Dear Mr. Alfaro:
When I returned from vacation on July 6th, I received a message from you that the time
scheduled on the agendas of the Committee meetings for approving my sign variance application
had been rescheduled again (this, of course, in keeping with the history of ever changing rules,
schedules, etc. ofthe city, regarding my attempt to erect a nice new sign on my property).
Both my secretary and myself have called during the week of July 6th and left messages on
your machine that both myself and Carey Matthews - the other owner of Center for Self
Discovery - will be out of the country from September 15th until October 11th, therefore unable
to represent ourselves during that time. I believe you indicated it was being rescheduled to late
September. I also received your mesage that my sign is "legal" where it is, for now, and no one
from the city will bother me about it until we finally are presented at an agreed upon scheduled
city meeting.
Since you have not returned my call to confirm that you received my message, I am
writing this to make sure there are no more mix-ups.
Please respond soon confirming you have my letter and have added this letter to my
burgeoning file. Also let me know when we will next be scheduled. I appreciate your attention
to this.

Dear Mr. Sy:
The owners of the above-referenced property have asked me to review the history of their application for a
pennit to replace 1he primllJ)' identification sign at their business location. As indicated in the attached letter from Scott
Bedford at Signs By Tomorrow, the sign contraetor, they have macle a good faith effort to comply with City sign code
requirements.
As Mr. Bedford's letter recounts, his pennit was reviewed and approved by the City's Development Review
Committee in October 1998. ThIs approval included a rcquC$t by YOW' Departm~t to remove the existini sign base and
replace it with a more structurall)' sound support. In reliance on these instructions, my clients removed the existing sign
support and invested a substantial sum of money in the manufacture of a sign that satisfies what they were told were
City code requirements. This initial investment has since escalated as mey have tried to deal with subsequent,
inconsistent interpretations of City sisn code policy. After months of frustrating delays, they bave still not been
permitted to erect a replaoement sign at the same location on the site. They have received numerous complaints from
business patrons who cannot locate the site because it is not adequately identified.
It is my understanding that you have authority to allow the sign pennit to be issued according to the temlS of
the approval;ranted by the Development Review Committee in October. I 5trongly utge you to do so. If a permit is not
forthcoming, my clients will continue to incur expenscs for which the City may ultimately be held liable.

of why the notation was added. In 1990, the County was planning to expand the intersection of
Seacrest Boulevard and GolfRoadlS.E, 23d Avenue. We have no way of knowing, but this project
(which has since been ,c.ompleted).may,have been 1he source of the notation ,on the survey. However,
based on my review of the public record, it appears that the notation on the survey was added in
error,
I spoke ~ly to Mr. David Cuff in an effort to determine if Palm Beach County is aware
of any right-of..way "dedications" in the vicinity of the Property. He responded that be has no
knowledge whatsoever of the source of the notation on the owners' survey. Howe"o'eI, he speculated,
the Board of County Commissioners has adopted as part of the County Comprehensive Plan a
"Thoroughfare Right-of-Way Protection Map" (the "Thoroughfare Plan"). This is a planning
document intended to guide the County in planning for future roadway e"pansioDS. This planning
document creates no encumbrances on private property. It does indicate that the County would like
to have 80 feet ofright~of-way for future expansion of GolfRoadfS.E. 23d Avenue from Seacrest
Boulevard to U.S. 1. At the present time, the County owns 50 feet of right of way. The County's
ultimate expansion plans would therefore require acquisition of another 30 feet ofright-of~way,
Mr, Cuff speculates that the 15 feet shown in the notation om the surVey would correspond
to half of the additional 30 feet the County Thorouihfare Plan provides. Typically, he reports, the
County would assign half of the desired additional 30 feet -~ i.e. 15 feet -- to the property ovmers
on either side of S.E. 23d Avenue. If this property were located within the unincorporated area, there
would be no prohibition on erecting signs within the "ultimate right-oi-way." The County Land
Development Code provides for a system of waivers whereby property owners can install
improvements (such as signs) within future rights-of-way shown on the Thoroughfare Plan.
However, to my knowledge, the County Thoroughfare Plan has no binding force within a.
municipality and should not be a factor in your evaluation of the variance request..
Your decision to pennit the property owners to use an older survey is greatly appreciated.
The notation OD the SllI'Vey has unfortunately, required a great deal of time and effort to explain. We
can at this point only speculate about the reason for the notation. Howeyer, my review of the public
record reveals the notation was added in error and should not affect your review of the variance
request.

I am informed that your variance application requitements include a survey of the property,
I am furtheJ: informed that YOW" office gave permission to the property owners to use an existing
survey of their property with the caveat that they assume responsibility for any matters of record
contained in or missing from the survey, The survey proffered by the o\\lI1ers was prepared in 1990
by the firm of O'Brien Suiter & Q!Brienl Inc. (Field Book 8100, Page 72, Job No. 82-30S-A) (a copy
of which is attached as Ex.hibit 4'A"). This survey contains a handwritten notation (in the form of
hatch marks and printed words) indicating the existence of a 15 foot wide 4'Proposed Right-of-Way
Dedication" across the property's front yard running parallel to S.E. 23d Avenue. I understand that
your office has asked for an explanation of this notation because it may affect your recommendation
to the Planning and Zoning Board and City Council regarding the variance request. My letter is
intended to address your concerns.
In an effort to address this matter, I have reviewed the following documents: (I) the 'sulvey;'
(2) an Ownership and Encumbrance Report for the Property prepared for me by Commonwealth
Land Title Company (File No. FM-86379, 4/13199) (attached as Exhibit '4B"); and (3) th~ P!at of
Highpoint Subdivision, recorded in Plat Book 23, Page 225, Official Re<,ords of Palm Bearh,County,
Florida (attached as Exhibit "C"). I have also spoken to Mr. David Cuff, P.E.~ Assistant C~unty'
Engineer in the Land Development Division of Palm Beaeh County Department of Engineering and
Public Works (561-684-4090).
