in the same zoning district;
B. That the special conditions and circumstances do not result from the actions of the
applicant;
C. That granting the variance requested will not confer on the applicant any special
privilege that is denied by this Ordinance to other lands, buildings or structures in the
same zoning district;
D. That literal interpretation of the provisions of this chapter would deprive the applicant of
rights commonly enjoyed by other properties in the same zoning district under the terms
of the Ordinance and would work unnecessary and undue hardship on the applicant;
E. That the variance granted is the minimum variance that will make possible the
reasonable use of the land, building or structure;
F. That the granting of the variance will be in harmony with the general intent and purpose
of this chapter and that such variance will not be injurious to the area involved or
otherwise detrimental to the public welfare.
6. An application fee in the amount of $400.00 plus postage, payable to the City of Boynton
Beach, must accompany a completed application. The $400.00 application fee covers a
request to vary one (1) section of the Code. Seeking relief from more than one section of the
Code will require payment of $100.00 for each additional Code section.

Pursuant to your request, and in accordance with the City of
iBoynton Beach's Zoning Code, enclosed is the Zoning Code Variance
~ppllcation for the above mentioned property, requesting the
Iheight of a single family structure be increased from a maximum
~f twenty five (25) feet to a maximum of thirty two (32) feet,
~@asured from the average finish grade around the exterior of
:structure_ Today, the single family home buyer requirements
are different from that of previous generations. Certain design
criteria and amendities, including the requirement of floor to
ceiling heights of ten (10) to fourteen (14) feet, are not only
preferred, but are dictated by the market. AS we discussed
during our recent meeting, we have surveyed numerous munici-
palities in Palm Beach and Broward Counties and found, with
little or no exception, that the maximum building heights allow-
~ble under their codes for single family structures is signifi-
cantly higher then that of Boynton Beach. For exarrple the City
pf Delray, which borders the subject propery to the South imposes
a thirty five (35) foot height limitation for single family struc-
tures. It is also important to note that we are anxious to pre-
perve as much native vegetation and pervious area as possible
while achieving a certain marketable square footage but can only
ao 50 if we are allowed marketable building heights versus a
~ingle story structure with the same square footage.
