Project: Agent: Owner: Location: Chairman Wische instruded the applicant to take the podium. The agent presented architect renderings and plans for the Board to view. Donald Bryan, President of Bryan & Associates with offices in Pompano Beach took the podium. Mr. Bryan stated he resides.in Boynton Beach at 916 SW 38th Court. ' Chairman Wische noted there were 26 staff comments. Chairman Wische instruded the applicant to respond to only those comments that he does not agree with or wished to discuss. Mr. Bryan stated that all comments have been reviewed with the City's technical review committee and concurs with all staff comments. Chairman Wische asked if Mr. Rumpf had any further comments. Mr. Rumpf noted that the applicant has been cooperative in working with staff comments. Chairman Wische announced the public hearing portion of the meeting. There were no comments and Chairman Wische closed the public hearing. Chairman Wische asked if any Board member had any comment. Ms. Frazier inquired as to the cost of constructing the school. Mr. Bryan responded that their budget, including site work, is $850,000. Mr. Rosenstock acknowledged that the applicant had to comply with City Codes, but questioned if there were State regulations for private schools or public schools that needed to be complied with. Mr. Rosenstock asked the applicant if he was in compliance with any applicable State regulations regarding school buildings. Discussion of the addition of a minority and women's preference for City contracts and bids Mayor Pro Tem Tillman would like the City Attorney to study the possibility of adopting a policy for preference to minorities and women in the awarding of contracts and bids. Mayor Pro Tem Tillman stated that the County and the School Board have adopted this preference and he has reviewed the County's ordinance and feels it contains some provisions that the City could utilize in adopting an ordnance. PZ 99-001 TO: Chairman and Members Planning and Development Board Michael Run$1:: Acting Manager of Planning and Zoning FROM: DATE: SUBJECT: January 6, 1998 Lake Worth Christian School - COUS 98-004 Conditional Use - Addition of elementary school building to existing school campus PROPOSAL SUMMARY The Lake Worth Christian School campus, situated on 9.96 acres, is comprised of a 13,952 square foot high school building, a 6,500 square foot middle school building, a 15,160 square foot gymnasium, and outdoor recreation facilities. The plans submitted for this conditional use approval propose the addition of a 10,797 square foot elementary school building located to the east of the existing buildings which all align, east to west, from High Ridge Road. The additional building will raise the parcel's building coverage to 11.26 percent, and does not reflect a change in use, function, or performance of the overall use of the site as measured by the city's land development regulations. Lake Worth Christian School Conditional use approval for the addition of an elementary school at the existing campus of the Lake Worth Christian School. The elementary portion of the school is currently located at a remote location, from which it is being relocated to consolidate the school. Property size: 9.96 acres (total) Land use: PublicJPrivate, Government, Institution (PPGI) Zoning: R-1-AAA, Single family residential, (the R-1-AAA zoning district permits school facilities as a conditional use). Location: East side of High Ridge Road, approximately one-half mile north of Miner Road (see Exhibit "A" - Location Map) N/A Number of Units: Building area: 10,797 square feet (See Exhibit "B" - Proposed Site Plan). SURROUNDING LAND USES AND ZONING North - Single-family homes zoned AR (County); East - Rights-of-way for Seaboard Airlines Railroad and 1-95; South - Single-family homes (Cedar Ridge Estates PUD), zoned PUD; and West - High Ridge Road, and farther west, single family homes zoned AR (County). / Lake Worth Christian School Memorandum No. PZ 98-004 Page 2 STANDARDS FOR EVALUATING CONDITIONAL USES AND ANALYSIS Section 11.2.0 of the Land Development Regulations contains the following standards to which conditional uses are required to conform. Following each of these standards is the Planning and Zoning Division's evaluation of the application as it pertains to standards. The Planning and Development Board and City Commission shall consider only such conditional uses as are authorized under the terms of these zoning regulations and, in connection therewith, may grant conditional uses absolutely or conditioned upon the conditions including, but not limited to, the dedication of property for streets, alleys, recreation space and sidewalks, as shall be determined necessary for the protection of the surrounding area and the citizens' general welfare, or deny conditional uses when not in harmony with the intent and purpose of this section. In evaluating an application for conditional use, the Board and Commission shall consider the effect of the proposed use on the general health, safety and welfare of the community and make written findings certifying that satisfactory provisions have been made concerning the following standards, where applicable: 1. Ingress and egress to the subject property and proposed structures thereon, with particular reference to automobile and pedestrian safety and convenience, traffic flow and control, and access in case of fire or catastrophe. The subject property has two points of direct ingress/egress located along the relatively narrow side of the subject property. The project meets the requirements of the Palm Beach County Traffic Performance Standards Ordinance; however, approval from the county is conditioned upon access limitations. Traffic circulation is be limited as follows: the south driveway is to be limited to entering traffic, and the north driveway is to be restricted to exiting, right-turn traffic, to minimize potential traffic congestion caused by peak traffic periods of the school in combination with the current two-lane width of High Ridge Road. 2. Off-street parking and loading areas where required, with particular attention to the items in subsection 1 above, and the economic, glare, noise, and odor effects the conditional use will have on adjacent and nearby properties, and the city as a whole. The proposed elementary school will generate the ,need for an additional 27 parking spaces, which are proposed at the eastern end of the existing parking lot. With the exception of traffic, the affects of the school expansion should be kept within the boundary of the school property. This is partially achieved by placing the play area internally, farthest from adjacent homes. In excess of regulations, a row of trees will accompany the hedge required along the north and south sides of the property, even to be extended beyond the limits of the vehicle use area (north side only). The new structure and parking area will contribute minimally to the current glare, noise or odor generated from the existing campus. 3. Refuse and service areas, with particular reference to the iter ~s in subsection 1 and 2 above. The proposed project includes positive changes to existing refuse/service areas. The dumpster will be relocated to the south side of the property, between the middle school and expanded driveway. This new location would include buffering by both existing buildings and landscaping. The service buildings will be moved approximately 24 feet northward, away from the property line. When staff comments relative to enclosure access and tree obstructions are satisfied, the proposed location of the refuse area will be acceptable. 4. Utilities, with reference to locations, availability, and compatibility. With incorporation of Utility Department comments, utilities are available and consistent with Comprehensive Plan policies and city regulations. ~ Lake Worth Christian School Memorandum No. PZ 98-004 Page 3 5. Screening, buffering and landscaping with reference to type, dimensions, and character. With trees proposed within the internal buffer, the landscaping exceeds the requirements of code. 6. Signs, and proposed exterior lighting, with reference to glare, traffic safety, economic effect, and compatibility and harmony with adjacent and nearby properties. At time of permitting, the parking lot light levels will be evaluated for traffic safety and excessive glare. No increased conditions regarding glare are anticipated from the proposed expansion. It is recommended that site lighting poles not exceed 20 feet in height and that light levels not exceed minimum standards, to preserve the residential character. It is further recommended that light fixtures required to illuminate the proposed parking area be directed away from the residential buildings located north of the site. No additional signage will be proposed. 7. Required setbacks and other open spaces. Required setbacks and landscaping/open space requirements are exceeded by the proposed project. 8. General compatibility with adjacent property, and other property in the zoning district. If impacts are anticipated and properly mitigated, schools and churches are acceptable and compatible uses within residential areas. Furthermore, although the school abuts residential properties, access is provided via the collector roads of High Ridge and Miner. 9. Height of building and structures, with reference to compatibility and harmony to adjacent and nearby properties, and the city as a whole. The proposed single-story building is to measure 24 feet in height, which is one foot less than the maximum allowed in the R-1-AAA zoning district, and nearly identical to the height of those two-story single family homes situated nearest to the subject project within the Cedar Ridge PUD (homes on lots #25 and #28 were researched and determined to have been constructed at approximately 24 feet). 10. Economic effects on adjacent and nearby properties, and the city as a whole. The proposed expansion or consolidation of the elementary school with the main campus will allow the elementary school to benefit from the greater resources at the main campus, will allow for greater efficiency in operation, and increased convenience to families who have children in and/or are involved with the varying grades of the school. Furthermore, the expansion of the schoo/:t this location will further expand private elementary school resources within the Boynton Beach area. As the school is compatible with adjacent and nearby properties, the expansion is not projected to have any negative economic affects on said properties. 11. Conformance to the standards and requirements which apply to site plans, as set forth in Chapter 19, Article II of the City of Boynton Beach Code of Ordinances. (Part III Chapter 4 Site Plan Review). With incorporation of staff comments, the proposed project will comply with all requirements of applicable sections of city code. J - Lake Worth Christian School Memorandum No. PZ 98-004 Page 4 12. Compliance with, and abatement of nuisances and hazards in accordance with the performance standards within Section 4 of the zoning regulations; also, conformance to the City of Boynton Beach Noise Control Ordinance. With incorporation of all conditions contained herein, the use would operate in a manner thpt is in compliance with the above-referenced codes and ordinances of the City of Boynton Beach. RECOMMENDATION Based, in part, on the overall need for educational facilities within the area, and consistency with the Comprehensive Plan which allows such uses within this land use classification contingent upon compatibility with neighborhood character, staff recommends that this project be approved. This recommendation for approval is conditioned upon satisfying all conditions of approval as contained in Exhibit "C". Furthermore, pursuant to Chapter 2 - Zoning, Section 11.2 Conditional Uses, a time limit is to be set within which the proposed project is to be developed. Staff recommends that a period of one (1) year be allowed to develop this project. As long as 25% or more of the total cost of the improvements are completed within one (1) year, this condition is met. Department of Health permits will be required for the water system X extensions serving this project. (Sec. 26-12) 4. Fire flow calculations will be required demonstrating the City Code X requirement of 1500 g.p.m. as stated in LDR Chap. 6, Art. , Sec. 16, or the requirement imposed by insurance underwriters, whichever IS greater. (See Sec. 26-16(a)). Please submit these calculations with your Health Department permit application and plans. 5. Sec. 26-34(E) of the City Code requires that a capacity reservation fee be X paid for this project either upon my request for signature on the Health Dept. application forms or within 30 days of site plan approval, whichever occurs first. Based upon one 1.5" meter, the fee is $1,205.82. 6. The Utilities Department will not require surety for installation of the X water and sewer utilities, on condition that the systems be fully completed, and given to the city before the first permanent meter is set. Note that setting of a permanent water meter is a prerequisite to obtaining the certificate of occupancy. 7. A building permit for this project shall not be issued until this office has X approved the plans for the water and/or sewer improvements required to serve the project. D of the Land Development Regulations contains the following standards to which conditional uses are required to conform. Following each of these standards is the Planning and Zoning Division's evaluation of the application as it pertains to standards. The Planning and Development Board and City Commission shall consider only such conditional uses as are authorized under the terms of these zoning regulations and, in connection therewith, may grant conditional uses absolutely or conditioned upon the conditions including, but not limited to, the dedication of property for streets, alleys, recreation space and sidewalks, as shall be determined necessary for the protection of the surrounding area and the citizens' general welfare, or deny conditional uses when not in harmony with the intent and purpose of this section. In evaluating an application for conditional use, the Board and Commission shall consider the effect of the proposed use on the general health, safety and welfare of the community and make written findings certifying that satisfactory provisions have been made concerning the following standards, where applicable: 1. Ingress and egress to the subject property and proposed structures thereon, with particular reference to automobile and pedestrian safety and convenience, traffic flow and control, and access in case of fire or catastrophe. The subject property has two points of direct ingress/egress located along the relatively narrow side of the subject property. The project meets the requirements of the Palm Beach County Traffic Performance Standards Ordinance; however, approval from the county is conditioned upon access limitations. Traffic circulation is be limited as follows: the south driveway is to be limited to entering traffic, and the north driveway is to be restricted to exiting, right-turn traffic, to minimize potential traffic congestion caused by peak traffic periods of the school in combination with the current two-lane width of High Ridge Road. 2. Off-street parking and loading areas where required, with particular attention to the items in subsection 1 above, and the economic, glare, noise, and odor effects the conditional use will have on adjacent and nearby properties, and the city as a whole. The proposed elementary school will generate the need for an additional 27 parking spaces, which are proposed at the eastern end of the existing parking lot. With the exception of traffic, the affects of the school expansion should be kept within the boundary of the school property. This is partially achieved by placing the play area internally, farthest from adjacent homes. In excess of regulations, a row of trees will accompany the hedge required along the north and south sides of the property, even to be extended beyond the limits of the vehicle use area (north side only). The new structure and parking area will contribute minimally to the current glare, noise or odor generated from the existing campus. 3. Refuse and service areas, with particular reference to the items in subsection 1 and 2 above. The proposed project includes positive changes to existing refuse/service areas. The dumpster will be relocated to the south side of the property, between the middle school and expanded driveway. This new location would include buffering by both existing buildings and landscaping. The service buildings will be moved approximately 24 feet northward, away from the property line. When staff comments relative to enclosure access and tree obstructions are satisfied, the proposed location of the refuse area will be acceptable. 4. Utilities, with reference to locations, availability, and compatibility. Screening, buffering and landscaping with reference to type, dimensions, and character. With trees proposed within the internal buffer, the landscaping exceeds the requirements of code. 6. Signs, and proposed exterior lighting, with reference to glare, traffic safety, economic effect, and compatibility and harmony with adjacent and nearby properties. At time of permitting, the parking lot light levels will be evaluated for traffic safety and excessive glare. No increased conditions regarding glare are anticipated from the proposed expansion. It is recommended that site lighting poles not exceed 20 feet in height and that light levels not exceed minimum standards, to preserve the residential character. It is further recommended that light fixtures required to illuminate the proposed parking area be directed away from the residential buildings located north of the site. No additional signage will be proposed. 7. Required setbacks and other open spaces. Required setbacks and landscaping/open space requirements are exceeded by the proposed project. 8. General compatibility with adjacent property, and other property in the zoning district. If impacts are anticipated and properly mitigated, schools and churches are acceptable and compatible uses within residential areas. Furthermore, although the school abuts residential properties, access is provided via the collector roads of High Ridge and Miner. 9. Height of building and structures, with reference to compatibility and harmony to adjacent and nearby properties, and the city as a whole. The proposed single-story building is to measure 24 feet in height, which is one foot less than the maximum allowed in the R-1-AAA zoning district, and nearly identical to the height of those two-story single family homes situated nearest to the subject project within the Cedar Ridge PUD (homes on lots #25 and #28 were researched and determined to have been constructed at approximately 24 feet). 10. Economic effects on adjacent and nearby properties, and the city as a whole. The proposed expansion or consolidation of the elementary school with the main campus will allow the elementary school to benefit from the greater resources at the main campus, will allow for greater efficiency in operation, and increased convenience to families who have children in and/or are involved with the varying grades of the school. Furthermore, the expansion of the school at this location will further expand private elementary school resources within the Boynton Beach area. As the school is compatible with adjacent and nearby properties, the expansion is not projected to have any negative economic affects on said properties. 11. Conformance to the standards and requirements which apply to site plans, as set forth in Chapter 19, Article II of the City of Boynton Beach Code of Ordinances. (Part III Chapter 4 Site Plan Review).
