman Wische informed the agent that there were 30 staff comments. The agent
requested to respond to item 11 regarding the instaUation of a sidewalk. The agent
stated that there were no sidewalks in this area and he has applied for a waiver.

The agent also requested to respond to item 13 requiring that all open areas between
and behind the buildings be sodded and irrigated. Mr. Pica said he would like to place
crushed stone in these areas. Mr. Pica thought it would look better and said he has
discussed this with Mr. Rumpf at prior meetings.
Mr. Rumpf stated that the applicant would be removing the fence and would maintain
the site as a cleaner open area. Mr. Rumpf also stated that the applicant has
expressed concerns regarding security and that a closed fence would lure people into
the area.
Chairman Wische noted that the condition cited is in accordance with LOR Chapter 4,
Section a.A and Chapter 6, Article IV, Section 5(8)(1)(c). Therefore, according to the
Code the area must be sodded.
The applicant stated he has the required amount and landscaping in the front of the
building and on the sides. The applicant stated the public would not see this and felt the
property would look nicer and prevents people from going behind the buildings and
hiding in their vehicles.
Chairman Wische stated that this Board must follow the Codes and asked Assistant City
Attorney Igwe for his opinion on this request. Assistant City Attorney Igwe stated that
there were regulations that guide the Board and unless there were any compelling
reason, felt the Board must abide the Code regulations.
Mr. Friedland wished to address the sidewalk issue and felt that the provision for
sidewalks along Railroad Avenue and along NE ath Avenue should be complied with
even there are no other sidewalks in this area.
Mr. Rumpf stated that the Code relies upon staff in certain circumstances to review and
inspect the areas to waive certain requirements. Mr. Rumpf stated the Board should
consider what would be accomplished to require one individual to place a sidewalk if in
fact it is not likely that future sidewalks would be placed to link certain areas. Mr. Rumpf
stated that other projects have been given waivers when there is no linkage being
provided.
Mr. Friedland asked Mr. Rumpf if staff would agree to not requiring sidewalks. Mr.
Rumpf stated there are no other sidewalks in the vicinity and this would be a spot
requirement. Mr. Friedland also questioned whether the City would at sometime
request that sidewalks be provided in this area and if this were the case, would this
project be grandfathered. Mr. Rumpf stated there was not enough space to provide for
sidewalks.

Mr. Myott noted that the buildings were "removable" and are prefabricated and asked
the applicant why he was building two buildings instead of one large building. The
applicant stated that because the building design had to meet the wind codes, it is
difficult to have a 100' wide building meet these requirements. Mr. Pica informed
members that he has worked over one year with the manufacturer to make certain that
the building would fit in the aesthetics of Boynton Beach and the Palm Beach area.
Mr. Myott questioned since the buildings were removable, is the applicant considering
the property temporary and at some point the buildings would be moved. Mr. Myatt
stated that the buildings were not very attractive and even though the buildings will be
located in an industrial area, Mr. Myatt would hope that any new projects going in this
area would be attractive.
Mr. Pica stated that the buildings would look attractive and that he already has one
building on the site. All three buildings wo.uld be alike. Mr. Myatt noted that the
landscaping was acceptable. Mr. Pica said that he has owned the property for a long
time and owns property ne~ to this property and does not plan to move the buildings.
Mr. Rosenstock did not feel that the. applicant could make the buildings look nice. Mr.
Pica stated that the building that is on the property has been there for 20 years and still
looks good today. Mr. Rosenstock asked staff if the Code states that the site must be
sodded and irrigated and that if it is hidden from public view, why doesn't staff give the
applicant a variance to place gravel. Mr. Rumpf stated that when the fence is removed
the entire site would be in view, except for the rear area. Mr. Rumpf stated that if the
applicant were permitted to place gravel, it would surround the buildings.
The applicant stated that the gravel would only be in the rear of the building and
between the three buildings. The applicant stated that the landscaping in the front
would have sod 15' between the buildings and will have trees and shrubs. Mr.
Rosenstock asked if irrigation would be included. The applicant stated that if there were
sod there would be irrigation, but if there were gravel he would not have irrigation.
Ms. Frazier stated that anyone who attended the Visions 20/20 planning meetings
would not want to see Quonset huts on this property. Ms. Frazier stated this entire area
is being improved and there was no place for Quonset huts.
Vice Chairman Reed also agreed with Ms. Frazier and expressed disappointment that
this land lacks value that the Board would be considering this request.
Mr; Friedland said that there is already one building there now and felt it would be more
attractive to allow the addition of the buildings with the landscaping than to leave it the
way it is with only one building on the property.

The applicant stated that his property has vagrants on it and wants the people off the
property. This is how he intended to rid the property of the vagrants. Mr. Pica stated
the buildings would be attractive and well lighted. Vice Chairman Reed agreed that the
property needed to be cleaned up and improved, but did not feel this was the way to go.
Mr. Rumpf stated that he has reviewed the Visions 20/20 documents and utilizes the
recommendations as projects are presented to staff. Mr. Rumpf stated that Visions
20/20 did not specify any recommendations in this type of situation. Mr. Rumpf said
that although the area is close to downtown, it is in a sizeable M-1 zoning district. Mr.
Rumpf also stated that the property is flanked by the C-4 zoning district and is not
visible from U.S. 1 which is a block away. Mr. Rumpf stated he views this project as an
improvement to the area.
Chairman Wische announced the public hearing portion of the meeting.
Assistant City Attorney Igwe administered the oath to Louis Lichtenstein of 942 D South
Drive Terrace, Oelray Beach who took the podium. Mr. Lichtenstein stated he was a
friend of Mr. Pica and when speaking of Quonset huts, people think of the old style
airplane Quonset huts. Mr. Lichtenstein stated the buildings were 20th Century Quonset
huts and are not the old-looking Quonset huts. Mr. Lichtenstein stated the Quonset huts
are modem and attractive.
Mr. Myott asked Mr. Pica if the Quonset huts resulted in a cost savings by going this
route and Mr. Pica stated this was the only way he could afford to do the project and it
has taken all his savings. Mr. Pica stated the buildings would be utilized for his own
use.
Motion
Mr. Friedland moved that the Board approve the request to construct two Quonset
storage buildings located at 817 N. Railroad Avenue, each at 2,960 square feet for a
total of 5,920 square feet, subject to all staff comments, with the exception to support
relief from requirement #11, allowing no sidewalks, and item #13. that the areas behind
the buildings not be sodded. Mr. Sherman seconded the motion.
Motion denied 1-6 (Mr. Friedland voting in favor of the motion).
The applicant asked for clarification of the denial and was informed that the entire
project was denied. The applicant stated he has already purchased the buildings. The
applicant was advised to bring this issue up when he appears before the City
Commission.

Mr. Myott stated that since so much development is going on in the downtown area, it
would be nicer to have a conventional building in this area. Mr. Myott also stated that
the applicant should have determined the requirements before spending his money.
The applicant stated he has spent over a year on the project and has worked with the
Building Department to make sure it would pass all the Codes.
