The Palm Beach County Traffic Division has reviewed the traffic study
for the project entitled Woolbright Medical Office, pursuant to the Traffic
Performance Standards in Article 15 of the Palm Beach County Land
Development Code. The project is on the south side of Woolbright
Road, west of 1-95. The project will consist of a 35,000 square feet of
medical office. The project will generate 1,196 daily trips. The build-out
is 1999.
The Traffic Division has determined that the project meets the Traffic
Performance Standards of Palm Beach County. ,Please note that

Staffhas reviewed the above referenced project and offer the following comments:
1. Palm Beach Health Department permits may be required, (Sec. 26-12).
2. Please show proposed water and sanitary sewer mains and points of connection to
existing mains, (Sec. 26.l6(a)).
3. Plan shall specify meter size and location, (Sec. 26.16( c)).
4. A Capacity Reservation Fee will be required within thirty (30) days of
City Commission approval, or upon request for my signature on the HRS/DEP
permit applications. The fee amount will be determined based upon meter
size or expected demand, (Sec. 26-34[ED.
5. City water will not be supplied for irrigation. Please show location and source of
irrigation water on your plan, (City Compo Plan, Policy 3C.3.4).
6. Backflow preventors are required for certain uses, (Sec. 26-207).
7. Fire hydrants shall be within 200' of all points on every commercial building,
(Chapter 6, Art. IV Sec. 16).
8. Only palm trees will be permitted within utility easements, (Sec. 7.5-18.1).
It is our recommendation that the plan proceed through the review process.

Building Division

location and size of all signage shall comply with the applicable sign code regulations. [Chapter 9-Community
Design Plan, Section 10.1.1. and Chapter 21-Sign Code, Article III, Section 5 and Article IV, Section 1.]
2. The handicapped accessibility code requires the site to have an accessibility path leading to the entrances of
both buildings from the abutting right-of-way, therefore, add the required path to all plan view drawings of the

4. Provide an Engineer's written certification that the drainage will conform with all rules, regulations and codes,
including but not limited to, Chapter 6, Article IV, Section 5 of the City's LDR. Chapter 4, Section 7F2

5. Show a continuous sidewalk thru all driveways. Chapter 23, Article II.P.

a building permit. Chapter 23, Article II.H.6
8. The maximum runoff flow distance over impervious surfaces before being diverted to percolation areas is 50

Recommendations
1. Ifthe sidewalks are six inches above the parking lot, increase their widths an additional two feet to act as a
continuous wheel stop. This eliminates the necessity for individual wheel stops and their maintenance and
reduces the potential for tripping.
2. Stripe all ingress driveways 15 ft. wide to provide greater vehicle latitude turning in from Woolbright Road.
We recommend that an amended set of plans be prepared for a second submittal prior to forwarding to Planning
and Development Board.

We recommend approval of the above referenced project subject to the following comments.
Building Division
I. On the site plan place a note indicating that the required handicapped accessible path leading
to the entrances of both buildings from the abutting public right-of-way and each
handicapped parking space will be designed and constructed in compliance with the
regulations specified in the Florida Accessibility Code for Building Construction, Section
4.1.2. III (1) thru (4). Where applicable, specify with notes on the plan the location of the
required curb cut ramps
2. Where applicable, provide the following information on the Paving and Drainage Plan:
a) Show the location of the handicapped accessible curb cut ramp(s).
b) Provide a detail drawing of the curb cut ramp(s).
c) Specify the finish grade elevations and/or slope of the accessible paths required to
both buildings from the abutting right-of-way and the handicapped parking spaces.
d) Identify the finish floor elevation of each building.
Note: All drawings, dimensions, surface finishes, elevations and slopes shall comply with
the regulations specified in the Florida Accessibility Code for Building
Construction, Section 4.1.2.III (1) thru (4).
3. At time of site plan review building and site signage is required to be submitted and reviewed
for compliance with the applicable code regulations. Because the applicant did not provide
the requested detail drawings of the site and building signage including showing, identifying
and dimensioning the location, size, color, type, style, height or form of illumination, the
monument sign shown on the plan view drawings shall be omitted from the plans. To clarify
the status of the signage for the project place a note on the site plan and elevation view
drawings of the buildings indicating that the site and building signage will be approved under
a separate site plan review submittal specifically for signage. [Chapter 21 - Sign Code and
Chapter 9 - Community Design Plan, Section 10.1.]
4. The 100 square foot proposed monument sign illustrated on the site plan exceeds the 64
square foot maximum sign area allowed by the sign code by 36 square feet. Considering
signage is not part of this request remove the monument sign drawing from the plan.
5. Permit plans for the proposed project shall comply with the applicable Building, Energy and
Handicapped Codes. [Chapter 20- Building, Housing and Construction Regulations]

1. On the north side of the medical office building (south side of north parking lot), the sidewalk
dimension on the site plan shows 7' and the dimension on the drainage plan shows 5'. Revise
plans.
2. Show stop bars at all locations having stop signs on the drainage plan. Also, reflect same
locations for stop signs and stop bars on the site plan. Three locations are not shown on site
plan. [MUTCD]
3. Provide the City with a copy of the County permit required for work on Woolbright Road.
[Chapter 23, Article II. H.6.]
4. Add a stop bar/sign for westbound traffic in the northwest parking area just before entering
the west driveway egress lane. [MUTCD]
5. Remove the ingress/egress pavement arrows shown within the Woolbright R/W. Install the
"Right Turn Only" arrows in front ofthe stop bars. [MUTCD]
6. Add "Right Turn Only" post signs underneath the egress driveway stop signs. Additionally,
install "One Way" arrow post mounted signs in the Woolbright Road medians directly across
from the two exit driveways. [MUTCD]
7. A curb cut detail for the handicap access aisles at the sidewalk will be required at time of
permitting. [Florida Accessibility Code]
8. Provide an Engineer's sealed certification that "the drainage plan will conform with all rules,
regulations and codes including, but not limited to, Chapter 6, Article IV, Section 5 of the

9. All plans submitted for specific permits shall meet the City's code requirements at time of
application. These permits include, but are not limited to the following; site lighting, paving,
drainage, curbing, landscaping, irrigation and traffic control devices. Permits required from

included with your permit request.

The following is a list of 2nd review comments regarding the site plan review of the plans for the
above-referenced project. The applicant shall understand that all documents and plans
submitted for site plan review are subject to additional comments. I recommend that the
applicant/agent contact this office regarding questions related to the comments. If the applicant
is not intending to correct code deficiencies, he should contact this office regarding the
procedures, application forms, fees and submittal deadline dates for seeking relief from the
code requirement.
1. Provide clause on the survey stating that the property was abstracted for right- of -way and
easements, as required by LDR, Chapter 4 Section 7.A.
2. On the Landscape Plan, indicate percentage of native species for code required
landscape. Note City of Boynton Beach ordinance #89-38 Policy 404.6 states that native
vegetation species shall satisfy at least 50% of all required site landscaping.
3. An amended traffic report submitted to Planning and Zoning Department waste be
evaluated by Palm Beach County Traffic Division.
4. All exterior utility boxes, meters, transformers, etc. shall be screened from view by a wall
or continuos hedge as described by Chapter 9, Community Design Plan Sec. 10.CA.
5. Indicate required setbacks and their dimensions for C-1 Commercial District, as per
Chapter 2 Section 6, on site plan, as required by the LDR Chapter 4, Section 7.B.
6. All exterior surfaces of the structure(s) shall be depicted on elevations submitted for
permit, including color code including manufacturer's name of products.

7. Building height shall be limited to 15 feet as stipulated by the conditions of rezoning for

8. Provide buffer wall details including color, finish material, and setback. According to LOR,

Find attached for your review the plans and exhibits for the above-referenced project. To
ensure that the project stays on line with the review time frame, I request that the
plans and exhibits be reviewed and formal written comments transmitted to the
Director of the Planning and Zoning Division no later than 5:00 P.M. on June 13. 1997.
The comments shall be separated into two categories. The first category comments
with code sections referenced and the second category references recommendations
that you believe will enhance the project.
If you believe the plans are substantially complete with regards to code compliance
and that your outstanding comments and/or recommendations may be addressed at
time of permit review rather than requiring the applicant to prepare amended plans for
a 2nd submittal indicate in your 1st review written comments that you recommend the

LAND USE ELEMENT AMENDMENT/REZONING REQUEST
Summary: Kieran J. Kilday, agent for the Jingoli Family Trust
Partnership, is requesting that a 2.7 acre parcel be rezoned from
R-lAA (Single-Family Residential) to C-l (Office/professional)
and that the Future Land Use Plan designation for this parcel be
amended from "Moderate Density Residential" to "Office
Commercial." The subject parcel occupies 526.79 feet of frontage
on the south side of Woolbright Road, immediately west of the
L.W.D.D. E-4 canal (See attached location map.) Currently, the
property is vacant, with the exception of a cluster of Florida
Holly adjacent to the E-4 canal, and an Australian Pine hedge
along the west and south property boundaries (See attached
survey.) The proposed use of this property, if rezoned, would be
to develop it for a 26,550 square foot professional/medical
office complex, consisting of two separate single story
structures.
Surroundin Land Use and Zonin (See attached location ma .):
Abutting the subject parcel to the east is a 155 foot wide
right-of-way for the Lake Worth Drainage District E-4 canal.
Across the canal, further to the east, is the Pylon Interstate
Park, zoned C-l (Office/professional), which is currently
occupied by an existing two story professional office building.
The approved site plan for this property includes a second two
story office bUilding which has not yet been constructed.
Abutting the subject parcel to the south and west are
single-family homes zoned R-IAA (PUD) in Section 10 of Boynton
Beach Leisureville. These homes are in good condition. Abutting
the subject parcel to the north is a 120 foot wide right-of-way
for Woolbright Road. Further to the north, across Woolbright
Road, is the future site of the Chua Eye Clinic, which is zoned
C-l and is currently under construction. To the northwest,
across Woolbright Road, is the Leisureville Convenience Center
zoned C-2, Neighborhood Commercial. To the northeast, across
Woolbright Road and the L.W.D.D. E-4 canal, is a narrow strip of
R-1A zoned property. To the east of this R-1A zoned strip is a
vacant C-2 (Neighborhood Commercial) district.
The property in question was originally zoned C-4 and was
intended to be a trailer and boat storage area for the residents
of Boynton Beach Leisureville. In 1980, this property was
rezoned to its present R-IAA designation.
Present Zoning: The present R-IAA zoning would allow for the
development of approximately 12 single-family lots. The R-1AA
zoning requires a minimum 8,000 space foot lot with a 75 foot
frontage. Access would be provided by an existing 30 foot wide
dead-end street adjacent to the south property boundary, if this
parcel were to become a part of the Section 10 Homeowner's
Association. Otherwise, access would occur by way of Woolbright
Road. There is an existing median cut on Woolbright Road which
could be modified to serve the site. The lots could be developed
so as to face away from Woolbright Road, similar to the existing
lots within Boynton Beach Leisureville, Section 10, which lie to
the west. It should also be noted that both Palm Beach County
and City policies would prohibit residential driveways onto major
thoroughfares. Woolbright Road is classified as an arterial
according to the 1980 Functional Classification map within the
Traffic and Circulation Element of the Comprehensive Plan
Evaluation and Appraisal Report.

Rezoning: Rezoning to C-l, Office Professional, would permit
office/professional structures up to 25 feet (two stories) high.
The maximum allowable height can be increased to 30 feet if
underbuilding parking is provided. Permitted uses in the C-l
zoning district include professional and business offices,
medical and dental offices and clinics, nursing and convalescent
homes, financial institutions, churches, funeral homes,
hospitals, pharmacies, and nursery/primary/secondary schools,
etc. as a Conditional Use. Assuming frontage on Woolbright Road,
the rear and side setbacks abutting the residential zoned
single-family homes to the south and west would be 30 feet. In
addition, a six foot high wall or hedge maintained at a six foot
height would be required along these property boundaries.. The
setback adjacent to the L.W.D.D. E-4 canal would be ten feet, due
to the existence of the C-l zoned Pylon Interstate Plaza parcel
across the canal to the east. Approval of this rezoning request
would allow for the development of any use permitted under the
C-l zoning district regulations. With underbuilding parking,
approximately 53,000 square feet of office space could be
constructed on the site.
The C-l, C-2 and C-3 zoning districts in the vicinity would allow
for the development of office/professional land uses. Since uses
similar to the proposed use are allowed under the current zoning
in the vicinity, it can be argued that this rezoning request,
if approved, would constitute an extension of the existing
commercially-zoned node at Woolbright Road and the L.W.D.D. E-4
canal, and that it would not constitute spot zoning.
Comprehensive Plan - Future Land Use Map: The property in
question is currently shown on the Future Land Use Element as
"Moderate Density Residential," so an amendment to the Future
Land Use Element to "Office Commercial," as requested by the
applicant, would be necessary.
Comprehensive Plan-Text: The fOllowing Comprehensive Plan
Policies are relevant to this rezoning request:
"Provide a suitable living environment in all neighborhoods."

"Preserve the present stock of sound dwellings and
neighborhoods." (Page 7)
"Provide a range of land use types to accommodate a full range of

"Encourage the development of commercial land uses where
accessibility is greatest and where impacts to residential uses
are minimized." (Page 7)

Issues/Discussions:
1. Whether development of this property for commercial uses will
have an adverse impact on surrounding residential properties.
The property is of sufficient size and depth so that it could be
developed without causing significant adverse impacts on the
residences to the south and west. Furthermore, the use of this
property for offices would not change the character of the
neighborhood, since office commercial land uses are already
established in the vicinity. The types of uses that are
allowed in the C-l zoning district generally do not create
nuisances such as litter, odors, noise, or glare, and usually do

not operate after 6:00 p.m.
With regard to buffering, there is an existing Australian Pine
hedge along the south and west property boundaries. Current
Comprehensive Plan and City pOlicies would require the removal of
this hedge in connection with site development, as Australian
Pine is an exotic and thus considered to be undesirable. The
City's zoning regulations would require either a two-foot high
hedge at time of planting or a six foot high concrete block wall
along the southern and western property boundaries.
As a condition of site plan approval, if this request is
approved, it is recommended that the six foot high concre~e ~
block wall be provided along the southern and western property
boundaries, and that the parking lot lighting along these ~_
property lines be directed away from the existing residences. ~
Although it is not anticipated that this facility would
experience significant use during the evening hours, parking lot
lighting is often activated during the evening hours to enhance
on-site security and to assist the police department in
patrolling the property.
As a condition of zoning approval, it is recommended (as proposed
by the a licant on the conce tual site plan) that the proposea ~
U1 1ng height be limited to one story feet) to further
protect the adjacent residences.
The above recommendations are consistent with Section 9.C.4.h.9
of Appendix A, Zoning - Comprehensive Plan Amendments; Rezonings,
and Sections 163.3194, 163.3197, 163.3201 and 163.3202 of the
Florida Statutes.
2. Whether there is currently an adequate supply of office space
and commercially zoned property in the vicinity?
Currently, there are about 308,000 square feet of office floor
space which has either been approved or constructed in the nearby
Pylon Interstate Park and Boynton Commercenter Planned Industrial
Development. These two projects are located east of the L.W.D.D.
E-4 canal, on the south side of Woolbright Road. In addition to
these two projects, the Chua Eye Clinic, which is currently under
construction across Woolbright Road from the subject parcel, has
been approved for 14,400 square feet of medical office floor
space. Furthermore, there are about 8 acres of C-2 zoned
property and 9.4 acres of vacant C-3 zoned property at the
intersection of Interstate 95 and Woolbright Road. Further to
the west, at the intersection of Woolbright Road and Congress ~f
Avenue, there are 230,000 square feet of office space which has ~
been constructed. It can be concluded, therefore, that there is
already an adequate supply of office floor space and commercially
zoned property in the vicinity. It should be noted, however,
that the office projects which have been approved in the vicinity
are general office buildings (with the exception of the Chua Eye
Clinic) which constitutes a somewhat different market than the
~/~ smaller medical office buildings that would probably be developed
on the subject property.

3. Whether the property in question is physically and
economically developable for single-family residences.
As outlined in the section entitled "Present Zoning," the
property could be developed for approximately 12 single-family
homes, with access available by an existing 30 foot wide dead end
street within Boynton Beach Leisureville, Section 10. Concerning
the issue as to whether or not it would be economically desirable
to build single-family homes at this location, it would appear to
be feasible, given adequate buffering from Woolbright Road and
Pylon Interstate Plaza. The recent development of new
Leisureville homes within the vicinity of Golf Road and Congress
Avenue, northeast corner, would tend to support this conclusion.
4. Whether commercial zoning of this property would be
consistent with Comprehensive Plan policies for the location of
and access to commercial uses.

The property is highly accessible and, considering the uses that
would be permitted, would have a minimal impact on nearby
residences. Commercial zoning of this property would not create
a commercial strip, since commercial zoning in the vicinity is
fairly compact and access is well controlled. Furthermore, due
to existing residential development to the west, commercial
zoning cannot extend any further along Woolbright Road. The
proposed development would be consistent with the locational
criteria of the Comprehensive Plan, provided that the
recommendations previously outlined under issue #1 of this
memorandum are incorporated into the site plan, if this project
is approved.

The site is currently undeveloped and contains four Palms on the
western part of the property. The parcel is also separated from the
Leisureville development along its western and southern property
lines by a mature 6 foot high ficus hedge.
The developer is proposing construction of two, 2-story medical
offices and a combined parking facility for 196 parking spaces.
Each building would contain 18,000 square feet (see Exhibit "B"-
proposed site plan).
The originally submitted traffic impact analysis is obsolete,
as the second submittal contains substantial changes with
regard to the number of access driveways which has be
decreased from four to two. Although the Palm Beach
County Traffic Engineering Division reviewed the original
traffic analysis and found this project consistent with the
Palm Beach County Traffic Performance Standards
ordinance, the new driveway configuration requires an
amendment to the traffic impact analysis final review and
determination of compliance by the county.
Insufficient drainage information has been submitted for the
Engineering Division to certify compliance with the City's
drainage levels of service at the time of site plan approval
when it is required. The Engineering Division is
recommending that this be postponed to time of permit
review.
Driveways: On-site traffic circulation consists of a two-way, looped system
connecting the site via two, 27 foot wide ingress/egress driveways
onto Woolbright Road.
Parking Facility: There are 196 on-site parking spaces to be provided, including six

(6) handicap accessible spaces as required by ADA. This exceeds
the minimum standard of 162 parking spaces as required by the
Land Development Regulations, Chapter 2 - Zoning for this use.

Community Design
Plan: There are two buildings proposed for the site. The building located
at the western part of the lot will contain medical offices. The other
building is designated on the site plan as a professional office
building. The exterior elevations of the buildings are identical. The
buildings are finished with a combination of various colored stucco.
Roofs of both buildings are flat and are hidden behind
approximately 3 foot high parapet walls. The site is located at the
western terminus of a neighborhood commercial development at
the corner of S.W. 8th Street containing several architecturally
diverse buildings. No specific architectural pattern has been
established in this area to which this project would be compared.

Signage, although required, has not been submitted as a part of
this application. Another formal submittal of a major site plan
modification will have to be made and be presented to the Planning

Conditions:
In September of 1987, the City Commission conditionally approved
a rezoning request of the subject parcel from R-1AA (single family
residential) to C-1 (Office and Professional Commercial). The
conditions of the approval are listed below.

The proposal incorporates (or will incorporate when staff comments
are addressed) the first two conditions of approval. The third
condition limiting the height of the building, which is not met under
the proposed development plan, was discussed with the
Leisureville Homeowners Association (the property owners
immediately to the south and to the west of the subject site and the
only residence within 400 feet - the area required to be notified of
rezonings and changes to rezonings). The applicant informed staff
that an agreement with Leisureville was reached allowing two story
buildings to be constructed on the site. Therefore, if the city is in
agreement with changing this rezoning condition, the applicant will
file the proper paper work to change the condition. This process
will require public hearings and an ordinance to be adopted.
RECOMMENDATION:
The Planning and Zoning Department recommends approval of this site plan request,
subject to the comments included in Exhibit "C" - Conditions of Approval. The
Technical Review Committee (TRC) recommends that the deficiencies identified in this
exhibit be corrected on the set of plans submitted for building permit.

PLANNING AND ZONING

27. Provide a clause on the survey stating that the property was abstracted for
right-of-way and easements, as required by LDR, Chapter 4, Section 7.A.

INTRODUCTION
Yvonne Ziel Traffic Consultants, Inc. was retained to perform a Traffic Impact Analysis to assess
the traffic impact of a proposed 36,000 square foot (SF) medical office to be located along the south
side of Woolbright Road west ofI-95, as shown in Figw'e 1. Build.out is anticipated in 1999.

The ~ior roadway adjacent to the project is Woolbright Road, which is a four lane road. Table 1
shows the existing (1996) average daily traffic (ADT) conditions on the impact area roadways, Table
2 provides the peak hour traffic conditions at the same locations. The ADT volwnes were obtained
from the Palm Beach County 1996 Traffic Volumes Map, the peak hour volwnes were detennined
by factoring the ADT volumes by 0.093.
ASSURF.D CONSTRUCTION
The Palm Beach County and Florida Department of Transportation Five. Y ear Road Program
includes the v.idening to six lanes of Woolbright Road from Congress Avenue; this section is under
constrUction at this time.

BACKGROUND TRAFFIC
The Palm Beach County Urban Study Area Traffic Volume Growth Tables provided by the Palm
Beach County EIliineeri~ DepartmeJlt. includes historical trai'fic COlmt data for the roadways v.ithin
the impact area of the project. The grov.1h rates for the roadway were determined from these tables,
and then applied to the respective links to determine backgroWld traffic growth to 1999. Appendix
A contains a table with the gro\o\'th rate calculations.
MAJOR PROJECTS
The Palm Beach County (PBC) Engineering Departments major project map and list were consulted
to locate those projects needed to be reviewed for consideration in projecting background traffic.
There are no major projects within the study area which would reflect traffic of 10 percent or more
of the threshold LOS nD" service volume on the impact area roadway links by the build-out of this
project.
TRIP GENERATION
Trip generation was performed using the rates found in the Palm Beach County Impact Fee.
Ordinance, and the Institute of Transportation Engineers', Trip Generation, 5th Edition. Table 3
shows the trip generation rates used, Table 4 shows the trips generated by the proposed project. Trip
generation resulted in 1,230 daily trips, 97 AM peak trips and 147 PM peak trips. Based on the daily
trips generated by the project, the radius of development influence. is two miles,

TRIP DISTRlBUTION
Trip Distribution was based on current travel patterns and the FSUTMS model. Figure 2 shows the
percent project trips and the project volumes on the impact area roadways.
PERFORMANCE STANDARDS ANALYSIS
Test One
Table 5 shows the ADT capacity analysis with the project trips and backgrowld growth with the
performance standards analysis on those links with project impact greater than one percent of the
LOS D capacity, Table 6 shows the same information for the peak hour. Figure 3 shows the above
information on a map, Woolbright Road from 1.95 to Seacrest Boulevard fails the Test One LOS
standard. An Alternative Test One analysis was perl'onned for this link.
Alternate Test One
The 1996 peak season~ peak hour~ peak. direction volume was obtained from the Palm Beach County
Traffic Division for the failed links, Tables 8 and 9 show the projected AM and PM peak
direction/peak season/peak hour volumes for the failed roadway links, All of the peak. direction link
LOS standards are met. The intersections at each end of the Alternate test One links were analyzed
to determine if they meet the intersection standaJ'ds,

Capacity analysis using a spreadsheet based on the 1985 Highway Capacity Manual Critical
Movement Analysis. was performed at the signalized intersections at each end of the failed link, The

I am herewith submitting 2 copies of our revised traffic study for the above referenced project. As
you will recall, there was an error in the original report in that it showed that there would be 4
driveways onto Woolbright Road from the project, when only three were proposed. In addition, we
were advised by the Technical Review Committee (TRC) that City Code would only permit 2
driveways. The revised analysis reflects the current proposal for 2 driveways. Further, the revised
analysis reflects our increase in the total floor area from 35,000 to 36,000 sq. ft, consistent with our
revised site plan. The revised analysis shows that the amended development program complies with
the Palm Beach County Traffic Performance Standards. I have delivered copies of the analysis to
Dan Weisberg of the County Traffic Division and requested that he review it and communicate his
conclusions to you.
I would also like to take this opportunity to confirm our earlier discussion about the mix of medical
and general office occupancy at this facility. As we discussed, although the site plan shows that one
building will be medical office space and one building will be general office space, we want to make
it clear that the entire facility is eligible for occupancy as medical offices. Both types of occupancy
are permitted under the current zoning. Further, the site plan provides a sufficient number of parking
spaces to accommodate all medical offices (which require more parking than general offices) and our
traffic analysis was prepared using the medical office generation rate for all 36,000 sq. ft. offloor
area.
Thank you for your attention to this matter. I look forward to receiving our staff report next week,
and to the Planning Commission meeting on August 12th.

I am enclosing three copies of a revised traffic report for the above referenced project, prepared
by Yvonne Ziel. As you will recall, you have already reviewed the initial report and have
advised the City of Boynton Beach that the project complies with the Palm Beach County Traffic
Performance Standards (TPS).
The modifications to the project are minor, as are the changes to the traffic report. The changes
are that we have reduced the number of driveways from 4 to 2, and we have increased the floor
area of the project from 35,000 sq, ft. to 36,000 sq, ft. Yvonne's analysis shows that the
modifications do not effect our ability to meet the TPS.
We will appreciate your reviewing the revised report and advising the City of your conclusions
at your earliest possible convenience, Weare scheduled for review by the Planning Commission
at their meeting of August 12th, and by the City Council the last week of August. Thank you

RIDER TO SITE PLAN APPLICATION
The undersigned as 'applicant for Final Site Plan Approval does hereby
acknowledge, represent and agree that all plans, specifications, drawings,
engineering, and other data submitted with this application for review by ~he
City of Boynton Beach shall be reviewed by the various boards, commissions,
staff personnel and other parties designated, appointed or employed by the
City of Boynton Beach, and any such party reviewing the same shall rely upon
the accuracy thereof, and any change in any item submitted shall be deemed
material and substantial.
The undersigned hereby agrees that all plans, specifications, drawings,
engineering and other data which may be approved by the City of Boynton
Beach, or its boards, commissions, staff or designees shall be constructed in
strict compliance with the form in which they are approved, and any change to
the same shall be deemed material and shall place the applicant in violation
of this application ~nd all approvals and permits which may be granted.
The applicant agrees to allowing the City of Boynton Beach all rights
and remedies as provided for by the applicable codes and ordinances of the
City of Boynton Beach to bring any violation into compliance, and the
applicant shall indemnify, reimburse and save the City of Boynton Beach
harmless from any cost, expense, claim, liability or any action which may
arise due to their enforcement of the same.
